FEDERAL BUREAU OF INVESTIGATION

STATEMENT OF WORK

1 Introduction

1.1 Background

The FBI Quantico Complex consists of multiple outside firearms ranges used to conduct weapons training, qualifications and re-qualifications for New Agent Trainees, National Academy Students, International Law Enforcement Students, Field Office Agents, Firearms Training Unit Instructors, and Agents assigned to staff and leadership positions throughout the National Capitol Region. The ranges are maintained by the Real Property Management Section Programs Office (RPO), Finance and Facilities Division. Over time, the Granulated Rubber Bullet Trap (GRBT) accumulates significant amounts of expended lead which must be extracted from the backstop to ensure continued safe operations and mitigate backsplash and ricochets.

Failure to extract the expended lead in a timely manner can lead to buildup, presenting a training hazard that could be catastrophic if not addressed.

1.2 Scope

This is a contract to provide lead extraction services for the outdoor ranges located at the FBI Quantico Complex. The lead extraction shall rotate yearly between Ranges #1 and #3 with pricing options for additional extractions to take place on any or all the ranges listed below.

The dimensions for each range need to be field verified for accuracy.

Range #1 260’L x 26’H x 20”-24” D Range #2 260’L x 26’H x 20”-24” D Range #3 260’L x 26’H x 20”-24” D Range #4 190’L x 26’H x 20”-24” D Range #5 115’L x 26’H x 20”-24” D Range #6A-6B 190’L x 24’H x 20”-24” D Range #7 180’L x 24’H x 20”-24” D Range #8 120’L x 24’H x 20”-24” D

A minimum depth of 24 inches of ballistic rubber is required to maintain safe firing standards on the ranges.

1.3 Objectives

Upon completion of this service, the following objectives must be met:

All lead and rubber will be extracted from backstop(s) Visual inspection of the bullet traps for wear and damage with written notification to the FBI of any findings.

SOLICITATION/ REQ #15F06725R0000294 Version 1.0 Page 3

Weapons Range Filtration System Cleaning: Clean and repair any installed engineered controls/stormwater management features which will reduce possibility of migration of lead from the site in stormwater runoff. The intent is to reduce the flow of stormwater to be slow enough to allow suspended lead particles to separate/settle onsite.

All berms must be restored to a usable condition by distributing the granular rubber evenly and consistently across the backstop

Add additional rubber to the backstop to maintain a minimum of 24 inches in depth if necessary Calcium carbonate will be added to the backstops as a fire-retardant, preventive treatment to the granular rubber backstops All extracted lead and hazardous waste generated during this process will be properly containerized and disposed of by the contractor in accordance with federal and state regulations.

2 Requirements/specifications This is a non-personal services contract. The Government shall not exercise any supervision or control over contractor employees performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor will be a co-generator of all waste generated; however, the FBI will have signature authority on all documents.

Waste Management: Resource Conservation and Recovery Act (RCRA), 40 CFR Parts 261-268 specifies hazardous waste identification, management, and disposal requirements. RCRA establishes guidelines for proper handling, sampling, treatment, storage, and disposal of hazardous waste. Any waste generated on the ranges must be characterized to determine whether it is non-hazardous or hazardous. No wastes shall be treated unless this contract is modified to include all regulatory requirements.

Lead and other range metals, if recycled or reused, are considered reclaimed scrap metal, and are therefore excluded from RCRA regulation and are not considered a hazardous waste if the metal is recycled at an appropriately certified and legitimate recycling facility per RCRA regulations.

Collected lead and other metal bullets and fragments for recycling must have a bill of lading for transport. Lead must also be recycled domestically unless the FBI meets all exporting requirements in the regulations.

OSHA Lead Exposure: Occupational Exposure to Lead, 29 CFR Part 1910.1025. Lead work must be performed by a licensed and certified contractor approved to perform lead work. All personnel must be trained in the handling of lead contaminated materials. Training must be in accordance with the latest guidelines as published by OSHA, state, and local jurisdictions.

