COMPLIANCE IS REQUIRED WITH THE FOLLOWING FEDERAL REGULATIONS
SPECIAL PROVISIONS
Bidders shall fill in all blanks on the Bid Schedule. For each item offered, bidders shall show the unit price and enter the extended price for the quantity of each item offered in the “Price” column of the Bid Schedule. In case of discrepancy between a unit price and the extended price, the unit price will be presumed to be correct, and the total bid will be corrected accordingly.
The successful bidder for an Abandoned Mine Land (AML) contract must meet eligibility requirements cited under federal regulations 30 CFR 874.16. Therefore, the low bidder will be required to complete an AML Contractor Information Form. This information will be used to determine whether or not the low bidder, or any person who controls the low bidder, has an outstanding violation in connection with any surface coal mining operation. This determination must be made prior to acceptance of the low bidder. In addition, the bidder must be registered on the United States Federal Contractor Registration Site Sam.gov, i.e. a have a current and active SAM registration number.
Within 7 days of the bid opening, the low bidder may be required to submit a written list of equipment to be utilized. This equipment shall be subject to inspection by the owner of the contract. Acceptance of the low bidder shall be subject to the equipment being in good operating condition and sufficient to perform the work within the specified contract time.
Upon receipt of the Notice of Proceed, the contractor shall immediately notify the Office of Surface Mining Reclamation and Enforcement (OSMRE) Contracting Officer Representative (COR), Mr. Marvin Barnaby, so that a preconstruction meeting at the site can be arranged.
OSMRE will provide funding for this project via the Surface Mining Control and Reclamation Act of 1977 (SMCRA). OSMRE will provide contract administration services for this contract.
All construction and materials shall conform to the Standard Specifications for Highway Construction, Oklahoma Department of Transportation, Edition of 2019, unless otherwise supplemented by plan notes or OSMRE Supplemental Specifications.
The Contractor shall not sublet, sell, transfer, assign, or otherwise dispose of the contract or contracts or any portion thereof, or any of his rights, title, or any interests therein, without written consent of the COR or any Inspectors designated by the Contracting Officer. In case such consent to subcontract is given, the Contractor will be permitted to sublet only that portion of the work identified in the written consent and only to a subcontractor approved by the COR or his authorized representative. The subcontractor will be required to complete an AML Contractor Information Form. This information will be used to determine whether or not the subcontractor, or any person who controls the subcontractor, has an outstanding violation in connection with any surface coal mining operation.
The engineer designated by OSMRE will have responsibility for the engineering details associated with the project. Inspectors or technicians employed by OSMRE or the designated engineer of the project will be authorized to inspect all work completed and all materials furnished. Inspectors shall have access to all parts of the project site in order to adequately perform inspection, sampling, and testing procedures as determined by the designated Engineer.
The specific elements of work associated with the bid items listed below will require the presence of an Inspector to monitor and inspect the Contractor's activities during the full duration of the specific event or element of work.

The Contractor shall give the responsible Inspector two business days’ notice prior to beginning any of the previously listed work. Work installed and not inspected, when designated, will be removed at the Contractor's expense.
Contract time for this job is 349 calendar days for construction, which includes 4 calendar days for non-work holidays as specified below. This does not include vegetation. The completion date will be shown on the work order. OSMRE may justify and document an extension of the contract time due to adverse weather by crediting adverse weather days on a monthly basis. The weather shall affect the Bid Item considered critical to completion at that time. A monthly report with an explanation for the credit will be submitted to the contractor along with available critical path workdays not utilized. The Contractor can file a written protest of the time charges indicated on the monthly report within 10 calendar days. Adverse conditions include precipitation creating unmanageable wet conditions, temperature and/or wind conditions at the project site.
If the Contractor fails to complete the work within the time specified in the contract, or any extension thereof, the Contractor will be required at OSMRE discretion to either pay OSMRE one thousand five hundred dollars ($1,500.00) or actual damages for each calendar day of the delay. Actual damages will be based upon the costs incurred by OSMRE including but not limited to personnel costs, travel, etc. The amount of such costs will be deducted from monies due or to become due to the Contractor.
The Contractor shall implement those measures necessary to suppress dusty conditions resulting from Contractor's operations that may affect residences or cause a hazard to vehicular traffic.
Work at the project site is limited to daylight hours Monday through Friday. The following holidays are non-workdays - New Year’s, 4th of July, Thanksgiving, and Christmas. Extended days/hours can be approved by OSMRE Inspector.
OSMRE shall provide the Contractor with control points with known elevations. The Contractor shall provide their own construction surveys. Price to be included in other items of work. If the drawings have been reduced, the scale may not be correct.
CLAIMS FOR ADDITIONAL TIME
If the Contractor wishes to make claim for an increase in contract time due to adverse weather conditions, written notice as provided herein shall be given. The Contractor's claim shall include a description of the probable effect of delay on progress of the work. In the case of a continuing delay only one claim is necessary. Any change in the contract time shall only be made by the execution of a Change Order.
