SECTION 01 11 00 SUMMARY OF WORK (SOW)

PART 1 GENERAL
1.1 GENERAL DESCRIPTION OF WORK:
1.1.1 Project Description
The work covered by this contract, consists of furnishing management, quality control, material, labor, equipment, construction layout/sketch, placement and project incidentals while performing all work in connection with an Indefinite Delivery/Indefinite Quantity (IDIQ) type contract. Covered within this Paving and Sustainable Infrastructure Contract, Fort Buchanan, Puerto Rico, are Exhibit Line Items (ELIN’s) with attached specifications and drawings, which may be compiled to complete a project Delivery Order.
The work includes the following types of pavements, markings, and incidental line items available to assemble a complete project within an issued Delivery Order- See Attach – 1 -Price ELINs descriptions.
The work includes all management, quality control, material, labor, equipment, construction layout/sketch, placement, and project incidentals to accomplish pavement repairs, new pavements, civil infrastructures, and other facility project requirements as indicated in individually issued Delivery Orders. Projects may include repairs to existing infrastructure or new infrastructure within the boundary of Fort Buchanan, PR. The Site Plan, which is on drawing S-1, attached in TE-2 provides a general site map of buildings, roads, and parking in Fort Buchanan.
The specific location, type, and ELINs quantities of the project will be specified in each Delivery Order. The Government will specify the sequence in which the Delivery Orders will be issued. Each Delivery Order will indicate the period for the completion of the specific repair or new construction project. The period includes from the day the Delivery Order is issued to the day the work shall be completed and accepted by the Government.
1.1.2 Drawings:
The attached drawings show details of line items elements to be done within issued Delivery Orders. Contract drawings are attached in TE-2. The Contractor will conduct joint site visit with the Government to verify all dimensions for proper execution of construction as shown on the following drawings:

1.2 INSTALLATION REQUIREMENTS:
Work areas shall be unoccupied for contractor performance.
Before work is started, the Contractor shall arrange with the Contracting Officer Representative (COR) a sequence of work procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways.
1.2.1 Installation Operation
1.2.1.1 Installation General Operation: Fort Buchanan is a U.S. Army Reserve installation in Puerto Rico within the San Juan metropolitan area. It serves under direct control of the Installation Management Command, Atlantic Region. Its mission is to synchronize, integrate, and deliver installation services and facilities in support of Senior Commanders in order to enable a ready and resilient Army. Contractor shall be responsible for all permits and certifications required by the Municipalities of Guaynabo/Bayamon, Puerto Rico.
1.2.1.2 Federal Observed Holidays. The Contractor shall submit to the Contracting Officer Representative (COR) an alternate schedule for service affected by federally observed holidays not later than ten (10) work days prior to the holiday. The schedule shall include dates for make-up of all services affected by the holiday.

Note: Any Contractor delays due to non-performance of work, lack of material/equipment or personnel, will not be justification for a time extension. The Contractor shall, at all times, maintain a workforce for uninterrupted performance of all tasks defined within this Statement of Work (SOW).
1.2.1.3 Hours of Operation. The Contractor is responsible for providing services between the Garrison’s normal hours of Operation: 7:00AM to 4:00PM, Monday through Friday. Exceptions include required services on Saturday and Sunday, Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
1.2.1.4 Irregular Work Hours Request. Unless otherwise approved, the Contractor shall perform the work between the hours of 7:00 a.m. to 4:00 p.m., Monday through Friday. Prior to the contractor performing any work during hours other than those specified, the Contractor shall submit a written request to the Contracting Officer Representative (COR) for approval by the Contracting Officer (KO) in a case-by-case basis. Requests shall be submitted no less than sixteen (16) Calendar days prior to the time the contractor desires to work. The Government shall evaluate the request and provide a written approval or rejection to Contractor.
