· SDB: 5%

· WOSB: 3%

· SDVOSB: 3%

L.4.3.2.2.2 The offeror shall explain how it is maximizing opportunities for small businesses and why the specific goals it has proposed are both challenging and realistic given the totality of circumstances in this acquisition. The offeror shall provide the percentage of total estimated contract dollars which it intends to subcontract to each socio-economic category (Small, SDB, WOSB, HUBzone, VOSB, SDVOSB). For proposal purposes, dollars and goals should be based on the Maximum Contract value of $248M. The dollar value is being used for proposal preparation purposes only, and dollars proposed will not be binding on the awardee. However, the percentages proposed will be monitored via the Subcontracting Plan (or a separate CDRL to be identified if the awardee is a Small Business). The Small Business Participation Plan shall not exceed five (5) pages.

L.4.3.3 FAR 52.219-8, FAR 52.219-9 and DFARS 252.219-7003 clauses are included in this solicitation and will be incorporated into any resultant contract. All Other than Small Business Offerors will be required to submit a Subcontracting Plan separate from this section as part of its General and Administrative Qualifying Criteria.

L.5 VOLUME 4 – FACTOR 4 - PAST PERFORMANCE.

L.5.1 Past Performance General Information: Submit only information on contracts most recent and relevant in demonstrating your ability to perform the proposed effort. Each Offeror shall submit present and Past Performance information for itself and for all major proposed subcontractors, team members, and/or joint venture partners in terms of size, scope, and technical complexity with its proposal.

1. No classified past performance supplements will be accepted. The Offeror may submit performance on classified programs if that information can be verified. If the Offeror intends to submit in this manner, the information that is classified (customer, contract number, etc.) should be marked “reserved” and the description/write up of the work performed shall remain unclassified. If the Offeror cannot describe what work was accomplished in an unclassified manner, for the Government will not consider that work for evaluation.

1. While the primary source of information for each Offeror is the Past Performance Volume and Questionnaires, this information, as well as other information the Government may obtain elsewhere, such as Government databases (CPARs, PPIRs etc.) and other Government agencies (DCMA, DCAA etc.), may be used to evaluate the Offeror’s Past Performance. The Government reserves the right to solicit feedback beyond what is identified in the questionnaire in determining the Offeror’s Past Performance Confidence Assessment.

L.5.2 Recent and Relevant Contracts: Offerors are notified that the Government will use the data provided in this Volume that is determined to be recent and relevant to the effort at hand and data obtained from other sources in the development of performance confidence assessments.

L.5.2.1 Recent. For the purposes of this solicitation, recent contracts are defined as those on which performance occurred during the last three years.

L.5.2.2 Relevant. The Definitions of Relevancy are as follows:

· Very Relevant-Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

· Relevant-Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

· Somewhat Relevant-Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

· Not Relevant -Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires

Table 1, Past Performance Relevancy Criteria Considerations below, outlines the Government’s areas of consideration with respect to determining relevancy. The Table 1 considerations are not all inclusive; the Government may consider factors that relate to relevancy but may not be specifically identified in the Table below. The more an effort is similar in these areas, the more relevant that effort becomes. No single relevancy criterion is more important than another when determining relevancy of a prime offeror effort, but rather all criterions are considered holistically in order to subjectively assess one overall relevancy rating. An Offeror’s past performance does not have to be “Very Relevant” in all criterion in order to be determined “Very Relevant” overall. Additionally, an offeror’s past performance could hypothetically be “Not Relevant” in one or more criterion and still be determined “Somewhat Relevant” or higher overall.

The Offeror shall identify whether its pricing approach includes DBA as a direct charge to the contract as an Other Direct Cost (ODC) or if DBA is included in its indirect rate structure. While the Government prefers a direct charge to the contract as an ODC for simplicity, either approach is acceptable as long as it is clearly identified. No strengths or significant strengths will be identified for either approach.

L.6.1.5 Other Information as Required. The offeror shall submit any additional information relevant to its price proposal including any strategies, business decisions, general assumptions, subcontractors, additional ODCs, indirect rates, escalation rates, and any other information deemed necessary by the offeror to adequately explain its overall price proposal.

The following information shall be utilized in completing Attachment J-13 – Awardable Task Order 01 Price Workbook in order to ensure a complete and accurate TEP. Note that DBA is removed from the calculation in the TEP.

