About this file
This document is an attachment detailing ordering procedures for multiple award Indefinite Delivery, Indefinite Quantity (IDIQ) contracts for Large Penetrator Warhead Assemblies Production. The Government is obligated only to award the guaranteed minimum quantity on the first delivery order, issued simultaneously with the basic IDIQ contract award. The total contract ceiling for the five-year period, plus an optional two-year extension, is $149,000,000.00, with a maximum of four IDIQ contract awards permitted. The cumulative value of all orders placed under multiple award IDIQ contracts cannot exceed this ceiling, meaning individual contract ceilings will vary based on the number of awardees and fair opportunity competition outcomes.
Future requirements will be competed among all IDIQ awardees using evaluation factors that may include price, production capacity, delivery schedule, and past performance based on prior contract performance only. The Government will notify contractors of which evaluation factors apply and their relative importance, and reserves the right to make tradeoffs and award to non-lowest-priced contractors. The Government may divide future requirements on any basis in its best interest and retains the right to issue single delivery orders without competition if an exception to fair opportunity applies. Protests of delivery orders are limited to challenges involving scope, period, maximum value increases, or orders exceeding $35 million, with an ombudsman available to ensure fair opportunity procedures are followed.

Attachment 3 Ordering Procedures – Multiple Award Contracts
The Government is only obligated to award the guaranteed minimum quantity on any resulting Indefinite Delivery, Indefinite Quantity (IDIQ) contract. The guaranteed minimum quantity will be awarded on the first delivery order at the same time the basic IDIQ contract is awarded.
In accordance with Revolutionary FAR Overhaul (RFO) 16.504, future requirements will be competed between the IDIQ contract awardees with consideration given to all or any combination of price, production capacity, delivery schedule, and past performance, to include consideration of price only. Assessment of past performance will be based on prior performance under this contract;
contractors shall not provide additional past performance information. The Government will notify contractors which factor(s) will be utilized in the evaluation of future requirements including their relative importance. In determining the best overall value, the Government reserves the right to make a tradeoff and award to other than the lowest priced contractor in accordance with the relative importance of factors identified.
a. The Government intends to conduct a competition among the awardees for each future lot buy;
however, the Government reserves the right to issue a single delivery order, without competing, if it is determined that an exception to Fair Opportunity applies in accordance with RFO 16.507- 6(b)(2).
b. No Protest Rule and Ombudsman: In accordance with 10 U.S.C. Section 3406(f)(1), no protest under RFO Subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract or exceeds $35 million. The address, phone number, and e-mail address for the ombudsman are provided in RFO Clause 52.216-32, Task-Order and Delivery-Order Ombudsman. The ombudsman will review complaints from the contractors and ensure all contractors are afforded a fair opportunity consistent with the procedures in this solicitation.
c. The Government will reserve the right to divide future requirements on any basis and combination as determined to be in the best interest of the Government. The total five (5) year, plus an option for two (2) additional years, maximum IDIQ contract ceiling for the Large Penetrator Warhead Assemblies Production contract is $149,000,000.00. If more than one (1), but not to exceed four (4) IDIQ contract awards are made, the cumulative orders placed under the multiple award IDIQ contracts shall not exceed $149,000,000.00. Therefore, each contract final ceiling will vary based upon the outcome of the fair opportunity process described above.
