About this file

This is an Addendum to the bid documents for the AAHA/Capitol Cafeteria Furniture project in Colorado (GovTribe ID: DQ1 AAHA 2026-0287). The addendum addresses vendor inquiries regarding warranty management and modifies the Statement of Work Section 5 concerning warranty and support provisions. The project involves the procurement of cafeteria furniture for the State Capitol, with specific attention to managing multiple warranty periods across different furniture components.

The addendum clarifies that the awarded vendor is responsible for managing all warranty claims and obtaining necessary expertise for warranty-covered repairs, rather than the State managing these complex warranty obligations. The State will retain 2.5% of the total furniture cost from the issuance of the State Purchase Order through June 30, 2027, at which point the retainage funds will be released to the vendor. The vendor remains responsible for warranty claim management for the duration of applicable warranties, while the State assumes responsibility for non-warranty repairs and will coordinate with the vendor for repair services and associated funding. This addendum represents a material change to the original bid documents and requires bidder signature and return to acknowledge understanding of the modified terms.

Addendum_1

This Addendum modifies the Bid Document(s) for Work only to the extent indicated herein. All other areas not specifically mentioned or affected by this Addendum shall remain in full force. This

Addendum shall be added as a part of the Original Bidding Document.

This Addendum is issued for two reasons (1) To respond to Vendor Inquiries, (2) to modify a section of the Statement of Work

(1) Vendor Questions and State Responses

Question 1 Received from Merchants & Company

“Can you confirm the accuracy of the highlighted statement from Exhibit A? Some products on this project have a 12 year warranty. I've never heard of someone holding retainage for that long. Furthermore, different components of a piece of furniture may have different warranty terms. For example, foam has a shorter warranty period than the frame of a chair.”

Answer 1

The intention of the State is to ensure that the warranties for the various furniture items will be managed and responded to by the awarded vendor and not the State. They are too complex for the State to manage and the awarded vendor is responsible for warranty claims management and should be capable of providing or obtaining personnel with the expertise to perform warranty covered repairs should they arise.

The State will modify the retainage period to be effective upon issuance of the State Purchase Order through

June 30, 2027. Effective July 1, 2027, the State will release the retainage funds to the awarded vendor.

The vendor is still responsible for managing all warranty claims while the specific warranties are in effect.

The State will be responsible for managing any repairs which are not warranty claims and will work with the awarded vendor for the provision of repair services and provide funding for repairs.

(2) Modify Exhibit A – Statement of Work, Section 5. Warranty and Support

(2A) Section 2.1 Schedule of Activities is modified as stated below:

The current statement regarding retainage of 2.5% is replaced by the following statement:

To ensure that the Contractor is in conformance with above requirement, the State will require a retainage of

2.5% of the total cost of the furniture from the issuance of the State Purchase Order through June 30, 2027.
