Res. 2 as enrolled), the Consolidated Appropriations Resolution, 2003, amending Public Law 105-277, sec. 347. This is a commercial item acquisition that has been tailored to fit the Government’s method of trading goods for services. Work includes performance of stewardship activities within the boundaries of this project as defined on the enclosed map “Hog Park CG Salvage Stewardship Contract Area Map” located in Attachments. The work required by this contract includes all of the requirements outlined herein and in the attachments, and includes, but is not limited to:

*Hazard trees will be felled, limbed, and skidded in the cutting units (see Appendix A);

*Timber harvest and removal and related work (see Appendix B);

*Road Maintenance T-Specifications (see Appendix C);

The Contractor shall provide everything necessary to perform this contract unless such items are specifically identified herein as Government-furnished property.

(b) Resulting Contract – The resultant contract will be a firm-fixed-price Task Order, including services and timber removal activities.

(c) Project Location – This project is located on the Medicine Bow-Routt National Forests and is located southwest of Encampment, Wyoming. The project can be accessed from Encampment by traveling west on WY HWY 70 for approximately 6 miles to the junction with NFSR 550 (Hog Park Road). Travel NFSR 550 approximately 15 miles south to the junction with NFSR 496. Continue south on NFSR 496 to the junction of NFSR 496.1E, at this point the east portion of ITM 3 can accessed. The remaining units are to the west and can be located on the Contract Area Map. The project is located in T12N, R84W, Section 8, 6th P.M., Carbon County, Wyoming.

2. USE OF BIOBASED PRODUCTS

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products. The Contractor shall utilize products and material made from biobased materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer (CO).

The following is an example list of products that may be used in this contract. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

· 2-Cycle Engine Oils

· Hydraulic Fluids

· Greases – Multipurpose

· Engine Crankcase Oil

· Transmission Fluids

· Power Steering Fluids

Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content. In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other commercially available biobased products. The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.

The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification. The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts. Within thirty (30) days of contract award, the Contractor shall submit a Proposed Progress Schedule. This submittal shall be approved by the CO in writing. The Contractor shall not commence work until this submittal is approved by the CO in writing. The Plan must be reviewed and updated annually, and as required by the CO. The Plan must contain and define the following elements:

· The Contractor’s written policy stating its commitment to the use of biobased products and sound environmental management practices.

· Describe how the Contractor intends to keep abreast of the development and increasing availability of designated and non-designated biobased products and how any new or improved products will be incorporated on an ongoing basis into contract performance.

· Proposed biobased products which must be selected in accordance with the criteria included above.

· At a minimum, the Plan must identify products by brand name for each of the product types.

· The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of biobased products

NOTE: A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.

The Contractor shall provide data on the quantity and dollar values of biobased products used in this contract. The data will be submitted to the Contracting Officer’s Representative (COR) quarterly. A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product.

6. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after receipt of Notice to Proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 12 months from date of contract award. The time stated for completion shall include final cleanup of the premises.

The conference will be held at: will be specified in the task order, and will include discussion of contract terms and work performance requirements, work progress schedule and fire prevention/suppression and safety plans.

26.

EROSION PREVENTION AND CONTROL

Contractor’s Operations shall be conducted reasonably to minimize soil erosion. Equipment shall not be operated when ground conditions are such that excessive damage will result. The kinds and intensity of erosion control work done by Contractor shall be adjusted to ground and weather conditions and the need for controlling runoff. Erosion control work shall be kept current immediately preceding expected seasonal periods of precipitation or runoff.

If Contractor fails to do seasonal erosion control work prior to any seasonal period of precipitation or runoff, Forest Service may temporarily assume responsibility for the work and any unencumbered deposits hereunder may be used by Forest Service to do the work. If needed for such work, Contractor shall make additional deposits on request by Forest Service. Any money deposited or used for this purpose shall be treated as cooperative deposits.

A. Skidding with tractors within 100 feet of live streams shall not be permitted except in places designated in advance by Forest Service, and in no event shall skid roads be located in live or intermittent streamcourses. Skid trails shall be located high enough out of draws, swales, and valley bottoms to permit diversion of runoff water to natural undisturbed forest ground cover.

B. Prior to periods of accelerated water runoff, especially during the spring runoff and periods of heavy rainfall, Contractor shall inspect and open culverts and drainage structures, construct special cross ditches for road runoff, and take other reasonable measures needed to prevent soil erosion and siltation of streams.

C. Unless otherwise agreed in writing, Contractor shall keep erosion control work current with his operations under the sale and in any case not later than 15 days after completion of skidding on each payment unit or cutting unit.

28.

PROTECTION OF RESIDUAL TREES

The contractor’s operations shall not unnecessarily damage residual trees. Residual trees are defined as POL and Sawtimber size trees.

