About this file
This is a special notices appendix for a Federal Open Channel Drainage Repair Work Order Contract (Contract No. 26-0694) in Pinellas County, Florida, involving the National Resources Conservation Service (NRCS) and potential coordination with the Florida Department of Transportation (FDOT), municipalities, and the Federal Emergency Management Agency (FEMA). The contract addresses emergency repair projects including re-establishing open channel slopes, removing trees and storm-related debris, erosion control, providing fill material, sodding, vegetation trimming, fencing, and incidental related work. Work will be executed on an assignment-by-assignment basis through individual work orders authorized by the Engineer, with no guaranteed concurrent or consecutive assignments or minimum quantities. The quantities listed in the pricing proposal are approximate estimates only, and actual compensation will be based on quantities completed. Each work order location constitutes an individual project requiring full completion within a reasonable timeframe as determined by the Engineer. The Contractor must maintain sufficient crews and equipment to perform all assigned work and restoration, and failure to meet contractual obligations or perform satisfactorily may result in work reassignment. The Engineer retains the right to add or delete project sites from work orders, and no compensation is provided for contract cancellation or work not constructed to satisfaction. Emergency projects may be distributed to the Contractor in the event of Federal Disaster Declaration.
Contractors must comply with extensive federal requirements including OSHA regulations, the Contract Work Hours and Safety Standards Act, Buy America provisions, employment eligibility verification through Form I-9, equal opportunity compliance under Title VI of the Civil Rights Act of 1964, and 2 CFR Part 200 Uniform Guidance requirements. The contract is grant-funded and contractors are prohibited from engaging with or providing funding to entities on federal sanction lists, including those identified by the Department of War, State Department, Treasury Department OFAC lists, and OMB telecommunications restrictions. Contractors must provide record drawings upon final project acceptance, protect and restore property markers at no additional cost, and indemnify Pinellas County, NRCS, FDOT, municipalities, and FEMA as additional insureds as applicable. The Davis Bacon Act does not apply to this contract. Award of the contract will be based on the total bid amount (Schedule of Values), though actual payments reflect completed work quantities rather than guaranteed minimums.
