ADDENDUM TO FAR 52.212-1 Instructions to Offerors – Commercial Items

(m) - General Instructions. Proposals submitted in response to this solicitation shall be furnished in the following format with the numbers of copies as specified below.

(1) - The proposal must include a technical proposal and business proposal. Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. The technical proposal Amendment 1, AG-82X9-S-09-0149, pg 3 of 5

Continuation of block 14.

must not contain reference to cost; however, resource information (such as data concerning labor hours and categories, materials, subcontracts, etc.) must be contained in the technical proposal so that the contractor's understanding of the statement of work may be evaluated.

(2) - Offerors may, at their discretion, submit alternate proposals or proposals which deviate from the requirement; provided, that an offeror also submit a proposal for performance of the work as specified in the statement of work. Any "alternate" proposal may be considered if overall performance would be improved or not compromised, and if it is in the best interest of the Government. Alternate proposals, or deviations from any requirement of this RFP, must be clearly identified.

(3) - Offerors shall submit their proposal(s) in the following format and the quantities specified:

a. 3 copies of the technical proposal

b. 1 copy of the business proposal

(n) Technical Proposal Instructions. Technical proposals will be evaluated to determine the ability of the contractor to meet the requirements of the Government. Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed description of the organization, techniques, procedures and program for achieving the objectives of the specifications/statement of work. Proposals that merely paraphrase the requirements of the Government's specifications/statement of work, or use such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable and will not be considered further. For task orders the government reserves the right to use any evaluation factors that it chooses. Typical evaluation factors might be use of biobased products, experience, past performance, technical approach, key personnel, utilization of biomass material, etc. For this solicitation, as a minimum, the proposal must clearly provide the following:

(1) Benefits to the Local Community

a. Specify, quantify, and describe any benefits that your proposal will provide for the Local Community.

b. Provide documentation to support the realism and veracity of any claimed benefits. For example, if proposal claims to provide employment in the local community, provide location of business that will perform the work – either prime or subcontractor.

(2) Past Performance

The technical proposal must address past performance for both the offeror and proposed subcontractors. OFFERORS SHOULD PROVIDE ONLY THE INFORMATION LISTED BELOW. PERFORMANCE INFORMATION WILL BE REQUESTED FROM REFERENCES PROVIDED.

a. Submit a list of all similar project work that was completed by your firm and/or any of your probable subcontractors in the last 3 years. Emphasis is placed on past work specifically related to the work elements in the solicitation. Provide:

· Names, telephone and fax numbers of principal officials who were in charge of the project and that are familiar with your performance.

· A description of the work performance,

· The agency/company or individuals you worked for,

· The size (value) and location of the contracts,

· Contract numbers.

b. Provide information on any problems encountered on the identified contracts and corrective actions taken.

c. Individuals or businesses without prior contracts as a business entity should list contracts and subcontracts completed by predecessor companies or key personnel.

d. The Office of Management and Budget (OMB) has authorized Federal agencies to collect past performance information under OMB clearance number 9000-0142. Both the information provided in the proposal and Government records will be used to evaluate the Offeror's past performance; however, references other than those listed may also be contacted.

(3) Capability to Perform Commercial Logging Work

Amendment 1, AG-82X9-S-09-0149, pg 4 of 5

Continuation of block 14.

a. Organization: List the names and proposed duties of key personnel. Provide information on their qualifications and recent work experience. List all areas of work that will be subcontracted out and the subcontractors you intend to use.

b. Equipment: Provide a complete list of all equipment that will be available for this contract. List should include type, model, make, and age. List should identify ownership of equipment (contractor, subcontractor, or leased).

c. Disposal of Product: Describe plan for disposition of product that must be removed from FS land. Plan must include location where product will be taken; plan must address what will be done if sawmills and other outlets are not accepting material.

(o) Business Proposal Instructions:

(1) Submit pricing for the sample task order.

