About this file
This Addendum 1 is issued by the Kansas Department of Transportation (KDOT) Bureau of Construction and Materials for a grading, bridge, and surfacing project in Douglas County. The project, identified as State Project No. K010-023 KA 3634-02 and Contract No. 526096101, involves work on SLT/K-10 from I-70/K-10 Junction south to 3500 feet north of K-10/US-40 Junction, spanning 1.198 miles. The addendum, dated September 3, 2026, introduces a Critical Path Method (CPM) Schedule requirement (Special Provision 15-PS0263-R2) as a mandatory contract component and replaces the previous version (15-PS0263-R1). All prime contractor bid holders must sign and return the acknowledgment to Joshua Matyi at Joshua.Matyi@ks.gov, and contractors are responsible for informing subcontractors and suppliers of these contractual changes. The project letting is scheduled for September 16, 2026, and all project documents are accessible through KDOT's website and Bid Express platform.
The addendum establishes comprehensive CPM scheduling requirements that contractors must follow throughout project execution. The contractor must designate a qualified Scheduler with a minimum of five years of dedicated scheduling professional experience and submit a Baseline Schedule for Engineer approval before commencing work, with the Engineer having ten business days for review. Progress schedules must be submitted every two weeks with supporting documentation, including three-week look-ahead reports and critical activity analyses. The contract includes a CPM Schedule bid item paid on a lump sum basis with milestone payments: 50 percent upon Baseline Schedule acceptance, 75 percent when 50 percent of the original contract is completed, and the remaining 25 percent upon Notice of Acceptance with all records submitted. The provision outlines strict protocols for schedule revisions, recovery plans for delays exceeding 28 calendar days, and change order fragnets due 10 business days after the contractor has substantive information. Time extension evaluations follow the AACEI Recommended Practice No. 52R-06 methodology, and the contract includes numerous other special provisions covering materials, traffic control, environmental concerns, asphalt surfacing, concrete work, and structural requirements typical of highway construction projects.

SECTION 108
PROSECUTION AND PROGRESS
108.3 PROJECT SCHEDULE
A Critical Path Method (CPM) Schedule is defined as the longest sequence of activities in a logical, constructible sequence which must be completed on time for the project to be completed by the Construction
Completion Date. The schedule shall be used to plan, coordinate, and manage the work, whether the Contractor’s personnel are performing the work or not. The CPM schedule shall identify the activities, sequencing logic, and activity durations. CPM Schedules shall be prepared and maintained according to the most current CPM Technical
Instructions and CPM Best Practices provided by KDOT.
BID ITEM UNITS
CPM Schedule Lump Sum
Float is a shared commodity and is not for the exclusive use or benefit of either party. It is available to all parties as needed until it is consumed. Any changes to the contract that results in negative float will be addressed through subsection 108.3f. Changes or delays to Activities in the network that do not impact the critical path shall not be justification for an extension of any Completion Deadline.
If the Contractor or Engineer discovers an error after the Engineer has accepted a schedule, the Contractor shall correct the error in the next schedule submission.
The Engineer's review and acceptance of the Contractor's Baseline Schedule is for conformance to the requirements of the Contract documents only. Review and acceptance by the Engineer of the Contractor's project schedule does not relieve the Contractor of any of its responsibility for the project schedule, or of the Contractor's ability to meet interim milestone dates (if specified) and the contract completion date, nor does such review and acceptance expressly or by implication warrant, acknowledge or admit the reasonableness of the logic, durations, manpower or equipment loading of the Contractor's Baseline Schedule. In the event the Contractor fails to define any element of work, activity or logic and the Engineer review does not detect this omission or error, such omission or error, when discovered by the Contractor or Engineer, shall be corrected by the Contractor at the next schedule submittal and shall not affect the project completion date.
The Contractor shall provide an individual, hereafter referred to as the Scheduler, to create, maintain and analyze the resource loaded CPM project schedule. The Scheduler, or any replacement Scheduler, shall demonstrate knowledge of industry guidelines and best practices and shall have a minimum of five (5) years of experience as a dedicated scheduling professional. The scheduler shall be technically proficient in performing the required tasks using the specified software. The Engineer has the right to require replacement of the scheduler at any time throughout the project should the quality or timeliness of the schedule submissions repeatedly fail to meet the contract requirements.
The Scheduler shall be present or available virtually at all CPM update meetings and made available for discussion or meetings when requested by the Engineer.
a. Baseline Schedule
The Contractor shall not begin work until the Baseline Schedule has been accepted by the Engineer.
