Q&A Set 1 Summary: Temporary Healthcare Staffing Services RFP 5259947

This is a comprehensive Question and Answer document issued by the California Department of General Services, Procurement Division (DGS-PD) Master Agreements Unit 1 (MAU1) in response to bidder inquiries regarding the Temporary Healthcare Staffing Services (THSS) solicitation (Event ID: 5259947). The RFP seeks proposals to establish multi-year Master Service Agreements (MSAs) for temporary healthcare staffing services supporting state and local agencies across ten regions statewide. The scope encompasses 25 Healthcare Groups consisting of 45 Temporary Healthcare Provider Personnel (THPP) classifications, including physicians, nurses, therapists, and allied health professionals. Proposers must submit fixed hourly rates and overhead rates in the provided Cost Workbook; rate ranges are not acceptable. The contract term is five years with one optional two-year extension option for a maximum cumulative term of seven years. All proposed rates are firm-fixed throughout the MSA term unless a rate adjustment is granted at the sole discretion of the State, which may be requested no more than once annually after the first year of the MSA term and is based on comparable California Human Resources (CalHR) classification salary increases.

Awards will be made by region and healthcare group to all responsive and responsible proposers with rates equal to or below an established baseline rate calculated from submitted proposals. No maximum number of vendors will be awarded per region or group. Subcontracting is not mandatory; however, proposers may qualify for a 5% Small Business (SB) preference by committing to 25% SB subcontracting for each User Agreement, or receive a Disabled Veteran Business Enterprise (DVBE) incentive of 2-3% based on participation levels. This is a new MSA with no historical spend data tied to specific regions or classifications; however, aggregate historical spend for similar services was $274.8 million in FY 2020-21, $1.44 billion in FY 2021-22, and $3.15 billion in FY 2022-23. MSAs are zero-dollar contracts with expenditures determined at the User Agency level based on individual needs. User Agencies will request services via a Request for Offer (RFO) process and must send RFOs to a minimum of three awarded contractors per region and healthcare group. Contractors must acknowledge and respond to service requests within 48 hours and provide services within 10 business days. Proposers must provide all labor, equipment, materials, transportation, and other necessary items at no additional cost to the State, with specific requirements determined at the User Agency Agreement level. Prior to MSA award, successful proposers must furnish proof of insurance, business licenses, and other required documentation within five business days of State notification.

