Government – Andrea Stanbro, Brett Yaw, Tom Burry, Julie Tarvin, Mike Johnson, and Dana Taylor Contractors – Brian Sines representing SineCo TimberOp, Bob Zacharias representing Zacharias Logging, Larry McCaulden representing Boise Cascade Wood Products, David Schmidt representing Integrated Biomass.
Andrea Stanbro, Contract Specialist, led the discussion on the parts of the contract.
Offerors must complete Blocks 14, 15A, 15B, 15C, 16, 17, and 18 on the Standard Form 33. Proposals are due July 9, 2013 by 4:30 PM. Proposals can be mailed or hand delivered to the Wallowa Whitman National Forest Supervisor’s Office, faxed or emailed proposals will not be accepted. Address is provided in Block 8.
The Schedule of Items lists the services and prices. Offerors must submit a unit price and total price for each line item, and a price which they will pay for the timber in B.2 of the Schedule of Items. There is one optional item for road reconstruction. Government may exercise the options at any time during the contract performance period.
In addition to the price to be paid by the contractor for the timber products to be removed the contractor shall also pay road deposits of $0.77/ton and co-op deposits of $0.01/ton for the cost of culturing, growing, and harvesting seed from native plants. The co-op deposits are for seed production not bags of seed.
It was clarified that the contractor awarded the contract will market the product removed and will determine theproposed delivery locations for those products. However, 100% weight scaling is required for all products removed from the project. A current Weighing Services Agreement must be in place at all delivery sites prior to approval as an acceptable delivery location.
Offerors shall provide one weighted price combining saw logs and Green Convertible Biomass as shown in B.2 Timber/Product Removal Price Schedule. All products will be assessed value at this one rate.
The Contractor shall identify the quality control system and the Government will use their quality assurance surveillance plan to monitor Contractor performance. Item 1 payment and acceptance will be on a per acre basis.
Government-furnished property will include grass seed and the product removal permits.
One page 8 of the solicitation, Clause 52.211-10 was discussed. The estimated start work date is September 1, 2013. All work shall be completed by October 31, 2016. Contract time runs continuously without suspensions. Contract time has already taken into consideration fire shutdowns, ground conditions, restricted access, and hauling days. The list of work schedule restrictions were also discussed. The contractor can request waivers for these restrictions.
The clauses that are unique to stewardship were briefly discussed. Although the Government is trading goods for services, based on Forest Service appraisal information , we anticipate product value will not cover the cost of all services, therefore the Government will make payments to the Contractor. Stewardship credits will be determined upon award which may be applied to timber value when service work activities are completed and accepted. Prior to harvesting any timber, the Contractor must provide payment guarantee to cover the value of the products expected to be cut in not less than 30 calendar days and not more than 60 calendar days. This amount is based on the offer the Contractor makes for purchasing the product material. Clause G.4 Contractor Certification is a required monthly certification that must be completed by the Contractor.
Stewardship credits do not cover the required road deposits ($.77/Ton or co-op deposits ($.01/Ton). These are required cash payment items only.
Generally discussed the other contract clauses commonly seen in service contracts. Fire requirements are the same from most service/construction contracts. The fire requirements are different than a timber sale in that the contractor can be held liable for full amount of suppression costs. Safety is very important and the list of of hazards on pages 14 and 15 are not all inclusive. Contractor will be required to submit a safety plan prior to start work. Other documents to be sumitted prior to start work are the quality control plan, the proposed progress schedule, list of proposed subcontractors using the SF 1413, traffic control plans, soil erosion and water pollution control plan, designation of contractor personnel, and fire plan.
On page 13 of the solicitation, AGAR Clause 452.237-74 Key Personnel was discussed. On page 16, the Restricted Road List was discussed. Haul is restricted to those roads listed in Appendix C Road Maintenance. The roads shall be dry or frozen when used by the Contractor.
Many clauses are incorporated by reference. Some clauses pertain only to construction, some only to service, and some pertain to all work. Full text is available at the websites listed in I.4 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1988).
The construction portion of this project is estimated to be between $25,000 and $100,000 so clause I.8 52.228-13 Alternative Payment Protection clause applies. This is only required if Option Item 3 Road Reconstruction is exercised.
Clause 52.228-8 Payrolls and Basic Records are only required if Option Item 3 is exercised.
The solicitation will not be set aside, use full and open competition.
Payment will be made by electronic funds transfer.
