About this file

The document is a Price Agreement from the Colorado Department of Transportation (CDOT), establishing a cooperative purchasing agreement for procurement of goods and services. The agreement allows CDOT and other state and local agencies, including city and county governments, public utilities, school districts, and higher education institutions, to purchase materials on an "as needed" basis. Prices are firm for the first 12 months, with potential price changes allowed after that period if submitted 60 days prior to renewal, and CDOT will issue a new award notice for each additional renewal year.

The agreement specifies that materials costing $10,000 or more must be ordered via a standard purchase order, and no quantities are guaranteed as orders will be based on CDOT's actual requirements. Each participating agency will be responsible for its own costs, contract establishment, ordering, invoicing, payments, and dispute resolution. The cooperative purchasing agreement allows flexibility for various CDOT personnel to order materials as needed, with CDOT retaining sole discretion in purchasing from multiple awarded vendors for a given solicitation.

Conditions of Award: This award is for the purchase per the specifications and terms and conditions of the above-mentioned bid. This award is made to the above referenced vendor for supplying the commodity/service specified above and on any attached supplementary pages per bid specifications to be ordered on an “as needed” basis for the period and award year indicated above, at CDOTs option. Prices shall be firm throughout the first 12 months of the award.

Requests for any proposed price changes after the first 12 months must be submitted along with supporting documentation, to the CDOT Purchasing agent, a minimum of sixty (60) days prior to the renewal date. A new award notice will be issued for each additional renewal year that CDOT selects.

Note: This award is a notice of intent to purchase only. This is not a purchase order. Material ordered by CDOT that costs $10,000.00 or more per item or aggregate must be ordered via a standard purchase order. No quantities are guaranteed. Quantities ordered will be based upon actual requirements at CDOT’s sole discretion. If multiple awards exist for a given solicitation, CDOT may purchase from any of the awards at CDOT’s sole discretion. Various CDOT personnel will order materials as needed.

In accordance with section 24-110-201, C.R.S., this agreement is established as a cooperative purchasing agreement available for use by the State Agency issuing this agreement and other State and local Agencies and Political Subdivisions, including, but not limited to, city and county government entities, public utilities, public schools districts, and State Institutions of Higher Education, under the terms, conditions and rates set forth in the cooperative purchasing agreement. Each agency or entity ordering goods or services under the cooperative purchasing agreement will be responsible for all costs and expenses incurred in connection with its orders, and shall, as necessary, establish its own contract, place its own orders, issue its own purchase orders, be invoiced therefrom, make its own payments, issue its own tax exemption certificates as requested, and resolve any disputes arising from any such order.
