* The Contractor shall be responsible for the protection from damage by their actions of all noted Monument Posts and Bearing Trees identified by the Forest Service within the contract area. The Contractor shall immediately notify the COR or CO if any damage occurs to these resources.
All unique features will be protected from damage by the contractor. If any unique features are disturbed the contractor will immediately contact the Contacting Officer (CO) and will be liable for the cost of repairs.
CUTTING PRESCRIPTIONS:
1) Units 1-2-3-4: Sawtimber – Clearcutting (Solicitation, H.11.2) - All trees that meet Utilization Standards shown in Appendix B or specifications for cutting in Appendix A within “Clear Cutting Units” are designated for cutting. This task involves cutting designated lodgepole pine 7.0 inches DBH and greater, ponderosa pine 10.0 inches DBH and greater, and Douglas-fir and other conifer species 8.0 inches DBH and greater. These units are patch clearcuts ranging in size from 2 to 5 acres. This task may be accomplished by hand falling or mechanical methods.
2) Units 1-2-3-4: Non-sawtimber – Clearcutting (Solicitation, H.11.2) - All trees that meet Utilization Standards shown in Appendix B or specifications for cutting in Appendix A within “Clear Cutting Units” are designated for cutting. This task involves cutting designated lodgepole pine 5.0- 6.9 inches DBH, ponderosa pine 5.0 – 9.9 inches DBH, and Douglas-fir and other conifer species 5.0-7.9 inches DBH. These units are patch clearcuts ranging in size from 2 to 5 acres. This task may be accomplished by hand falling or mechanical methods.

This task may be accomplished by hand falling or mechanical methods.
4) Units 5-6-7-8: Non-Sawtimber – Designation by Prescription (Solicitation, H.11.15) - All trees that meet Utilization Standards shown in Appendix B or specifications for cutting in Appendix A within “Designation by Prescription” are designated for cutting. This task involves cutting designated lodgepole pine 5.0-6.9 inches DBH, ponderosa pine 5.0-9.9 inches DBH, and Douglas-fir and other conifer species 5.0-7.9 inches DBH. This task may be accomplished by hand falling or mechanical methods.
5) Units 5-6-7-8: Biomass – Designation by Prescription (Solicitation, H.11.15) All trees that meet Utilization Standards shown in Appendix B or specifications for cutting in Appendix A within “Designation by Prescription” are designated for cutting. This task involves cutting ponderosa pine 1.0 to 4.9 inches DBH, Douglas-fir and other conifer species 1.0 to 4.9 inches DBH, and lodgepole pine 1.0 to 4.9 inches DBH. This task is to be accomplished by hand falling or mechanical methods.
H.11.15 DESIGNATION BY PRESCRIPTION. (4/07) As shown on Contract Area Map, the following criteria shall be used by Contractor to designate trees and other products for cutting and removal within the Subdivision(s) or unit(s) listed below.
Contractor will be required to sample cut tree mark an area with Contractor's non-tracer __Blue__ paint for approval by Forest Service prior to cutting. If Forest Service approves marking than contractor will not be required to mark leave trees prior to cutting. If at any time Forest Service determines that cutting is not according to prescription than Contractor shall mark cut trees with Contractor's non-tracer __Blue__ paint if requested to do so by the Forest Service. Forest Service shall inspect and approve Contractor marking prior to cutting.
(a) Additional trees to be cut, if any, are Marked by Forest Service with __Blue or Green___ tracer paint.
(b) Cutting unit boundaries and other trees that shall be left uncut are marked by Forest Service with __Orange__ tracer paint.
Units 5-6-7: Selection Criteria
Forested Stands
1. Species preference of healthy leave trees: Douglas-fir, ponderosa pine, and lodgepole pine. Do not include limber pine in spacing or existing basal area.
2. Reduce up to 40% of the existing BA and/or 15’-25’ average crown spacing with a combination of individual and clumps of trees (3-7 trees greater than 5” DBH) especially in lodgepole pine.
3. Cut all conifers less than 5” DBH and within 5’ of the dripline for individual leave trees. Within the perimeter of clumps of trees (see above), conifers less than 5” DBH will not be cut.
4. Protect residual conifer regeneration and saplings from operations where trees are not a ladder fuel. Maintain approximately 1-2 pockets of regeneration (5+ conifers) for every 5 acres where possible.
5. Reduce existing basal area by 20% within 50’ of either side of trails or roads.
Grasslands and Meadows
1. If stumps are present, thin all conifers to a 30’ spacing favoring species listed above.
2. If stumps are not present, cut all conifers to the edge of the grassland/meadow (point where conifer trees are greater than 8” DBH).
Aspen
1. Clone identification: 100 trees or more with diameters less than 1” DBH or more than 10 trees w/ diameters greater than 5” DBH. Cut all conifers (less than 8”DBH) and girdle all conifers (greater than 8” DBH) with the exception of Engelmann spruce, blue spruce and Douglas-fir.
Unit 8: Selection Criteria Forested Stands
1. Retain all trees that are marked in orange, appear to contain dens, or have large nests.
2. Reduce existing basal area up to 40%.
3. Preference for leave trees will be Douglas-fir, ponderosa pine, and lodgepole pine. Do not include limber pine in spacing or existing basal area.
4. Cut and remove lodgepole pine trees that are greater than 5” DBH.
5. (Situation) If a healthy ponderosa pine or Douglas-fir (less than 5” DBH and greater than 40% live crown) is located within the dripline of an 8” to 13” DBH ponderosa pine, cut and remove the overstory tree.
6. Cut and remove the following ponderosa pine trees between 5” to 13” DBH.
· Suppressed trees with less than 40% live crown ratio.
· Diseased, defective, or slow-growing (less than 40% live crown ratio) trees not likely to increase their growth rate.
· Vigorous trees that are crowded.
· Leave live trees without understory – crown space 10 to 25 feet apart.
7. Favor trees with the greatest live crown ratio regardless of size.
8. Protect residual conifer regeneration and saplings from operations where trees are not a ladder fuel. Maintain approximately 1-2 pockets of regeneration (5+ conifers) for every 5 acres where possible.
9. Reduce existing basal area by 20% within 50’ of either side of trails or roads.
Grasslands and Meadows
1. If stumps are present, thin all conifers to a 30’ spacing favoring species listed above.

