About this file

This document is a Non-Disclosure Agreement (NDA) between the Commonwealth of Pennsylvania's Department of Military and Veterans' Affairs and an unnamed security services contractor for armed security guard services at Fort Indiantown Gap. The NDA establishes confidentiality protocols for information sharing related to an Armed Security Services Contract, with specific provisions for handling, protecting, and restricting the use of confidential information. The agreement covers the handling of sensitive materials, including a Critical Information List, and requires the receiving party to maintain strict confidentiality, use information only for specified purposes, and ensure that all employees, contractors, and subcontractors also execute similar non-disclosure agreements.

The NDA outlines comprehensive protections for the Commonwealth, including provisions for potential legal compulsions to disclose information, requirements for maintaining confidential records for at least three years, and mechanisms for returning or destroying confidential materials upon contract termination. The agreement is governed by Pennsylvania law, preserves the Commonwealth's sovereign immunity, and provides for specific performance and injunctive relief in case of breaches. While the related state and local contract opportunity document mentions support for the Office of Administration's Information Technology Office, the NDA itself is specifically focused on establishing confidentiality protocols for armed security guard services at Fort Indiantown Gap.