1.2.1.5 Place of Performance. The work to be performed under this contract shall be performed at Fort Buchanan, Puerto Rico. The areas in which the work is to be done may be occupied during the performance of work under this contract. It is the Government’s responsibility to secure all items inside the work prior to contractor commence work. The Government shall identify any sensitive work area and it’s the Contractor’s responsibility to obtain the approval from the Government before entering sensitive work area. Contractor is responsible to safeguard Government property in the work area. It shall be the Contractor's responsibility to coordinate with the COR to schedule and perform work in such a manner as to create the least possible interference with the realization of normal activities within the areas. The contractor shall not block more than one access of any building(s) at any time, nor shall they disrupt the existing parking arrangement to any of the building(s) parking areas, unless authorized by the KO. Contractor employees having private owned vehicles (POV) shall park at Contractor’s designated area. POVs shall not be parked at working areas.
1.3 ACCIDENT REPORTS:
1.3.1 Accident Reporting. The contractor and associated sub-contractors shall maintain an accurate record, and shall report to the Contracting Officer, exposure data and all accidents resulting in death, traumatic injury, occupational disease, or damage to property, material, supplies, and equipment incidental to work performed under the contract. The Contractor shall immediately notify emergency personnel upon any incidences and accidents. All incidents and accidents shall be reported to the COR within thirty (30) minutes of incident occurrence in accordance with the requirements indicated in AR 385-40, Accident Reporting and Records.

1.4 INSTALLATION SECURITY:
1.4.1 Access and General Protection/Security Policy and Procedures. The Contractor and all associated subcontractors’ employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by a Government representative). The Contractor workforce must comply with all personal identity verification requirements as directed by DOD, Headquarters Department of the Army (HQDA), and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.
1.4.2 Installation Access Procedures. Contractor personnel and property shall be subject to search and seizure upon entering and leaving the confines of Fort Buchanan. The Contractor shall be responsible for assuring that all personnel authorized to perform work under this contract obtain installation access as required.
Installation access will be granted for the period of performance (POP) of each delivery order. Contractor shall submit a letter from the contractor listing all employees and the last four numbers of social security number for each to the Contracting Officer Representative (COR). This is being provided for the purpose of obtaining identification badges and access clearances to enter the installation.
Should the Force Protection Condition (FPCON) change, the government may require additional changes in contractor access. Government furnished badges shall be returned immediately to the government when an employees no longer perform work for the contractor or sub-contractor under this contract. New/replacement personnel shall obtain this same approval prior to the proposed new/replacement hire performing on the contract. Contractor access to the post will be exclusively for work in connection with this contract.
ALL NON-US GARRISON ID CARD APPLICANTS WILL PROVIDE A VALID AND ORIGINAL FORM OF ID (STATE DRIVER’S LICENSE, PASSPORT, AND SO FORTH, WHICH COMPLIES WITH PUBLIC LAW (THE REAL ID ACT OF 2005)). THIS IS TO PROVE IDENTITY (FOR ENROLL-MENT INTO THE AIE DATABASE IF AVAILABLE) AND ISSUE A VISITOR PASS OR CARD. SECURITY PERSONNEL PROCESSING AN APPLICANT WILL SCREEN DOCUMENTS FOR EVIDENCE OF TAMPERING, COUNTERFEITING, OR OTHER ALTERATION. A CHECK OF RECORDS THROUGH THE NATIONAL CRIME INFORMATION CENTER (NCIC) INTERSTATE IDENTIFICATION INDEX (III) IS THE ARMY MINIMUM BASELINE BACKGROUND CHECK FOR ENTRANCE ONTO ARMY INSTALLATIONS FOR NON-CAC HOLDERS TO INCLUDE ENTRANCE OF VISITORS. THE FBI PERMITS THE USE OF NCIC III FOR