CORP Specifications Appendix A – Crescent Netting
SECTION 100- DESCRIPTION, SPECIFICATIONS OR WORK STATEMENT
CRE Netting C-1 SCOPE OF CONTRACT:
This solicitation is to provide services for of protection of seedlings from big game browse damage, using the following treatment methods:
(a) Installation of new flexible netting over tree seedlings of previously untreated (un-netted) units.
(b) Maintenance of flexible netting and , where necessary, installation of new flexible netting over tree seedlings of previously treated (netted) units consisting of __________ acres.
*Note: Trees to be treated include planted seedlings as well as natural needed to meeting specific spacing requirements.
The Contractor shall furnish all labor, supervision, transportation, supplies, except those designated as government-furnished, and incidentals to perform all work specified herein.
CRE Netting C-2 PROJECT LOCATION AND DESCRIPTION:
Vicinity maps showing project location and access are attached and made a part of this contract. Other information regarding specific units is contained in the Flex Netting Data Sheets located in list of attachments & exhibits of this solicitation.
(a) Accessibility:
(1) Work areas may be reached by Forest roads that are accessible by standard two wheel pickup equipped with snow tires and chains, if needed, during normal operating seasons, unless otherwise indicated on the attached Tree Planting Data Sheets. Vehicles shall not operate off system roads without prior written approval of the Contracting Officer.
(2) Inaccessibility due to snow, fallen trees, slides or washouts on roads may or may not be corrected at the option of the Government.
(3) Roads shown on unit maps indicate access to units and are not to suggest the roads are open within units for any further travel.
(b) Boundaries:
Planting unit boundaries are usually obvious on the ground. Boundaries, which are not obvious, will be marked with either _________ or __________ flagging and or blue timber boundary tags and _________ tree paint.
CRE Netting C-3 CONTRACT DEFINITIONS:
Installation of netting Definitions:
(a) Best Tree: Tallest tree with fullest crown that is least affected by visible disease, defect, and animal, insect, or mechanical damage.
(b) Designated Seedling: All live, planted seedlings and natural seedlings used to meet spacing requirements as specified in the detailed unit information sheets.
(c) Lateral Branch: All tree branches growing generally at an angle to the main stem of the tree.
(d) Natural: A naturally regenerated seedling, as opposed to one that was planted. Naturals used for spacing purposes during planting will have had protectors installed them. For the purposes of contract, such trees will not be considered as naturals.
(e) Terminal Buds: The growing, vegetative, pointed bud tips of the main stem, or leader (usually the highest part of the tree). The terminal (central) bud is usually surrounded by 2-5 smaller lateral buds.
(f) Terminal Leader: The topmost portion of the main stem extending from the top lateral branch, or whorl of lateral branches, upward to the terminal bud.
(g) Treatment: The removal of rigid mesh Vexar tubing and installation of flexible netting, or the maintenance of flexible netting on specified seedlings.
(h) Whorl: One set of a series of sets of lateral branches radiating from a single height along the main stem of the tree.
CRE Netting C-4
TREES TO BE TREATED
(a) Live planted or natural preferred species trees needed to meet spacing requirements and that are less than 36 inches tall, or as stated on the Detailed Unit Information Sheets. Select on the basis of the preferred species listed in the Detailed Unit Information Sheet.
(b) A variance of 25 percent from the specified spacing shall be used to determine trees to be treated in all units. Spacing for individual treatment units can be found on the Detailed Unit Information Sheets(s).
(c) In plantations less than four years old, naturals of a different species than that of the planted species shall only be treated to ensure spacing requirements are being met. (See Definitions CRE Netting C-3 (d) – “Natural”).
(d) In any unit, where a natural of the same species is within the 25 percent spacing variance to planted tree, the best tree shall be treated. (See Definitions CRE Netting C-3 (a)).
(e) For application and maintenance of netting, the terminal buds shall be protected as stated herein. When terminal buds are missing, at least one lateral branch included within the installation must contain a live bud, or the dominant lateral branch with a live bud itself may be treated, provided it is large enough so that the netting can be secured to it as described herein.