1Attachment 2 - Cost WorkbookAre you able to clarify the hourly overhead rate a bit more? Would the Hourly Pay Rate+ the Hourly Overhead Rate = Our Bill Rate?Yes. Refer to RFP Section 4.1.2.i, "Hourly rates submitted shall be inclusive of labor, personnel, training, and equipment costs necessary to perform services described in this RFP, including travel cost. Refer to, Exhibit A – Scope of Work. Only the rates submitted in the Cost Workbook shall be included in the awarded agreement. No other fees can be charged to User Agencies unless otherwise identified in the RFP."No
2Attachment 2 - Cost WorkbookAre vendors allowed to submit hourly rate ranges, or is a single, fixed rate required for each classification? No, providing hourly rate ranges is not acceptable. A fixed rate is required. No
3Attachment 2 - Cost WorkbookPlease confirm that eligibility for award at the Healthcare Group (Therapy – Physical) level requires all proposed PT classifications (PT I, PT II, PTA) in a region to be ≤ the calculated baseline after DGS’s evaluation method described in §6.2.6.Yes. Refer to RFP Section 6.2.6.4.b, "All proposed rates for each THPP Classification in each region that are equal to or less than the corresponding baseline rate will be accepted and then evaluated at the Healthcare Group level."No
4Attachment 2 - Cost WorkbookFor Attachment 2, the Hourly Overhead Rate section asks us to complete an overhead rate. Could you please clarify what this refers to? We do not charge an overhead rate, so would it be appropriate to enter $0 in those fields?Yes to both questions. Refer to RFP 4.1.2.j., "Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel and operating cost."
Refer to RFP 4.1.2.f., "A $0 entry on the Hourly Overhead Rate will be understood as the Proposer providing that Overhead Rate for that THPP Classification within that region at no charge to the State."No
5Attachment 2 - Cost WorkbookWhy are we getting red highlight as below, even though all are rates are higher than $50.00/ hour?
The Proposer Summary (Legend) tab (image at left) is an example only. This tab will not change based on the information entered in the Cost (In-Person) - All Regions and Cost (Telehealth) - All Regions tabs.No
6Attachment 2 - Cost WorkbookShould overtime be "blended" into the hourly bid rate? No. Refer to Attachment 2 - Cost Workbook, Instructions Tab Rate Details, "Hourly rates and overhead rates must not include overtime costs."No
7Attachment 2 - Cost WorkbookDo you have any rounding requirements?Yes. Refer to RFP Section 4.1.2.3.g, "Rates must be rounded to the nearest whole cent (e.g. $19.88)."No
8Attachment 2 - Cost WorkbookFor a Healthcare Group with more than one (1) THPP Classifications: If all of the Proposer’s Cumulative Hourly Rates are less than or equal to the corresponding baseline rate, the Proposer will be eligible to receive an award for that Healthcare Group in that region. If one or more of the Proposer’s Cumulative Hourly Rates are greater than the corresponding baseline rate, the Proposer will not be eligible to receive an award for that Healthcare Group in that region.
For THSS Category 8: Our cumulative proposed houly rate for a CNA must be lower than or equal to the minimum hourly rate of $23 - please clarify.Refer to Attachment 2 - Cost Workbook. The proposed hourly rate for each THPP Classification must be greater than or equal to the Minimum Hourly Rate. For Region 8, the Certified Nursing Assistant (CNA) Miminum Hourly Rate is $23, as shown in the Attachment 2 - Cost Workbook. Therefore, the proposed hourly rate must be greater than or equal to $23 for a CNA.No
9Attachment 2 - Cost Workbooka) Is there a recommended maximum bid rate for each THPP classification?

b) Are there any maximum bill rate caps per classification or region? a) There is no recommended maximum bid rate for each THPP classification.

b) If awarded a MSA, the rates listed in Exhibit B.1 - Rate Sheet for each THPP classification will be the maximum rate that can be charged to a User Agency. No
10Attachment 2 - Cost Workbooka) For the optional two-year extension, can proposers include a proposed escalation rate, or must rates remain unchanged?

b) Will rates proposed in the cost workbook be locked in for the entire contract term, or will there be opportunities for renegotiation based on market changes or facility-specific requests? a) Refer to Addendum 3 Attachment 6, Exhibit B, Section 4.A - "All THPP Classification rates shall be firm fixed for the MSA term, including any optional year extensions, unless a rate adjustment is granted for the THPP Hourly Rates."

The determination of rate adjustments shall be at the sole discretion of the State, and rate adjustments may be requested no more than once annually in accordance with the following guidelines.

1) Rate adjustments shall not be requested or made until one month after the first term of the awarded MSA has ended.

2) Rate adjustments will be based on the rates of the comparable CalHR classification posted on the CalHR Pay Scales / Classification Salary webpage. If the Contractor’s rate(s) fall below the comparable CalHR classification, the maximum rate adjustment allowed will be the minimum salary percentage increase from the previous year.

3) The Contractor is solely responsible for notifying the DGS-PD via email to the DGS Contract Administrator, as specified in the MSA User Instructions, of a rate adjustment request, no earlier than July 1st and no later than July 31st. The Contractor shall identify the classification and provide a copy of the Pay Scales / Classification Salary to the Contract Administrator. The subject line of the email request must contain "Request for Rate Adjustment – MSA Number XXX". In the event of a rate increase, should the Contractor fail to make a request and submit supporting documentation to the DGS-PD within the timeframe noted above, the Contractor shall be deemed to have waived its right to any increase in rate for that year.