VETTING VISITORS TO ENSURE THE SECURITY OF MILITARY INSTALLATIONS. PROCEDURES: THE NCIC-III AND “PERSONS” FILES CHECKS ARE ACCOMPLISHED BY USING THE “QWI” INQUIRY UNDER THE PURPOSE CODE C. THE QWI IS AN NCIC INQUIRY MESSAGE WHICH PROVIDES THE AUTHORIZED USER WITH THE CAPABILITY TO ACCESS BOTH THE NCIC-III (FOR CRIMINAL HISTORY) AND NCIC PERSONS FILES SIMULTANEOUSLY WITH ONE INQUIRY. THE NCIC PERSONS FILES INCLUDES WANTED PERSONS, KNOWN OR APPROPRIATELY SUSPECTED TERRORIST (KST) LIST, MISSING PERSON FILE, FOREIGN FUGITIVE, WANTED PERSON, GANG, PROTECTION ORDER, IMMIGRATION VIOLATOR, IDENTITY THEFT, SUPERVISED RELEASE, VIOLENT PERSON, PROTECTIVE INTEREST FILES AND THE NATIONAL SEX OFFENDER REGISTRY. THIS REQUIREMENT APPLIES TO ALL UNAFFILIATED PERSONNEL (VISITORS) NOT IN POSSESSION OF ONE OF THE ID CARDS REAL ID: CONTRACTOR PERSONNEL SHALL POSSESS A VALID REAL ID (EX. PR DRIVER LICENSE WITH THE STAR) TO REQUEST ACCESS AT FORT BUCHANAN. THIS IS MANDATORY AFTER OCTOBER 1, 2022. CONTRACTOR IS RESPONSIBLE TO ENSURE ALL EMPLOYEES DRIVING OR REQUESTING ACCESS AT FORT BUCHANAN POSSESS A VALID” REAL ID.
1.4.3 Personnel. The Contractor shall provide a work force sufficient in number that possesses the skills, knowledge and training to satisfactorily perform the services required by this contract including license to operate heavy equipment. The Contractor shall ensure that personnel present a professional appearance. Individuals with a record of conviction for criminal offenses shall not be employed to perform services under this contract.
1.4.4 Vehicle Registration/Operation. Contractor and employee owned motor vehicles entering Fort Buchanan shall have a valid license plate, current registration, and valid liability insurance. Heavy equipment operators shall have a current Puerto Rico license in order to operate such equipment (i.e. bucket truck, heavy tractors, backhoes, grapple truck, skid steers, etc.).
1.4.5 Contractor Vehicle Identification. Contractor owned vehicles used in the performance of services under this contract on the installation shall be marked with the contractor name and phone number.
1.4.6 Uniforms/Identification cards/badges. The Contractor shall provide uniform safety vests to their employees for contractor identification purposes. All Contractor personnel shall visibly have on them, at all times their identification cards. In the event a government issued identification card/badge is lost or stolen, the contractor Project Manager (PM) will immediately notify the COR. The Contractor shall prohibit the use of Government issued identification badges by any persons other than the Contractor’s employees it has been issued to.
1.5 REQUIRED TRAINING:
1.5.1 AT Level I Training. This provision/contract text is for contractor employees with an area of performance within an Army controlled installation, facility, or area. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. This training shall be completed within thirty (30) calendar days of contract award and within five (5) calendar days of new employees commencing performance with the results reported to the COR NLT forty-five (45) calendar days after contract award. 1.5.2 iWATCH Training. This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. The Contractor and all associated sub-contractors shall brief all employees on the local iWATCH program (training module provided within the Army OneSource website: http://www.myarmyonesource.com/).
This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within thirty (30) calendar days of contract award and within five (5) calendar days of new employees commencing performance with the results reported to the COR NLT forty-five (45) calendar days after contract award.
1.6 EMERGENCY SERVICES:
1.6.1 Emergency Services. In case of emergency the Contractor and/or Contractor employees shall contact the Fire/Ambulance Service Emergency Number: (787) 707-5911. The Contractor or their employees shall immediately notify their supervisor of any accident requiring emergency medical treatment. All incidents and accidents shall be reported to the COR within thirty (30) minutes of incident occurrence in accordance with the requirements indicated in AR 385-40, Accident Reporting and Records.
