About this file

This is Addendum No. 5 to IFB No. 04A4828 issued by the California Department of Transportation (Caltrans) on March 9, 2016, for the repair or replacement of storm water pumps and other related equipment. The addendum provides clarification on four key questions related to bidding requirements and labor classifications for work to be performed in Contra Costa and Alameda counties.

The addendum specifies that bidders must provide a bid bond of no less than 10% of their total bid amount. Contractors awarded the work will be responsible for payment bonds on task orders over $25,000. Labor classifications are specifically defined by county: Pump Repairman is approved for Contra Costa County work, while Plumber classification is required for Alameda County work. Operating Engineers may be used for Boom Truck Operators, and Laborers may assist Plumbers but cannot perform the specified work independently. Regarding apprenticeship requirements, contractors may file for exemption with DAS if they do not require apprentices, though Caltrans cannot grant such exemptions directly.

ADDENDUM NO.5

IFB No. 04A4828

Repair or Replace Storm Water Pumps and Other Related Equipment

Your attention is directed to the following question and answer, to the above-noted Invitation for Bid (IFB).

QUESTION AND ANSWER:

Q1- BIDERS BOND: Is it correct that a bond needs to be issued and paid for by the bidder to bid the job? If so is this based on the Bid Budget of $435,000 (Addendum #1) or of the actual bid price we are quoting?

A1- Yes, a Bidders Bond is required from the Bidder to bid. The bidder’s bid bond shall be no less than ten percent (10%) of bidder’s total bid. Reference IFB Solicitation Section C) (Bid Requirements and Information), Item 12 (Bonds) page 4 of 11

Q2- PAYMENT BOND: If the bid is awarded, is the contractor or Cal Trans responsible for the fee to issue a payment bond for each task over $25,000 (Exhibit D).

A2 Yes, contractor is responsible for payment bond for each task order over $25K. Reference Proposed form of Agreement (Attachment 10), Exhibit D (Special Terms and Conditions), Item 11 (Bonds).

Q3- PREVAILING WAGES: Per previous jobs completed with Cal Trans, in Contra Costa County we are OK to use Water Well Driller Pump Repairman per the scope (no apprentice required), but not in Alameda County due to the scope on the DIR website and was advised we had to use Plumbers by the Office of Labor Compliance on a previous job, we have used Laborers Group 3 and Operating Engineer for other jobs, will this be acceptable for this job?

A3- Answer from Labor Compliance Office

• Pump Repairman – approved for work in Contra Costa County

• Plumber – correct classification for work in Alameda County

• Operating Engineer may be used for the Boom Truck Operators.

• Laborers may tend to a Plumber, but the work identified in this contract’s Scope of Work is not covered under the laborer classification work and as such a laborer cannot perform the work alone.

THE AWARDED CONTRACTOR SHOULD USE CLASSIFICATIONS AS ACCORDINGLY TO THE

TYPE OF WORK THEY WILL BE PERFORMING BASED ON THE SCOPE OF WORK PROVIDED

IN THIS IFB AND THE SCOPE OF WORK DESCRIBED IN THE CLASSIFICATIONS LISTED ON

DIR’S WEBSITE.

Q4 - APPRENTICE REQUIREMENTS: We normally have one Journeyman on the job and one Boom Truck Operator, so we really do not have the need for an apprentice, please advise if this is a problem or what the procedures are.

A4- Answer from Labor Compliance Office. If a classification is considered an apprenticable craft by DIR, Labor Code 1777.5 applies. The contractor may file an exemption directly with DAS to be exempt from the use of apprentices on a public works projects. However; Caltrans does not have the authority to grant exemption, we only monitor and enforce the requirement.

IF THE CLASSFICICATION USED DOES NOT HAVE A NEED TO MEET THE APPRENTICESHIP

REQUIREMENT, THEN NO APPRENTICE RATIO IS REQUIRED

All other terms and conditions set forth in the Request for Proposal shall remain in full force and effect.
