About this file

This is an Evaluation Clause (FAR 52.212-2) for a commercial items solicitation for Utility Terrain Vehicles (UTVs) and related services to be delivered to Base Aeronaval (Fort Sherman) in Colon, Panama.

The Government will award a single contract to the responsible offeror with the lowest evaluated price and an acceptable technical rating, using a Lowest Price Technically Acceptable (LPTA) selection process. The requirement includes procurement of six UTVs: four standard models with four-person side-by-side seating and two extended-bed models with two-person seating and cargo beds capable of securing six to seven-foot litters. All vehicles must be no more than two years old at delivery, possess off-road capability for rugged terrain, and include all servicing and warranty work completed. Technical evaluation comprises five sub-factors: (1) UTV procurement capability with proper specifications; (2) delivery and pickup logistics including joint inspection with the Contracting Officer Representative (COR); (3) scheduled and unscheduled maintenance with 24/7 emergency support; (4) emergency support for breakdowns, accidents, and urgent maintenance; and (5) commencement of performance no later than July 30, 2026, with failure to meet this date rendering the offer ineligible. Offerors must submit inventory availability, vehicle location, mobilization plan, and delivery timeline. Price evaluation will assess fairness and reasonableness using price analysis, with total evaluated price calculated by summing all Contract Line Item Numbers. The Government reserves the right to conduct clarifications and will reject offers with unbalanced pricing. All offerors must receive acceptable ratings on all technical factors and sub-factors to be eligible for award.

52.212-2 - EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV

2021)

Basis for Award. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered. The following factors shall be used to evaluate quotes:

a) Technical Capability

b) Price

This competitive best value selection will be conducted using the Lowest Price Technically

Acceptable (LPTA) selection process in accordance with Federal Acquisition Regulation (FAR)

FAR part 12, Acquisition of Commercial Items.

Although the technical capability factor is of paramount consideration in the award of the contract, price is also important to the overall contract award decision.

One award will be made to the offeror who is deemed responsible in accordance with FAR Part 9, whose quote conforms to the solicitations requirements and is the lowest evaluated price with an

“Acceptable” rating in the technical capability assessment. Quotes that exceed the evaluation criteria will not receive higher ratings. If an offeror fails to meet all solicitation requirements, the

Government may not make an award to that offeror. The LPTA source selection process does not permit tradeoffs between price and non-price factors.

The Government intends to evaluate quotes and award a contract with clarifications permitted with all offerors. The offeror’s initial quote should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct clarifications if the Contracting

Officer (KO) later determines them to be necessary.

An Offeror must receive a rating of acceptable for each factor and sub-task. Failure to meet the criteria will render the response not eligible for award. The Government will not make an award to any Offeror with an unacceptable rating or a deficiency in ANY factor or sub-task.

(a) Factor 1 – Technical Capability:

The technical plan reflects the degree to which the offeror’s quote meets or does not meet the operational requirements. The government will evaluate the technical plan for each task listed below to ensure it is acceptable. Technical Capability evaluations provide an assessment of the quoter’s capability to satisfy the Government’s minimum requirements.

Sub-Factor 1: Procurement of the Specified Utility Terrain Vehicles (UTV). This sub-factor involves an explanation of the contractor’s ability to procure UTVs with the proper specification.

Specifications include four (4) standard UTVs with side-by-side seating for four personnel. UTVs should not be more than two (2) years old at the time of delivery. Contractor should also provide two (2) extended-bed UTVs with side-by-side seating for two (2) personnel and extended cargo beds capable of securing six (6) to seven (7) foot litter. All UTVs should come with all servicing and warranty work completed and should possess off-road capability suitable for rugged terrain.

Ensure to include ways to meet all tasks outlined in section 5.1 of the PWS.

Sub-Factor 2: Delivery and Pickup of Utility Terrain Vehicles (UTV). This sub-factor involves the contractor explaining their plan for delivering all six (6) UTVs to Base Aeronaval (Fort Sherman) in

Colon, Panama. Details should include coordinating a delivery scheduled with the Contracting

Officer Representative (COR), conducting a joint inspection and inventory with the COR at the time of delivery to validate condition, safety equipment, and documentation, and pick-up of vehicles for routine maintenance, exchanges, and final contract completion. Ensure you include ways to meet all tasks outlined in section 5.2 of the PWS.

Sub-Factor 3: Maintenance of the Utility Terrain Vehicles (UTV). This sub-factor involves the contractor explaining how they will conduct scheduled and unscheduled maintenance for the

UTVs. Contractor should describe how they will engage with the COR in the specified period for notification of maintenance support and explain how they will provide required consumables and spare parts to support uninterrupted UTV operations. Ensure to include ways to meet all tasks outlined in section 5.3 of the PWS.

Sub-Factor 4: Emergency Support. This sub-factor involves the contractor explaining how to provide 24/7 emergency contract support for breakdowns, accidents, or urgent maintenance requirements. This involves coordination of recovery or replacement actions with the COR and addressing any unforeseen conditions to avoid downtime.

Sub-Factor 5: Commencement of Performance. The Offeror shall demonstrate its ability to provide all required UTVs and commence performance no later than 30 July 2026. Failure to demonstrate the ability to meet the required start date will render the offer technically unacceptable and ineligible for award.

Offerors are required to submit:

Inventory available for performance

Vehicle location

Mobilization plan

Delivery timeline

Rating Description

Acceptable Technical Plan clearly meets the minimum requirements of the solicitation

Rating Description

Unacceptable Technical Plan does not clearly meets the minimum requirements of the solicitation

(b) Factor 2 – Price:

Price will be evaluated using the price analysis process to ensure the Government receives a fair, reasonable and balanced price. If the Government cannot determine the proposed pricing to be fair and reasonable, then “Other Than Certified Cost and Pricing Data” will be obtained from the offeror. The Government will evaluate offers for award purposes by adding the total price for all

Contract Line Item Numbers (CLINS). In addition to the price analysis, price quotations will be analyzed to identify any potential unbalanced pricing. If the Government sees a wide variation in proposed contract line item prices, the Contracting Officer will engage with the vendor as soon as possible during the initial evaluation of quotes so the appropriate personnel may seek clarity through offeror clarifications. Absent any issues related to the stated requirement, unbalanced pricing may pose an unacceptable risk to the Government and may be a reason to reject an offeror’s quote.

There is an expectation of competition for this requirement. Offerors are cautioned to present their best price quote. The offeror’s price quote shall represent the offeror’s best effort to respond to the requirement.

The Government will evaluate quotes for award purposes by adding the price for all CLINs to calculate the Total Evaluated Price.