1.6.2 Fire Protection. The Contractor shall comply with AR 420-1 Army Facilities Management Chapter 25 and the Fort Buchanan USAG-FB Policy #29 Fire Prevention guidelines. See TE-5 for a copy of USAG-FB Policy #29 Fire Prevention.
1.6.3 Extinguishing Equipment. The Contractor equipment shall have available a portable fire extinguisher as required to comply with the Fire Department instructions. Existing building extinguishers shall not be used to meet this requirement.
1.7 LIABILITY AND RESPONSIBILITY FOR DAMAGED PROPERTY:
1.7.1 Damage to Government Property. The Contractor shall be held liable for damage or destruction of Government property (e.g. buildings, vehicles, sidewalks, fences, etc.) caused by the Contractor, Contractor personnel or representatives of the Contractor in the performance of services on this contract. The Contractor shall be aware that Government property - beyond standard structures and equipment - also includes trees, flower beds, and turf (for example, wounded trees or damaged turf shall be repaired or replaced). If the Contractor fails to take the required corrective action, the Government retains the right to exercise other rights or remedies available to the KO.
1.7.2 Damage to Privately-Owned Property. The Contractor shall be held liable for damage or destruction of privately owned property (e.g. privately owned vehicles), as defined in this SOW, caused by the Contractor, Contractor personnel or representatives of the Contractor in the performance of services in this contract. The Contractor shall take corrective action within 5 working days to repair damages or replace destroyed property. Contractor will purchase and maintain at all times a general third-party liability insurance policy of not less than $500,000 per event coverage in accordance with FAR 52.228-5.
1.7.3 Property Damage Reports. The Contractor shall submit a damage report to the KO and COR within 24 hours of damage or destruction to Government property or privately owned property caused by the Contractor, Contractor personnel or representatives of the Contractor. The damage report shall detail the facts and the extent of damages or destruction and the corrective action taken by the Contractor to repair damages or replace destroyed property.
1.8 ENVIRONMENTAL PROTECTION:
1.8.1 Contractor Environmental Plan. The Contractor shall provide an Environmental Plan that complies with the provisions contained within Section 01 57 19 Temporary Environmental Controls to minimize potential environmental impacts to the Installation’s natural, cultural and energy resources. The Contractor shall submit the Environmental Plan to the Contracting Officer within thirty (30) days after the date of contract award.
1.8.2 Pollution. Contractor shall comply with all applicable Federal, State and local laws, regulations, and standards regarding environment pollution. All environmental protection matters shall be coordinated through the Contracting Officer with the Post Environmental Protection Office at DPW. The Post Environmental Protection Office is located at Building 34, telephone (787) 707-3575 or (787) 707-3508.
1.8.3 Material Spills. Contractor shall be responsible for the prompt containment, clean up, and restoration (if applicable, of any petroleum, oil, lubricant (POL) or coolant liquids that may have spilled from its vehicles as a result of the operation of its fleet in support of this contract. The contractor shall have at all times spill response equipment in sufficient amount to respond and contain any leak until garrison emergency responders are able to arrive at the spill scene. Furthermore, any such release shall be immediately notified via telephone, within the first 30 minutes from spill incident awareness, by the operator to the DPW Environmental Office - The Post Environmental Protection Office is located at Building 34, telephone (787) 707-3575 or (787) 707-3508.
1.8.4 Environmental Condition Reports. Contractor shall provide reports as follows: Report any circumstances of unusual soiling of an area which may affect performance of contract work, unhealthful and/or hazardous conditions, and any delays or interference of work by employees of the Government. Such reports shall be made as expeditiously as possible by the Contractor to the Contracting Officer. In any event, the report shall be made not later than the close of business (4:00 pm, Monday-Friday) on the same day.
