About this file

This document is an Addendum (#11) and Annual Drinking Water Quality Report for the Taconic Developmental Center, involving New York State's Empire State Development (ESD), the New York State Office for People with Developmental Disabilities (OPWDD), and the Dutchess County Department of Health. The addendum addresses a Request for Proposals (RFP) for the purchase and development of the Taconic Developmental Center, a 330-acre property located in Wassaic, New York. The RFP seeks a developer to transform the former developmental disabilities facility into a mixed-use, transit-oriented community near the Tenmile River Metro-North station. The Phase 1 Plan requires developing up to 250 residential units, with a minimum of 20% as rental housing and 10% designated as affordable housing. The site visit is scheduled for March 18, 2025, with proposals due by June 20, 2025, at 2:00 PM EST.

The project includes specific set-aside and participation goals for minority-owned (15%), women-owned (15%), and service-disabled veteran-owned (6%) businesses. Developers must submit a Cost Agreement Check for $300,000 to cover ESD's project expenses. The property will be conveyed "AS IS," with developers responsible for all environmental remediation and compliance requirements. The site contains 52 existing buildings totaling 732,328 square feet and includes complex environmental considerations such as historical petroleum storage, potential asbestos-containing materials, and wetland areas. The project will be partially funded through the state's $500 million Redevelopment of Underutilized Sites for Housing (RUSH) initiative. The attached annual drinking water quality report provides detailed information about the site's water system, including well reports, water quality analysis, and compliance with state and federal regulations.

Annual Drinking Water Quality Report for 2024

Wassaic TDDSO Water System

26 Center Circle, Wassaic, NY 12592

(Public Water Supply ID# 1310291)

INTRODUCTION

To comply with State regulations, Wassaic TDDSO Water issues this annual report describing the quality of your drinking water. The purpose of this report is to raise your understanding of drinking water and awareness of the need to protect our drinking water sources. Last year, your tap water met all State drinking water health standards.

We are proud to report that our system did not violate a maximum contaminant level or any other water quality standard. This report provides an overview of last year’s water quality. Included are details about where your water comes from, what it contains, and how it compares to State standards.

If you have any questions about this report or concerning your drinking water, please contact VRI Environmental Services at (845) 677-3839. We want you to be informed about your drinking water.

WHERE DOES OUR WATER COME FROM?

In general, the sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of the land or through the ground, it dissolves naturally occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activities. Contaminants that may be present in source water include:

microbial contaminants; inorganic contaminants; pesticides and herbicides; organic chemical contaminants; and radioactive contaminants. In order to ensure that tap water is safe to drink, the State and the EPA prescribe regulations which limit the amount of certain contaminants in water provided by public water systems. The State Health Department’s and the FDA’s regulations establish limits for contaminants in bottled water which must provide the same protection for public health.

Our water system serves approximately 165 people through 25 service connections. The water supply consists of four wells located within the Wassaic campus. The source wells are designated #1a, #2a, #5 and #7. The water is pumped from the wells to a clear well, then through a filtration system and is sent to a 275,000-gallon storage tank.

There is also a 1,000,000 gallon finished water storage tank currently not in regular use. The well water is disinfected with sodium hypochlorite prior to entering the distribution system.

Well #7 has been put back into service as per DOH approval on November 14, 2024. A full part 5 was collected on September 19, 2024 and submitted to DOH for approval.

Failure to have a functioning SCADA (Supervisory Control and Data Acquisition) system is a violation of 5-1.71(b) of the NYS Sanitary Code of not operating according to the approved plans from 2007.

ARE THERE CONTAMINANTS IN OUR DRINKING WATER?

As the State regulations require, we routinely test your drinking water for numerous contaminants. These contaminants include: total coliform, turbidity, inorganic compounds, nitrate, nitrite, lead and copper, volatile organic compounds, total trihalomethanes, haloacetic acids, synthetic organic compounds, and radiologicals. The table presented below depicts which compounds were detected in your drinking water. The State allows us to test for some contaminants less than once per year because the concentrations of these contaminants do not change frequently. Some of our data, though representative, are more than one year old.

