31 Attachment A - Scope 19 Could you please clarify the type of solicitation? Is this primarily a Temporary Staffing, MSP, or VMS type RFP? Is providing a VMS platform mandatory under this RFP?
This Solicitation is intended to establish a contract with a single provider responsible for delivering and managing a comprehensive contingent workforce The scope includes temporary staffing, payroll/employer of records services, and program management. If an active supplier network exists today, how many staffing suppliers are currently engaged, and what percentage of total spend or fills do the top five suppliers represent? Will OUC require supplier carryover, or is an open supplier optimization expected at transition?

Please detail the skilled trades roles anticipated under this contract by craft (e.g., lineworkers, substation technicians, water plant operators, mechanics), including any applicable license or certification requirements, CDL/DOT applicability, and which roles are classified as safety-sensitive and therefore subject to 10-panel drug screening and physical exam requirements.
As outlined in the RFP, all contractors are subject to drug testing as part of the standard pre-employment screening requirements.
Positions designated as safety-sensitive will be identified at the time of request based on the operational and regulatory requirements. For those roles, additional requirements, including 10-panel drug screening and physicals, will apply as specified in the RFP and as required by the assigned work location. The RFP does not define a fixed list of safety-sensitive roles, as positions may vary. Proposers should demonstrate their ability to support all applicable screening compliance and onboarding requirements as defined for each assignment.
Attachment A, Scope of Services p. 19;
Requirement 21 (Employer of Record),
p. 22
The RFP requires the vendor to be the "sole employer of record" for all temporary personnel (Requirement 21) while also referencing direct hire and independent contractor management. Additionally, payrolling/EOR is listed as an in-scope service but no volume or exclusion parameters are defined. Please confirm the expected service delivery model:
specifically whether OUC expects (a) a supplier-neutral MSP only, (b) MSP with in-house staffing capability, and/or (c) MSP with EOR/payrolling for pre-identified talent. If payrolling/EOR is in scope, please also indicate what percentage of current assignments involve pre-identified workers, anticipated volume under the new contract, and whether any role categories or departments are intended to be excluded from the EOR model.
The RFP includes a range of contingent workforce services, including temporary staffing, employer-of-record (EOR)/payrolling services, independent contractor management, and direct-hire support. The company is not prescribing a specific service delivery model (E.g., supplier-neutral MSP, MSP with staffing capabilities, or other structures). Attachment A, Requirements 13 and 14,
p. 21
IC assessments, 1099 compliance, and hold harmless agreements are listed as requirements but no volume, frequency, or departmental context is provided. Please confirm the anticipated volumes for independent contractor (IC) assessments, agent-of-record services, and 1099 compliance management. Additionally, please identify any roles, departments, or project types where IC engagement is most frequent, as this directly impacts compliance program design and risk exposure.

Exhibit 1, p. 1; Exhibit 2, p. 3; RFP p. 26 (Attachment E note)
Exhibit 1 states the security questionnaire applies to shortlisted vendors, but Exhibit 2 cloud terms appear to apply broadly. Exhibit 1 (Information Security Requirements, p. 1–2) and Exhibit 2 (Cloud Hosting Terms & Conditions, p. 3–6) are referenced as informational for all vendors. Please confirm whether all bidders proposing a cloud-hosted VMS are required to complete the full security questionnaire at proposal submission, or only shortlisted vendors. Additionally, please clarify whether an on-premise VMS deployment would be considered acceptable.
All Proposers are required to complete the security questionnaire at proposal submission.
OUC has not prescribed a specific system architecture or deployment model. Proposers may propose either a cloud-hosted or on-premises solution based on their standard offering, provided it meets the functionality and performance requirements outlined in the RFP.
Attachment B (Price Schedule — Excel); Attachment A, Requirement 4 (Detailed Usage Billing), p. 20
The billing requirements reference "all billing from staffing firms" as a line item, suggesting a consolidated markup or pass-through model, but the fee structure is not defined. Will OUC require the MSP to establish and enforce a standard bill rate/markup structure across all subvendor staffing suppliers, or will supplier rates be negotiated independently? Please clarify whether the MSP management fee is expected to be embedded in the bill rate (markup model) or invoiced separately as a program management fee.
Pricing should be provided in accordance with the structure outlined in the RFP Pricing Schedule. The pricing schedule defines the required markup structure and applicable program fee. Proposers should complete the pricing schedule as provided, including identification of any embedded and separate fees, as applicable.
39 Attachment A, Requirement 22b, p. 22
The language is permissive ("if there is a fee") but given OUC's Florida Public Records obligations, data return at no cost would be more consistent with the overall compliance framework. Requirement 22b (p. 22) states that if there is a fee for the return of OUC data upon contract expiration, the amount must be described in the proposal and included in the final agreement. Please confirm whether OUC will accept data return fees, or whether this is expected to be a no-cost obligation of the vendor.
As outlined on page 22, section 22b, of the RFP, proposers must disclose any fees associated with the return of OUC data at contract expiration, including any and all applicable requirements. OUC has not prescribed that such services be provided at no cost. Data must be returned in a useable, standard format. For example, data is not considered usable if a specialized software or key is needed to read or understand the data. Standard format examples include CSV (Comma-Separated Values) or Adobe PDF.
Exhibit 3, GC, pp. 7–9; Exhibit 2, pp.
3–6; RFP Section 1.6, p. 5
Exhibit 3, GC (pp. 7–9) contains terms structured for an on-premise perpetual software license, including physical delivery, installation, source code escrow, and backup media — none of which apply to a cloud-hosted SaaS VMS. Exhibit 2 (Cloud Hosting Terms & Conditions) appears to already contemplate a hosted delivery model. Please confirm that OUC will replace GC with Staff Aug and SaaS-appropriate terms covering uptime SLAs, subscription-based fees, cloud data security, and data portability rights, and confirm that Exhibit 2 - not Exhibit 3 GC - governs for vendors proposing a cloud-hosted solution.
Per page 5, Section 1.6. The vendor shall review the OUC’s terms and conditions provided (refer to attachment E).
In addition, the vendor must provide all applicable ancillary agreements of their proprietary and/or third party tools used for the services, for OUC’s attorneys review, such as: Master Software License Agreement, SaaS Agreement, Maintenance and Support Service Agreement, Service Level Agreement, Software Terms, etc. or others (as applicable).
41 RFP Section 3.9, pg. 11 The link to the Exceptions form is not working. Please provide a copy of this form. Compliance Forms have been uploaded to VendorLink as a separate file titled Compliance Forms for vendor download and use.
Attachment B: Price Schedule, RFP pg.
23 Should the Price Schedule Certification be provided in Tab 4 of the Technical Proposal?
Per page 23 of the RFP document. Upload the completed Excel file as a separate attachment in VendorLink. (Do Not convert spreadsheet to portable format document (pdf) or password protect.)
DO NOT INCLUDE Excel Price Schedule or any pricing information within the vendors Technical Proposal. Include the signed Attachment B: Price Schedule Certification in the Technical Proposal under Tab 4 upon submission.
43 RFP Section 3.5, pg. 11 The RFP instructs to “separate and identify each part of the submission...with a divider separation page” (RFP Section 3.5, pg. 11). Since this proposal will be submitted electronically, is it acceptable NOT to include divider pages?