Specific requirements of this clause will be included in individual task orders if applicable.
INDIVIDUAL TREES (LEAVE TREE MARKING) (Solicitation, H.11.10) - Notwithstanding H.11.7 - C.3.5, all live,dead, and windthrown trees meeting utilization standards in A.2 specifications for cutting in Appendix A shown as LTM on the Contract Area Map, are designated for cutting.Trees to be left uncut are marked above and below stump height as shown in the table below:

RESERVE TREES (Solicitation, H.9.1) - Notwithstanding the designations for cutting elsewhere live or dead __designated_______ reserve trees or groups of reserve trees within such cutting units or clearings shall be left uncut. Reserve trees are identified by 1.Orange band at eye level with orange butt mark at the base of the tree below stump height 2. Groups of reserve trees are identified with orange stripes with one stripe facing into the unit and two stripes facing in the direction of the next boundary tree. All boundary trees also have an orange mark at the base of the tree below stump height and shall be protected in accordance with Appendix B- KG. 3.2#. Units with reserve trees are shown on task order Contract Area Maps.
PROTECTION OF RESERVE TREES (Solicitation, H.9.2) - Contractor’s damage or destruction of reserve trees described in Appendix B- K-C.3# will cause serious and substantial silvicultural or other damage to the National Forest. It will be difficult if not impossible to determine the amount of such damage. Therefore, Contractor shall pay as fixed, agreed, and liquidated damages ____N/A______ or each ____N/A___________ reserve tree and $___100_______ for each _______________ reserve tree damaged or destroyed by Contractor's Operations, in addition to amounts payable under Appendix B- D.4.4 and Appendix B- D.4.5.
Damage, as used herein, includes any injury to the living crown, bole, or roots of reserve trees. If areas are marked on the ground around such reserve trees, operation of heavy equipment or skidding of products within the area shall be considered to be damage to the tree.
Stump Height (Appendix A, 6.1) - All trees which are required to be cut shall be cut at or below at a maximum of 6 inches above ground, measured from the uphill side, after a tree is felled. Trees shall be completely severed from the stump.
Felling (Appendix A, 6.1) - Cut-trees shall be completely severed from the stump. Trees shall be felled directionally away from all private land boundaries, utilities, fence and other improvements, protected water and drainages, and land survey corners. Cut trees shall not be left leaning or suspended by any leave tree or fence. No hang-ups shall be permitted. Trees which are felled across telephone or electrical lines the contractor shall immediately notify the utility company than the CO, COR. Removal of these trees shall be performed at the Contractor’s expense.
Slash (Appendix A, 5) - Any non-merchantable woody debris, exclusive of stumps and chips/chunks from mastication, created from work under this contract and remaining on the ground after treatment operations, including all cut trees and shrubs and their tops, trunks, and branches. The slash that is generated as a result of fuel treatments and sawtimber removal will be treated as specified below.
TREATMENT SPECIFICATIONS:
Sawtimber Slash Treatment (Appendix B, K.G.7) - Slash is defined as logs, tops, limbs, and other woody material, exclusive of stumps, which is created by the logging operation and remaining on the ground after logging. In areas where Contractor-created slash is intermingled and inseparable from pre-existing slash, slash disposal requirements shall apply to the pre-existing slash as well as the Contractor-created slash. Such areas are designated in the Contractor Slash Responsibility Table herein.