It should be noted that all drinking water, including bottled drinking water, may be reasonably expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the EPA’s Safe Drinking Water Hotline (800-426-4791) or the Dutchess County Health Department at (845) 486- 3404.

WHAT DOES THIS INFORMATION MEAN?

As you can see by the table, our system had no violations. We have learned through our testing that some contaminants have been detected; however, these contaminants were detected below the level allowed by the State. We are required to present the following information on lead in drinking water.

Lead can cause serious health effects in people of all ages, especially pregnant people, infants (both formula-fed and breastfed), and young children. Lead in drinking water is primarily from materials and parts used in service lines and in home plumbing. Wassaic TDDSO Water is responsible for providing high quality drinking water and removing lead pipes but cannot control the variety of materials used in the plumbing in your home. Because lead levels may vary over time, lead exposure is possible even when your tap sampling results do not detect lead at one point in time. You can help protect yourself and your family by identifying and removing lead materials within your home plumbing and taking steps to reduce your family's risk. Using a filter, certified by an American National Standards Institute accredited certifier to reduce lead, is effective in reducing lead exposures. Follow the instructions provided with the filter to ensure the filter is used properly. Use only cold water for drinking, cooking, and making baby formula. Boiling water does not remove lead from water. Before using tap water for drinking, cooking, or making baby formula, flush your pipes for several minutes. You can do this by running your tap, taking a shower, doing laundry or a load of dishes. If you have a lead service line or galvanized requiring replacement service line, you may need to flush your pipes for a longer period. If you are concerned about lead in your water and wish to have your water tested, contact VRI Environmental Services for Wassaic TDDSO Water. Information on lead in drinking water, testing methods, and steps you can take to minimize exposure is available at https://www.epa.gov/safewater/lead.

IS OUR WATER SYSTEM MEETING OTHER RULES THAT GOVERN OPERATIONS?

During 2024, our system was in compliance with applicable State drinking water operating, monitoring and reporting requirements.

INFORMATION ON LEAD SERVICE LINE INVENTORY

A Lead Service Line (LSL) is defined as any portion of pipe that is made of lead which connects the water main to the building inlet. An LSL may be owned by the water system, owned by the property owner, or both. The inventory includes both potable and non-potable SLs within a system. In accordance with the federal Lead and Copper Rule Revisions (LCRR) our system has prepared a preliminary lead service line inventory and have made it publicly accessible by visiting https://www.health.ny.gov/environmental/water/drinking/service_line/NY1310291.htm https://www.epa.gov/safewater/lead https://www.health.ny.gov/environmental/water/drinking/service_line/NY1310291.htm

DO I NEED TO TAKE SPECIAL PRECAUTIONS?

Although our drinking water met or exceeded state and federal regulations, some people may be more vulnerable to disease causing microorganisms or pathogens in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice from their health care provider about their drinking water. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium, Giardia and other microbial pathogens are available from the Safe Drinking Water Hotline (800-426-4791).

WHY SAVE WATER AND HOW TO AVOID WASTING IT?

Although our system has an adequate amount of water to meet present and future demands, there are a number of reasons why it is important to conserve water:

Saving water saves energy and some of the costs associated with both of these necessities of life;

Saving water reduces the cost of energy required to pump water and the need to construct costly new wells, pumping systems and water towers; and Saving water lessens the strain on the water system during a dry spell or drought, helping to avoid severe water use restrictions so that essential fire fighting needs are met.

You can play a role in conserving water by becoming conscious of the amount of water your household is using, and by looking for ways to use less whenever you can. It is not hard to conserve water. Conservation tips include:

Automatic dishwashers use 15 gallons for every cycle, regardless of how many dishes are loaded. So get a run for your money and load it to capacity.

Turn off the tap when brushing your teeth.

Check every faucet in your home for leaks. Just a slow drip can waste 15 to 20 gallons a day. Fix it up and you can save almost 6,000 gallons per year.

Check your toilets for leaks by putting a few drops of food coloring in the tank, watch for a few minutes to see if the color shows up in the bowl. It is not uncommon to lose up to 100 gallons a day from one of these otherwise invisible toilet leaks. Fix it and you save more than 30,000 gallons a year.