Training must be current for all personnel involved with the services. Personnel conducting lead reclamation shall protect themselves from exposure to lead using proper Personal Protective Equipment and breathing apparatus as deemed necessary.

2.1 Task Descriptions

LEAD MINING SCOPE OF WORK

Procedures for Lead Mining and Reclamation

The granular rubber filled backstop accumulates expended lead over time that must be extracted from the backstop to ensure continued safe operation and ricochet mitigation. Failure to extract lead presents a training hazard that could be catastrophic if not addressed.

Lead recovery and recycling are two distinct processes, both of which are necessary components of lead management at shooting ranges. The rubber backstops should be cleaned by a lead reclamation contractor when one of the following conditions is met:

1. The number of bullets fired reaches 100,000 rounds per lane.

2. Fragmentation of bullets is escaping from the trap.

3. Excessive amount of fragmentation is visible on the surface.

The following summarizes the general procedures for conducting lead mining and reclamation as information only. The contractor is responsible for developing a scope of work, health, and safety plan, and for performing the recycling event in a safe and efficient manner that meets all federal, state and local regulations.

1. All mining and reclamation procedures must be performed by qualified and properly trained companies and employees. Any persons working directly with the mining equipment and lead material must have medical monitoring and be trained under Occupational Safety and Health (OSHA) requirements. Documentation of contractors’ company certifications will be requested by the facility.

2. At all times lead reclamation activities should be conducted with controls that protect public health and the community, protect workers during implementation, and protect the environment.

3. The ranges will be shut down for two (2) weeks during the process. The time frame must be coordinated in advance with the range staff prior to execution. Since training is happening at the site, the work will need to be performed during the agreed upon time at each range. This is to minimize the impact of lead operations on class schedules. The range must be made accessible for equipment and inaccessible to staff by coordinating the work area with some type of visible and physical barrier. A work area as close to the backstop as possible should be selected to minimize moving of materials.

4. Personnel and/or equipment extending above the top surface elevation of the existing impact berm could be within the surface danger zone of existing adjacent ranges. As a matter of safety, personnel and equipment shall only be permitted to extend above the top surface elevation of the existing impact berm as scheduled by the contract COR.

SOLICITATION/ REQ #15F06725R0000294 Version 1.0 Page 5

5. Removal of lead rounds, lead fragments and other existing metals from rubber berms shall be by dry method(s). During berm mining and lead extraction, the rubber must be removed from the backstop and lead separated from rubber. The extracted lead shall not contain more than 10% rubber (or industry standard whichever is lower) to ensure that the FBI receives a quality product for recycling. The contractor is responsible for providing the drums for this project. Once fully separated from lead, the rubber should be placed back on the bullet trap with a 24-inch uniform thickness (measured in the direction of incoming bullets).

6. It may be necessary for the contractor to incorporate new wire free rubber granules to achieve the

24-inch thickness. The contractor will treat the rubber with calcium carbonate, unless the rubber is pretreated, to maintain the fire-retardant nature of the granular rubber backstops. Calcium carbonate should be spread over the granular rubber backstops at a rate of one pound per linear foot of backstop. Addition of ballistic rubber to maintain the 24 inches as required is to maintain safe firing on the ranges.

7. The live fire shoot house has several bullet traps which will require an annual extraction. This service should be coordinated with the COR to ensure this facility is not scheduled to be in use.

8. All debris generated during this process must be containerized in a DOT approved container so that it can be disposed of as lead contaminated waste. All debris and waste materials generated during the lead extraction work should be disposed of in accordance with RCRA.

9. All extracted lead will also be containerized in DOT approved sealed containers and the contractor shall offer a fair market value and arrange for the lead to be recycled by a legitimate domestic recycling facility as per RCRA requirements. This process will not off-set the project cost, the contractor will have to submit a payment to the FBI via the pay.gov system. The contractor is responsible for providing the DOT containers required for this project along with the dumpster’s required to dispose of all the waste generated during this process. The contractor is also responsible for coordinating the removal of the waste created.