INSTALLATION OF FLEX NETTING.
Flexible netting shall be installed as described below for trees up to 36 inches in height.
(Reference Exhibit B):
1) The flex netting shall be fed onto the tree over the first whorl of lateral branches and terminal leader.
2) If the terminal leader and first whorl of branches are not sufficient to secure the netting as described herein, a second whorl of lateral branches shall be included in the installation. On larger trees, if the terminal leader is at least 12 inches in length and provides sufficient needles for the installation to be secured as described herein, the inclusion of the first whorl within the netting will not be necessary.
3) After the flex netting, there shall be enough material to property secure the netting to the seedling as described herein, prior to cutting.
4) Securing the netting shall be accomplished by gently pulling the installation upward or downward so as to cause the needles to begin to project through the netting material. Netting material shall be secured to the tree in such a manner that a gentle tug or a moderate wind of 10-20 MPH does not alter the installation.
5) After securing, any netting material in excess of 10 inches beyond the terminal bud shall be trimmed prior to continuing the installation.
6) After cutting, the netting material extending beyond the terminal bud shall be folded over approximately 4 - 6 inches so that the total length of the fold extending beyond the tip of the terminal bud is 5 inches (+ - 1 inch). (See Exhibit B).
7) After folding to the proper length, the material at the top of the installation shall be carefully stretched so that upon completion of the installation, the opening at the top is 3 -5 inches. The netting extending from the terminal bud to the top of the installation shall generally have an inverse cone shape and not be smaller than 2 inches in diameter at any point. (See Exhibit B).
8) In all cases, the dominant leader must be protected with 5 inches of folded netting material extending past the live terminal bud, and opening at the top of the fold shall be
3 -5 inches in diameter. The terminal bud shall not be damaged and shall be erect and free to grow through the specified opening at the top of the installation. (See Exhibit B).
9) Any installation where netting material is less than 4 inches below or more than 6 inches above the terminal bud will be considered an unsatisfactory installation. Openings at the top of any installation that are less than 3 inches or more than 5 inches in diameter will constitute an unsatisfactory installation. Seedlings with sufficient whorls/ needles to facilitate a secure installation, but which have a loose installation will be considered as unsatisfactory on the inspection summary.
10) Installations consisting of excessive amounts of netting will be considered as unsatisfactory on the inspection summary, and excess netting will be counted as waster material. An example of excessive netting would be the inclusion of a second whorl within the installation, when it is obvious that one whorl would be sufficient to secure the installation.

EXCESS MATERIALS
Upon completion of netting projects where it is determined that no further installation of netting will occur within 72 hours, all excess netting material shall be returned by the Contractor to the Crescent Ranger District Office.
CRE Netting C-7 TREE DAMAGE
Care shall be taken to prevent damage to trees when installing/maintaining netting. A tree with a broken or bent-over terminal leader or one with lateral branches which are broken or bent downward, due to the removal of rigid tubing or the current installation or maintenance of netting, is not acceptable and will be deducted from creditable trees as unsatisfactory on the inspection summary.
CRE Netting C-8 CREW ORGANIZATION
a) One nonworking supervisor shall be provided for each crew of 5-20 workers. In no instance shall one supervisor have more than 20 workers under his supervision. Unless authorized in writing by the COR, crews shall not be smaller than five workers. Detaching or splitting one or more persons from the crew will not be permitted.
b) Working supervisors for crews installing flexible netting will not be permitted. Crews shall work in a treatment unit as a single work force. Crew members shall not be separated or scattered in different parts of the same treatment unit or in between units except as necessitated by on-the-ground conditions and only when approved by the COR.
CRE Netting C-9 GOVERNMENT – FURNISHED PROPERTY The Contractor shall be liable for any loss or damage of delivered Government – furnished property until completion and final acceptance of work required under this contract. The Government will provide the following materials:
a) Unit maps
b) Netting Material
c) Flagging for plots
d) Plot cards
CRE Netting C-10 CONTRACTOR OBLIGATIONS
a) The Contractor shall provide the expertise, personnel, equipment, vehicles, appropriate permits and licenses, and incidentals necessary to perform Netting Application services.
b) The Contractor shall comply with all applicable Federal, State of Oregon, and OSHA safety and fire regulations.
c) The Contactor shall designate an English speaking foreman, to be on the site at all times while work is being performed. This foreman shall be a designed representative qualified to represent the Contract in respect to Quality Assurance requirements and directing crews in the compliance with contract specifications.
d) The following list of equipment and supplies shall be furnished by the Contractor. This list includes but is not limited to:
1) Netting measuring device
2) Other supplies and equipment necessary to assure contract compliance.

SECTION 200 – INSPECTION AND ACCEPTANCE
CRE Netting E-1 CONTRACTOR INSPECTION PROCEEDURE
a) The Contractor shall inspect all units for compliance with specifications.
b) Each work unit, as designated on the maps and described on the Detailed Unit Information Sheets shall be inspected as a separate unit and will not be averaged with any other unit for acceptance or payment.
c) Install a series of circular, 1/50th acre (16ft 6” radius) plots. Plots shall be located throughout the unit to obtain a representative sample of the work to yield.

d) Locate and flag plot center. Flagging shall be marked width plot number, date and inspector’s initials. Flagging shall be a minimum of 1 inch in width and 20 inches in length.
e) At each plot, the contractor shall examine the plot area and record the following findings on the inspection sheet:
1) NUMBER OF TREES – Record the total number of live trees requiring treatment.
2) SATISFACTORY TREES – Record the number of trees that meet all applicable work.
3) UNSATSFACTORY TREES AND SPECIFICATIONS – Record the number of trees that fail to meet anyone of the work specifications. The reason for the unsatisfactory rating, listed by specification number, shall also be recorded.
4) Work quality for each work area will be calculated as follows:

Note: Percentage rate will be rounded to the nearest whole percent.
Final Treatment Unit work quality will be calculated by averaging the plots.
Example: 100+100+86+100+100+100 = 586/6 = 97.66 = 98% work quality
f) Contractor shall submit an inspection sheet for each unit to the COR, certifying that the unit is satisfactorily completed and ready for government inspection. The Government shall not proceed with its inspection of a unit until the inspection form or plot card has been submitted by the contractor.
CRE Netting E-2 UNSATISFACTORY TREATMENT FLEX NET INSTALLATION
a) If the percentage of satisfactory treatment falls below 90 percent, the COR will immediately notify the Contractor in writing and order him to rework the unit.
b) If work falls between 90 and 95 percent, the Government Inspector will notify the Contractor. The Contractor may, at his discretion, rework the unit to raise the level above 95 percent and get full payment.
c) Contractor shall rework unsatisfactory acres at his own expense, and shall be limited to one rework opportunity.
d) If the final inspection results are at least 90 percent but below 95 percent, the work will be accepted but only adt a reduced rate. Reference Section 408.0
e) Work quality, after one rework below90 percent, has no value to the Government and shall receive no pay.
f) Failure to rework the unsatisfactory areas and bring them up to or above the 90 percent minimum acceptance standard, after notice in writing of unsatisfactory treatment, could be cause to terminate Contractors right to proceed and the contract may be considered in default.
CRE Netting E-3 RE-EXAMINATION UPON CONTRACTOR’S DEMAND If the original examination results are unacceptable to the Contractor and a second examination is demanded in writing, the same inspection procedure will be used. However, the inspection grid will be shifted so the new inspection plots will not overlap previously inspected plots. The results of the second examination when greater than 90 percent shall be used as a basis for calculating payment.
CRE Netting E-4 INSPECTION AND ACCEPTANCE FLEX NET INSTALLATION
a) Standards for acceptable performance are stated in the specifications. Reference Section 100 of this contract.
b) Inspections will be made periodically as work progresses, or as work is completed, to determine acceptability of method and manner of performance, and to make measurements for payment.

SECTION 400 – CONTRACT ADMINISTRATION DATA
CRE Netting H-1 METHOD OF MEASUREMENT
a) All linear and area measurements required under this contract will be measured on the horizontal plane.
b) Remeasurement
1) Remeasurement of the acreage under this contract will be made upon written request of the Contractor. Request for remeasurement must be made in writing within
5 days after work has been completed.
2) If remeasurement indicates a difference of not more than 5 percent from the original measurement, the Contractor shall bear the actual costs of the remasurement.
Payments will be based on the second measurement. No adjustment will be made for a difference of one acre or less.
CRE Netting H-2 BASIS OF PAYMENT Payment will be made for all completed acres at the unit bid price whenever the quality of work is 95 percent or above, based on inspection results. Whenever inspection results indicate quality to be less than 95 percent but at least 9;;0 percent after one rework, a five percent reduction in pay will be made from the Contractor’s pay for each one percent quality is below 95 percent.

CRE Netting H-3 PRE WORK CONFERENCE
Prior to commencement of work, the Contractor shall meet with the Contracting Officer and or Contraction Officers Representative to dis cuss contract terms and work performance requirements, work progress, schedule, and fire prevention and suppression plans. The meeting will be held at the Forest Service District or Supervisor’s Office where work will be performed unless otherwise agreed.
CRE Netting H-4 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE
The Contracting Officer designates the Contracting Officer’s Representative (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract. The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly (This does not apply to individual task assignments which were issued the COR provided they do not affect the delivery schedule or performance period stated in the contract). On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
CRE Netting H-5 PUBLIC OFFICIALS NOT PERSONALLY LIABLE
There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them, by or with the scope of the contract, it being understood that in all such matters they act solely as agents and representative of the Government.
CRE Netting H-6 NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement. The notification shall include as a minimum:
a) The name, address and telephone number of the subcontractor
b) The date upon which the subcontract was entered into and its duration.
c) A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
d) Documentation of the subcontractor’s representative authority.
CRE Netting H-7 CONTRACTOR’S REPRESENTATIVE
Before work starts, preferably at the prework conference, the Contractor shall designate in writing the person or persons who will represent and act for the contractor in the Contractor’s absence form the job. In the designation, the Contractor shall describe the areas of responsibility assigned to the representative(s).
CRE Netting H-8 CONTRACTOR OR REPRESENTATIVE ON THE JOB
The Contractor or authorized representative shall be on the project area where work is in progress. In the absence of the Contractor, the Contractor’s authorized representative shall receive orders and instructions from the COR and take such action as is required to keep the job in progress under the terms of the contract.