1.8.5 As per referenced in 1.8.1, the Section 01 57 19 Temporary Environmental Controls shall apply in all contract performance actions, construction, demolition, and/or renovation projects that will require both interior and exterior works at any Facility/Building in USAG Fort Buchanan PR. All contracts and contract modifications shall specify that contractors and grantees are required to comply fully with applicable Federal, state, and local environmental laws and regulations, Executive Orders, DoD and Army, regulations, policies, and guidance and that contractors and grantees are responsible for any enforcement actions, fines, penalties, and cleanup costs, to the extent provided for by law and policy, resulting from their failure to comply with applicable environmental requirements.
1.9 SAFETY PROGRAM:
1.9.1 Contractor Safety Plan. The Contractor shall safeguard and maintain all Government property as well as provide for the safety and wellbeing of personnel employed in the performance of this contract. The Contractor shall implement a safety program for employees performing work under this contract. The Contractor shall submit the safety plan to the Contracting Officer within thirty (30) days after the date of contract award.
1.9.1.1 The Contractor shall comply with the Occupational Safety and Health Act (OSHA). Contractor personnel shall wear safety items required by OSHA during the performance of tasks requiring protective equipment or clothing.
1.9.1.2 In addition to the standard safety rules applicable for Government work, the Contractor shall provide to all Contractor employees safety equipment. The Contractor shall be responsible for the use of safety equipment at all times by all employees. Contractor shall ensure employees have their safety equipment (PPE) at all times during each day of performance of work.
1.9.1.3 Safety shoes or boots and gloves shall be worn by all employees in the performance of work in serviced areas.
1.9.1.4 Noise reduction protection shall be worn by all employees when operating motorized equipment or in the vicinity of equipment inducted noise.
1.9.1.5 Occupational Safety and Health. The Contractor shall comply with the Occupational Safety and Health Administration (OSHA) standards on 29 CFR 1910. The Contractor shall be responsible for ensuring adherence to all applicable Fort Buchanan, Puerto Rico, and federal rules and regulations.
1.9.1.6 Contractors shall comply with the latest version of EM 385-1-1 (including interim changes) that is in effect on the date of award. Prior to making an offer, bidders should check the HQ USACE Safety and Occupational Health web site (http://www.usace.army.mil/CESO/Pages/Home.aspx) for the latest changes. Any changes observed by the contractor shall be notified to the Government prior to bid opening date. No separate payment will be made for compliance with this paragraph or for compliance with other safety and health requirements of this contract for changes after contract is awarded.
1.10 LANDFILL FOR DISPOSAL:
1.10.1 Solid Waste. The contractor shall dispose solid waste debris resulting from construction and demolition according to the waste classification. The contractor shall dispose of waste and recycle construction material in accordance with instructions and specifications listed in Summary of Work, Section 1.11 RECYCLING PROGRAM. No landfill area will be available for use by the contractor at Fort Buchanan.
1.11 RECYCLING PROGRAM:
1.11.1 Recycling and Waste Minimization. The Contractor shall participate in State and local government sponsored recycling programs. The Contractor shall minimize solid waste generation throughout the duration of the project. The Contractor shall participate in recycling and waste minimization activities to divert non-hazardous solid waste. The Contractor shall recycle all non-hazardous solid waste generated in this project and shall submit a recycling form stating the amount of material in either pounds or tonnage diverted by its type. The form shall specify amount and type of ferrous or non-ferrous metals, concrete debris, wood (doors, windows, cabinets, etc.) asphalt, etc. in order to properly sub classify diverted materials. Whenever technically and economically feasible the contractor shall promote deconstruction, salvage, and reuse of integral materials and shall limit demolition activities only to those materials permanently affixed to a structure which cannot be disassembled like concrete walls, gypsum board walls, stucco, and brick wall assemblies.
