Changes to the Solicitation
1. Appendix A, # 1, Scope of Work, pg 1 of 27: The following phrase is deleted: “Indefinite Delivery Quantity (IDQ)”.
2. Appendix A, # 2, paragraph (b), Boundaries: The phrase, “Cutting Unit Boundaries are marked with orange paint”, is deleted and replaced with the following: “Cutting Unit Boundaries are normally marked with orange paint. Any deviation from the norm will be specified at the task order level.”
3. Appendix A, # 6.3.2, Slash Treatment – Piling, 3): The phrase, “Piles will not be more than 20 feet in height, or 20 feet in width” is deleted and replaced with: “Piles will not be more than 20 feet in height , or 30 feet in width”.
4. Appendix A, # 6.3.2, Slash Treatment – Piling, 5): The phrase, ”Piles shall not be more than
100 feet long”, is deleted and replaced with: “Piles shall not be more than 30 feet long”.
5. Appendix A, # 6.8, Mechanical Pile Only, 3): The specified width of the pile is changed from 20 feet to 30 feet.
6. Appendix A, # 6.8, Mechanical Pile Only, 5): The specified length of the pile is changed from 100 feet to 30 feet long.
7. Appendix A, # 6.11.1, pg 18 of 27: The phrase, “Task orders for Item 18A thru 18I” is deleted and replaced with, “Task orders for Item 0031R3 thru 0031Z3”.
8. Appendix A, # 7, Government Quality Assurance Surveillance Plan: There were 8 paragraphs in this section. Paragraphs 3 thru 8 are deleted in their entirety. Paragraph 3 began with the words “Inspections will be made”.
9. Appendix A, # 8, Plot Inspections: This section is deleted in its entirety.
10. Appendix A, # 9, Performance Work Summary Table for non-saw timber treatments: This section is deleted in its entirety.
11. Appendix B, K-D.3.5# - Scheduled Rate Redetermination. (5/08): The first sentence in the 3rd paragraph is deleted and replaced with the following:
In scheduled rate redeterminations, Contracting Officer may make modifications in minimum specifications for trees or products in Division A of Appendix B, road maintenance requirements, deposits’ or cost allowances in Appendix D or H.27, logging methods in Appendix B - G.4, slash disposal in Appendix B - G.7, weight factors in Appendix C-4, and fire precautionary measures in H.21 if, and to the extent that, such changes are reasonably necessary to protect the interest of the United States.
12. The Provision RO-K-G-8.2.5#, Scaling as Presented (Sales by Load Count) (Option 2) (1/08), is added to Appendix B. The text is provided below:
RO-K-G-8.2.5# - SCALING AS PRESENTED (SALES BY LOAD COUNT)(Option 2) (1/08) Unless otherwise agreed to in writing, notwithstanding criteria in G.8.2, volume for all material will be paid for at rates listed in B.2 - Timber Removal Price Schedule on a predetermined conversion factor of __________ tons per load times the total loads

Unless otherwise agreed to in writing, log trucks are restricted to a maximum gross vehicle weight of ____________ pounds, as well as State limits for width and height.
This provision can be added to task orders at the request of the contractor if certified weighing facilities are unavailable. The weight factors in Appendix C, and average load data will be used by the Forest service to establish the average number of tons per load of each product. So, for the example in B2-Timber Removal Schedule the price per ton is $2.77. If the average net weight hauled per load is 25 tons, the price per load would be $69.25 per load.
13. Appendix B, K-F.3.2# Road Maintenance Deposit Schedule (9/04); The provision is changed to read as follows:
K-F.3.2# – ROAD MAINTENANCE DEPOSIT SCHEDULE. (9/04) Other provisions herein notwithstanding, when Forest Service requests payment in lieu of Contractor’s performance of road maintenance, Contractor shall make Required Deposits (16 USC 537) for current and/or deferred road maintenance. Such deposits are based on the estimated volume and distance hauled and Contractor’s commensurate use of each road listed in the Road Maintenance Plan in K-F.3.1#.
Contractor and Forest Service may agree in writing on adjustment of such rates. If Contractor uses roads under jurisdiction of Forest Service other than those listed in the Road Maintenance Plan, Forest Service shall establish rates commensurate with Contractor’s use of such roads.
The Required Deposits for Forest Service work in lieu of Contractor performance and for deferred maintenance is: $___1/______ per green ton___.
1/ Specific requirements of this provision will be included in individual task orders if applicable. A surface rock replacement deposit of $0.16 per ton per mile will apply only to the work on the ARNF and will be required in individual task orders for hauling products over Forest Service roads with a rock surface. Other road maintenance deposits in lieu of Contractors performance of during haul or post haul road maintenance would be by mutual agreement only.
The following table lists who Contractor will make deposits for road maintenance to, and the rate per unit of measure of the deposit. The Road Maintenance Agreement is available for inspection at the Forest Supervisor’s Office.