Landing Cleanup
A landing is considered a place where any logs or products are gathered for loading. Logs not meeting utilization standards accumulated at landings shall be (decked) or (returned to the cutting unit) as agreed to in writing by the Forest Service. All slash accumulated at landings shall be piled, unless it is agreed in writing that slash can be thrown back into an area that is planned to be broadcast burned.
Piles shall be reasonably compact and free of soil to facilitate burning. Piles will not be less than__10__ feet in height. Piles shall be of a size and location which will not impair road use or result in damage to residual timber. Piles shall be located at least__35__feet from residual timber. Piles shall not be greater than __25__ feet high x __25_ feet in diameter.
Landing debris along temporary roads within the cutting units may be piles in conjunction with temporary roads construction slash. Landing piles shall be placed along the lower side of the road. All objects which extend more than__10__feet in any direction from the window or pile profile will be cut off and returned to the window or pile.
Fall Leaners and Broken Tops
Purchaser shall fall any damaged tree not meeting utilization standards set forth in A-2. A damaged tree is one that is larger than two inches in diameter at breast height, and has the top knocked out, is leaning more than 10 degrees, has less than one half of it’s original limbs, or has approximately 50 percent of bark removed from the circumference of the bole.
Units 1-2-3-4-5-6-7-8 - Slash Treatment - Bring Slash to the Landing (Appendix A, 6.3.3) – the tops and limbs of sawtimber and non-sawtimber sized trees designated for cutting and the bole required to be yarded to the landing, will be removed from the unit and brought to the landing. The usual method of accomplishing this treatment is by whole tree skidding. Proposals for other methods to accomplish the treatment will be considered. Tops and branches that break off during skidding operations, shall be lopped and scattered according to the specifications of Appendix A 6.3.1. At the landing, limbs will be cut from the stem of the trees, limbs will be piled in locations approved by the Forest Service, and boles stacked parallel in a deck at approved locations. All slash treatments are considered part of the thinning process and shall be keep current with the thinning operations.
Units 1-2-3-4-5-6-7-8 - Slash Treatment –Piling at Landing (Appendix A, 6.3.2) - This task involves cutting limbs from the trunks of designated cut trees and then piling the slash. Slash to be piled shall include all material from one (1) inches diameter up to and including eight (8) inches in diameter at the large end, having a minimum length of three (3) feet.
Piles shall be reasonably compact and free of soil.
Piles shall have a minimum height of ten (10) feet.
Piles will not be more than 25 feet in height, or 25 feet in width.
Piles shall be located at least 30 feet from residual timber and 100 feet from protected stream courses. If conditions make it impractical to locate piles so that damage to residual green trees can be avoided, an area will be designated by the Forest Service.
Piles shall not be more than 25 feet long.
All objects that extend for more than 4 feet in any direction from the pile profile will be cut off and returned to the pile.
If piling is accomplished with a machine, it will be of such size that will cause minimal damage to the residual timber and with acceptable brush piling blade. Forest Service will need to approve the equipment and the type of brush blade.
An inventory or tally of the size, shape and number of piles shall be made following the instructions in the task order and recorded on the pile inventory form provided by the COR.
Units 5-6-7-8 - Slash Treatment – Lop and Scatter with Hand Pile (Appendix A, 6.5, 6.7) –Lop and scatter 25% of the slash created by cutting biomass trees and moving and rearranging slash concentrations to achieve a slash depth of 18 inches. No thinning and/or logging slash shall be allowed outside the treatment unit boundary, unless otherwise approved by the Contracting Officer. Contractor shall remove all thinning and/or logging slash from:
(a) Roads – Remove all cut material at least 25 feet from the road shoulder on the upper (uphill) side, and 50 feet on the lower (downhill) side.
(b) Utility Lines – within 25 feet of utility corridor.
(c) Land Survey Monuments – lop and scatter pullback within 10 feet.
Slash that exceeds 25% ground cover will be placed into piles. All piles shall be constructed as compactly as possible, with heavier material placed on top. The contractor may be required to cover piles with waterproofed material (covering 50% of the pile with a piece of 4-mil polyethylene plastic) or other material as specified in the task order. Some limbing may be required to construct a compact pile.
All slash between 1 and 5 inches in diameter and greater than 2 feet in length shall be piled. Slash less than 1 inch in diameter and less than 2 feet in length shall be left on the ground. Slash left on the ground shall not exceed 18 inches in depth. The task order or the COR in writing may designate a different size within this range for individual units (example: slash 1-4 or 2-6 inches only, instead of the less than 6 inches), but not greater than 6 inch diameter.
All piles shall be constructed by laying limbs, stems, cut boles, and other slash in the pile so as to be triangular in shape. All ends that stick out more than two (2) feet must be bucked off and piled. Larger material in piles shall be placed perpendicular to slope so it cannot roll down hill when burned.
Slash that causes large air spaces in piles shall be cut to eliminate air spaces. Each pile shall include an area of small sized slash (small branches less than ¼ to ½ inch in diameter and/or small branches with needles or leaves attached) to provide “kindling” for prompt ignition and to aid in combustion of larger slash. These fuels shall be placed in the center of the pile.
Unless approved by the COR, maximum pile size shall be 10 feet in diameter by 8 feet in height, and minimum pile size shall be 6 feet in diameter by 6 feet in height (measured on the uphill side) at the time of final inspection.
Piles shall not be constructed in roadways unless specified by the COR. In some cases, the COR may determine that it is beneficial to place piles or slash in old roads that have been closed. Piles shall not be constructed in roads, ditches or drains. Piles shall not be constructed any closer than twenty (20) feet from established roads, trails, existing fences or utility poles. Piles shall not be constructed within the channel of any stream, or on top of downed logs, stumps or snags.
INSPECTION AND ACCEPTANCE
Government Quality Assurance Plan (Appendix A, 7) The Government will inspect completed units as a basis for acceptance and payments, and to provide recommendations to improve work quality while work is in progress. The Contractor is responsible for providing quality control to assure that work complies with requirements of contract specifications.
All work included in the contract specifications shall be subject to inspections by the Government at periodic intervals during the performance of this contract. Treatment inspections are for the sole benefit of the Government and shall not release the Contractor of the responsibility of providing quality control measures to assure that the work strictly complies with the contract requirements.
Surveillance plots that are ¼ acre in size will be installed prior to operations beginning in each unit at a minimum of 1 per 5 acres. The Contractor will be unaware of the location of these plots prior to implementation, the Contracting Officer or designee will conduct sampling within the plot to determine compliance with cutting prescriptions.
Each inspection plot will be subdivided into four (4) quadrants based on cardinal directions. Each quadrant will be evaluated for compliance with all contract specifications as stated in Section C that pertains to that individual treatment. If two (2) or more quadrants fail to comply, the plot will fail.

