AMENDMENT #2 DATED 04/06/09

SOL. NO: RFP AG-8197-S-09-0012

UNIT: CORONADO NF, Forest-Wide

PROJECT NAME: IDIQ ROADS

Economic Fuel Price Adjustment During the contract period, including any renewals, the equipment hourly rate may be unilaterally adjusted by contract modification by the contracting officer as set forth herein to reflect changes in the cost of diesel fuel. Adjustments may be made every four months if prices change by at least 75 cents from the baseline price or from the last adjusted price. Based upon such a change, a 4% adjustment will be made for each 75 cent change from the baseline or from the last price adjustment for those pay items which consist of equipment which directly consumes fuel for operation up to the maximum allowed change under this contract. Any price adjustment will be indexed to diesel prices regardless of whether the pay item equipment consumes diesel, gasoline or LPG. The contract will then be modified and contractors notified by mail of the price adjustment. The price adjustment will be based upon the use of the Tucson Average Price of Diesel (TAPD) index, described below. Adjusted prices will be reflected on subsequent task orders.

Baseline Price. The initial baseline price will be determined by the Contracting Officer based on the TAPD index price for diesel fuel for the date that the Contracting Officer prepares formal award of the contracts.

The net change in any contract unit price shall not exceed 12 percent of the original contract unit price. This includes the contract base year plus option years.

The TAPD index consists of diesel prices obtained from the website www.tucsongasprices.com diesel price listings. Prices collected for the TAPD index will be a numerical average calculated from the website’s displayed high and low prices from within seven days of the economic price adjustment four month anniversary date.

Hypothetical Example:

Contract Date: April 1, 2008

Price at beginning of contract: $2.20/gallon (base) TAPD value for August 1, 2008: $2.95/gallon The $2.20/gallon price will be the baseline amount and will be adjusted based on a price increase of at least 75 cents. A 4% adjustment in the pay item will be made. Prices will be reviewed every four months.