It is the Contractor’s responsibility to determine the most feasible order of work consistent with the contract requirements. Plan and organize work to produce the least interference with traffic, businesses, and homeowners and to minimize the use of planned detours. Plan and organize work to meet the Contract Time and any interim Contract
Times. If the Schedule reflects completion of parts or all the work earlier than the Contract Time (early completion), the Secretary shall not be liable for additional costs the Contractor incurs to achieve early completion or liable for delays that prevent the Contractor from achieving early completion.
Sheet 2 of 5
The Baseline Schedule shall be in accordance with the CPM Best Practices Document and CPM Technical
Instructions Document. The Engineer shall have ten (10) business days to review and accept the Schedule. If the
Contractor has failed to submit a schedule that meets the requirements, then the Engineer will reject the submitted schedule and the Contractor will have five (5) business days to provide the necessary corrections. The Engineer may allow minor corrections, such as nomenclature changes or other technical details, to be made with the first Progress
Schedule update. .
Provide a schedule narrative with the Baseline Schedule in accordance with the Contractor Baseline Schedule
Narrative Template. The Baseline Schedule Narrative shall not be considered notification of delays, requests for change orders, or other issues.
Once a baseline schedule is accepted by the Engineer, the contractor shall start on the Construction Start date reflected in the accepted baseline schedule with simultaneous commencement of contract time, unless barred by ROW acquisition or utility relocation delays that exceed dates shown in the job special provisions or by any other unforeseen department driven delays that directly impact the critical path of the schedule. The contractor can request a change to the construction start date prior to the date of the accepted baseline schedule construction start by officially re-submitting a Baseline Schedule Revision including all required documentation and the reason for the requested change of construction start. The contract duration, as awarded, will not be affected, or modified. The requested revised baseline schedule for construction start date change must be accepted prior to starting construction. Out of sequence work may be progressed and updated in the schedule as approved by the Engineer.
b. Progress Schedule. Every two weeks, perform a complete schedule update and submit it to the Engineer.
Each update shall include an electronic backup file of the schedule. The following reports shall be provided: three-week look-ahead, critical activities (longest path), full project schedule, and Oracle Primavera schedule log reports (Pre
& Post corrections).
The Engineer will have five (5) business days after the receipt of all supporting documents to review the updated schedule file and report the findings back to the Contractor. Make the necessary corrections to address all findings with the subsequent Progress Schedule submittal.
Provide a schedule narrative with every other submittal (i.e. every four weeks) in accordance with the
Contractor Progress Schedule Narrative Template. The schedule narrative shall not be considered notification of delays, requests for changes orders, or other issues.
c. Progress Schedule Revisions The Contractor may modify a Progress Schedule without Engineer
Approval, except the Contractor shall receive prior Approval from the Engineer for any changes to the Completion
Deadlines, Key Milestones, or any Activities that require action or include commitments by the Engineer, including changes to the dates such Activities fall upon. A log of all logic changes with explanations will be included with the progress schedule submittal. If the Engineer provides comments to any Progress Schedule, the Contractor shall address such comments with subsequent Progress Schedule submittal. The Progress Schedule shall include all information current as of the data date. The Engineer may request the submission of a revised schedule if any of the following circumstances occur:
• There is a delay greater than 28 days (actual or projected) to the scheduled milestone or project completion dates.
• The Engineer executes a contract revision that adds or deletes work, modifies the planned sequence of work, or modifies the means and methods of its performance.
The requirement to prepare a revised schedule is not a directive by the Engineer to accelerate the work.
Prepare and submit the revised schedule as soon as the need for a revised schedule is necessary, but no more than five (5) business days after the Engineer’s request.
Sheet 3 of 5
Within five (5) business days of receipt of the revised schedule, the Engineer will respond in writing either accepting the revised schedule or rejecting the revised schedule and identifying the reasons for rejection or requesting more information. Within five (5) business days after the date of the Engineer’s written response, address the reasons for rejection and resubmit the revised schedule or provide the information requested.
d. Recovery Plan. If the work is delayed at the contractors fault such that the projected finish date of any completion deadline or contract milestone, in the current update schedule, is behind by twenty-eight (28) calendar days, then the Contractor shall provide a detailed Recovery Plan within five (5) business days, which may include a recovery schedule if directed by the Engineer. The Recovery Schedule shall demonstrate the Contractor’s plan to regain lost progress and achieve all completion deadlines per the Contract Documents.
e. Change Orders. Incorporate all change orders (COs) affecting schedule durations, sequencing, and/or resource quantities into the schedule, whether additive or deductive.
Develop a fragnet for all potential change orders (see CPM Technical Instructions). The Change Order schedule, with incorporated fragnet, showing anticipated durations for Department Change order review/approval, material procurement and construction activities shall be submitted for inclusion with the change order package.
