ADDENDUM NO. 3
SPECIAL NOTE
The Standard Form of the General Conditions of the Contract, AIA Document A-201 as defined by the American Institute of Architects, the General Requirements and the Project Manual are a part of this document, and each Contractor shall consult them in detail for instructions pertaining to his work. Failure of the Contractor to consult these documents shall not relieve him of his obligations thereto.
SCOPE OF WORK
The attached items are changes and/or clarifications to the drawings and MICHSPEC, and shall be noted by the Contractor in making up his proposal. All of these items shall be considered a part of the Contract Documents.
The following items and attachments refer to the drawings and MICHSPEC dated Sept. 19, 2023.
PRE-BID CONFERENCE CALL DISCUSSIONS:
A mandatory pre-bid conference call (Microsoft Teams Meeting) was held on October 24, 2023 at 10:00 am local time. The mandatory pre-bid conference call meeting minutes are attached to this addendum for the record and for inclusion to the contract documents and for clarification.
MDOT CONSTRUCTION PERMIT:
Refer to the attached MDOT individual construction permit for operations within State Highway Right-Of- Way along with MDOT Environmental Requirements, MDOT Bat Notice, Archeological and Historic Findings.
Directional Bore RFI Clarification:
The original intent was to directional bore (drill) 4 runs, one for each conduit. Therefore multiple bores or drills are acceptable. If the contractor combines the conduits in a larger sleeve then MDOT will require control survey documentation along the existing I96 freeway pavement as stated in the MDOT permit.
SPECIFICATION ITEMS:
Item No. 1:
Refer to the attached revised specification section 01 21 00 – Allowances. Allowance No. 1 for the truck scale is in the amount of $450,000 in lieu of $300,000. Allowance No. 2 for construction contingency is in the amount of $100,000 in lieu of $50,000.
Item No. 2:
The following manufacturers are approved equals:
Spec. Section 07 42 43 – Composite Wall Panels: Alcotex Aluminum Composite Cladding System Contact: Doug Holmes 312-480-1566
Item No. 3:
The specified Guardian Glass tint “CrystalBue” is no longer available. Please use Guardian Glass tint “CrystalGray”
Item No. 4:
For clarification: The Acoustical ceiling spec calls for “Armstrong or approved equal with a 2x2x3/4” tile, while the plans call for “CertainTeed 2x2x5/8” tile. Both are acceptable products.
Item No. 5:
For clarification: The specifications include MDOT standard details. Refer to detail SIG 240-A for handhole details. The standard 24” round is to be used when the number of conduits makes this an appropriate size. The 36” round is to be used when the number of conduits makes this an appropriate size.
Item No. 6:
For clarification: As the project has included many “as equal” manufacturer’s as described in the addendums, all finishes will be final selected during the shop drawing process and will be prefinished products from the factory from the manufacturer's full range of finishes. The intent is to match as close as possible the finish colors called out on bid documents.

a. Description. This work consists of all labor, equipment, and materials necessary to protect the existing and newly installed MDOT ITS infrastructure during construction activities to ensure the safety of the construction workers and the general public.
b. Materials. None specified.
c. Construction. Any damage to MDOT ITS infrastructure will be repaired immediately by the Contractor causing the damage, or by another Contractor, at the sole discretion of the MDOT Engineer. Contacting MISS DIG is not sufficient to protect MDOT ITS infrastructure.
1. Underground ITS Infrastructure Staking Request. Download and complete MDOT Form 5300, MDOT Underground ITS Infrastructure Staking Request Form (http://mdotcf.state.mi.us/public/webforms/public/5300.pdf). Provide location information for the staking request including: route number, direction, and mile marker; or major cross streets, city, and county. Include construction drawings or a detailed sketch with MDOT Form 5300. Electronically submit the completed form and any attachments to the appropriate region email address listed on the form at least 5 days prior to the anticipated digging start date. Digging work is prohibited until the staking request has been approved.
2. Hand Digging. Hand dig to confirm the location of MDOT ITS infrastructure whenever the proposed work is within 10 feet of the marked location, or when directed by the Engineer.
3. Protection. Where indicated on the plans or by the Engineer, provide rectangular steel cover plates of at least 8 feet by 8 feet by 1 inch thick to serve as a buffer and shield between traffic loads or demolition and the critical infrastructure. Use these plates to cover handholes that will be driven over by traffic during construction, to protect conduit runs from bridge demolition activities and debris, and wherever indicated by the Engineer.
4. Renewing Markings. When construction activities obliterate facility staking markings, place a subsequent request to MDOT to refresh the facility staking markings. The Contractor is responsible for ensuring they know where all MDOT facilities are after the initial staking at each site.
d. Measurement and Payment. All costs associated for this work will not be paid for separately, but are included in the applicable pay items, such as, but not limited to: guardrail installation, fence installation, pavement placement, etc. All costs of any emergency repairs will be paid by the Contractor responsible for the damage regardless of who completes the repair.