CLOSING

Thank you for allowing us to continue to provide your family with quality drinking water this year. In order to maintain a safe and dependable water supply we sometimes need to make improvements that will benefit all of our customers. The costs of these improvements may be reflected in the rate structure. Rate adjustments may be necessary in order to address these improvements. We ask that all our customers help us protect our water sources, which are the heart of our community. Please call our office if you have any questions.

1.0 INTRODUCTION

This annual summary report documents post-closure activity conducted for the 2024 calendar year at the closed

Construction and Demolition (C&D) debris landfill located at the New York State Office for People with

Developmental Disabilities (OPWDD) Taconic Developmental Center, 26 Center Circle, Wassaic, New York.

Bergmann performed these activities under authorization from the OPWDD.

The landfill is located approximately 150-feet east of the Ten Mile River, situated within the southwest corner of the 750-acre Taconic DDSO Campus. The landfill consists of an approximately 150-feet by 250-feet solid waste disposal area, adjacent to the south side of a former sand and gravel quarry.

According to information provided to Bergmann, waste disposal activities at the landfill at the Taconic DDSO

Campus occurred in the early 1970’s through the late 1990’s. The majority of the waste disposed of at the landfill included old furniture, mattresses, box springs, construction and demolition debris, and white goods.

Additionally, limited quantities of sludge from oil/water separators, putrescible waste from facility dining, spent containers from janitorial activities, cleaning supplies, and general trash have likely been disposed of at this site.

According to documentation provided to Bergmann, groundwater was sampled and analyzed for baseline parameters in June 2004 prior to closure of the landfill in July 2004. Due to high turbidity and high metal concentrations in the samples collected, the New York State Department of Environmental Conservation

(NYSDEC) requested that supplemental sampling using low-flow techniques be completed. The NYSDEC required that additional groundwater and surface water samples be analyzed for 6 NYCRR Part 360 baseline parameters. Per the documentation received by Bergmann, monitoring events have previously been conducted fifteen (15) times from 2004 until 2021.

According to the documentation, in a January 16, 2009, letter to DASNY and OPWDD, NYSDEC requested that the three monitoring wells located at the site be analyzed annually for baseline parameters to establish a record of groundwater quality at the site. This request was made due to incongruent groundwater data between July

2004 and August 2008. The NYSDEC indicated that following several rounds of groundwater quality data, DASNY may petition to reduce or eliminate the annual groundwater monitoring program, with samples being collected 2009, 2010, and 2011.

A Data Gap Investigation Work Plan was submitted to NYSDEC and was approved in November 2012. Work was carried out at the site in February and March 2013, and was followed by a Data Gap Investigation Report submitted to the NYSDEC in April 2013. NYSDEC rejected the recommendations made in this report, and an agreement was reached which included six (6) quarterly rounds of groundwater sampling and disposal area cap repairs. The six sampling events were completed in April, July, and October of 2015 and January, June, and

October of 2016. Samples were collected, water levels were gauged, and groundwater flow direction was determined through this sampling. One additional round of sampling was conducted in 2018.

On August 27, 2020, a Variance Request was submitted to the NYSDEC on behalf of the Dormitory Authority of the State of New York (DASNY) to reduce the sampling frequency to one (1) annual sampling event to be performed in the same quarter each year. The NYSDEC agreed to this sampling reduction as per a letter dated

September 14, 2020. DASNY’s sampling reduction request and the NYSDEC response letter are included in

Appendix 4.

During 2024, the annual routine sampling event was conducted on December 5, 2024.

During 2024, laboratory analysis was performed for Part 360 Routine Parameters. Results were compared to

NYSDEC Class GA Standards. None of the analytical results for the December 5, 2024, sampling event were found to be at or above their applicable standard.

1.1 POST-CLOSURE MONITORING AND MAINTENANCE PROGRAM

There are three (3) groundwater monitoring wells associated with the landfill located beyond the extent of the former waste disposal area that are maintained and monitored during the post-closure period. The wells are identified as MW-01, MW-02, and MW-03, and are shown on Figure 1 – Monitoring Point Location Map. The monitoring wells consist of two-inch diameter PVC installed into the underlying stream sediment soils.