Failure to submit a fragnet with the change order, without prior approval from the engineer, forfeits any recovery for an associated recoverable project delay at any future date. Fragnets are due 10 business days after contractor has substantive information (scope, materials, and quantities) pertaining to the potential change.
To the extent possible, change order fragnets shall be submitted prior to the start of construction on the change order scope. The construction of change order scope shall proceed regardless of change order documentation status, unless otherwise directed by the Engineer. Accepted Change Order schedule fragnets shall be incorporated into the current accepted schedule with the activity(s) clearly identified and logically tied to the current schedule activities in accordance with the CPM Technical Instructions. Potential time extensions created by change orders will be analyzed based on the most recent accepted schedule prior to the impact, impact to the longest path, and subsequent movement of the current project completion date in accordance with the Evaluation of Delays and Calculation of Time Extensions section and CPM Technical Instructions.
Change order / potential change order fragnets are to be submitted only once (excluding requested revisions).
The Engineer will meet with the contractor to discuss the findings of the time impact / time extension analysis and modify when necessary. Failure to submit the required document(s) using the specified format and methodology may result in an analysis not reflecting the anticipated calculation of time extension, including mitigation efforts unless the
Contactor has met the requirements of subsection 108.6.c.
If a change order fragnet is on the longest path and affects the contract completion date(s), that submitted schedule will be analyzed in accordance with section 108.3.f.
f. Evaluation of Delays and Calculation of Time Extensions. The Engineer will consider a Contract Time extension for a delay on the longest path when the delay occurred. For consideration, the delay must result in contractual milestone, substantial completion, and/or project completion date(s) that are later than the date required by the Contract. All parties are required to use all means necessary to mitigate potential delays.
Submit a Notice of Potential Time Impact in accordance with SECTION 104.
Evaluate delays and calculate the appropriate time extension for excusable delays in accordance with the
CPM Technical Instructions and the Association for the Advancement of Cost Engineering, International (AACEI)
Recommended Practice No. 52R-06, Time Impact Analysis as Applied in Construction. Use time impact analysis
(TIA) to identify and measure critical delays that have not yet occurred. Use a retrospective window analysis supported by contemporaneous documentation when evaluating delays that are currently in progress or have already occurred.
Sheet 4 of 5
The Contractor’s request for a time extension shall:
• Use the construction progress schedule with a data date closest to, and prior to, the identified impact event.
• Update the schedule to reflect all actual progress up to the current data date
• Include an impact schedule incorporating a fragnet representing the impact. The impact schedule shall:
o Include added activities o Show logical relationships demonstrating the identified impact event o Identify modifications to existing activity durations.
o Identify the impacted activity. If the activity is already in progress, suspend/actualize a completion as needed to reflect the impact.
• Include a narrative report describing:
o Description of impacted event;
o Added activities;
o Changes in logic between the planned and impacted schedules;
o Justification for the excusable delay o Mitigation efforts
• Provide supporting documentation, including:
o Native schedule files o Calculations
• Include any additional documentation required to support the requested time extension and compensation
• Calculate time impacts in calendar days
Contractor mitigation efforts shall be incorporated into all TIA submittals, noting any request of the contractor for Department mitigation effort. All mitigations shall be listed in the TIA narrative.
Only one TIA submittal is allowed (excluding Department or Contractor requested revisions) and must be in accordance with the procedure(s) noted in the contract documents. The Department will analyze the submitted TIA as dictated by the contract documents within a maximum of 30 calendar days, correcting any errors within the submittal, such as using the incorrect schedule as stated in the contract document. After the analysis has been performed by the
Department, a meeting / working session will be held to present the results of the analysis and discuss potential modification as appropriate. After the review meeting, a final determination will be provided to the contractor within
10 business days including the disposition of possible contract time modification, including all noted changes presented within the final analysis. The time determination shall be incorporated into the next schedule update, as presented by the Engineer. Should the contractor dispute the time determination, the contractor has the right to appeal the time determination to the next level as stated in subsection 105.13.
If the baseline schedule, or any updates or revisions, show completion occurring prior to the Completion Date and/or interim milestone, the Contractor must demonstrate to the Engineer that the schedule is reasonable, practical, and achievable. Moreover, it is expressly understood and agreed that (1) the Contractor shall have no claim for delay, disruption, hindrance, or other impact based on any early completion indicated in the Contractor’s schedule(s); (2) a delay is critical if and only if to the extent that the delay extends the completion of the entire work to a date that is beyond the contractually specified date for full completion of the work, regardless of the Contractor’s planned early completion; and (3) the contract price includes full compensation for all time-related costs associated with the
Contractor working at the project site for the full duration of the time set forth in the Contract, even if the contractor represents that the Contractor plans to fully finish the work in less time established by the contract for full completion of the work.
