REFERENCES 3
PART 1 GENERAL 4
1.01 DEFINITIONS 5
A. General Explanation: Specification language often includes terms that are defined 6 elsewhere in the Contract including the Construction Clauses. Certain terms are 7 defined in this section. These definitions or explanations are not necessarily 8 complete or exclusive, but are general for the Work and may be explained more 9 explicitly in other sections. 10
B. "General Conditions" refer collectively to the Construction Contract Clauses, 11 Labor Standards and the U.S. Department of Labor Wage Decision bound into the 12 specifications. 13
C. "Indicated" refers to graphic representations, notes or schedules on the Drawings, 14 or to requirements elsewhere in the Specifications or other Contract Documents. 15 Terms such as "shown", "noted", "scheduled" and "specified" have the same 16 meaning as "indicated" and are used to further help locate the reference, but no 17 limitation on location is intended except as specifically stated. 18
D. The terms “Owner” and “Engineer” used throughout the specification means 19 contracting Officer (CO) and Contracting Officer Representative (COR), 20 respectively. 21
E. Where "directed", "authorized", "selected", "approved", or a similar term is used 22 in conjunction with the Contractor's submittals, applications, requests and other 23 activities, and the specifications state that an individual other than the Contracting 24 Officer (CO) shall provide this action, it is understood that only the CO has this 25 authority unless the individual stated is so authorized in writing by the CO. 26
1. When the individual is so authorized by the CO, the Contractor may still 27 appeal the action to the CO. 28
2. The CO’s decision will be final. 29
3. In no case shall the CO action be interpreted as releasing the Contractor 30 from responsibility to fulfill the requirements of the Contract. 31
F. "Regulations" include laws, ordinances, statutes and lawful orders issued by 32 authorities having jurisdiction, as well as rules, conventions and agreements 33 within the construction industry that control performance of the Work. 34
G. "Project site" refers to the space available to the Contractor for performance of the 35 Work, either exclusively or in conjunction with others performing other work. 36
H. "Furnish" means to supply and deliver to the Project site, ready for unloading, 37 unpacking, assembling, installation and similar operations. 38
01 42 00-2
I. "Install" describes operations at the Project site, including unloading, temporary 1 storage, unpacking, assembling, erecting, placing, anchoring, applying, working 2 to dimension, finishing, curing, protecting, cleaning and similar operations. 3
J. "Provide" means to furnish and install, complete in place and ready for full use. 4
K. "Cutting" refers to removal of material by cutting, sawing, drilling, breaking, 5 chipping, grinding, excavating and similar operations. 6
L. "Patching" refers to restoration of a surface to its original completed condition by 7 filling, repairing, refinishing, closing and similar operations. 8
M. "Installer" is the Contractor or another entity engaged by the Contractor, either 9 directly or indirectly through subcontracting, to perform a particular construction 10 operation at the Project site, including installation, erection, application and 11 similar operations. Installers shall be skilled in the operations they perform. 12
N. "Testing agency" or "testing laboratory" is an independent entity engaged to 13 perform specific inspections or tests, either at the Project site or elsewhere, and to 14 report the results of those inspections and tests. 15
O. "Notice to Proceed" is the CO’s notification by letter to the Contractor to proceed 16 with the Contract, activating the time period for construction and establishing the 17 completion date. 18
1.02 CODES AND STANDARDS 19
A. Applicability of Standards: Unless the Contract includes more stringent 20 requirements, applicable construction industry standards have the same force and 21 effect, to the extent referenced, as if bound or copied directly into the Contract. 22 Such standards are made a part of the Contract by reference. 23
B. Codes: The Work shall be performed in compliance with the latest editions of the 24 following codes: IMC, NEC, IBC and IPC. 25
C. Conflicting Requirements. Where compliance with two or more standards is 26 specified, comply with the most stringent requirement. Refer uncertainties, and 27 requirements that are different but apparently equal, to the CO in writing for a 28 decision before proceeding. 29
D. Abbreviations: Names and titles of standards are frequently abbreviated. 30 Abbreviations and acronyms used in the Contract mean the recognized name of a 31 trade association, standards-producing organization, authority having jurisdiction 32 or other entity applicable to the context of the particular provision. Except as 33 otherwise indicated, refer to the current editions of the following publications for 34 abbreviations: 35