Additional time added for project days lost due to adverse weather conditions will be computed by deducting from the credited adverse weather days the number of days that work could have progressed but did not due to the lack of sufficient and adequate equipment and personnel on site with work reasonably progressing on the critical path as shown on the project schedule submitted by the contractor (adverse weather days minus available work days with work not reasonably progressing).
In case of ambiguity or conflict between Drawings and Specifications, the Specifications shall govern.
Figured dimensions shall be followed in preference to measurements by scale. Large scale drawings take precedence over small scale drawings. If the drawings have been reduced, the scale may not be correct.
Dimensions on drawings are subject to field measurements of adjacent work.
On sites not provided with a sanitary sewer, the Contractor shall provide one of the following toilet facilities unless prohibited by local codes:
• Privies (where the use will not contaminate ground or surface water).
• Chemical toilets.
• Recirculating toilets.
• Combustion toilets.
OSMRE and the designated Engineer makes no representation as to the existence or nonexistence of utilities in the work area. The Contractor shall be responsible for identifying the location of utilities and notifying the owners prior to construction activities. The Contractor shall "Call Okie" (1-800-522-6543 in Oklahoma) as one means of notifying the owners of utilities prior to starting work at the project site. The Contractor shall be responsible for the modification of utilities made necessary by this project.
If work is required within 50 feet of a power line, the Occupational Safety and Health Administration (OSHA) regulations 29 CFR 1926.1408 must be followed. OSHA requires equipment to be kept at least 10 feet away from power lines and all setbacks must be marked. For lines with voltages higher than 50kV, the required distance is even greater (see below). When uncertain of a power line’s voltage, stay 50 feet away and call the local electric utility to identify the voltage of power lines before you begin working.
The Contractor must assume that all power lines are energized unless the utility owner/operator confirms that the power line has been and continues to be de-energized and visibly grounded at the worksite.

Before final payment will be made, the Contractor must have removed all equipment from the project site or must have made other arrangements with the landowner, to be verified by the Inspector.
SAFETY
The Contractor shall comply with all applicable state and federal safety regulations during performance of all work. The Contractor shall have on-site at least one person trained in administration of basic first aid along with the presence of basic first aid supplies and equipment.
Rollover protective structures will be required on the following equipment: crawler and rubber-tired tractors (such as dozers, push-and-pull tractors, winch tractors, tractors with backhoes, and mowers) and off-highway, self-propelled, pneumatic-tired earth movers including scrapers and motor tankers (excluding trucks with cabs). These requirements shall also apply to agricultural and industrial tractors and similar equipment. Equipment shall also be equipped with backup warning devices. Warning devices must be in use throughout the duration of the project.
Contractor shall be solely responsible for safety at the site, including safety of their employees, all others present at the site, and others on property in close proximity to the work site. Contractor shall take appropriate precautions to discourage access by the general public at all times during the project.
The Contractor shall be responsible for maintaining a safe flow of traffic around the work areas at all times.
Staging of trucks, equipment, etc. on all adjacent roads shall be the responsibility of the Contractor.
STORM WATER POLLUTION PREVENTION PLAN
A Stormwater Pollution Prevention Plan is required for all AML Reclamation Projects.
OSMRE’s responsibility shall be limited to the development of the Storm Water Pollution Prevention Plan (SWPPP). The SWPPP must comply with Oklahoma Department of Environmental Quality (ODEQ) and the Environmental Protection Agency (EPA) SWPPP regulations. A site specific SWPPP Sheet is included in the project plans. For this project, no Storm Water Discharge Permit is required. However, Best Management Practices (BMPs) as shown on the plan sheet must be installed and maintained by the Contractor as specified.
The Contractor shall be responsible for storm water pollution prevention associated with the reclamation activity on the AML site, including but not limited to day-to-day implementation of the SWPPP as specified in the project plans, maintenance of the BMPs and modifications or additions to BMPs as directed by the Inspector or Engineer due to varying field conditions. The specified erosion control measures and other appropriate erosion control measures needed to control storm water discharge during construction shall be installed in a timely manner. Failure to do so shall be cause to suspend all work until the measures are properly in place. Failure of the Contractor to fulfill his responsibilities for implementing the BMPs shall be cause to terminate the contract. The Contractor shall be liable for all penalties and fines imposed by the ODEQ, EPA, or other jurisdictions associated with storm water discharge resulting from failure to comply with the SWPPP.
During rainfall events of 0.5 inches or more, the contractor must be onsite to ensure through observation or required appropriate actions that the prevention erosion protections and sedimentation control measures are performing correctly and effectively.
