About this file

Summary

This is an Asbestos Abatement Scope of Work document prepared by Environmental Technical Solutions (ETS) for the Auraria Higher Education Center (AHEC) regarding Phase II window abatement at the West Classroom Building located at 1050 10th Street Mall, Denver, Colorado 80204. The project involves the removal of approximately 384 square feet of trace asbestos-containing drywall systems with friable asbestos-containing joint compound to facilitate window replacement across four window types located throughout the building's first and second floors. The General Abatement Contractor (GAC) will deploy four separate crews working simultaneously in four different building areas to meet the general contractor's schedule. The project is scheduled to commence on May 16, 2026, and must be completed by June 12, 2026, with work hours available Monday through Sunday from 6:00 a.m. to 6:00 p.m. Prior inspections conducted by Clear Consulting in July 2024 identified drywall systems containing friable joint compounds with an estimated 2-3% chrysotile asbestos content, while subsequent sampling by ETS in January and February 2025 determined that window caulking and glazing bulk samples contained no detectable asbestos.

The scope requires unit pricing for removal of window caulking, window glazing, and trace asbestos-containing drywall systems, as well as secondary containment construction rates and labor costs broken down by worker, supervisor, and project manager hourly rates. All work must comply with Colorado Department of Public Health and Environment Regulation #8, OSHA 29 CFR 1926.1101, and EPA 40 CFR 61 Subpart M standards. The GAC is responsible for all regulatory notifications, including NESHAP notification to CDPHE, though a formal abatement permit is not anticipated. Environmental containment requirements include negative pressure ventilation maintained at minimum -0.02 inches of water column with a minimum four air exchanges per hour, one-chamber decontamination units within secondary containments, and three-chamber remote decontamination units. All asbestos waste must be double-bagged in 6 mil polyethylene bags with appropriate OSHA warning labels and disposed of at EPA-approved landfills. Final air clearance monitoring using Phase Contrast Microscopy must be conducted by a CDPHE-certified Air Monitoring Specialist, and all critical barriers must remain in place for a minimum of six hours following final visual inspection to allow for general contractor verification before dismantling.

1.0 Background

Between July 2, 2024, and July 10, 2024, Clear Consulting performed limited asbestos building inspection services at the Auraria Campus West Classroom Building located at

1050 10th Street Mall, Denver, Colorado 80204. Clear Consulting identified drywall systems with friable asbestos containing joint compound that will need to be abated to facilitate the 2026 window replacement project or Project C.

Clear Consulting identified drywall systems with friable asbestos containing joint compound throughout the building. Composite drywall system bulk samples had analytical composite results of less than 1% asbestos content. The friable joint compounds contained an estimated 2-3% Chrysotile asbestos.

See Clear Consulting West Classroom Pre-Renovation Building Inspection for Suspect

Asbestos-Containing Materials, Window Unit Replacement Project Report, dated

December 11, 2024, in Appendix D for details.

On January 31, 2025, and February 6, 2025, Environmental Technical Solutions (ETS) performed limited bulk sampling of suspect asbestos containing window caulking and glazing identified throughout the building. PRE-RENOVATION BUILDING INSPECTION DECEMBER 11, 2024

1.0 PROJECT SCOPE OF WORK

Pre-renovation inspections of the West Classroom Building (WC-1139) located on the Auraria Higher Education Center (AHEC) campus were conducted from Tuesday, July 2, 2024 through Wednesday, July 10, 2024 by Clear Consulting, LLC for suspect asbestos-containing materials (ACM) that will potentially be impacted by the scheduled replacement of window units located on Floors 1 and 2 and storefront/exterior door units located on Floor 1. The purpose of the inspections was to locate and sample suspect materials associated with the specific areas of the building to be impacted in order to compile an inventory of identified ACMs.

The inspection was conducted for Auraria Higher Education Center (AHEC) and the building is located on the AHEC Campus at 1050 10th Street Mall in Denver, Colorado.

1.1 INSPECTION FOR SUSPECT ASBESTOS-CONTAINING MATERIALS (ACM)

During the inspection conducted by Clear Consulting, LLC, the following suspect ACMs were identified by homogeneous areas of presence for the collection of bulk samples:

• Drywall walls – non-textured with joint compound (31 homogeneous areas)

• Interior window stool adhesive (1 homogeneous area)

For the identification of ACM, a sampling scheme was utilized that employed the selection of sample locations for suspect materials on a random basis and the quantity of samples collected were in compliance with the requirements of the U.S. Environmental Protection Agency (USEPA) Asbestos Hazard Emergency Response Act (AHERA), 40 CFR 763, Subpart E, as required by Colorado Air Quality Control Commission (AQCC), Regulation No. 8 for the inspection of school and commercial buildings.

Each bulk sample collected has an identification number that begins with the following acronym sequence:

• WC-1139-

This acronym sequence is followed by the room/area number identifying the location of the sample collection.

This room/area number is followed by another acronym describing each suspect material, followed by a sequential homogeneous area number (if applicable), and last by a sequential individual sample number.

• CDW = non-textured drywall with joint compound

• WSA = interior window stool adhesive

The thirty-one (31) homogeneous areas of non-textured drywall with joint compound (CDW) located throughout the exterior perimeter walls and associated with window/storefront/exterior door unit locations on Floors 1 and 2 of the building were separated and identified as follows:

• CDW 01-01 to 01-07 - Floor 2 – exterior perimeter drywall walls – pink/tan drywall w/ off-white compound

• CDW 01-08 to 01-14 – Floor 1 – exterior perimeter drywall walls - pink/tan drywall w/ off-white compound

The one (1) homogeneous area of interior window stool adhesive (WSA) located under metal window stool covers was identified as follows:

• WSA 01: Floor 1 – 145/151 – window stool cover adhesive – brown resinous material

Bulk samples of the suspect materials encountered were collected and each sample was assigned a unique identification number. Bulk samples were collected by an EPA/State of Colorado certified building inspector.

