About this file

This document is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form used for the sources sought notice SS-26-PHX-010 titled "IAW Buy Indian Act -Sources Sought Pluralsight Software License" dated December 30, 2025. The form serves as a self-certification mechanism for offerors to declare whether they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined under 25 U.S.C. 47 and HHSAR 326.601.

Offerors must maintain eligibility as an Indian Economic Enterprise throughout three critical periods: when submitting an offer, at the time of contract award, and during the full contract performance period. Any loss of eligibility status requires immediate written notification to the Contracting Officer. Contracting Officers may request documentation to verify eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. Successful offerors must also register with the System of Award Management (SAM). The form requires the offeror to indicate whether it meets the definition of an Indian Economic Enterprise and mandates disclosure of the federally recognized tribal entity affiliation, business name, 51% owner name, Unique Entity Identifier number, and a certifying signature. False or misleading information constitutes a violation of law under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729 to 3731 and 18 U.S.C. 287.