1.11.2 Non-Hazardous Solid Waste Diversion Report. The Contractor shall maintain an inventory of non-hazardous solid waste diversion and disposal of construction debris for each Delivery Order. Upon completion of each Delivery Order, the Contractor shall submit a report to the COR, in accordance with Section 01 57 20.0010 Environment Protection, including non-hazardous demolition debris quantified in cubic yards and tons or pounds.
1.11.3 Diversion Solid Waste / Construction Debris. Solid Waste Diversion as per Executive Order and the Fort Buchanan Solid Waste Management Plan the contractor is responsible to make the adequate diversion for at least 50% of non-hazardous solid waste from disposal of the construction SOW activities and no less than 75% diversion of construction and demolition materials and debris for disposal.
1.12 STORM PROTECTION:
1.12.1 Should warnings of wind of gale force or stronger be issued, the Contractor shall take every practicable precaution to minimize dangers to persons, to the work, and to adjacent property. These precautions shall include removing all loose materials, tools, and/or equipment from exposed locations, and removing or securing other temporary work.
1.13 HOT WORK:
1.13.1 Hot Work Permit. The Contractor shall notify the Fort Buchanan Fire Department daily in the event “hot work” is to be performed. The Fire Department will inspect and ensure proper fire prevention measures and equipment are available depending on work to be performed. The Fire Department will issue DA Form 5383-R (Hot Work Permit) which authorizes open flame, welding operations or other hazardous potential fire actions. Contractor shall furnish his own portable fire extinguishers as required (minimum weight 10 lbs) to comply with the Fire Department instructions.

1.14 EXISTING WORK:
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
1.15 GOVERNMENT-FURNISHED MATERIAL AND EQUIPMENT:
1.15.1 The Government will not furnish any material and/or equipment unless is required by the Contracting Officer.
PART 2 PRODUCTS
2.1 GREEN PROCUREMENT:
2.1.1 Green Procurement Quarterly Reporting. In order to comply with the green procurement requirements of Section 6002 of the Resource Conservation and Recovery Act of 1976 (RCRA) and Executive Order 13423, the Government requires the use of recycled, bio-based, biodegradable, non-hazardous, and/or recovered materials and products identified in the Environmental Protection Agency's (EPA) Comprehensive Procurement Guidelines. These materials and products must meet the requirements of the contract, must not delay the progress of work, must be available from more than one source, and must not be cost prohibitive. EPA guideline items are seen as the minimum that should be considered when evaluating recyclable materials. Other materials and products not listed, but commonly used in industry outside of the Government, should also be considered. Material and product submittals for all recycled-content items should list the recycled and recovered materials used and the percentage content. The Contractor shall track the purchase, quantities, and the percent of recyclable content for these materials throughout the life of the contract. The Contractor shall consolidate and provide this information to the COR quarterly, in reports. The Contractor shall annually submit a summary report of certification and estimate as required by FAR 52.223-9, title, Certification and Estimate of Percentage of Recovery Material Content for EPA Designated Items, upon completion of the base year and each follow-on year, until completion of the contract to the COR. The intended end use of the item, materials with recovered materials content, at levels recommended by the EPA's CPG is found at website; http://www.epa.gov/cpg/products.

3.3 CONTRACT ADMINISTRATION AND MANAGEMENT ROLES:
3.3.1 Post Award Conference/Periodic Progress Meetings. The Contractor shall attend the post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation (FAR) Subpart 42.5. The Contracting Officer (KO) and Contracting Officer’s Representative (COR) shall meet periodically, quarterly as a minimum IAW AR 70-13, paragraph 4-4, b. (1), with the Contractor to review the Contractor's performance. Written minutes of such meetings will be recorded by the Contractor and signed by the Contractor’s Project Manager and the KO, or COR. The Contractor shall distribute written minutes electronically, within five (5) workdays after the meeting, to the KO and COR. The Contractor may request a meeting with the KO or COR when the Contractor believes such a meeting is necessary. Written minutes of such meetings shall be recorded by the Contractor and signed by all participants involved and distributed electronically within five (5) workdays after the meeting.
