About this file
This is Amendment 2 to an Invitation for Bid issued by the South Carolina Department of Public Safety (SCDPS) for promotional items to support DPS Administration. The solicitation requests multiple items including koozies, fans, bandanas, crayons, sunscreen/lip balm with carabiners, clear backpacks, first aid kits, and clear cell cases. The amendment addresses scheduling changes and vendor inquiries, moving the opening date from April 4, 2024 to April 5, 2024 at 2:00 PM, with award notification moved from April 5, 2024 to April 08, 2024. The primary deadline for item delivery is May 1, 2024, though bandanas may be delivered as late as May 13, 2024 if production timelines require extension. No pre-bid conference or site visit is required. Bidders must submit offers online through the South Carolina procurement website at http://www.procurement.sc.gov and must acknowledge receipt of this amendment on the bid submission.
The amendment clarifies specifications in response to vendor questions, confirming that SPF 30 sunscreen is acceptable as an alternative to SPF 50, bandanas must be cotton rather than polyester, and both sunscreen and lip balm must be manufactured in FDA-approved facilities in the United States. Line items 1 through 5 (koozies, fans, bandanas, and crayons) require full-color imprints, while line items 7 through 9 (clear backpacks, first aid kits, and clear cell cases) require one-color imprints. Offerors must hold their bids open for a minimum of 30 calendar days following the opening date. All other terms, conditions, bidding instructions, and specifications from the original invitation remain unchanged. No information regarding pricing, discounts for prompt payment, or contract term options is specified in this amendment document.

PREFERENCES - A NOTICE TO VENDORS (SEP. 2009): On June 16, 2009, the South Carolina General Assembly rewrote the law governing preferences available to in-state vendors, vendors using in-state subcontractors, and vendors selling in-state or US end products. This law appears in Section 11-35-1524 of the South Carolina Code of Laws. A summary of the new preferences is available at www.procurement.sc.gov/preferences. ALL THE PREFERENCES MUST BE CLAIMED AND ARE APPLIED BY LINE ITEM, REGARDLESS OF WHETHER AWARD IS MADE BY
ITEM OR LOT. VENDORS ARE CAUTIONED TO CAREFULLY REVIEW THE STATUTE BEFORE
CLAIMING ANY PREFERENCES. THE REQUIREMENTS TO QUALIFY HAVE CHANGED. IF YOU
REQUEST A PREFERENCE, YOU ARE CERTIFYING THAT YOUR OFFER QUALIFIES FOR THE
PREFERENCE YOU'VE CLAIMED. IMPROPERLY REQUESTING A PREFERENCE CAN HAVE SERIOUS
CONSEQUENCES. [11-35-1524(E)(4)&(6)]
PREFERENCES DO NOT APPLY PER SECTION 11-35-1524 [E](5).
PREFERENCES - ADDRESS AND PHONE OF IN-STATE OFFICE: Please provide the address and phone number for your in-state office in the space provided below. An in-state office is necessary to claim either the Resident Vendor Preference (11-35-1524(C)(1)(i)&(ii)) or the Resident Contractor Preference (11-35-1524(C)(1)(iii)). Accordingly, you must provide this information to qualify for the preference. An in-state office is not required, but can be beneficial, if you are claiming the Resident Subcontractor Preference (11-35-1524(D)).
PREFERENCES DO NOT APPLY PER SECTION 11-35-1524 [E](5).

AMENDMENTS TO SOLICITATION (JAN 2004)

(c) If this solicitation is amended, then all terms and conditions which are not modified remain unchanged.
[02-2A005-1]
The purpose of this Amendment is to move the Opening/Award Dates and answer vendor questions.
OPENING DATE/TIME WAS: 04/04/2024 02:00 PM
NEW OPENING DATE/TIME: 04/05/2024 02:00 PM
AWARD DATE: 04/05/2024
NEW AWARD DATE: 04/08/2024
Vendor Question 1: Regarding the Sunscreen/Lip Balm with Carabiner, suppliers are currently backordered on SPF50 sunscreen, and will not be restocked until too close to the deadline of May 1, 2024, and will miss the delivery date. Will SPF30 be considered in that instance?
SCDPS Answer: Yes, SPF 30 is acceptable.
Vendor Question 2: We are able to get significantly better pricing on the bandannas with a slightly longer lead time (about 25 days production following proof approval). Is it possible to receive this item later than the May 1 deadline?
SCDPS Answer: Due to needing the items for upcoming events we can only extend the deadline to May 13, 2024 but no later.
Vendor Question 3: Would polyester fabric be considered for the bandana? As per question number 2, pricing is significantly better with polyester fabric instead of cotton.
SCDPS Answer: The bandanas must be cotton.
Vendor Question 4: Which items will receive a full color imprint, and which will receive a 1 color imprint? Pricing will vary based on the number of colors.
SCDPS Answer: Please reference the Bidding Schedule for each line item. The Bidding Schedule states the following:
Full Color Imprints: Line 1 (Koozies), Line 2 (Fans), Line 3 & 4 (Bandanas), and Line 5 (Crayons) One Color Imprints: Line 7 (Clear Backpacks), Line 8 (First Aid Kits) and Line 9 (Clear Cell Cases)
Vendor Question 5: Are there any requirements for FDA approval for either the sunscreen or lip balm?
SCDPS Answer: Both the sunscreen and lip balm must be made in an FDA-Approved facility in the USA.
ALL OTHER TERMS, CONDITIONS, BIDDING INSTRUCTIONS, AND SPECIFICATIONS REMAIN UNCHANGED. IF THERE ARE ANY QUESTIONS OR IF ANY CONFUSION OR UNCERTAINTY ARISES AS A RESULT OF THIS AMENDMENT, IT IS THE SOLE RESPONSIBILITY OF THE OFFEROR TO CONTACT THE PROCUREMENT OFFICER FOR CLARIFICATION.
