Desert View Overlook Rehabilitation Project

PART IV - REPRESENTATIONS AND INSTRUCTIONS

SECTION M - EVALUATION FACTORS FOR AWARD

M- 1 Evaluation Criteria

(a) In the evaluation of proposals, all evaluation factors other than cost or price (listed in this provision), when combined, are approximately equal in importance to price. The relative importance to be placed on the factors in relation to each other is contained in paragraph (e) of this provision. However, the degree of importance or cost or price may increase with the degree of non-cost or non-price equality between the proposals. If a proposal is determined by the Contracting

Officer to be “technically unacceptable” as a result of evaluating all factors other than cost or price, the proposal may be rejected from further consideration. The Contracting Officer reserves the right to make award to other than the technically-acceptable offeror with the lowest cost/price proposal if it is determined that the technical benefits of another offeror’s proposal justify its higher cost/price, lower-scored offeror if it is determined that the cost/price premium involved in awarding to a higher-rated, higher-cost/price offeror is not justified. Since technical proposals are being solicited to obtain information to be used in the evaluation, the Government reserves the right to use information outside of the proposal to evaluate the capability of offerors and the value of offers.

(b) Pursuant to FAR 15.305, a cost or price evaluation may be performed to determine the reasonableness of costs or prices proposed and the offeror’s understanding of, and ability to perform the prospective contract.

(c) The following factors and significant subfactors (if listed), will be considered in evaluating proposals and making the source selection:

(1) Past Performance and Company Experience – Offerors shall demonstrate satisfactory past performance in performing work similar to the type, magnitude and complexity of the work required under this solicitation/contract particularly in the construction and performance of:

concrete work, excavation work, trail construction, drainage structure construction, retaining wall construction and paving.

(2) Technical Approach and Understanding of the Project– Offerors shall demonstrate a complete and thorough understanding of all features of work required under this solicitation/contract and shall demonstrate the requisite comprehensive and detailed knowledge to successfully construct such features.

(3) Key Personnel and Oversight of the Project - Offerors shall demonstrate the satisfactory availability, capability, knowledge and expertise in its proposed key personnel.

(4) Safety Record and Safety Plan – Offerors shall demonstrate their ability to perform the work under this solicitation/contract in a safe manner and in compliance with Forest Service

Safety and Health Standards.

(d) Price Proposal. This criterion will include consideration of cost information provided to support item prices entered in Section B, Schedule of Items. It is the Government's intent to assess the price/cost breakdown to determine (1) reasonableness, and (2) offeror's understanding of the work.

AMENDMENT 001 AG-0261-S-12-0004

Desert View Overlook Rehabilitation Project

(e) The relative importance of the technical factors listed in paragraph (c) are in descending order of importance. The evaluation factors other price, when combined, are approximately equal in importance to price.

M- 2 Award Statement

Award will be made to the responsible offeror submitting a proposal, which conforms to the solicitation and is most advantageous to the Government considering the factors and any significant subfactors listed in this provision.

Technical proposals will be evaluated and ranked by an evaluation panel according to the criteria in

Section M- 1 (a). The panel will not have access to the price proposal during the technical evaluation process. See Section L- 3 for information required for the price and technical proposals.

The Government intends to evaluate proposals and award a contract without discussions with offerors

(except clarification as described in FAR 15.306(a)). Proposals should be submitted initially on the most favorable terms, from a price and technical standpoint, which the offeror can submit to the Government.

However, the Government may, after evaluation of proposals, conduct further oral or written discussions as appropriate, with all offerors whose proposals are within a competitive range.

M- 3 FAR 52.217-4 Evaluation of Options Exercised at Time of Contract Award (JUNE 1988)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate the total price for the basic requirement together with any option(s) exercised at the time of award.
