ADDENDUM TO CLAUSE 52.212-2 Evaluations

The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement. The Government will award a single contract to the offeror whose proposal is technically acceptable, the lowest price, is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), Part 12 Acquisition of Commercial Items, in conjunction with FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items, and FAR 19, Small Business Program, as supplemented, by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS), and whose offer conforms to the solicitation's requirements (to include all stated terms, conditions, and all other information required by the solicitation).

Offers that fail to address all the requirements set forth in the Solicitation will be rejected. The Government intends to evaluate proposals and award a contract without discussions. Therefore, the Offeror's submission should contain their best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to reject an offer upon initial submission and not consider it for contract award if any required data is absent or the data received conveys a misunderstanding of the requirement.

BASIS FOR AWARD:

The Government will award one (1) Firm Fixed Priced (FFP) contract to the Lowest Price Technically Acceptable (LPTA) Offer. The Government will evaluate the contractor's Technical Capability, Pricing Schedule (SF 1449), CLIN Totals Unit Total & Max Amount (Item No 0001- 4002), and Past Performance to ensure that it reflects a sound understanding of this requirement and complies with the requirements in the solicitation. An evaluation will be made to verify that the offeror is capable of providing the required services at a fair market price. The Government will award one (1) Firm Fixed Priced (FFP) to the lowest priced technically acceptable (LPTA) offeror. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement.

The following factors shall be used to evaluate offers:

EVALUATION CRITERIA. Evaluation criteria consist of factors and elements. The proposal will be evaluated under three evaluation factors: Technical, Price and Past Performance.

Factor 1: Technical

Factor 2: Price

Factor 3: Past Performance

Factor 1 -Technical

a. The Technical factor evaluation provides an assessment of the offeror's capability to satisfy the Government's minimum requirements. The Government will evaluate the contractor's technical proposal to ensure that it reflects a sound understanding of this requirement.

b. A narrative fully describing their approach that will be used to effectively accomplish the scope of work outlined in PWS. The narrative should state and satisfy the following requirements:

▪ The ability to control pests to the standards specified in the PWS 95% of the time

▪ The ability to control termites to the standards specified in PWS 100% of the time

▪ The ability to perform all pest control operations IAW specifications in Fort Jackson IPMP

▪ The ability to submit all documents required by the PWS

▪ The ability to submit reports timely and accurate 95% of the time

▪ The ability to provide personnel who are certified in the appropriate categories

c. The Offeror fully described how they will develop and maintain an effective quality control program.

The Technical Factor will receive one of the adjectival ratings defined below:

ADJECTIVAL RATING DEFINITION

Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 2 - Price.

a. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3(a) will be the primary means of assessing price for commercial items to determine price reasonableness. To be viable for award, an Offeror's price must be determined fair and reasonable. The Offeror's total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of the base period, and all option periods (to include the option to extend services in accordance with FAR 52.217-8.

b. The Offeror total proposed price documents SF 1449, CLIN Totals (0001-4001) for completing required work inclusive of all process associated with this requirement will be evaluated. The Offeror costs (direct and indirect) inclusive of profit, all overhead, cost escalation, labor burden, insurance, adjustments to listed prices, general and administrative expenses, travel, subcontractor fees, and all other costs, including but not limited to compliance with environmental laws, preparation of reports, correspondence and documentation required by law or the contract specifications, tax laws, protection and/or moving of Government property, and engineering services.

c. The Pricing worksheet shall be submitted in Microsoft Excel and shall not be read only or password protected. All formulas, lookup tables, and links should be intact, and no links shall exist to files not included with the submission. Spreadsheets shall not contain hidden worksheets. PDF or flat files will not be considered adequate. The offeror must submit a proposed unit price and amount for each.

d. Contract Line-Item Number (CLINs) listed in the solicitation. Offerors are not required to enter a price for the six-month period.

e. Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLIN's, the base period, first option period, second option period, third option period, fourth option period and ½ of the fourth option period price as an evaluation of potential pricing under FAR Clause 52.217-8.

Offerors are not required to enter a price for the 52.217-8 six-month period.

f. Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-l(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.

g. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

h. A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Factor 3 - Past Performance.

The past performance evaluation will assess the offeror's probability of meeting the solicitation's requirements as indicated by that offeror's record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror's recent past performance and focusing on performance that is relevant to the services being procured under this solicitation.

Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror's proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems.

Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.

Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror's performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.

Unacceptable Based on the offeror's performance record, the

Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Neutral In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. In the context of acceptability/unacceptability, a "neutral" rating shall be considered "acceptable