If the contractor leaves the project for a period of more than 14 days, temporary stabilization practices will be provided by the contractor at no cost to OSMRE. Temporary Stabilization is defined as “the stabilization of exposed portions of the site in order to provide temporary cover in areas where earth-disturbing activities will resume again in the future”
As required in the OKR10 General Permit Section 3.3.2 A. “Initiate the installation of stabilization measures immediately in any disturbed areas where construction activities permanently ceased on any portion of the site or will be temporarily inactive for 14 or more calendar days on any portion of the site. The term ‘immediately’ is used to define the deadline for initiating stabilization measures. In the context of this provision, immediately’ means as soon as practicable, but no later than the end of the next workday, following the day when the earth-disturbing activities have temporarily or permanently ceased.
In addition, OKR10 General Permit Section 3.3.2 B details stabilization criteria that meets the permit requirements.
When the reclamation work has been completed the Contractor shall provide permanent stabilization practices as detailed in the plans and specifications. Contractor will be responsible for establishing permanent vegetative cover prior to final payment.
OSMRE-AML SUPPLEMENTAL SPECIFICATIONS
Bid Item No. 1 Mobilization
Description
This work shall consist of mobilization of the Contractor's forces and equipment necessary for performing the work required under the contract. It shall include the purchase of contract bonds, transportation of personnel and equipment, payment of all road permits and fees, establishment of office buildings and other necessary facilities, and other preparatory work at the project site. It also includes removal of personnel, equipment, buildings, supplies, etc., from the project site. Seventy percent (70%) of the Mobilization bid price may be paid on the first partial payment and the balance paid on the final payment.
The lump sum bid for mobilization shall not exceed seven percent (7%) of the total contract price. No additional payment will be made for demobilization and remobilization due to shutdowns, suspensions of the work, or for other mobilization activities.
Measurement and Payment
Total payment will be the lump sum contract price for mobilization, regardless of actual cost to the Contractor. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
Bid Item No. 2
Clearing and Grubbing
Description
This work shall consist of clearing, grubbing, removing, and disposing of all vegetation, debris, and rubbish which are within the designated limits of the project site; except such objects as are specified to remain in accordance with other sections of these specifications.
All trees, stumps, brush, debris, and rubbish will be cleared from the limits of the project as directed by the Inspector. This material will be bunched, burned, or otherwise disposed of in an approved manner.
Area and time for burning will be approved by the Inspector.
All trees, stumps, brush, debris, and rubbish should be cleared, bunched, and burned between August 1st and March 14. There shall be no brush piles burned after March 31.
Measurement and Payment
Payment for this item of work will be on a per acre basis for clearing, grubbing, burning, and burying all debris and rubbish. The quantity of 63 acres represents the approximate area for clearing and grubbing.
The Contractor agrees that final payment for this item will be made at the contract unit price bid times the quantity of 63 acres.
Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
Bid Item No. 3
Air Curtain Incinerator
Description
The Air Curtain Incinerator materials shall meet the requirements of the Oklahoma Department of Environmental Quality (ODEQ) document “Air Curtain Incinerators” attached herewith.
Contractor shall use a forced air destructor system in a pit to burn all wood and brush debris. Contractor shall coordinate all burn activities with the Oologah Fire Department (918-443-2471). The Fire Department and Inspector shall be notified a minimum of one day prior to burning. Burning is allowed only when the wind is ten (10) miles per hour or less.
The area to be used for burning operations shall be approved by the Inspector. The length of the pit can only be equal to the length of the plenum which directs air across the pit. The width of the pit must not exceed eight (8) feet, and the depth should be between twelve (12) and fifteen (15) feet. Both ends of the pits must be closed.
Contractor is responsible for obtaining necessary ODEQ air quality permits for the construction and operation of the air curtain. Permit applications can be found at https://oklahoma.gov/deq/permits/air-permits/general-permits-pbr.html. Permit questions shall be directed to ODEQ at 1-405-702-4100. All costs shall be included in Pay Item No. 3 Air Curtain Incinerator.
Measurement and Payment
Payment for this item of work will be on a lump sum basis. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
Bid Item No. 4
Earth Fill (without pumping)
This item of work consists of:
• Filling the pit(s) and other areas below planned grade from the spoil area.
• Disposing of any excess spoil in the designated area if required in the plans.
• Smoothing and shaping spoil or borrow areas to the proposed grade, or to slopes not exceeding twelve percent (12%).
• Dressed spoil should normally be no flatter than two percent (2%) with no standing water pockets.
Clearing and grubbing of areas to be excavated or filled shall be completed prior to beginning excavation or filling of these areas. The clearing and grubbing operations shall progress ahead of the excavation and fill operations, not be carried out concurrently.
Fills shall conform to the planned grades or as directed in the field by the Inspector. The fill areas shall be filled in uniform layers not to exceed two feet in loose thickness and all rubber-tired equipment (i.e.
scrapers, dump trucks) run over entire lift. If only track equipment is used, the maximum loose lift thickness shall be limited to 12 inches. Equipment should be routed to give the best compaction with a tolerance of ±0.3 foot from finished (planned) grade permitted. When fill is placed against a highwall, the highwall shall be benched as much as practical (in unconsolidated material) and equipment routed parallel to the highwall to assure uniform compaction of fill materials adjacent to the highwall. The fill adjacent to the highwall shall be walked in parallel with equipment a minimum of every day’s end or as directed by the Inspector. Cuts shall be made to proposed grades or to grades approved by the Inspector as necessary to obtain the material needed to complete the fill.