10. The weight of lead and other metals recycled, and recycling proceeds paid by recycler shall be certified by the recycler in writing and written certification by recycler shall be provided to the FBI. The certification documentation will identify in writing:

total weight of lead removed, total weight of lead recycled, total weight of other (i.e., non-lead) metal recycled, location of recycler, name of recycler, and date(s) of delivery for recycling.

11. The Contractor will provide the Government with a bill of lading or manifest shipping document to transport and track the property to the final destination facility that meets the EPA requirements. The Contractor is responsible to ascertain and comply with all

SOLICITATION/ REQ #15F06725R0000294 Version 1.0 Page 6 applicable federal, state, local, and multi-jurisdictional laws, ordinances, and regulations pertaining to the registration, licensing, handling, possession, transportation, transfer, management, or sale of the property listed in the Invitation. This includes compliance with recycling laws and regulations and OSHA standards. All licenses, permits, and inspections are the sole responsibility of the Contractor.

12. Should any discharge, leakage, spillage, emission, or pollution of any type occur upon or from the premises due to Contractor’s use and occupancy thereof, the Contractor, at its expense, shall be obligated to clean all property affected thereby to the satisfaction of the FBI (insofar as the property owned and controlled by FBI is concerned) and any governmental body having jurisdiction thereover.

13. Site shall be left in the same condition it was in before work was begun. Contractor shall be responsible for sweeping or power washing the site to remove rubber residue and other remaining debris resulting from the services provided.

14. Once work is complete the contractor will be required to conduct a final walk through with the Contracting Officer’s Representative (COR) and end user to ensure the site is left in an acceptable condition.

15. A detailed written lead extraction procedure, means by which the rubber and lead is separated, is not a standardized process throughout the industry. The procedures provided should incorporate best management practices to minimize lead particulate escaping into the atmosphere so not to endanger human health or the environment. While the Government does seek best value for this service, heavy consideration will be given to the process. A process that accomplishes the requirement in a timely manner and incorporates a more environmentally friendly process weighs favorably in proposal evaluations.

16. Provide hazardous waste transporter and disposal facility in which waste generated from the lead extraction will be handled.

17. Vendor or Contractor shall have established programs and shall submit with proposal a copy of the following OSHA required, and other items:

Respiratory Protection Program endorsed by a Certified Industrial Hygienist

Medical Surveillance Program

Certificates of worker training

Reference list demonstrating at least 10 previous projects of similar scope and a minimum of five years’ experience in this type of work. Include point of contract for verification purposes.

18. Contractor is responsible for complying with the following regulations that govern shooting ranges:

19. Contractor shall provide general liability, workmen’s compensation, and no less than $1 million in lead pollution liability coverage.

20. Contractor performing repair work, disassembly, re-assembly, alteration and/or return to service for the bullet trap shall be trained and authorized to perform such work by the original equipment manufacturer.

21. Detailed written plan of action and after-action account of work performed is required.

Written recommendations to correct any noted deficiencies along with a quote for corrective action is required.

22. The Contractor must coordinate the performance of contracted services with the COR, or the designated point of contact.

23. The Contractor must comply with all applicable laws, ordinances, regulations, and directions of proper authorities having jurisdiction over this project. The Contractor is solely responsible for all work related to contract performance, including the work of employees, subcontractors, and any other affiliates. The Contractor is responsible for correcting improper work to the FBI’s satisfaction and resolving schedule delays caused by the Contractor.

24. The Contractor is solely responsible for the conduct of its employees, subcontractors, and affiliates throughout contract performance.

25. The FBI reserves the right to inspect contract performance at any time and reject any work not conforming to the requirements of this SOW. The Contractor must immediately correct any work the CO rejects at no additional cost to the Government. The Contractor is responsible for any resulting schedule delays.

26. The FBI may direct the Contractor to stop work partially or completely, if activities do not comply with contract requirements, including safety and security requirements. Such stoppage, suspension, or forfeiture of work does not nullify the terms of the contract or justify slippages in the contract schedule.

27. The Contractor must resolve contract issues as they arise and coordinate all work with the COR. If the Contractor discovers potential or actual delays, a representative must notify the FBI CO and COR within 24 hours and recommend corrective action to keep the services on schedule.