Monitoring wells MW-1, MW-2, and MW-3 are sampled for post-closure monitoring purposes. Monitoring Wells

MW-1 and MW-3 wells were inspected and sampled during the 2024 sampling event, and MW-2 was dry during the December 2024 sampling event.

Monitoring well MW-3 has been designated as the up-gradient monitoring point. Groundwater values at this point are indicative of local groundwater quality not impacted by the landfill. Monitoring well MW-2 is located cross-gradient from the landfill, while monitoring well MW-1 is located at a down-gradient location at the toe of the landfill cap.

2.0 2022 ANNUAL BASELINE SAMPLING EVENT

During 2024, the annual site inspections and groundwater sampling event was conducted on December 5, 2024 and consisted of Part 360 Routine Parameters.

2.1 WATER LEVEL GAUGING

Monitoring wells MW-01, MW-02, and MW-03 were gauged for water level elevations prior to sampling to assess groundwater elevation and evaluate groundwater flow at the site. Groundwater elevations at the site ranged from 7.50 feet (ft) below top of casing (btoc) at MW-01 to dry at MW-02. Depths to groundwater for the

December 5, 2024, monitoring event are provided in Table 1 – Summary of Well Details and Historic Depth to

Groundwater.

Historic depths to water measurements from 2011, 2018, 2020, and 2021 derived from documentation provided to Bergmann, are also provided in Table 1. Data provided to Bergmann appears to indicate that seasonal variation is the reason for changes in depth between 2011 and 2024.

2.2 GROUNDWATER SAMPLING

Monitoring wells MW-01, and MW-03 were sampled on December 5, 2024. Monitoring well MW-02 did not have a measurable water column present at the time of the sampling. The monitoring wells were purged using a peristaltic pump and dedicated tubing. Water quality indicator parameters were measured prior to sampling using a YSI Professional Plus Multiparameter Instrument which was calibrated in accordance with manufacturers specifications prior to use. Parameters measured included: turbidity, temperature, pH, conductivity, and oxygen.

Data from these measurements are provided in Appendix 3 – Field Forms.

The Taconic Developmental Center Landfill is no longer subject to NYSDEC Part 360 Baseline Parameters

Analysis, per NYSDEC’s direction in a letter dated September 14, 2020. Routine Parameters are carried out during the annual sampling event.

Laboratory analytical results for Part 360 Routine Parameters are summarized in Tables 2, 3, and 4, and the laboratory analytical report is included with this report in Appendix 2 – Laboratory Analytical Results. The criteria for NYSDEC Class GA groundwater standards are listed for those parameters for which Class GA standards have been established. No analytical results were determined to be at or above the NYSDEC Class GA parameters for the December 12, 2024, sampling event.

An equipment blank consisting of distilled water was submitted for laboratory analyses during this sampling event. The groundwater samples were submitted to ALS in Rochester, New York for laboratory analyses.

3.0 LEACHATE OCCURRENCE

During the 2024 annual site visit and inspection, visual evidence of leachate breakout was not observed at the landfill site.

To help identify potential occurrences of leachate, assist in the long-term tracking of groundwater quality and to help determine if a significant increase has occurred, key groundwater quality parameters were plotted on tracking charts. These charts include selected groundwater analytical results obtained from monitoring wells

MW-01, MW-02 and MW-03.

Parameters tracked on the charts include:

• Chart C-1, Aluminum.

• Chart C-2, Iron.

• Chart C-3, Sodium.

• Chart C-4, Thallium.

• Chart C-5, Ammonia.

• Chart C-6, Phenols.

• Chart C-7, Magnesium

• Chart C-8, Manganese

The tracking charts present analytical data for 18 sampling events, between June 2004 and December 2024.

Analytical results from well MW-03 are indicative of up-gradient groundwater conditions, and results from monitoring well MW-01 are indicative of down-gradient conditions.

The charts indicate that a significant increase in the tracked parameters has not occurred as of December 2024.

A general trend indicative of increasing values over time, between November 2002 and December 2024 was not apparent, as presented on the control charts. Control charts are included in Appendix 2 – Leachate Tracking

Charts.
