About this file

This is a Project Manual for the Delaware Army National Guard (DEARNG) Biden Microgrid construction project, prepared by Fayda Engineering & Energy Solutions, LLC. The project involves designing and constructing a microgrid system to support the Biden Headquarters, Army Aviation Support Facility (AASF), AASF Cold Storage Building, AASF Fire Pump House, and Duncan Readiness Center located at 1 Vavala Way, New Castle, Delaware 19720. The scope of work includes site clearing, demolition, installation of photovoltaic solar arrays, battery energy storage systems, engine-generator sets, electrical distribution systems, switchgear enclosures, SCADA controls, cybersecurity systems, telecommunications infrastructure, natural gas distribution pipelines, water utility piping, and associated civil work. A mandatory pre-bid meeting is scheduled for October 14, 2026, at 10:00 AM at the Biden National Guard/Reserve Center; attendance is a prerequisite for bidding. Sealed bids are due by 1:00 PM on Tuesday, November 10, 2026, at the Security Officers Desk in the Main Lobby, with public bid opening immediately following. The contract is awarded to the lowest responsive and responsible bidder, with contract execution required within twenty calendar days of the award notice.

The contract is a lump sum stipulated sum agreement utilizing the AIA Document A101-2017 form. Bidders must provide bid security equal to ten percent of the bid amount plus all additive alternates. The successful contractor must furnish performance and payment bonds equal to one hundred percent of the contract price. Bidders are required to submit a completed subcontractor list identifying one subcontractor per trade category, a non-collusion statement, an affidavit of employee drug testing program compliance, and an affidavit of contractor qualifications. The bid includes an allowance of $1,000,000 for all utility company charges and impact fees. An alternate bid is available for directional drilling/boring in lieu of open cut excavation. Contract documents are available for $100.00 electronically or $750.00 for hardcopy sets, non-refundable, from Fayda Engineering & Energy Solutions at 801 W. Newport Pike, Wilmington, Delaware 19804, or by phone at (302) 999-1060. The project is subject to Delaware prevailing wage requirements and applicable state and federal employment regulations, including craft training compliance for contractors employing ten or more employees.

The bid bond need not be for a specific sum, but may be stated to be for a sum equal to 10% of the bid plus all add alternates to which it relates and not to exceed a certain stated sum, if said sum is equal to at least 10% of the bid. The Bid Bond form used shall be the standard OMB form (attached).

4.2.3 In the event of any successful Bidder refusing or neglecting to execute a formal contract and bond within 20 days of the awarding of the contract, the bid bond or security deposited by the successful bidder shall be forfeited.

For clarification, if the Bidder intends to perform the work themselves, the Bidder may not insert “not applicable”, “N/A”, “self” or anything other than its own full name and address (City & State). To do so shall cause the bid to be rejected. In addition, the failure to produce a completed subcontractor list with the bid submittal shall cause the bid to be rejected. If you have more than three (3) third-tier contractors to report in any subcontractor category, print out additional page(s) containing the appropriate category, complete the rest of your list of third-tier contractors for that category, notate the addition in parentheses as (CONTINUATION) next to the subcontractor category and an asterisk (*) next to any additional third-tier contractors, and submit it with your bid.

C § 6902 and described in 29 Del. C. § 6960(b), regardless of where the work is performed, unconditionally and not less often than once a week and without subsequent deduction or rebate on any account, the full amounts accrued at time of payment, computed at wage rates not less than those stated in the specifications, regardless of any contractual relationship which may be alleged to exist between the employer and such laborers and mechanics.

4.7.3 As per 29 Del. C. § 6960(b), the scale of the wages to be paid must be posted by the employer in a prominent and easily accessible place at the site of the work. There may be withheld from the employer so much of accrued payments as may be considered necessary by the Department of Labor to pay laborers and mechanics employed by the employer the difference between the rates of wages required by the contract to be paid laborers and mechanics on the work and rates of wages received by such laborers and mechanics to be remitted to the Department of Labor for distribution upon resolution of any claims.

4.7.4 Every contract based upon these specifications shall contain a stipulation that sworn payroll information, as required by the Department of Labor, be furnished weekly. The Department of Labor shall keep and maintain the sworn payroll information for a period of 6 months from the last day of the work week covered by the payroll.

A request for withdraw by letter or fax, if the Architect is notified in writing prior to receipt of fax, is acceptable. A fax directing a modification in the bid price will render the Bid informal, causing it to be ineligible for consideration of award. Telephone directives for modification of the bid price shall not be permitted and will have no bearing on the submitted proposal in any manner.

4.9.2 Bidders submitting Bids that are late shall be notified as soon as practicable and the bid shall be returned.
