Upon examination of the initial offers, the CO will review this determination and if, in the CO’s opinion, adequate price competition exists, no additional cost information will be requested. However, if at any time during this competition the CO determines that adequate price competition no longer exists, offerors may be required to submit other than certified cost or pricing data to the extent necessary for the CO to determine the reasonableness of the price.

For Not to Exceed (NTE) CLINs, the Offeror(s) will not fill in or change the amount of the NTE CLIN of the Supplies or Services and Prices/Cost section of the RFP, but the amount will be added at time of award. The extended amount must equal the unit price multiplied by the number/quantity of units. The proposed prices shall be based on the Offeror’s own approach and the Government’s PWS requirements as set forth herein.

The Offeror shall submit only pricing information that will be evaluated for award or become part of the resulting contract. Supply costs and associated General and Administrative (G&A) cost plus profit or fee, should be included in the unit price for each task listed in the Supplies or Services and Prices/Cost section of the RFP and the excel Price Sheet .

5.1.2.2. Representations and Certifications. Complete the necessary fill-ins, certifications, and provisions. The Offeror shall complete only paragraph (b) of the provision FAR 52.212-3 if the Offeror has completed the annual representations and certification electronically via the SAM.gov website (System for Award Management) located at https://sam.gov. 5.1.2.3. Status as a Service-Disabled Veteran-Owned Small Business (SDVOSB) concern.

This requirement is an SDVOSB set-aside. Status as an SDVOSB concern under the SDVOSB Program is determined by the Small Business Administration (SBA) in accordance with 13 CFR part 128. For setting aside awards under the SDVOSB Program, the contracting officer shall verify that an offeror is eligible for consideration by confirming that a concern either—

(1) Is designated as certified by SBA in SBA's Veteran Small Business Certification (VetCert) database at https://veterans.certify.sba.gov; or

If an offeror meets the criteria at (1) or (2) above, the contracting officer may proceed with offeror evaluation. If an offeror is a joint venture, the contracting officer may proceed with offeror evaluation if the managing SDVOSB joint venture partner meets the criteria at (1) or (2) above. If an offeror does not meet either criteria at (1) or (2), the contracting officer shall remove the concern from consideration.

5.1.2.4. Financial Disclosure Release Statement. Provide a release statement authorizing the Government to request information from current financial institutions or lenders which must be submitted on official letterhead. Addendum to FAR 52.212-2 Evaluation—Commercial Products and Commercial Services.

Addendum to 52.212-2(a), Paragraph (a) is tailored as follows:

1.0 Basis for Contract Award

The Government intends to award one (1) Firm Fixed Price (FFP), single-award Indefinite Delivery/Indefinite Quantity (IDIQ) contract for this competitive Service-Disabled Veteran Owned small business set-aside acquisition to the responsible offeror (IAW FAR 9.104) with the lowest evaluated price and a technically acceptable proposal that conforms to all solicitation requirements. By submitting an offer, the Offeror agrees to all solicitation requirements unless specifically identified otherwise. Failure to meet a requirement may result in ineligibility for award. The evaluation and award will be conducted IAW FAR 13.106, and will NOT be based on FAR Part 15.

1.1 Evaluation Process

Offerors should submit their best initial proposal. The Government reserves the right to conduct interchanges, if deemed necessary by the Contracting Officer, to resolve technical, price, or contract documentation issues. The Government may consider the "correction potential" of any proposal, with judgment at the Government's sole discretion. Proposals with uncorrectable deficiencies may be ineligible for the award. The Government may hold interchanges only with offerors deemed to have the highest potential to provide the best value. Resolution of minor or clerical issues does not constitute interchanges, and the Government reserves the right to award without revisions. All technically acceptable proposals will be treated equally except for their cost/price. Offers will be ranked based on initial assessment of total evaluated price, followed by full evaluation of Technical Acceptability, and then Price Reasonableness of the lowest priced, technically acceptable offer. Only technically acceptable proposals are eligible for award

1.2 Price Factors

1.2.1 Price Evaluation. An Offeror’s proposed TEP will be determined by multiplying the estimated quantities identified in the Schedule of Supplies/Services by the proposed unit price for each CLIN to obtain an extended amount. The CLIN 0002 Price List (Attachment 3) will also be considered for price evaluation. For evaluation purposes only, the total cost for each unscheduled item will be calculated to determine the Offeror’s overall TEP.