All samples were submitted to Eurofins Reservoirs Environmental, Inc. (ERE), a third-party independent laboratory. ERE is accredited through the National Voluntary Laboratory Accreditation Program (NVLAP) as required by USEPA. Bulk samples were analyzed by Polarized Light Microscopy (PLM) in general compliance with guidelines established by 40 CFR 763, Subpart E. Asbestos concentrations were visually estimated and/or point counted and reported by percent for each layer of the sample.

The specific information regarding the identified ACM is presented in Section 4.0 of this report.

3.0 REGULATORY REVIEW – ASBESTOS-CONTAINING MATERIALS

USEPA and Colorado Department of Public Health and Environment (CDPHE) regulate all building materials that contain greater than 1% asbestos as determined by polarized light microscopy (PLM) analysis. The Occupational Health and Safety Administration (OSHA) regulates any building materials containing greater than 1% asbestos as well as smaller amounts of asbestos (“trace” amounts of 1% or less but greater than 0%) that may result in an airborne asbestos exposure due to physical disturbance.

USEPA and CDPHE Regulation No. 8, Part B, requires that suspect ACM in buildings built prior to 1988 be assumed to be asbestos-containing or an inspection be conducted by an EPA-accredited/CDPHE-certified asbestos building inspector. CDPHE, Regulation No. 8, Part B, requires an asbestos inspection in compliance with the AHERA protocol be conducted prior to demolition or renovation activities that could disturb ACM.

The USEPA and CDPHE require all friable ACMs be removed prior to renovation or demolition and any non-friable ACMs that may be rendered friable by those same activities.

In some circumstances, “point count” analysis is required for bulk samples previously identified by PLM. Point counting is a more detailed method of analysis than standard PLM. Federal and state agencies define ACM as materials containing greater than 1% asbestos. The NESHAP regulation requires that if standard PLM analysis determines that a sample contains less than 10% asbestos, the material must be considered asbestos-containing or be point counted.

CDPHE Regulation No. 8 (Section III.A.1.c.) requires that if the asbestos content of a sample of friable asbestos is estimated to be 1% asbestos or less, but greater than 0%, by a method other than point counting, the determination shall be repeated using the point counting technique with PLM and if the result obtained is different from the PLM result, the point count result must be used.

6.0 IDENTIFIED MATERIALS CONTAINING “TRACE” AMOUNTS OF ASBESTOS

Suspect materials can yield results indicating “trace” amounts of asbestos (1% or less but greater than 0%).

These materials are not regulated as ACM but require removal methods to comply with the exposure limits stipulated by the OSHA Construction Standard for Asbestos (29 CFR 1926.1101) with regard to their disturbance and/or removal:

• No encountered suspect materials sampled were identified with “trace” amounts of asbestos.

6.1 LOCATIONS AND QUANTIFICATION OF IDENTIFIED “TRACE” MATERIALS

6.2 CLASSIFICATION AND PHYSICAL ASSESSMENT OF “TRACE” MATERIALS

6.3 POINT COUNT ANALYSES OF “TRACE” MATERIALS

7.0 DRYWALL MATERIALS WITH ACM JOINT COMPOUND – COMPOSITE ANALYSIS

Drywall materials without applied texture containing asbestos in amounts greater than 1% in only the joint compound component of the drywall system may be subjected to “composite” analysis. This procedure as conducted by the Polarized Light Microscopy (PLM) analytical laboratory considers the percentage of the entire drywall system bulk sample that is asbestos-containing joint compound as compared to the rest of the bulk sample and, accordingly, yields a “composite” result indicating the percentage of asbestos within the entire drywall system bulk sample.

Composite analysis is only permissible for drywall systems that are non-textured and composite results yielding an asbestos content of 1% or less renders the abatement/demolition of the drywall system to a status of “OSHA” drywall. These materials may therefore be removed/demolished employing limited engineering controls and by utilizing removal methods that meet the requirements for protecting employees/personnel from airborne asbestos fibers through compliance with the exposure limits stipulated by the OSHA Construction Standard for Asbestos (29 CFR 1926.1101) regarding the disturbance and/or removal of asbestos-containing materials.

• Drywall walls – non-textured with joint compound (12) homogeneous areas)

Note: Due to the assumption that all drywall partition walls adjacent or perpendicular to exterior perimeter walls are OSHA drywall (Refer to Section 8) based upon the visual homogeneity of these materials, the approximate quantities of the following identified non-ACM, non-textured drywall walls are irrelevant but reported as approximate below.

8.0 CONCLUSIONS AND RECOMMENDATIONS

• The identified ACM in the form of joint compound associated with twelve (12) drywall window recesses, concrete column recesses, and partition walls attached (adjacent or perpendicular) to or in contact with window/storefront/exterior door unit frames have been subjected to composite analyses thereby rendering them non-regulated by U.S. Environmental Protection Agency (EPA) and Colorado Department of Public Health and Environment (CDPHE). However, all materials identified with less than 1% but greater than 0% asbestos content are regulated by U.S. Occupational Safety and Health Administration (OSHA) due to the potential exposure to airborne asbestos fibers upon physical disturbance, such as demolition. As such, unprotected construction/demolition personnel should not conduct physical impact-causing activities on these less than 1% but greater than 0% asbestos content materials and it is therefore recommended that these drywall components should be demolished/removed by a CDPHE-licensed GAC to facilitate the removal of the window unit frames by the GC. Any resultant generated waste materials may be disposed as general construction waste.