3.3.2 Performance/Progress Meetings. Performance/Progress meetings will be held as necessary. There may be occasions when subsequent meetings will be called by either party to reconfirm mutual understandings and/or address deficiencies in the QC system or procedures which may require corrective action by the Contractor. The Contractor Representative shall meet with the COR and/or Contracting Officer (KO) as required. A mutual effort will be made to resolve all problems identified. The Contractor Representative and the Quality Assurance Representative shall sign the written minutes of these meetings.
3.3.3 Contract Administration. Notwithstanding the Contractor’s responsibility for total management during the performance of this contract, the administration of the contract requires maximum coordination between the Government and the Contractor.
3.3.4 Contract Roles. The following provides the roles and their respective authority during the performance of the contract:
3.3.5 Contracting Officer (KO). The KO is the only person authorized to direct changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in this contract, said authority remains solely in the KO. In the event the Contractor effects any such change at the direction of any person other than the KO, the change will be considered to have been made without authority and solely at the risk of the Contractor. All contract administration will be effected by the KO. Communications pertaining to contractual administrative matters shall be addressed to the KO. No changes in or deviation from the terms and conditions shall be affected, without a written modification to the contract, executed by the KO authorizing such changes in accordance with FAR 52.204-1.
3.3.6 Contracting Officer’s Representative (COR). The KO shall designate contract level CORs during the term of this contract, under Defense Federal Acquisition Regulation Supplement (DFARS) clause 252.201-7000 “Contracting Officer’s Representative.” The COR will provide assistance in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems. The COR will perform in accordance with the responsibilities and duties identified in the Interim Army Contracting Command – Contracting Officer’s Representative Policy Guide Pamphlet 70-1, (ACC PAM 70-1, dated 26 March 2010).
3.3.7 COR Authority. A letter of designation issued to the COR by the KO, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially about changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
3.3.8 COR Functions. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, and specifications; monitor Contractor's performance and notify both the KO and Contractor of any deficiencies; coordinate availability of Government-furnished property, and provide site entry of Contractor personnel.
3.3.9 Representation Clause. The Contractor shall not in any way represent that it is a part of the U. S. Government, or that it has the authority to contract or procure supplies for the account of the United States of America.
3.3.10 Quality Control (QC). Quality Control is the responsibility of the Contractor. The Contractor shall provide and maintain a quality control system that is acceptable to the Government IAW FAR 52.246-4, Inspection of Services-Fixed Price.
3.3.11 Identification of Contractor Employees. All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed. Contractor personnel on duty shall wear Contractor provided identification badges displaying employee's name, picture, position, signature and name of Contractor. Identification badges shall be worn on the upper right front quadrant of the upper outer garment.
3.3.12 Key Personnel. The Government considers the following positions to be key personnel: Project Manager, Quality Control Manager and Safety Manager. Key personnel identified as emergency replacements shall manage the identified position temporarily, during the event of unforeseen situations regarding Contractor personnel. All key personnel shall have means of verbal communication and by e-mail with the COR. Key personnel and alternates must be able to communicate fluently in English both verbally and in writing. The Contractor shall submit an organization chart (to include contact info) for initial key personnel and emergency replacements of key personnel positions, to the KO, within thirty (30) days after the date of contract award.
3.3.13 Project Manager (PM). The Contractor shall provide a PM who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the PM is absent shall be designated in writing to the KO. The PM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The PM shall have demonstrated a minimum of ten (10) years of experience as a direct supervisor of Road Maintenance operations in commercial or public site(s). The PM shall be fluent in understanding, speaking, reading and writing the English language. The Contractor shall provide and maintain in good working condition a mobile phone to enable the KO to contact the Contractor or the Contractor Representative through a telephone at any time twenty-four (24) hours per day, seven (7) days per week for the duration of the contract. A list of all mobile phones (and corresponding names) shall be submitted with the Key Personnel organization chart to the Contracting Officer (KO) after award of contract during pre-performance meeting.