1.2.2. Price Reasonableness. The Government will conduct a complete Price Analysis using one or more of the techniques defined in FAR 13.106, to determine if the lowest price technically acceptable offer is reasonable.

1.3 Technical evaluation.

If the Government receives three (3) or fewer initial proposals, all proposals will be evaluated for Technical Acceptability. If the Government receives more than three (3) proposals, the Government will only select the three (3) lowest priced proposals and then evaluate them for Technical Acceptability.

The Government reserves the right to evaluate additional proposals for Technical Acceptability if in the Government’s best interest. If additional proposals are evaluated for Technical Acceptability, they will be selected in the order of TEP.

1.3.1 Technical Acceptable/Unacceptable Rating Method

The technical rating reflects the evaluation of the acceptability of the offeror’s technical approach for meeting the Government’s requirement. The offeror’s proposal shall be evaluated to determine whether the proposal is acceptable or unacceptable. The evaluation factors listed below will be evaluated and receive one (1) of the following ratings:

(i) Acceptable – The proposal meets the requirements of the solicitation.

(ii) Unacceptable – The proposal does not meet the requirements of the solicitation.

1.3.2 Evaluation of Factors

Offerors are advised that their submission should be their best effort. Only technically acceptable proposals, either initially or as a result of interchanges, are eligible for award. If award is made without interchanges, proposal revisions will not be permitted. The Government will evaluate the proposals selected above for technical acceptability on an Acceptable/Unacceptable basis. For the technical proposal to be rated as "Acceptable", all technical factors must be rated acceptable. If any technical factor is rated "Unacceptable", the overall proposal will be rated as "Unacceptable".

The technical proposal will be evaluated for the following technical factors:

Factor # 1 – Technical Approach

Standard: The Offeror shall submit a “Technical Approach” that demonstrates a clear, effective, and safe methodology for performing tree assessment, trimming, and removal services (BASH prevention). The plan should demonstrate a thorough understanding of the PWS requirements and the specific techniques to be employed. At a minimum, the plan should:

(i) Demonstrate a methodology for:

• Assessment: Trimming/removal criteria & nest annotation.

• Trimming: Hollow canopy pruning (ANSI A300), safe limb removal, pruning paint application.

• Removal and Debris Disposal: Safe procedures and equipment. Collection & Transport of debris.

• Traffic Control: Safety measures.

(ii) Provide a schedule and resource allocation plan:

• Timeline: Provide a detailed project timeline, including milestones for assessment, trimming, and removal of associated trees.

• Resource Capabilities: Describe the types of personnel (e.g., certified arborist, experienced tree climbers, ground crew) and the equipment allocated to each task, demonstrating the capability to perform the work IAW the PWS.

• Contingency Planning: Outline specific contingency plans for addressing potential delays due to weather, equipment breakdowns, nesting birds, or other unforeseen circumstances.

• Coordination: Describe the process for coordinating with the COR and CO, including communication protocols, reporting requirements, and procedures for resolving issues.

The standard has been met when: The offeror provides a “Technical Approach” that clearly and comprehensively demonstrates a feasible, efficient, and safe methodology for meeting all requirements of the PWS, including but not limited to tree assessment, trimming, removal, debris disposal, and traffic control.

Factor # 2 – Quality Control Plan

Standard: The Offeror shall submit a “Quality Control Plan” (QCP) outlining the system for ensuring contract compliance and addressing deficiencies. The QCP should detail a systematic approach to monitoring, evaluating, and improving performance to consistently meet or exceed the PWS requirements. At a minimum:

(i) Define QCP oversight responsibilities and authority, including coordination with the

COR/CO.

(ii) Describe performance monitoring methods, deficiency communication, and corrective action processes.

(iii) Include sample inspection forms, records, and reports.