(2) Submit 1 copy of the signed offer (includes: pages 1 and 2 of this solicitation, acknowledgement of any amendments, a completed copy of the representations and certifications at FAR 52.212-3 and Addendum to FAR 52.212-3)

(3) Provide a list of all open contracts of the type work listed in this solicitation. List should include: contract #, dollar value, brief description, percentage complete, expected completion date, and point of contact and phone number of the other party.

(4) If your firm does not intend to work in all districts or counties of the Medicine Bow-Routt National Forest, list those areas that your firm does not intend to work in. This is not an evaluation factor and your disclosure is non-binding. This information may be used to help the FS determine the appropriate number of awardees.

FAR 52.212-2 Evaluation – Commercial Items (JAN 1999)

(a) The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. THE PRICE SUBMITTED FOR THE SAMPLE TASK ORDER WILL BE USED TO EVALUATE PRICE FOR THIS SOLICITATION. Proposals shall be prepared and submitted in accordance with far 52.212-1 and the addendum to far 52.212-1. All evaluation factors other than cost or price, when combined, are significantly more important than cost or price.

The technical factors listed below shall be used to evaluate all offers; THEY ARE WEIGHTED AS FOLLOW: bENEFITS TO THE LOCAL COMMUNITY IS THE MOST IMPORTANT TECHNICAL FACTOR; pAST PERFORMANCE AND CAPABILITY TO PERFORM COMMERCIAL LOGGING WORK ARE EQUAL IN IMPORTANCE.

1.Benefits to the Local Community

The government will evaluate each proposal in terms of the benefits it offers to the Local Community. The government considers the use of contractors who reside in the Local Community to be a significant benefit to the Local Community. Other information that demonstrates benefits to the Local Community will also be considered.

Local Community is divided into two zones. Zone 1 consists of the following counties: Albany, Carbon, Converse, and Natrona counties in Wyoming; Routt, Jackson, Grand, Garfield, Moffat, Rio Blanco, and Larimer counties in Colorado. Zone 2 consists of all counties in the States of Colorado and Wyoming except those counties in Zone 1.

In order to meet the standard, proposals must demonstrate realistic, substantiative benefits to the Local Community in Zone 2. To exceed the standard, proposals must show realistic substantiative benefits in zone 1. Proposals that do not demonstrate realistic, substantiative benefits in Zones 1 or 2 do not meet the standard and will receive a low rating.

2. Past Performance:

Amendment 1, AG-82X9-S-09-0149, pg 5 of 5

Continuation of block 14.

In addition to the information requested in addendum to FAR 52.212-1, contractors may also discuss past accomplishments that indicate your firm's ability to perform the work required by this solicitation. The government will contact a sample of the vendor’s past customers to determine the rating for this factor. The currency and relevance of the information and general trends in contractor’s performance shall be considered. The Forest Service considers that current (within the last 3 years), relevant (similar in nature and scope) performance is a better indicator of ability than older or less similar work. Any offeror who does not have a record of relevant past performance or for whom information on past performance is not available will receive a rating of neutral. Sub-factor A, Business Relations, is the most important sub-factor. The other sub-factors are all equal in value. The four sub-factors will be evaluated to determine an overall rating for past performance.

A. Business Relations: the standard is met by vendors who have a history of effective working relationships and cooperative behavior toward the employing entity.

B. Compliance with Contract Terms and Specifications: the standard is met by vendors who have consistently met contract terms and specifications and demonstrated conformance to standards of good workmanship.

C. Timeliness of Performance: the standard is met by vendors who have consistently demonstrated compliance with contract schedules and have completed work on-time.

D. Customer Satisfaction: the standard is met by vendors who have consistently satisfied their customer’s expectations as evidenced by the willingness to rehire.

3. Capability to Perform Service and Logging Work:

This standard is met by offerors who have the organization, equipment, and strategy needed to accomplish the work described in the sample task order within 1 year – bearing in mind that the Normal Operating Season is only 4 months long. Additional merit may be awarded to vendors who exceed the standard.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