3.3.14 Quality Control Manager (QCM). The Contractor shall designate an employee for quality control with a minimum of three (3) years of experience in performing quality control for road maintenance and related construction activities. The QCM is responsible for the daily inspection report requirement of work conducted and inspection of Contract performance standards and progress, and shall submit documentation of a monitoring system for assuring all line items are performed according to Contract specification (see Section 01 45 00 Contractor Quality Control and SOW Section 3.2.1 for details of the Quality Control Plan (QCP)). The QCM duties shall be separate from those of the PM. The employee shall be available for consultation with the COR daily, during the normal work schedule of Monday through Friday
3.3.15 Safety Manager. The Contractor shall designate an employee to manage the safety program as per EM 385-1-1, Safety and Health Requirements Manual, and AR 385-10, The Army Safety Program. This employee shall possess a certificate of 30-Hours of General Industry approved by OSHA. The employee shall be available for consultation with the COR on an as need basis, during the normal work schedule of Monday through Friday. The individual shall be present during provided services on post.
3.3.16 Duties listed in section 3.3.15 can be combined with the duties outlined in section 3.3.13, Project Manager (PM).
3.4 JOB ORDERING PROCEDURES: RESERVED. NOT USED IN THIS CONTRACT.
3.5 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK:
3.5.1 The Contractor shall commence work immediately upon KO approval of Contractors project proposal and concurrence with procedures outlined within section 3.4 JOB ORDERING PROCEDURES of this SOW.
3.5.2 The Contractor shall prosecute said work diligently and shall complete all work ready for use not later than the time stated in approved Contractor’s project schedule (Gantt chart). The time stated for completion shall include final cleanup of the work area.
3.5.3 Final Inspection. After completion of work, the contractor shall notify the COR and a site inspection shall be made by a representative of the Contractor and the COR. All work, notification of completion, inspection and correction of deficiencies shall be accomplished within the time frame specified for completion of work.
3.5.4 Post Delivery Order Submittals. The Contractor, after completion of final inspection and upon submittal of the final invoice for each delivery order, shall provide concrete, construction aggregate, sod/seed, asphalt, and all material delivery tickets received during the performance of the Delivery Order, to the COR with Delivery Order invoices. 3.5.4.1 Wide Area Work Flow (WAWF). A secure web system for electronic invoicing, receipt, and acceptance. WAWF allows Government vendors to submit and track invoices and receipt/acceptance documents over the web and allows Government personnel to process those invoices in a real-time, paperless environment.
3.6 PERIOD OF PERFORMANCE:
3.6.1 The period of performance which will be commensurate with work being ordered will be stated on individual delivery orders.
3.7 DELIVERY ORDER LIMITATION (APR 1984) (FAR 52.216 19). MINIMUM ORDER
3.7.1 When the Government requires supplies or services covered by this contract in an amount of less than $500.00, (SEE FAR CLAUSE 52.216-19), the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or under the contract.
3.8 WATER SUPPLY
3.8.1 Water will be furnished at no cost to the Contractor from a non-potable water hydrant designated by the COR or authorized representative and located within a reasonable proximity to the work area. The Contractor shall furnish all equipment, material, and labor required to obtain and deliver water from the designated fire hydrant to the work area(s).
3.9 SHOP DRAWINGS, MANUFACTURERS DATA AND CERTIFICATIONS REQUIRED OF THE CONTRACTOR:
3.9.1 Safety Data Sheets (SDS)
Contractor shall maintain and have available Safety Data Sheets (SDS) for all materials to be used in this contract. The Contracting Officer may request inspection and verification of Contractors SDS’s at any time during the duration of the contract.
3.10 CONSTRUCTION PROJECT SIGNS:
Except when otherwise directed by the Contracting Officer, the contractor shall furnish, install, and maintain the construction project signs at the worksite covered under this contract.