4) Any rate increase shall not be effective until an MSA amendment is executed. No retroactive rate adjustments will be allowed. Rate increases shall not apply to User Agreements executed prior to rate adjustment."No
11Attachment 2 - Cost WorkbookIn the rate we provide do we need to account for an economic adjustment over the initial 5-year period, since the renewal increase is not accounted for until year 6? Or are we able to make a note of the economic adjustment that we intend to charge in our proposal and just provide the 1st year fixed rate?Refer to Addendum 3, Attachment 6, Exhibit B, Section 4.A - "All THPP Classification rates shall be firm fixed for the MSA term, including any optional year extensions, unless a rate adjustment is granted for the THPP Hourly Rates. The Hourly Overhead rates are not subject to rate adjustments.

Requests for rate adjustments will be reviewed in the order they are received.

Rate increases shall not apply to User Agreements executed prior to rate adjustment."No
12Attachment 2 - Cost Workbooka) Do we need to provide fully burdened hourly rate?

b) Should proposers include all indirect costs (fringe, overhead, G&A, fee) within the “Hourly Rate,” or should the “Hourly Overhead Rate” represent a separate additive component to avoid duplication? a) Proposers must provide an hourly rate and an overtime rate. No other fees can be charged to User Agencies unless otherwise identified in the RFP." Refer to RFP Section 4.1.2.j, "Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel, and operating cost."

b) Proposers must provide an hourly rate and an overtime rate. No other fees can be charged to User Agencies unless otherwise identified in the RFP." Refer to RFP Section 4.1.2.j, "Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel, and operating cost."No
13Attachment 2 - Cost WorkbookCan you confirm that the non-taxable stipend paid to a professional is intended to be included in the Hourly Rate and not the Overhead rate?Hourly rates submitted shall be inclusive of labor, personnel, training, and equipment costs necessary to perform services described in this RFP, including travel cost. Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel, and operating cost.No
14Attachment 2 - Cost WorkbookCan you confirm that the rates we respond with in the Cost Workbook are "not-to-exceed" rates?Proposed Hourly THPP Rates and Overhead Rates within Attachment 2 - Cost Workbook will become the maximum Cumulative Hourly Rates for the initial term and optional extension years. These rates will then be reflected in Attachment 6, Exhibit B.1 - Rate Sheet. No
15Attachment 2 - Cost Workbooka) Regional Pricing: Can rates vary by region based on local market conditions?

b) Can you have different rates per region? a) No. Rates must be at or above the Minimum Hourly THPP Rate indicated in Attachment 2, Cost Workbook. Refer to Attachment 2 - Cost Workbook, Instructions Tab Rate Details.

b) Yes, proposed rates for each THPP classification in each Region will be evaluated independently of other proposed Regions. No
16Attachment 2 - Cost WorkbookWe believe we would be overcharging DGS if we included potential sick leave costs in our Maximum Hourly Rates, as we would need to estimate on the high side to cover potential costs. We request that DGS adopt the same policy adopted by many of our other government clients who allow us to bill for eligible sick leave as if the employee worked that day, so DGS is only paying for time used. Will DGS agree to this approach? No. Refer to Addendum 3 Attachment 6 - Proposed Agreement, Section 4.1.2.i, "Hourly rates submitted shall be inclusive of labor, personnel, training, and equipment costs necessary to perform services described in this RFP, including travel cost. Refer to, Exhibit A – Scope of Work. Only the rates submitted in the Cost Workbook shall be included in the awarded agreement. No other fees can be charged to User Agencies unless otherwise identified in the RFP."No
17Attachment 2 - Cost WorkbookWe are unsure how to account for undefined costs (e.g., travel, mandated time-off obligations such as sick leave or prenatal leave), special equipment not provided by the User Agency, since such costs cannot be reasonably estimated prior to award. Because these variables are not yet known, including them in the base hourly rate could require bidders to assume high utilization, thereby charging the State for costs which may not be incurred.
a. Would DGS consider allowing such expenses to be billed on an as-incurred basis, separate from the proposed hourly rate? No. No other fees can be charged to User Agencies unless otherwise identified in the RFP."No
18Attachment 2 - Cost Workbooka) Can the State please clarify what else should be included in the Hourly Rate in Attachment 2 Cost Workbook besides the direct compensation paid to the employee (which can be no less than the Minimum Hourly Rate), as well as the associated payroll taxes, including FICA, unemployment, workers comp, etc.?