14. Main body of solicitation, B.2 Timber Removal Price Schedule, footnote 1 under the heading “Required Surface Replacement Depostits”; The following is added to footnote 1: No Surface Replacement Deposits will be required or collected for work done on the PSINF. Surface

Replacement Deposits will only apply to work done on the ARNF.
15. Main body of solicitation, E.3, Government Quality Assurance Surveillance Plan, is deleted from the solicitaiton.
16. Main body of solicitation, H.25, Temporary Roads: The first paragraph is deleted and replaced with the paragraph below:
Temporary Roads are roads other than specified roads that are constructed by contractor for the purpose of harvesting included timber or for the completion of required work items.
The location and clearing widths of Temporary Roads or facilities shall be designated or agreed to in writing by the Forest Service prior to construction. Such location shall include the marking of road centerline or grade line and the setting of such construction stakes as are necessary to provide a suitable basis for economical construction and protection of National Forest Lands. Definitions, specifications, and drawings for the following temporary road construction work items are listed in Appendix D. The Forest Service will pay the contractor for the construction of approved temporary road construction items outside of the cutting or treatment unit boundaries. The Forest Service will not pay the contractor for any temporary road construction, closure, or obliteration work required within the cutting or treatment unit boundaries. Temporary road construction payment rates are listed below.
17. Main body of solicitation, H.25.1, Obliteration and Closure Requirements for Temporary Roads, skid trails and Landings (11/06): This clause is deleted and replaced with the clause below:
H.25.1 OBLITERATION AND CLOSURE REQUIREMENTS FOR TEMPORARY ROADS,
SKID TRAILS AND LANDINGS. Unless otherwise agreed in writing, temporary roads, skid trails and landings associated with the cutting unit(s) listed in the following table shall be closed using the method described.

Specific requirements of this provision will be included in individual task orders if applicable.
Contractor will be paid for the obliteration or closure of Temporary Roads outside of treatment units at the rates listed above. Contractor will not be paid for obliteration or closure of Temporary Roads, Skid Trails, or Landings within the treatment units.
18. Main body of solicitation; the following clauses are added:
H.42 Maximum and Average Skid Distances Within a unit, the maximum distance the contractor will be required to skid material is 3,000 feet. The average will likely be 1,000 feet or less.
H.43 Maximum and Average Walk in Distances For units where non-mechanized work is required, the maximum distance the contractor will be required to walk from the road in order to access the unit is 1.5 miles. The average distance will likely be ¼ to ½ mile.
19. Main body of solicitation, Part II – Contract Clauses: A new heading is created in the section
Solicitation AG-82X9-S-08-0120, Amendment 2, pg 5 of 5 that lists clauses by reference. The heading is titled “Pertaining Only to Service and Timber
Harvest Contract Items”. The clauses 52.222-41 Service Contract Act of 1965, as amended (JUL 2005) and 52.222-43 Fair Labor Standards Act and Service Contract Act – Price Adjustment (Multi Year and option Contracts) (MAY1989) are moved from the heading Pertaining Only to Service Contract Items and placed under the new heading.
20. Main body of solicitation, Part II – Contract Clauses, ”Pertaining to All Contract Items”: The clause 52.219-14, Limitations on Subcontracting ( DEC 1996), is deleted from the solicitation.
21. The applicable SCA wage determination is added to the solicitation and has been posted on Fedbizopps: SCA Wage Determiniation # 1976-1351, Revision 33, Date of Revision 5/29/2008.
22. Main body of solicitation, the NAICS small business size standard is changed from $16.5 million to $17.5 million. This change is written into clauses K.2, L.10, and any other place that the size standard is written.
23. Main body of solicitaiton, L.14, Instructions for the Preparation of Technical and Business Proposals (SEP 1999), Letter C, Business Proposal Instructions: # (4) is added and pertains to Large Businesses only. # (4) reads as follows:
Large businesses must submit with their offer an “Individual Contract Plan”, (subcontracting plan) in accordance with clause 52.219-9, Small Business Subcontracting Plan. The plan must also address the additional requirements found in I.9, Enhanced Subcontracting Small Business Requirement.
24. Amendment 1, dated 11/20/2008, Questions and Answers; #26 is corrected by deleting the phrase “See # 24 above” and replacing it with “See # 23 above”. # 32 is corrected by deleting the phrase “See # 32 above” and replacing it with “See # 31 above”.
25. Main body of solicitation, Section B.1 Services and Prices; The bid items in this section contained many numbering errors that have been corrected in attachment 1 to this amendment. Section B.1 Services and Prices in the original solicitation is deleted and replaced with attachment 1 of this amendment. Vendors are to use attachment 1 when submitting their prices for the service work.
