About this file
This addendum to Bid Invitation 29-27 issued by the New Hampshire Division of Procurement and Support Services clarifies specifications for a 2027 model-year backhoe loader procurement. The bid closing date is September 8, 2026, at 10:30 a.m. Eastern Time, with questions due by September 3, 2026. The equipment will be delivered to the DNCR Trails Bureau in Pittsburg, New Hampshire within 90 days of purchase order receipt. The specification is based on a John Deere 410 P Backhoe Loader with detailed requirements including a four-cylinder turbocharged diesel engine with minimum 4.5 liter displacement and 116 horsepower certified to EPA Final Tier 4/EU Stage IV emissions standards, a powershift transmission with Autoshift control, and a sealed operator cab with air conditioning and heating. The backhoe boom must achieve a standard digging depth of at least 15 feet 11 inches with an extendable dipperstick, and the loader must lift at least 7,355 pounds at full height with a 1.5 cubic yard bucket.
The addendum specifically addresses the evaluation of alternate manufacturer equipment by clarifying that the State will accept only current manufacturer published specification sheets as evidence that alternate machines meet or exceed requirements. Supplemental technical information, engineering documentation, or manufacturer demonstrations will not be considered if the equipment does not satisfy requirements based on published factory specifications alone. Pricing must include all delivery costs, attachments, documentation, spare parts, and extended warranty coverage with minimum 3,000 operating hours or 60 months coverage and a $200 maximum deductible. Bid prices must remain firm for the entire contract period with no surcharges or fuel charges permitted, and payment terms are net 30 days via ACH transfer following invoice receipt and agency acceptance.

ADDENDUM # 02 TO BID INVITATION 29-27
DATE AND TIME OF BID CLOSING: 9/8/2026 10:30 AM
FOR: Backhoe Loader
Question 9:
We respectfully are requesting clarification regarding how the Purchasing Agency intends to determine whether an alternate manufacturer's machine "matches or exceeds" the specified Deere machine when the specification is based on particular design characteristics rather than objectively measurable performance requirements.
With the State's response indicating that alternate makes and models are acceptable provided they "match or exceed" the specified machine, could the Purchasing Agency please clarify:
a) If an alternate manufacturer achieves the same intended result through a different engineering design, what documentation will the State accept as evidence that the alternate machine meets or exceeds the requirement?
b) Will manufacturers/dealers be permitted to provide supplemental technical information, engineering documentation, or other supporting information beyond the manufacturer's standard published specification sheet to demonstrate equivalency?
c) Will the Purchasing Agency consider a demonstration or technical discussion with an alternate manufacturer/dealer when a specification cannot reasonably be demonstrated through a published factory specification alone?
We are asking for this clarification so that alternate manufacturers can submit a responsive bid and provide the appropriate supporting documentation to demonstrate compliance.
State Response:
a) The state will accept the current manufactures published specification sheet.
b) The state will accept the current manufactures published specification sheet.
c) No, if the piece of equipment does not meet or exceed the requirements in its supporting documentation, then it will not be considered.