When placing fill in the pit(s) in water, the Contractor shall utilize coffer dams to help control and contain the mud. Coffer dams will be spaced at intervals not to exceed 300 feet or as directed by the Inspector.
When fill is placed in water and only a portion of the pit is to be filled, fill placement shall be accomplished in a manner to minimize the volume of mud displaced into the remaining water. Any excessive mud or muck (as determined by the Inspector) must be disposed of in a manner suitable to the Inspector at the contractor’s expense.
Material on the surface or uncovered in the filling operation deemed unsuitable by the Inspector for supporting vegetation shall be placed in the pits first. Material on the surface or uncovered in the filling operation deemed suitable by the Inspector for supporting vegetation shall be spread in a uniform layer as the final surface of the fill areas. This material shall also be placed on the slopes of borrow areas as directed by the Inspector. Once the Inspector designates any material for finish grade, it will be used as such, unless the Inspector and Contractor mutually agree that some other material can replace it.
The Inspector will determine the area to receive finish fill material, if adequate material is not available to cover the entire fill area.
After filling and grading operations have been completed, and prior to completion of the job, all haul roads shall be ripped or disked to a minimum depth of 10 inches.
Earth Fill Continued
All disturbed areas shall be left smooth and free of large rocks (including shale) over 6.0 inches, woody chunks, or other debris that would hinder vegetative operations and maintenance as determined by the Inspector.
NOTE: Burying residential waste shall be performed by placing fill a minimum of 10 feet above any water elevation (if buried in wet pit area), then place residential waste in a layer not exceeding 4.0 feet in height. The waste shall be crushed by a dozer or other equipment after placement. A layer of earth fill shall be placed over the waste as specified in this section. The waste shall be placed at least 10 feet below finish grade.
Measurement and Payment
The quantity of 351,777 cubic yards represents the approximate amount of in-place fill in the pit(s) and other areas below planned grade. The Contractor agrees that final payment for this item will be the unit price bid times the quantity of 351,777 cubic yards of fill.
Subsidiary Bid Item
Removal of Structures and Obstructions
This work shall consist of the removal, wholly or in part, and satisfactory disposal of all buildings, bridges, culverts, fences, structures, old pavements, abandoned pipelines, and any other obstructions except those designated or permitted to remain or for the obstructions to be removed and disposed of under other items in the Contract. It shall also include the salvaging of designated materials and backfilling the resulting trenches, holes, and pits.
If the proposal does not include pay items for removal of structures and obstructions as set out in this item, such work shall be performed under Bid Item No. 4, Earth Fill.
Measurement and Payment
The accepted quantities of items, measured as provided above, will be paid at the contract unit price bid for lump sum, which shall be full compensation for all labor, equipment, materials, and other items necessary and incidental to complete this item of work.
Bid Item No. 5 Fence (5-wire)
The materials and construction of this item shall be in accordance with Sections 624 and 732 of the Standard Specifications for Highway Construction, Oklahoma Department of Transportation, Edition of 2019, except as otherwise required by this specification and/or the drawings for fence detail. The work shall consist of furnishing and installing a five-strand barbed wire fence and two double-gated entrances using 10-foot gates (as shown on the plans) in accordance with fence specifications and to the lines and grades shown on the plans or established by the Inspector.
Materials
Corner, End, Pull, Gate, and Brace Posts (pipe): These posts shall be new or used Schedule 40 steel pipe. If used pipe is utilized, it must be inspected for soundness and approved by Inspector. Corner and brace posts will be 4-inch OD weighing 9.11 lbs./foot. Braces will be 2.375 OD new or used schedule 40 steel pipe weighing 3.66 lbs./foot. The posts will be 7.0 feet in length as shown on the plans with 3.0 feet below ground. Brace member shall be of sufficient length to provide 7.5 feet between centerline of the corner post and the centerline of the brace post. Corner and brace posts may be new or used steel schedule 40 pipe with welds cleaned after welding and entire assembly painted with aluminum paint. Welds must be sound welds utilizing E6011 welding rod or equivalent.
Barbed Wire: Barbed wire shall be No. 12½ gauge, galvanized, double strand with No. 14 gauge, 4-point barbs on 5-inch centers. The wire shall have a zinc coating of at least 0.30 ounce per square foot of wire surface.
Wire Stays: Where specified in a contract, wire stays shall be No. 10 gauge (minimum), galvanized, two-strand spiral, twist-on type.
Line T-Post: Line posts shall be new steel. Used T-posts are not to be utilized. The steel posts shall be from 6.0 feet to 7.5 feet long, studded "T" weighing not less than 1.33 ± 0.05 pounds per foot in the black, coated with a shop coat of red lead and a finish coat of aluminum weather resistant paint or galvanized by the hot-dip process at the rate of not less than 2 ounces of zinc per square foot. Line posts may be 6.0 feet rather than the 6.5 feet minimum shown on the plans.