Work Quality Percentage Work quality percentages are derived from data developed from inspection plots. The total number of satisfactory plots divided by the number of plots inspected determines the quality rate. This rate multiplied by 100 provides the work quality percentage.

Acceptable Quality Level - Acceptance of work will be based on compliance with all Section C.5.0 Specific Tasks that correspond to the treatment. A minimum basic quality of 85 percent is required.
Unsatisfactory Work - If the work quality falls below 85 percent, the COR will immediately notify the Contractor in writing and direct the Contractor to improve the quality of his work. If the quality of work is not raised to an acceptable level within 5 working days after written notification, the Contracting Officer may issue a Suspend Work Order to resolve the problem, during which time contract performance time will continue to run. If untreated or unsatisfactory treated areas are the primary reason for unsatisfactory work, the area shall be reworked to obtain satisfactory work quality. If, after the allowable time for correction of the quality of work, the COR in conjunction with the Contracting Officer may deduct a percentage of funds from the line items that corresponds to the 85 percent required and the actual percentage obtained. Disagreement between the parties will be subject to the clause entitled “Disputes”.
In the event that work is performed that is contrary to the requirements in the task order the Government is not liable for costs incurred by the contractor during negligent performance that is without the fault or negligence of the Government.

EROSION PREVENTION AND CONTROL (Solicitation, H.7.1) - Skidding with tractors within 100 feet of live streams shall not be permitted except in places designated in advance by Forest Service, and in no event shall skid roads be located in live or intermittent stream courses. Skid trails shall be located high enough out of draws, swales, and valley bottoms to permit diversion of runoff water to natural undisturbed forest ground cover
Prior to periods of accelerated water runoff, especially during the spring runoff and periods of heavy rainfall, Contractor shall inspect and open culverts and drainage structures, construct special cross ditches for road runoff, and take other reasonable measures needed to prevent soil erosion and siltation of streams.
Unless otherwise agreed in writing, Contractor shall keep erosion control work current with his operations under the contract and in any case not later than 15 days after completion of skidding on each work unit.
EROSION CONTROL SEEDING (Solicitation, H.7.2) - Following completion of skidding and yarding operations in an area, Contractor shall seed and fertilize all exposed areas of raw soil as designated by the Forest Service on skid trails, landings, firebreaks, slides, slumps, Temporary Roads and traveled ways of Specified Road following closure.

When fertilizer and seed are applied in separate operations, the second operation shall be carried out within 72 hours of the first.
Seeding shall be done during the period 5/1 to 6/15 and 9/1 to 10/31 and under the above specified conditions unless otherwise approved.

TEMPORARY ROADS (Solicitation, H.25) - Temporary Roads are roads other than specified roads that are constructed by contractor for the purpose of harvesting included timber or for the completion of required work items. The location and clearing widths of Temporary Roads or facilities shall be designated or agreed to in writing by the Forest Service prior to construction. Such location shall include the marking of road centerline or grade line and the setting of such construction stakes as are necessary to provide a suitable basis for economical construction and protection of National Forest Lands. Definitions, specifications, and drawings for the following temporary road construction work items are listed in Appendix D. The Forest Service will pay the contractor for the construction of approved temporary road construction items outside of the cutting or treatment unit boundaries. The Forest Service will not pay the contractor for any temporary road construction items within the cutting or treatment unit boundaries. Temporary road construction payment rates are listed below.

USE OF ROADS BY CONTRACTOR (Solicitation, H.26) - Except as provided herein, Contractor is authorized to use existing National Forest roads and Specified Roads, when such use will not cause damage to the roads or National Forest resources and when hauling can be done safely. If Contractor’s use of an existing temporary or National Forest system road cannot be satisfactorily accommodated without reconstruction, Contractor shall be authorized to use such road upon agreement as to the minimum reconstruction work that Contractor shall perform before hauling.
The Contract Area Map shows existing temporary or permanent roads that for such reasons as limitations in structural capacity, safety, and protection of soil, water, and roads:
(a) Cannot be used for log hauling or
(b) May be used only under the restrictive limitations stated therein.
Contractor's use of existing roads identified on Contract Area Map by the following codes is prohibited or subject to restrictive limitations, unless agreed otherwise:

The contractor should not expect to be able to work outside of the normal operating season; however, the government may allow the contractor to work outside of the normal operating season if the contracting officer determines that it is in the best interest of the government.
