About this file

Addendum No. 3, issued July 24, 2026, by the Maryland Department of General Services clarifies and modifies bid documents for Project P-052-260-010, Greenbrier State Park Parking & Trail Improvement. This addendum addresses eleven questions and answers submitted by prospective bidders regarding proposal requirements and contract conditions. The revised proposal submission deadline is Thursday, August 6, 2026, at 4:00 PM Local Time. Key clarifications include confirmation that all four required example projects in Section F must have completed construction (not ongoing projects), the page limit for Section H(d) project understanding and design approach is four pages, only the prime offeror's current certificate of insurance is required with the technical proposal (not subcontractor certificates at the proposal stage), and Attachment R may be submitted anywhere towards the end of the proposal if indicated in the table of contents. The addendum also confirms that land surveyors will not be evaluated as key personnel but may appear on the organizational chart as support staff.

Additional clarifications address MBE participation calculations, joint venture eligibility, and pricing methodology. The full $150,000 fee from a geotechnical MBE subcontractor counts toward the overall MBE goal, including equipment rental expenses. Joint ventures between Small Business Reserve (SBR) firms are permitted. No across-the-board requirement mandates that the prime firm self-perform a specific percentage of work; however, the prime must subcontract sufficient work to meet the 20% MBE participation goal established in the solicitation. Due to the 4.3-year project duration, the architect/engineer must provide a fixed fee that accounts for long-term inflation, labor rate escalations, and extended risk, as all fees are fixed and not subject to adjustment after contract initiation.

P-052-260-010 Questions and Answers

Question 1. SF-330 Section F – Example Projects

Section 5.3.2.F.4 states that, of the four submitted projects, up to three are to be completed projects performed by the lead design firm as Engineer of Record, and the remaining project is to be submitted by the professional geotechnical firm as Geotechnical Engineer of Record.

Section 6.2.5 also states that projects in various stages of construction will be considered with regard to past performance. Could you please clarify whether an ongoing project may be included as one of the four projects in SF-330 Section F, or whether all four Section F projects must have completed?

Answer 1. No. Section 6.2.5 says projects in various stages of construction are considered "with regards to past performance only". All four Section F projects must have completed construction.

Question 2. SF-330 Section H(d) – Page Limit

Section 5.3.2.F.6(d) states that the project understanding and design approach narrative is limited to no more than three single-spaced pages. However, Section 5.3.2.F.6(e) states that Item (d) is limited to four pages.

Could you please confirm whether the applicable page limit for Section H(d) is three pages or four pages?

Answer 2. A, B, and C, are limited to five (5) pages. while D(6d) is limited to four (4) pages

Question 3. Certificate of Insurance

Section 5.3.2.I states that the Offeror shall submit its current certificate of insurance under Tab F. Section 3.5.6 also requires subcontractors to maintain comparable insurance coverage and provide the same documentation required of the Contractor.

Could you please confirm whether certificates of insurance for all proposed subcontractors must be submitted with the Technical Proposal, or whether only the prime Offeror’s certificate is required at the proposal stage, with subcontractor certificates to be provided after award or upon request?

Answer 3. Only the primes require a copy of their current certificate of insurance with Technical Proposal

Question 4. Where in the proposal (what section) should Attachment R be submitted?

Answer 4: Anywhere towards the end of the Proposal is fine. Make sure its indicated in your table of content.

Question 5. Key Personnel include a Land Surveyor?

Answer 5. No. A surveyor can appear on the Team Organizational Chart as support but will not be evaluated

Question 6. Page 5 Item H, is the limit of page 3 or 4 for (d) understanding of project

Answer 6. A, B, and C, are limited to five (5) pages. while D(6d) is limited to four (4) pages

Question 7. Can an MBE firm's direct expenses be accounted for in the overall MBE goal?

For instance, if we have a geotechnical sub who gives us a fee of 150,000 but 50,000 of that is because of equipment that they have to rent, does that total 150,000 account for the MBE goal or is it just 100,000?

Answer 7. The $150,000.00

Question 8. Do project examples for section F have to be construction completed or Design completion?

Answer 8. Construction complete. Refer to Section 5.3.2.F.4

Question 9. Is joint venture with another SBR firm allowed?

Answer 9. Yes

Question 10. Are there requirements for the prime firm to perform a certain percentage of the overall project themselves? Example: at least 51%, or is there no such requirement?

Answer 10: In the Procurement Manual / COMAR Title 21 generally: There's no across-the-board requirement that a prime self-perform 51% (or any set percentage) of a Maryland state contract for services, commodities, or IT. The manual addresses subcontracting mainly through the socioeconomic programs (MBE/VSBE), and those work in the opposite direction , the prime must subcontract at least enough work to meet the MBE/VSBE participation goals set in the solicitation. Per COMAR 21.11.03.10, a prime contractor, including a joint venture, shall accomplish an amount of work not less than the MBE subcontract goal with certified MBE subcontractors, but there's no companion rule capping total subcontracting

Question 11 The project scope is limited to parking lot improvement and design of pedestrian bridge for a trail. What will be the basis of the fixed pricing if the project duration is 4.3 years.

Answer11: The A/E is responsible for providing a fee that must account for long-term inflation, labor rate escalations, and extended risk as this cannot be adjusted after the contract is initiated. The firm's initial fixed fee must act as an all-inclusive fee, and all risk must be priced entirely into the upfront number.