The Contractor must pay employees based on the attached Service Contract Act wage determination 1977-0079 along with fringe benefits for the service work items 1 and 2 in the schedule.
The Davis Bacon Wage Determination only applies to the road reconstruction not the road maintenance. The Contractor must pay employees based on the attached Davis Bacon Act wage determination OR130001 along with fringe benefits for the construction work items. It was also determined that the project areas is located in Zone #3 (Power Equipment Operators), Zone #1 (Laborers), and Zone #4 (Truck Drivers).
Offerors must register in SAM.gov. Migrant & Seasonal Work Protection Act and Oregon Farm Forest Labor License DO NOT apply to any of the service work items included in this solicitation.
A formal site visit is not planned for the construction portion of the project however one can be arranged by contacting Brett Yaw. Additional information on page 41.
The clause, Instructions for the Preparation of Technical and Business Proposals provides instructions for what needs to be submitted with the price quote. Alternate proposals may be provided and are encouraged provided that the offeror also submits a proposal for the performance of the work as specified in the Statement of Work. The number of copies required is listed in paragraph (a)(4)(a), (b), and (c). Offers must provide information on Past Performance in the last 3 years, Technical Approach, Key Personnel (resume for Project Manager only), and Utilization pof Local Work Forces (local is defined as the Counties of Union, Baker, Wallowa, Umatilla, and Grant). Follow the instructions carefully and provide the information that is requested in each of the factors.
Clauses M.2 and M.3, describes how the Government will evaluate. The following evaluation factors are listed in descending order of importance: Past Performance, Technical Approach, Key Personnel, and Utilization of Local Workforce. All technical factors when combined are approximately equal to price.
Offerors Technical Approach, Key Personnel, and Utilization of Local Workforce will be incorporated into any resultant contract. The accepted proposal will take precedence if there is any inconsistency between the accepted proposal and the Government’s solicitation requirements.
Julie Tarvin, discussed the technical requirements in Appendix A and B.
Appendix A – standard specifications regarding the cut, skid, and deliver timber harvest operations.
The list of units and acres was reviewed.
The technical requirements and specifications for this work is included in Appendix B.
Visual inspections will be performed by the FS.
Appendix B – Timber Removal Requirements
There was discussion about the tables and information on pages 2 and 3 of Appendix B. A summary of cruise information is attached which displays estimated volumes in CCF by product and species within each cutting unit and the weight conversion factors utilized to convert CCF to Tons.
All information in Appendix B was briefly discussed such as stump height, scaling instructions, weighting facility (certified scales), paint and branding information, the designation table on page 11, felling requirements, treatment of stumps (Borax), yarding/skidding requirements, co-op deposits, and removal of chip residue.
Clause KT-FT.1.0.1# - Temporary Road and Landing Construction (Option 1) was reviewed and discussed. Temp roads are not required but there are options. Temporary road access was planned and part of the Decision Notice for Units 138, 306, 309 and 333. All temporary roads will be restored by the method shown in Clause KT-FT.1.0.1#.
Temp roads, skid trails, and landings are to be scarified and seeded as stated in K-G.6.0# -Erosion Control and Soil Treatment by Contractor.
Pile landings requirement is stated in K-G.7.4.2#. If accumulations of soil are discovered in landing piles after Forest Service burning of piles, the contractor will be required to return, level remaining dirt piles and re-pile as needed.
Brett Yaw, discussed the technical requirements in the Appendix C and D.
Appendix C – Road Maintenance Requirements
Local material sources were discussed. There are various source locations in the contract area for the 4” pit run but the suggested location is off the 6220280 road, see page 6 of Appendix C. The pit is well developed but it is expected that some of the material will need to be ripped to meet the project specifications.
There are no water sources within the project area. City of Cove is an option.
There is a culvert on FS RD 6232062 that is washed out. The contractor shall make it functional pre-haul and then pull it out post-haul.
Dust abatement requirements were discussed (Mill Creek Lane, 0.1 mile during haul, use of mag-chloride or lig).
Appendix D – Option Item: Road Reconstruction/Construction Requirements.
In regards to the Optional Item 3: Road Reconstruction: FP-03 specifications apply, a commercial source will be needed for the crushed material, and all three parts of Line Item 3 will be awarded together if the Government decides to excerise the option.
Also discussed was the contract area boundary, no trees.debris to be left on ATV trails, the protection of noxious weed sites, ATP sites will be flagged by the FS, and the ATP sites are sensitive plant sites.
