About this file

This is a federal contract clause template titled "Utilization of Indian Organizations, Indian-Owned Economic Enterprises, and Native Hawaiian Small Business Concerns" (252.226-7001, January 2023).

The clause establishes definitions and requirements for contractor utilization of Indian organizations, Indian-owned economic enterprises, and Native Hawaiian small business concerns in subcontracting. Key definitions include: Indians (members of federally-recognized tribes or Alaska Natives), Indian tribes (federally-recognized entities including Alaska Native villages and corporations), Indian organizations (governing bodies of Indian tribes), Indian-owned economic enterprises (for-profit businesses with at least 51 percent Indian ownership as determined by the Secretary of the Interior), and Native Hawaiian small business concerns (small businesses as defined in the Small Business Act, owned and controlled by Native Hawaiians). Contractors must use best efforts to provide these entities maximum practicable opportunity to participate in subcontracts consistent with efficient contract performance. The clause permits good-faith reliance on self-representations of eligibility unless challenged by an interested party or the Contracting Officer has independent reason to question status. Challenges to subcontractor eligibility are referred to either the Bureau of Indian Affairs (for Indian organizations and Indian-owned enterprises) or the Department of Hawaiian Home Lands (for Native Hawaiian concerns) for determination. Contractors may request incentive payments of 5 percent of the estimated, target, or fixed price of subcontracts awarded to qualifying entities, provided the contractor has burden of proof and asserts claims prior to contract completion. Incentive payments are not authorized while challenges are pending or if a subcontractor is deemed ineligible. The clause must be inserted in all subcontracts exceeding $500,000, and if a contractor receives an incentive payment on behalf of a subcontractor, it must pass the full incentive amount to the subcontractor.
