About this file
This is a Vendor Preference Certificate from the State of West Virginia, issued under West Virginia Code 5A-3-37, which establishes a framework for evaluating bidders based on residency and employment criteria in procurement decisions. The certificate does not apply to construction contracts and serves as an application tool for vendors to request preference consideration at the time of bid submission. The Purchasing Division makes final determinations regarding vendor preference eligibility. Bidders must complete the certificate by identifying which preference category they qualify for and submitting it with their bid; any changes to the information contained in the certificate during the contract term must be reported to the Purchasing Division immediately.
The certificate outlines seven preference categories offering discounts ranging from 2.5% to 5% on bids. These include preferences for individual residents with four years of continuous West Virginia residency; resident partnerships, associations, or corporations with four years of continuous headquarters location in the state; nonresident vendors with state affiliates or subsidiaries meeting employment thresholds; vendors certifying 75% employee residency during contract performance; veterans meeting residency requirements; and certified small, women- and minority-owned businesses. Bidders meeting multiple criteria may qualify for cumulative preferences up to 5%. The certificate requires bidder certification of accuracy and authorizes the Department of Revenue to disclose tax compliance information to the Director of Purchasing. If a bidder fails to maintain preference eligibility during contract performance, the Secretary of Revenue may rescind the contract or assess penalties up to 5% of the bid amount.
