(b) To assure timely and equitable evaluation of proposals, offeror must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being ineligible for award. Submit proposals, to include all fill-in clauses to the office specified in this solicitation at or before the exact time specified in this solicitation.
(g) The Government intends to make award based on the initial proposal submissions without conducting interchanges. Therefore, each proposal should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to hold interchanges if, during the evaluation, it is determined to be in the best interest of the Government, IAW FAR
52.212-1(g). Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the contractors that may address any aspect of the proposal. However, the Government reserves the right to conduct interchanges using Interchange Notices (IN). Vendor responses to the INs will be considered in making the order selection decision. Be advised that Interchanges may also lead to
Solicitation Amendments. Contractors should read Interchanges and Amendments carefully to ensure whether revised proposals will be accepted or not as part of the Interchange or Solicitation
Amendment. Interchanges may be conducted with one, some or all offerors as the Government is not required to conduct interchanges with any or all vendors responding to this solicitation.
(h) Multiple Awards. The Government will award a single contract on an “all or none” basis;
multiple awards shall not be contemplated.
7. The provision at 52.212-2, Evaluation - Commercial Items applies to this solicitation.
ADDENDUM TO FAR 52.212-2 EVALUATION PROCEDURES
(a) Basis for Contract Award. The subject acquisition is being competed under FAR 13.5
Simplified Procedures for Certain Commercial Items, utilizing the Lowest Price Technically
Acceptable (LPTA) procedures. The Government intends to award one Firm Fixed Price
Indefinite Delivery (ID) Requirements contract for this competitive Small Business Set-Aside service acquisition. Award will be made to the technically acceptable Offeror with lowest evaluated price who is deemed responsible in accordance with FAR 9.104 and whose proposal conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by this solicitation.
Unless specifically identified in your proposal, by submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications and technical requirements, in addition to those identified as evaluation factors or sub factors.
Failure to meet a requirement may result in a proposal being determined ineligible for award.
Technical tradeoffs will not be made, and no additional credit will be given for exceeding acceptability. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by this solicitation. It is the Government’s intent to evaluate proposals and award contracts without interchanges with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a price, and technical standpoint. However, the
Government reserves the right to conduct interchanges if the Contracting Officer (CO) later determines them to be necessary.
(b) The government intends to award one contract for this requirement. The resultant contract will have five (5) ordering periods and a phase in period (see attachment 2 Schedule of Service and attachment 1 Performance Work Statement).
(c) If any aspect of an offeror’s proposal does not meet the government’s requirements and is not considered correctable, the offer may be eliminated. The three (3) lowest priced proposals submitted timely will be evaluated for technical acceptability. If less than three (3) proposals are received, the government will evaluate all proposals submitted. The government may evaluate additional proposals if required. Only proposals rated technically acceptable are eligible to receive an award.
Evaluation CRITERIA will consist of — Price and Technical Factors.
Proposals must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The proposal shall demonstrate the ability to provide the required services in accordance with (IAW) the attached Performance Work Statement (Attachment 1). The proposal shall be clear, concise and include sufficient detail for effective evaluation and for substantiation of the validity of stated claims. General marketing documentation that does not speak to the identified Technical Factor and/or Sub-Factors, if any, may render a proposal unacceptable.
Offers must be submitted with acknowledgement of all amendments, if applicable. Failure to furnish a complete proposal may result in the proposal being determined unacceptable by the
Government.
PART I, PRICE PROPOSAL. Offerors are required to complete / provide the information described below.
Offeror Information and Schedule: The offeror shall complete the offeror information and
Schedule / Price List (Attachment 2) and submit the attachment with their proposal. In doing so, the offeror accedes to the contract terms and conditions as written in the solicitation, to include all attachments.
The contract will include FAR Clause 52.217-8, Option to Extend Services, with the potential to extend the contract an additional 6 months beyond the awarded contract performance period.
There is no CLIN for this clause-related pricing. The price for that period will be determined based on the unit prices proposed for the ordering period that would directly precede the use of this clause, if used at any time during this contract. For evaluation purposes, the pricing for the last ordering period on the Schedule will be evaluated at time of award for price reasonableness.
In the event the Government requires continued performance under this clause, the Government's evaluation of prices proposed will be considered fair and reasonable as applied to an extension of services. Should an extension of services be required, rates will only be adjusted because of any revisions to applicable prevailing Department of Labor wage rates up to the point of executing this clause.
Price reasonableness will primarily be determined based on competition, however, other techniques to include historical pricing, current market conditions, comparison to the independent government estimate, and/or any other analysis techniques under FAR 13.106-3(a) may be used.
Upon examination of the initial offers, the contracting officer will determine if adequate price competition exists. If the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit other than cost or pricing data to support the price reasonableness.