T-Post Ties: Post tie wire of not less than 11 gauge to tie the barbed wire to steel T-posts shall be commercial fasteners of galvanized wire approved by the Inspector.
Gate assemblies: Commercial gates shall be the type shown on the drawings constructed with materials conforming to the kinds, grades, and sizes specified, including the necessary fittings and stays. Wire gap gates shall be fabricated as shown on the plans. Gates shall be located as shown on the drawings or as directed by the Inspector.
Concrete: Concrete used to set posts (pipe) shall have a 28-day strength of 3,000 psi (Class A minimum).
Coarse aggregate shall be gradation No. 57.
Fence (5-wire) Continued
Construction
The contractor shall perform such clearing and grubbing as may be necessary to construct the fence to the required grade and alignment. Both sides of the fence will be cleared for a width of 15 feet. The ground shall be leveled of minor irregularities so the fence can be free of an excessive number of anchor posts and fans.
At locations where breaks in a run of fencing are required, or at intersections with existing fences, appropriate adjustment in post spacing shall be made to conform to the requirements for the type of closure indicated. It is required that corner, end, pull, gate, and brace posts and anchors be embedded in Class A concrete. The hole for these posts shall have a minimum diameter equal to the diameter of the post plus six (6) inches. Concrete shall be delivered and discharged in place within 1.5 hours after the introduction of the cement to the aggregates. Bagged concrete mix may be used. Bagged concrete mix must produce concrete to the compressive strength of 3,000 psi. The contractor shall install temporary guys or braces as may be required to hold the posts in proper position until such time as the concrete has set sufficiently to hold the posts. Unless otherwise permitted, materials shall not be installed on posts or strain placed on guys and bracing set in concrete until 48 hours have lapsed from the time of placing of the concrete. Steel brace posts may be driven at a minimum depth of 36 inches, with the total pipe length a minimum of 7 feet, at the Inspector’s discretion.
Tops of steel posts (pipe) shall be closed by welding a top on the post, using commercial caps, or made-to-fit caps secured by welding. The tops of all posts shall be set approximately to the required grade and alignment. Line posts shall extend at least 2 feet below ground.
Extra-length T-posts will be required at small depressions where it is not practicable for the fence to follow closely to the contour of the ground. At such small ground depressions, the contractor shall close the space below the bottom of the fence with additional barbed wire, stretched taut between posts, either on horizontal lines or fanned at 6-inch maximum spacing, as shown on the plans or as directed by the Inspector.
The wires shall be stretched taut and securely fastened to the posts to prevent vertical movement of the wires. Concrete for encasing posts as indicated on the plans may be poured without forming if the excavation is of sufficient stability to receive the concrete without caving or sliding in. If specified by the Inspector, footings shall be formed.
Unless otherwise specified, corner assemblies shall be installed at all points where the fence alignment changes 15 degrees or more.
End panels shall be built at gates and fence ends.
Pull post (pipe) assemblies shall be installed at the following locations:
• In straight fence sections, at intervals of no more than 660 feet.
• At any point where the vertical angle described by two adjacent reaches of wire is upward and exceeds 10 degrees unless otherwise directed by the Inspector.
• At the beginning and end of each curve.
Fence (5-wire) Continued
The fencing shall be stretched and attached to posts as follows:
• The fencing shall be placed on the side of the post opposite the area being protected, except on curves, along roads, and along railroads.
• The fencing shall be placed on the outside of curves.
• The fencing shall be fastened to each end post, corner post, and pull post by wrapping each horizontal strand around the post with a double wrap and tying it back on itself with not less than five tightly wound wraps.
• The fencing shall be fastened to steel line T-posts with the post manufacturer's special wire fasteners. Each strand of barbed wire shall be attached to each post.
• Wire shall be spliced by means of a Western Union splice or by suitable splice sleeves applied with a tool designed for the purpose. The Western Union splice shall have not less than 8 wraps of each end about the other. All wraps shall be tightly wound and closely spaced. Splices made with splice sleeves shall have a tensile strength no less than 80 percent of the strength of the wire.
Each horizontal fence wire shall be attached to brace, corner, or end posts with a double wrap of No. 9 gauge galvanized wire tied back with a minimum of 5 wraps. At pull panel locations, the horizontal fence shall be extended to the opposite end post and tied as previously described. At junctions of fence wire and posts where ties are not specified, the wire shall be secured to the post with standard wire clips or fasteners except on metal pipes where brace bands will be utilized to maintain a stable wire alignment with No. 9 wire or Galvanized Rings used to fasten horizontal fence wire to brace bands.
At changes in vertical fence alignment, line posts that restrain upward pull of fence strands shall be anchored by setting such posts in concrete. The concrete anchorage shall be uniformly tapered from ground surface to the bottom of the hole with a minimum concrete thickness of 3 inches at the top and 6 inches at the bottom. The Inspector will designate the locations where this anchorage is required.