Damage, as used herein, includes any injury to the living crown, bole, or roots of reserve trees. If areas are marked on the ground around such reserve trees, operation of heavy equipment or skidding of products within the area shall be considered to be damage to the tree.

29.

30.

DESIGNATIONS

30.1 - C.3 Timber Designations. Timber designated for cutting shall be confined to Contract Area, except as otherwise provided. Contract Area Map indicates subdivisions, if any, where Marking is to be done after advertisement, except for construction clearing, minor changes, and damaged timber. The boundaries of cutting units were plainly marked on ground before advertisement and are shown on Contract Area Map.

30.2 - C.3.2 Construction Clearing. All timber is designated for cutting that is within the clearing limits of roads constructed hereunder or is in other authorized clearings. All dead or unstable live trees are designated for cutting that are sufficiently tall to reach Contractor’s landings, work areas, or the roadbed of Specified and Temporary Roads when Marked in advance of work in the immediate area. Pieces meeting Utilization Standards from such dead or un-stable live trees shall be removed, unless there is agreement that to do so could damage the road. Such designation may be revised as part of agreed changes in road locations.

30.3 - C.3.2.2 Other Authorized Clearings. Timber within authorized clearings for Temporary Roads, landings, or other construction clearings is designated for cutting. Quantities of such timber are not included in Appendix B - Division A.

30.5 - C.4 Volume Estimate. The estimated volumes of timber by species designated for cutting and expected to be cut under Utilization Standards are listed in Appendix B - Division A and are not to be construed as guarantees or limitations of the timber volumes to be designated for cutting under the terms of this contract.

37.

FIRE PRECAUTIONS AND CONTROL

Specific fire prevention measures are listed in the contract, and shall be effective for the period May 1st – November 15th of each year. The Forest Service may change the dates of said period by advance written notice if justified by unusual weather or other conditions. Required tools and equipment shall be kept currently in serviceable condition and immediately available for initial attack on fires.

39.

USE OF ROADS BY CONTRACTOR

Except as provided herein, Contractor is authorized to use existing National Forest roads and Specified Roads, when such use will not cause damage to the roads or National Forest resources and when hauling can be done safely. If Contractor’s use of an existing temporary or National Forest system road cannot be satisfactorily accommodated without reconstruction, Contractor shall be authorized to use such road upon agreement as to the minimum reconstruction work that Contractor shall perform before hauling.

The Contract Area Map shows existing temporary or permanent roads that for such reasons as limitations in structural capacity, safety, and protection of soil, water, and roads:

(a) Cannot be used for log hauling or

ROAD MAINTENANCE

Contractor shall maintain roads, commensurate with Contractor’s use, in accordance with Road Maintenance Requirements and the Road Maintenance T-Specifications located in Appendix C. Performance of road maintenance work by Contractor may be required prior to, during, or after each period of use. The timing of work accomplishment shall be based on Contractor’s Operating Schedule.

When two or more commercial users are simultaneously using the same road where Forest Service is not requiring maintenance deposits, the commercial users will develop maintenance responsibilities and arrangements for accomplishing the work. Forest Service must agree to this plan. If the commercial users cannot agree on maintenance responsibilities, Forest Service shall resolve the differences. If Contractor elects to use different roads than those listed, Forest Service shall determine Contractor’s commensurate share of road maintenance and revise road maintenance deposits. If Forest Service cannot perform its full commensurate share of road maintenance, Forest Service shall make a cash payment to Contractor for performance of such work.

Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordinary nature.

FAR 52.212-2 Evaluation – Commercial Items (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Proposals will be evaluated using the tradeoff process. This process allows the government to award to other than the lowest priced or highest technically rated proposal. Since award may be made without further negotiations, proposals should be submitted in the most favorable terms that the vendor can offer. Firms lacking a past performance record (e.g., new firms or those with no relevant experience within their organization) will be treated as an unknown performance risk, receiving a neutral score in this criteria. Proposals shall be prepared and submitted in accordance with FAR 52.212-1 and the Addendum to FAR 52.212-1.

All technical factors when combined, are approximately equal to cost or price. Past Performance is the most important technical factor; all other technical factors are approximately equal in value. The technical factors and subfactors listed below shall be used to evaluate all offers.

1. Past Performance:

In addition to the information requested in ___________for past performance, contractors may also discuss past accomplishments that indicate your firm's ability to perform the work required by this solicitation. The government will contact a sample of your past customers to determine your rating for this factor. Any offeror who does not have a record of relevant past performance or for whom information on past performance is not available will receive a rating of neutral. The following sub-factors are equal in value and will be evaluated to determine the overall rating for past performance:

A. Compliance with Contract Specifications

B. Timeliness of Performance

C. Business Relations - between the contractor and contracting entity; between contractor and subcontractors

D. Customer Satisfaction
