Questions from Versar
February 23, 2023
Amendment #4
In reference to “Section 3.2.1 (A) ‐ End of Contract Transition”:
“Would the government please confirm if the additional services and support needed from the contractor are in fact, in addition to the (sic) scope of work? And if it is so, are these additional services and support, will be billable?”
Response:
Additional services to support “End of Contract Transition” required of the Contractor should be incorporated into the final year scope-of-work under the contract. In this way, services and support provided during transition would be billable under the existing contract.
These services are not additional services.
In reference to “3.4.1 ‐ MBE liquidated damages are identified in Attachment M.”:
“Would the State add the liquidated damages amount via an amendment to this solicitation as these data are missing from the draft Contract i.e. Attachment M?”
Note: An amended RFP will be posted on eMMA with the updated liquidated damages values for
Attachment M.
Yes, the following information will be added to Attachment M via an amendment to this solicitation:
(a) Failure to submit each monthly payment report in full compliance with COMAR 21.11.03.13B
(3): $<<insert value>> per day until the monthly report is submitted as required.
(b) Failure to include in its agreements with MBE subcontractors a provision requiring submission of payment reports in full compliance with COMAR 21.11.03.13B (4):
$<<insert value>> per MBE subcontractor.
In reference to “Section 7, Table 1 ‐ RFP Attachments & Appendices ‐ Proposal Bond”:
“Is Proposal Bond a requirement?”
No, a Proposal Bond is not required under this solicitation.
In reference to “3.7.2 ‐ Security Clearance/Criminal Background Check”:
Does this requirement apply to subcontractors?
Yes, the Security Clearance/Criminal Background Check requirements apply to both contractor and subcontractor personnel, but only for Functional Area D (Radiological Laboratory Services).
In reference to “Section 5.3.2 (G.3) ‐ Volume I ‐ Technical Proposal”:
“This section states “Letters of intended commitment to work on the project, including letters from any proposed subcontractor(s).” Would the Government please confirm if these letters are needed from both prime contractor and its subcontractors OR from respective key personnel proposed by prime contractor and subcontractors?”
“Letters of intended commitment to work on the project” are required only from those subcontracting firms proposed to work in support of the contract. A letter of commitment is not required of the Prime
Contractor, nor from any key personnel individually.
In reference to “Section 6.3 ‐ Financial Proposal Evaluation Criteria”
“1) If the outyear rates will be in accordance to the CPI, how do bidders propose these rates? 2)
Would the Government please confirm if the Proposal Price and Total Proposal Price (which are based on the sum of the labor rates per labor category to be listed in Attachment B‐2) will be the basis of the Financial Proposal Evaluation as stated in this Section?”
1) The Financial Proposal Form B-2 requires the offeror to provide Labor Category Hourly Rates for the first contract-year only; noting that CPI will be used to adjust these rates in ensuing contract-years.
2) The Financial Proposal Form B-2 requires the offeror to provide a Proposal Price for each of the 5 years of the contract, and as a sum of these, a Total Proposal Price. The Total Proposal Price will be used to evaluate each proposal received in accordance with Section 6.3 Financial Proposal Evaluation Criteria.