Notice: New MDOT Visibility Policy
Many permit applicants may already be aware that the Federal Highway Administration (FHWA) adopted a rule regarding the use of high visibility clothing for all workers on Federal-aid highways. The Michigan Department of Transportation (MDOT) supports this rule as we believe that worker safety is paramount, and the use of high visibility clothing is but one way to help ensure our workers go home at the end of their shifts. We need assurance that permit applicants who are working in State highway Right-of-Way are in compliance.
In November 2006, the Federal Highway Administration issued 23 CFR, Part 634, and Worker Visibility Final Rule. The rule states, “All workers within the right-of-way of a Federal-aid highway who are exposed either to traffic or to construction equipment within the work area shall wear high-visibility safety apparel.” The compliance date for this rule is November 24, 2008.
High visibility safety apparel is defined as: “personal protective clothing that is intended to provide conspicuity during both daytime and nighttime usage, and that meets the Performance Class 2 or 3 of the ANSI IISEA (American National Standard Institute) 107-2004.”
Many permit applicants are already in compliance with this requirement, but MDOT needs to assure FHWA that this rule has been adopted and is being observed statewide. Please ensure that by November 24, 2008, all individuals working in State highway Right-of-Way are wearing the proper high visibility clothing.
If you have any questions about this rule, please contact Jim Gaus, MDOT Occupational Safety Specialist, at (517) 241-4188 or email him you questions at gausj@michigan.gov.
The MDOT website that provides information and the appropriate forms for construction permit applicants to meet the Work Zone Safety and Mobility Policy requirements for individual or annual construction permit applications is:
Go to web site: http://www.michigan.gov/mdot
On the left side of page click on “Doing Business” Click on “Work Zone Safety and Mobility” under the “Resources” category
Emergency Operations: In time of disaster or emergency, or when utility lines or facilities are so damaged as to constitute a danger to life and/or property of the public, access to the same may be had by the most expeditious route. Work is to be completed in a manner which will provide the traveling public with maximum possible safety and minimize traffic distribution. Notice of such situations shall be given to the nearest police authority and the department as soon as can reasonably be done under the circumstances. During normal Department work hours, the facility owner shall advise the Department of any operations within right of way which affect traffic operations or the highway structure or facilities prior to performance of the work. After normal Department work hours, the permittee, at the beginning of the first working day after the emergency operation, shall advise the local MDOT Transportation Service Center of any operations which affect traffic operations or the highway structures and facilities. If determined necessary by the Department, the permittee shall secure an individual permit for such work after notification
All work requires the submission of a permit application package, the 5-day Advance Notice/Approval of Permitted Activities, and approval from the TSC before work may be performed in state highway Right-of-Way. These submissions are available on-line only.
If you have any questions, please feel free to contact Kerwin Keen.

Updated January 2019
Notice: MDOT Mobility Policy
Effective January 1, 2009, the federally mandated Work Zone Safety and Mobility Policy (23 CFR 630(j)) shall be implemented for all State highway Right-of-Way construction permit activities. This rule requires Michigan Department of Transportation (MDOT) to systematically consider and manage the traffic impact of permit activities to the traveling public. Therefore, the permit applicant is responsible for evaluating the effect on traffic caused by their proposed work.
Note: Emergencies, Miss Dig and Land Survey (surveying not impacting travel lanes or shoulders) operations are the only exemption to this new policy. See below for definition of an emergency operation.
The permit applicant is required to analyze if the proposed work is within restricted State highway Right-of-Way. The Mobility Impact Map shall be used for this assessment. If restrictions exist, the permit applicant shall determine if the work can be completed outside of the restrictions. Instructions have been posted on the MDOT website detailing the requirements. The MDOT Transportation Service Center (TSC) Construction Permit Staff may assist in determining this if necessary.
SITUATIONS AFFECTING PERMITTED ACTIVTIES
When proposed work cannot be performed outside of the restricted time frames provided on the Mobility Impact Map, (pavement cure times, duration of work activity etc.) the permit applicant must submit a Temporary Traffic Control Plan (TTCP) and Transportation Operation Plan (TOP). The Suggested Mobility Mitigation Methods for Construction Permit Activities, (Form 2204A) and Transportation Operation Plan (TOP) Checklist for Permits, (Forms 2204B) shall be utilized for determining alternative strategies.
The TTCP includes mitigation methods, plan sheets, details and maintaining traffic typical that will be used during the permitted activity.
Form 2204B is a tool to bring awareness of issues to both the permit applicant and MDOT.
These issues may need further investigation.