The proposed hours and days shall align exactly with the offerors Transition Plan. For all other periods of performance and labor categories (Base Year, Option Year 1, etc.) the offeror shall utilize the government-provided months / days / hours.

L.6.3.3 Travel & Other Direct Costs. The Government has high confidence in providing “plug” values for certain aspects of this requirement (PPE and Travel) due to the maturity of the program and robust historical data. Additionally, doing so provides for maximum competition among Offerors. Therefore, Offerors shall utilize the Government-provided plug numbers for PPE and Travel. Offerors may elect to propose additional ODCs, which may only be expensed after receiving COR approval. . Authorized indirect rates/burdens are detailed below.

L.6.3.3.1 Travel. The Offeror shall utilize the government-provided “plug” number (provided in Attachment J-13 – Awardable Task Order 01 Price Workbook) as the basis of cost for Travel. For the purposes of evaluation, additional Indirect rates including Overhead, G&A, and Profit shall NOT be applied to Travel.

L.6.3.3.2 Personal Protective Equipment (PPE). Offerors shall utilize the government-provided “plug” number (provided in Attachment J-13 – Awardable Task Order 01 Price Workbook) as the basis of cost for PPE. For the purposes of evaluation, additional Indirect rates including Overhead, G&A, and Profit shall NOT be applied to PPE.

L.6.3.3.2 Defense Base Act (DBA) Insurance. The Offeror shall provide, identify and price DBA insurance quotes in accordance with FAR 52.228-3. DBA is only applicable to the OCONUS labor and shall be expressed as a percentage (rate) to be applied to the total direct OCONUS labor compensation. Offerors shall provide a rate based on the labor categories, quantities and locations provided in Section J, Attachment 13, Awardable Task Order 01 Pricing Workbook. Indirect rates including Overhead, G&A and Profit shall not be applied to DBA. The Offeror shall provide a Certificate of Insurability from their insurance provider. The insurance provider shall state the rate and acknowledge the rate is based on current actuarial risks for the linguist labor categories, quantities and locations required per SOW. Offerors shall address in the cost narrative how DBA costs will be proactively managed and minimized during contract performance (e.g., Safety Program). If the Offeror is not proposing DBA Insurance, the entity shall submit documentation that they are authorized and enrolled in the DBA self-insurance program, approved by the Department of Labor.

L.6.3.4 “Schedule B” Tab. The Offeror shall provide actual Awardable Task Order 01 pricing, including the offeror’s actual DBA cost in “Transition-In, Base, OY 1, OY 2, OY 3, and OY4” tabs of Attachment J-13 – Awardable Task Order 01 Price Workbook. The DBA cost in the “Section B” tab incorporates the DBA cost provided in the offeror’s DBA Quote included in its proposal. The pricing proposed herein will be incorporated into the final award price of Awardable Task Order 01. This information is NOT considered the Total Evaluated Price and will be utilized for Government budget purposes only.

L.6.4 SOFARS 5652.215-9010. Cost and Pricing Data Not Required (1998) Section L. It is anticipated that adequate price competition will be available to determine price reasonableness. In the event that the price reasonableness cannot be determined based on adequate competition, the Contracting Officer may require the submittal of other than cost or pricing data in accordance with FAR 15.403-3.

L.6.5 Completeness, Realism, & Reasonableness. The proposal is the Offeror’s price to perform the work described in this solicitation and will be used in the analysis of the completeness, realism (compensation plan only), and reasonableness of the proposal (per FAR 15.404-1). Therefore, any inconsistency, whether real or apparent, between promised performance and price should be explained in the price volume. All labor and burden rates proposed must be fully substantiated. Inconsistences between technical and price, if unexplained, raises a fundamental issue of the Offeror’s understanding of the nature and scope of the work required and/or its ability to perform the required services. Offerors are encouraged to provide sufficient detail for the Government to determine fair and reasonableness of the total evaluated price (TEP). Unrealistically low estimates may be grounds for eliminating a proposal from competition either on the grounds that the Offeror does not understand the requirement or that it has made an unrealistic proposal. The burden of proof of credibility rests with the Offeror, and the numbers must be verifiable. If the Government determines an Offeror’s price to be inexplicably low, that Offeror may be eliminated from the competition without further discussion.