Measurement and Payment
The length of fence will be measured to the nearest foot along the profile of the fence, including gate openings. Payment for fence will be made at the contract unit price for fence. Such payment will constitute full compensation for all labor, materials, equipment, and all other items necessary and incidental to the performance of the work including fabricating and installing gates.
Bid Item No. 6
Temporary Fence (3-wire)
Description
Temporary fencing shall be installed as shown on drawings. Permanent fencing specifications are to be used with the following exceptions listed below.
Materials and Construction
• Temporary fence will be 3-stranded utilizing Class III 13 ½ - 15 ½ gauge galvanized high-tensile smooth wire. Bottom wire must be 12-18 inches from the ground and top wire shall be 2/3 shoulder-height of livestock.
• Inline t-posts must be steel, 1.25 lbs./ft or heavier, and spaced every 25 feet. No stays are allowed.
• Steel corners must utilize single H braces installed at each end of fence run with wire pulled taut.
Measurement and Payment
The length of fence will be measured to the nearest foot along the profile of the fence, including gate openings. Payment for fence will be made at the contract unit price for fence. Such payment will constitute full compensation for all labor, materials, equipment, and all other items necessary and incidental to the performance of the work including fabricating and installing gates.
Bid Item No. 7
Traffic Bound Surface Course
Description
Traffic Bound Surface Course may be placed at the entrance to the work area at the discretion of the Inspector for ingress and egress of the construction. Payment will not be made for material hauled and placed at site that was not deemed necessary by Inspector prior to placement.
Delivered material shall be 1.25 inch and/or 3-inch crusher run rock. Actual size to be determined in the field by Inspector. The source of materials shall be approved by the Inspector prior to delivery to the site, unless the source is on the current ODOT approved source list.
Measurement and Payment
The Contractor shall furnish the Inspector a copy of the weight ticket for each load of material delivered to the project site and placed in accordance with the plans and specifications. All materials shall meet the requirements of this specification and be approved by the Inspector. The Inspector may correct the quantity to be paid to correct for any wastage.
Payment will be made at the contract unit price on the basis of weight to the nearest one-tenth ton of material delivered, placed, and approved by the Inspector. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
Bid Item Nos. 8 and 9
Temporary Erosion and Sediment Control
Description
This work shall consist of the construction, maintenance, and removal of temporary erosion and sediment control measures at locations shown on the plans or determined by the Inspector. Sediment barriers shall be used to trap sediment at the toes of slopes, or across ditches and defined waterways.
Temporary Straw Wattle (Item No 8)
Straw Wattles shall be a minimum of 9-inch diameter with a weight of 1.7 lbs./LF. They shall be cylindrical with closed ends. The netting shall be a minimum 0.5 inches X 0.5 inches HD Synthetic photodegradable netting engineered for high water flow. The wattle shall be filled with 100 percent weed free straw matrix.
Straw Wattle shall be installed per manufacturer’s recommendations. Wood support stakes at intervals of not more than 4 feet shall be installed to support the wattle, water and sediment retained by the structure.
Straw Wattles are designed to retain sediment-laden stormwater and allow settlement of suspended. Straw Wattles shall be located on the contour to capture overland, low-velocity sheet flows at slopes less than 10 percent. Install on a level grade along the contour with the ends curved uphill (J-hooked) to provide sufficient ponding storage for the anticipated runoff. Place rock sediment barriers to allow controlled release of storm water at a maximum interval of 50 feet and in areas to ensure drainage, or as directed by the OSMRE Inspector. DO NOT overlap ends on top of each other. Either butt ends together tightly or overlap behind each other a minimum of 4 feet.
Rock Check Dam (Item No. 9)
Defined channels subject to concentration flows in larger quantities and higher velocities will be protected with rock/sandbag barriers. The dams impound sediment-laden water and allow for settlement of suspended soil before the stormwater goes through and over the device. Dams shall be placed along the water course at linear intervals in which the elevation of the bottom of the upstream check dam is at the same elevation as the top of the check dam immediately below it. The dam shall not be more than 2 feet high. The check dam shall be constructed carefully to ensure its effectiveness. This will allow the most ponding capacity and will not increase the velocity of the water flowing in the channel. Typical locations, spacing and details of the check dams are shown on the sediment control plans.
Maintenance
The Contractor shall keep sediment barriers in good condition by replacing broken or damaged barriers immediately after damage occurs. Accumulated silt shall be removed when it reaches a depth equal to half the barrier height, but no more than 12 inches or as directed by the Inspector.
Sediment barriers may be removed or left in place at the discretion of the Inspector.
All erosion and sediment controls shall be maintained in good working order by the Contractor from the beginning of construction until the work has been accepted as complete by OSMRE. Inspection by the Contractor and any necessary repairs shall be performed once every 14 calendar days and within 24 hours after any storm event greater than 0.5 inches (as recorded by a non-freezing rain gauge to be located on-site).