b) Please confirm if all other expenses, besides payroll taxes (including FICA, unemployment, workers comp, etc.) and travel time, which relate to the administration, recruitment, overhead, travel, and operating cost should be included in the Hourly Overhead Rates. a) Refer to RFP Section 4.1.2.i, "Hourly rates submitted shall be inclusive of labor, personnel, training, and equipment costs necessary to perform services described in this RFP, including travel cost. Refer to, Exhibit A – Scope of Work. Only the rates submitted in the Cost Workbook shall be included in the awarded agreement. No other fees can be charged to User Agencies unless otherwise identified in the RFP."

b) Refer to RFP Section 4.1.2.j, "Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel, and operating cost."No
19Attachment 2 - Cost WorkbookPlease also clarify why travel costs are listed in the Hourly Rate in addition to the Hourly Overhead Rate – is the travel cost in Hourly Rate meant to mean travel time as opposed to transportation costs?"Hourly rates submitted shall be inclusive of labor, personnel, training, and equipment costs necessary to perform services described in this RFP, including travel cost." Refer to RFP Section 4.1.2.i
"Overhead rates submitted shall be inclusive of all expenses related to administration, recruitment, overhead, travel, and operating cost." Refer to RFP Section 4.1.2.jNo
20Attachment 2 - Cost WorkbookIf an employee has to travel between two sites in one day, since the employee has to be paid for the time in transit and since we don’t know how much travel time there could be, will the State allow us to bill for the time they take to travel from one site to another as if they were working? No. No other fees can be charged to User Agencies unless otherwise identified in the RFP."No
21Attachment 2 - Cost WorkbookHow will we be able to price the provision of medical equipment into our OH rate if we are unsure whether or not we need to provide it? We would have to assume we will always need to provide it and factor that into the rate, which means the State could be paying for equipment it is providing. Would the State change the provision to indicate that if the Contractor is required to provide equipment, the cost of the equipment can be billed separately to the State? No. Refer to Addendum 3 Attachment 6, Section 5.A.2, "The Contractor shall provide all labor, equipment, materials, staff, transportation, travel, licenses, permits, and every other item of expense necessary (e.g., internet) to complete THPP services. All equipment and materials required to complete the THSS services shall be identified in the User Agreement at no additional cost to the State."No
22Attachment 3 - Narrative ResponseThe RFP requires proposers to certify compliance with the Medical Practice Act (Business and Professions Code section 2000, et seq.).

a) Can DGS confirm whether entities that are not physician-owned (e.g., healthcare staffing or management firms that employ or subcontract with licensed practitioners) are eligible to submit proposals as long as they comply with the Act through their contracting structure (e.g., using W-2 employees or subcontracted licensed providers) rather than physician ownership?

b) Regarding Attachment 3 – Narrative Response, please confirm whether proposers are only required to provide “Yes” or “No” responses in the Excel file, or if additional written narrative explanations are expected for certain items. If narrative responses are required, please clarify which specific sections or questions must include detailed explanations versus simple “Yes/No” answers. a) Refer to RFP Section 2.1.6 Narrative Response. Proposers may add attachments to the Attachment 3 Narrative Response to further explain its response, but there is no additional requirement to do so.

b) Proposers are only required to provide Yes or No answers to Questions 1-9 of the Attachment 3 - Narrative Response document. The document will only allow the selection of either response. For Question 10, Proposer's must provide their Secretary of State business entity number. No
25Attachment 3 - Narrative ResponseAre there any guidelines or limits (format, structure, page/word maximums) for that narrative? No. Refer to RFP Section 2.1.6 Narrative Responses, "The RFP includes some items that require a narrative response. Those items have been listed on Attachment 3 – Narrative Response. Proposers are to provide narrative responses on this attachment only, and only for the items requested. If necessary, Proposers may add attachments to the Attachment 3 to further explain its response. Attachment 3 – Narrative Response shall be submitted with the proposal."No
