About this file
This document is an Addendum to Clause 52.212-2 Evaluations for a Lowest Price Technically Acceptable (LPTA) contract opportunity for emergency spill response services at Fort Jackson, SC. The government will award a single Firm Fixed Price (FFP) Blanket Purchase Agreement (BPA) to the lowest-priced technically acceptable offeror who meets all solicitation requirements. The evaluation will focus on three key factors: Technical Capability, Price, and Past Performance.
The technical requirements mandate a Project Manager with HAZPWOPER and RCRA Certification, 24/7 emergency response capabilities with on-site personnel within 90 minutes, ability to conduct environmental sampling and site cleanup, and provide electronic incident reports within 3 days. Offerors must submit a detailed Microsoft Excel/PDF pricing worksheet breaking down costs for project manager, project foreman, and other personnel. The total evaluated price will include the base period and all option periods. Offerors will be rated as either Acceptable or Unacceptable across the technical, price, and past performance factors, with a neutral past performance rating considered acceptable for firms without relevant performance history.

ADDENDUM TO CLAUSE 52.212-2 Evaluations
The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement. The Government will award a single contract to the o eror whose proposal is technically acceptable, the lowest price, is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), Part 12 Acquisition of Commercial Items, in conjunction with FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items, and FAR 19, Small Business Program, as supplemented, by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS), and whose o er conforms to the solicitation's requirements (to include all stated terms, conditions, and all other information required by the solicitation).
O ers that fail to address all the requirements set forth in the Solicitation will be rejected. The Government intends to evaluate proposals and award a contract without discussions. Therefore, the O eror's submission should contain their best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting O icer to be necessary. The Government reserves the right to reject an o er upon initial submission and not consider it for contract award if any required data is absent or the data received conveys a misunderstanding of the requirement.
BASIS FOR AWARD:
The Government will award one (1) Firm Fixed Priced (FFP) Blanket Purchase Agreement (BPA) to the Lowest Price Technically Acceptable (LPTA) O er. The Government will evaluate the contractor's Technical Capability, BPA Price List, Fully Completed Price Estimate (excel), and Past Performance to ensure that it reflects a sound understanding of this requirement and complies with the requirements in the solicitation. An evaluation will be made to verify that the o eror is capable of providing the required services at a fair market price. The Government will award one (1) Blanket Purchase Agreement (BPA) to the lowest priced technically acceptable (LPTA) o eror. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the o er and award this requirement.
The following factors shall be used to evaluate o ers:

The Technical Factor will receive one of the adjectival ratings defined below:
ADJECTIVAL RATING DEFINITION
Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
Factor 2 - Price.
a. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3(a) will be the primary means of assessing price for commercial items to determine price reasonableness. To be viable for award, an O eror's price must be determined fair and reasonable. The O eror's total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of the base period, and all option periods (to include the option to extend services in accordance with FAR 52.217-8).
b. The O eror total proposed price documents SF 1449, BPA Price List/Price Estimates for completing required work inclusive of all process associated with this requirement will be evaluated.
The O eror costs (direct and indirect) inclusive of profit, all overhead, cost escalation, labor burden, insurance, adjustments to listed prices, general and administrative expenses, travel, subcontractor fees, and all other costs, including but not limited to compliance with environmental laws, preparation of reports, correspondence and documentation required by law or the contract specifications, tax laws, protection and/or moving of Government property, and engineering services.
c. The Pricing worksheet shall be submitted in Microsoft Excel/PDF and shall not be read only or password protected. All formulas, lookup tables, and links should be intact, and no links shall exist to files not included with the submission. Spreadsheets shall not contain hidden worksheets. The o eror must submit a proposed unit price and amount for each item listed on the BPA Price List/Price Estimate. O erors are not required to enter a price for the six-month period.
EXAMPLE BASE YEAR:
QUANTITY UNIT UNIT PRICE AMOUNT
1 Project Manager 24 MONTHS $XXXX $ XXXXXX 2 Project Manager OT 5.75 MONTHS $XXXX $ XXXXXX 3 Project Foreman 24 MONTHS $XXXX $ XXXXXX
(Break out all costs as per above for base year, all options years and include cumulative cost on excel spreadsheet)
e. Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLIN's, the base period, first option period, second option period, third option period, fourth option period and ½ of the fourth option period price as an evaluation of potential pricing under FAR Clause 52.217-8.
O erors are not required to enter a price for the 52.217-8 six-month period.
f. Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-l(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.
g. Options. The Government will evaluate o ers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an o er is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
h. A written notice of award or acceptance of an o er, emailed or otherwise furnished to the successful o eror within the time for acceptance specified in the o er, shall result in a binding contract without further action by either party. Before the o er's specified expiration time, the
Government may accept an o er (or part of an o er), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Factor 3 - Past Performance.
The past performance evaluation will assess the o eror's probability of meeting the solicitation's requirements as indicated by that o eror's record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the o eror's recent past performance and focusing on performance that is relevant to the services being procured under this solicitation.
O erors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the o eror's proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems.
Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.
Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.
Unacceptable Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Neutral In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.