Measurement and Payment
Payment for Temporary Straw Wattle (Item No. 8) will be on a linear feet basis for all installed straw wattles. Cost to include all labor and materials for installing, maintaining and removal (if required) of the Temporary Straw Wattle.
Payment for Rock Check Dam (Item No. 9) will be made at the contracted unit price for rock on the basis of weight to the nearest one tenth ton of material delivered, placed, and approved by the Inspector. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
The Contractor shall furnish the Inspector a copy of the weight ticket for each load of rock delivered to the job site and placed in accordance with the plans and specifications. All materials shall meet the requirements of this specification and be approved by the Inspector. The Inspector may correct the quantity to be paid to correct for any wastage.
The Inspector will use the location of the sediment control measures shown on the plans as a general guide to placing sediment control but will have the latitude to add or subtract as they deem necessary to prevent off-site sedimentation.
Seventy percent (70%) of the bid price for each unit installed will be paid after installation of erosion control measures directed by the Inspector, and the balance will be paid on the final payment. The final payment includes replacement of failed sediment control measures and removal of accumulated silt. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and incidental to complete this item of work.
Bid Item No. 10
Rip Rap Type IA (12”)
Description
Riprap shall meet the requirements of Section 713 of the Standard Specifications for Highway Construction, Oklahoma Department of Transportation, Edition of 2019.
The source of materials shall be approved by the Inspector prior to delivery to the site, unless source is on the current ODOT approved source list.
Riprap shall be placed in accordance with Section 601 of the Standard Specifications for Highway Construction, Oklahoma Department of Transportation, Edition of 2019 in the areas and to the dimensions shown on the drawings or as directed by the Inspector.
• Quantity includes 700 Ton of 12” Rip Rap to be placed for rock drop.
• Quantity includes 400 Ton of 12” Rip Rap to be placed at north end of pit where inflow from offsite enters site.
Measurement and Payment
The Contractor shall furnish the Inspector a copy of the weight ticket for each load of riprap delivered to the job site and placed in accordance with the plans and specifications. All materials shall meet the requirements of this specification and be approved by the Inspector. The Inspector may correct the quantity to be paid to correct for any wastage.
Payment for riprap will be made at the contract unit price for each bid item on the basis of weight to the nearest one tenth ton of material delivered, placed, and approved by the Inspector. Such payment will constitute full compensation for all labor, equipment, materials, and other items necessary and incidental to complete these items of work.
Subsidiary Item
Filter Fabric
Description
The materials and construction of this item shall be in accordance with Sections 601.04 and 712.04 of the Standard Specifications for Highway Construction, Oklahoma Department of Transportation, Edition of 2019. Filter Fabric shall be laid across the slope beginning at the bottom of the slope. Each subsequent strip shall overlap the lower strip as laying shingles a minimum of two (2) feet. The upstream edge of the filter fabric shall be turned down and buried 18 inches. Along the sides of the lined channel, the fabric shall be installed so as to provide an extra width of 18 inches prior to placement of riprap.
The filter fabric shall be unrolled along the placement area and loosely laid (not stretched) in such a manner that it will conform to the surface irregularities when the stone or other material is placed on or against it. No cuts or punctures will be permitted in the filter fabric unless otherwise specified. The filter fabric may be folded and overlapped to permit proper placement in the designated area.
Securing pins, provided by the filter fabric manufacturer, shall be placed along the edge of the filter fabric to adequately secure it during placement. Pins shall be steel or fiberglass formed as a "U", "L", or "T" shape or contain "ears" to prevent total penetration. Steel washers shall be provided on all but the "U"-shaped pins. At vertical laps, securing pins shall be inserted through both layers along a line through the approximate midpoint of the overlap. At horizontal laps and laps across slopes, securing pins shall be inserted through the bottom layer only. Securing pins shall be placed along a line approximately two (2) inches in from the edge of the outer limits of the placed filter fabric at intervals not greater than 12 feet unless otherwise specified. Additional pins shall be installed as necessary to prevent any slippage of the fabric, regardless of location. The use of securing pins will be held to the minimum necessary. Pins may be left in place unless otherwise specified.
This item will be paid under Bid Item No. 10 Rip Rap Type IA
Bid Item No. 11
Deep Disking
Description
This item of work consists of treating the area designated with a deep disk. The area is estimated to be 72 acres.
Prior to deep disking the site, a heavy beam or land leveling device should be dragged over the site to level the soil and to fill any low areas to prevent water ponding on the site, leaving no depressions greater than two (2) inches.
Disk Treatment 1
Depth of deep disking will be not less than 12 inches and no wider than 14-inch spacing. Disking operation shall be across all slopes not greater than 20 percent (5 to 1) on the approximate contour.
Exception may be made on relatively flat area or where not practical at Inspector discretion. After the disking operation has been completed, the area shall be free from rocks or concrete chunks over 6 inches, and roots or other undesirable foreign material that would interfere with planting operations. The offset disk used will have minimum depth of penetration of 12 inches.
Disk Treatment 2
Following Disk Treatment 1, a mulch treatment will be applied that consist of thoroughly incorporating mulch within the upper 12 inches of the soil profile utilizing the deep disk. Mulching must be completed no less than 30 days prior to seeding. Application shall consist of three tons per acre of any combination of oat or rye straw, hay, and/or milo residue. Discolored weathered, brittle, caked material is acceptable, as long as it is not so decomposed it cannot be easily handled and uniformly spread.
Contractor shall avoid making tillage operations when the soil is wet. (Rule of thumb is that the soil squeezed in your hand falls apart when tossed, if it's not too wet.)
Measurement and Payment
The quantity of 72 acres represents the approximate area for deep disking. The Contractor agrees that final payment for this item will be made at the contract unit price bid times the quantity 72 acres.
Payment for this item will be for performing tillage operation and burying all debris and rubbish uncovered by tillage operation. Such payment will constitute full compensation for all labor, equipment, materials, and other necessary items and any other incidentals to complete this item of work.
Bid Item Nos. 12, 13, 14, 15 & 16
Permanent Erosion Control
Description
This work shall consist of the preparation of seedbed, soil testing, liming and fertilization of seedbed, and seeding of all areas disturbed by construction. If areas outside the Project limits are disturbed, Contractor shall repair and reseed per the specifications at no additional cost. Any deviations to these bid items must be approved by the Inspector prior to implementation.
After final grade, Inspector will collect soil samples and make subsequent recommendations for the area to be treated with permanent erosion control. This will be performed according to Oklahoma State University Extension guidelines and the results given to the contractor for implementation in bid items Nos 12, 13, 14, 15 & 16.
Agricultural lime, nitrogen (N), phosphorus (P2O5), and potassium (K2O) shall be applied to all areas to be seeded and incorporated by disking into the top six inches of the prepared seedbed to avoid losses due to inclement weather. Areas fertilized must be seeded within one week after fertilizer application.
Prepare seedbeds by any method that will result in a friable, smooth, firm seedbed to a depth of no less than six inches without excessive competitive cover, without stones over six inches, and without compaction layers (plow pan or hardpan). Multiple passes of a disk in a cross pattern are recommended.
The seedbed is considered firm when you can walk on it without sinking more than 0.5-inch sole of shoe.
Agriculture Lime (Pay Item No. 12)
Agricultural lime shall be ground calcitic limestone from a source approved by the Inspector. The lime shall have Effective Calcium Carbonate Equivalent (ECCE) of at least 50 percent per bulk ton of lime to be applied. Submit to Inspector the Effective Calcium Carbonate Equivalent (ECCE) per ton of liming material a minimum of one week prior to application. Provide receipts or weigh tickets substantiating the quantity of materials used on project to Inspector. For bidding purposes assume a rate of 1.0 Ton/acre.
Recommendations shall be based on results from a current (two year or less) soil analysis at grass establishment rates as listed on Oklahoma State Extension Service fact sheet PSS-2225, Table No. 12.
Lime must be applied thirty days prior to seeding vegetation.
Fertilizer (Pay Item No. 13, 14 & 15)
Fertilizer may consist of organic fertilizer in the form of poultry litter and/or inorganic fertilizer. Poultry litter shall be dry enough to spread mechanically and not treated with alum. Contractor shall supply an analysis from an approved lab for each litter source to the Inspector prior to any application recommendations being made. Inorganic fertilizer shall be standard commercial product which, when applied at proper rate, will supply necessary amounts as specified.
The rate of application of poultry litter shall be determined by the amount of litter needed to meet the soil test requirements. For bidding purposes assume 2 tons/acre.
For bidding purposes of inorganic fertilizer, the amount of nutrients to be supplied is as follows:
Nitrogen 40 lbs./acre Phosphorus (P2O5) 80 lbs./acre Potassium (K2O) 80 lbs./acre
Permanent Erosion Control Continued
If lime and/or fertilizer is applied but not yet incorporated, and the Inspector believes significant loss of either lime or fertilizer or both has occurred due to bad weather, the Contractor shall reapply lime or fertilizer or both, as applicable, at the rates and in the areas of the site so directed by the Inspector, without additional compensation.
Seeding (Pay Item No. 16)
As weather and site conditions permit, within the specified seeding season of March 15 to June 15, seed site on all disturbed areas. Disturbed area will be broadcast planted to Wrangler Bermudagrass and Korean Lespedeza. If Wrangler Bermuda is not available, either Stampede (blends) or Cheyenne varieties of Bermudagrass are acceptable. Bermudagrass will be broadcast seeded at a rate of 25 pounds per acre Pure Live Seed (PLS) and Korean Lespedeza at a rate of six (6) pounds per acres PLS.
When conditions are such that less than satisfactory results are likely to be obtained by reason of drought, excessive moisture, or frozen soil, seeding work shall be halted as directed by the Inspector and resumed only when…
