FA489022R0010
L-1 SPECIAL NOTICE TO OFFERORS
L-1.1. This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3, DoD Source Selection Procedures dated 31 March 2016 as supplemented.
L-1.1.2. This requirement is solicited as a non-commercial services 8(a) competitive acquisition under NAICS Code 541330 - Engineering Services except, Military and Aerospace Equipment; Size Standard of $41.5M. Offers are solicited only from small business concerns expressly certified by the Small Business Administration (SBA) for participation in the SBA's 8(a) Program per FAR Clause 52.219-18.
L-1.2. Notice To Offeror(s). Funds have been programmed but are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date for receipt of proposals. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any proposal preparation costs.
L-1.3. Offerors shall acknowledge awareness of all amendments to the solicitation by signing and dating Page 1 of each Standard Form 30, Amendment of Solicitation/Modification of Contract, and include it in Volume III, Price, of the proposal.
L-1.4. Proposals in response to this solicitation will be valid for 360 calendar days. Block 12 of Standard Form (SF) 33 is completed to read 360 calendar days.
L-1.5. Section L of the RFP provides general guidance for preparing proposals as well as specific instructions on the format and content of the required proposal volumes. Proposals must include all data and information requested in the RFP.
L-1.6. No contractor support will be used during the proposal evaluation process.
L-1.7. Offerors submitting a proposal as the prime Offeror in response to this solicitation are not permitted to submit a separate proposal under which they would be a Subcontractor, or team member to another prime. Subcontractors are permitted to support multiple primes.
L-1.8. A Top Secret Facility Clearance is required. An Offeror without the requisite clearance will not be permitted as the prime contractor due to the required security classification. Offerors shall possess or acquire a facility clearance equal to the requirement on the DD254 (RFP Section J, Attachment 1) without additional authorization (i.e. National Interest Determination (NID)) by the proposal due date. If an Offeror does not have the required clearance at the time of proposal submission, the proposal will not be evaluated and is not eligible for award. The Sensitive Compartmentalized Information (SCI) work will take place at a Government facility. Offerors that are unpopulated Joint Ventures may meet this requirement by each member of the Joint Venture possessing a TOP SECRET facility security clearance.
L-2 ACCESS TO BIDDERS’ LIBRARY
L-2.1 Forms, regulations, manuals, Technical Orders, or other publications referenced in the solicitation will not be issued with the solicitation. Documents cited within PWS, Appendix 2 – Publications and Forms, annotated as being available electronically, with the exception of documents labeled "For Official Use Only (FOUO)” or “Controlled Unclassified Information (CUI)” in the title or publication description, are available at http://www.e-publishing.af.mil/. Documents cited as FOUO or CUI as well as other documents, i.e. manuals, workload data, will be made available in the bidder's library at the location listed below. The library will be available by appointment only from solicitation release date through the proposal closing date. E-mail ACC AMIC ACTS Recompete Org Box (ACCAMIC.PKB.ACTSContract@us.af.mil) at least five (5) business days in advance to arrange access. Title the e-mail “Bidders Library Appointment – Company Name” (example: “Bidders Library Appointment – ABC Company”). Offerors will not be allowed to remove any documents labeled FOUO or CUI in the title or publication description from this area. Hours of availability will be determined at the time of request. One computer will be available in the Bidders’ Library. Only one offeror with no more than two (2) representatives per offeror may use the library at any given time. L-2.2. All documents in the Bidders’ Library are either in hard copy or in an electronic format on a laptop at the bidder’s library. The documents that are labeled FOUO or CUI in the title or publication description must be handled in accordance with applicable labeling. Offerors may copy any document that is not labeled FOUO or CUI in the title or publication description to a CD provided by the offeror. Please note use of removable flash media, to include memory sticks, thumb drives, and camera flash memory cards, are unauthorized on all Department of Defense computers.
L-3 FORMAL COMMUNICATIONS
L-3.1. Any formal communication such as requests for clarification, discussions, and information concerning this solicitation shall be submitted in writing (by e-mail) to the Contracting Officer at the address below:

L-3.1.1. Questions in response to this solicitation are due no later than 15 calendar days after final solicitation release date by 12:00 noon EST to the POCs listed above. Questions received after this date will be addressed at the sole discretion of the Contracting Officer. All questions impacting the solicitation will be posted to SAM.gov without referencing the originating sources. NOTE: This solicitation stands independently from prior draft notices. Any previous questions or concerns that may be outstanding must be asked or submitted again.
L-4 SUBMISSION OF PROPOSALS
L-4.1. Proposal Submission. Proposals shall be submitted via the PIEE Solicitation module at https://piee.eb.mil/. An overview of the PIEE Solicitation Module is available: https://dodprocrementtoolbox.com/cms/sites/default/files/resources/2021-08/Solicitation%20Module%20Overview%2020210414.pdf. All Vendors can view solicitations in the Solicitation Module by selecting “SOLICITATION SEARCH” in the Award section or “Solicitation Search” under the SUPPORT section at the bottom of the page. Search for FA489022R0010 postings. The SAM.gov site will reference back to this module.
L-4.1.1. The Solicitation Module is a vendor portal for solicitations within the PIEE platform to automate and secure the process for capturing solicitations, attachments, and responses from industry. The Solicitation Module allows vendors to retrieve and respond to solicitations and communicate directly with Solicitation Managers in a secure environment. Vendors choosing to submit an offer/proposal in d submit a request for the Proposal Manager role. Training resources are provided below (there are additional resources available online as well.

The Government strongly recommends that offerors familiarize themselves with the system: both for retrieving information and to enable them to submit their offers in a timely manner.
L-4.1.2 The offeror shall establish a Proposal Manager account in sufficient time to access documents and submit offers within the RFP’s submission deadline. Proposals must be received no later than the date stated in L-6.3.4. Do not use the PIEE Solicitation Module to submit classified information. Offerors are strongly encouraged to plan accordingly, submit proposals well in advance of the designated submission deadline, and ensure affirmative receipt of proposals. After successfully adding the Offer, a success message of the submission will be displayed in the Solicitation module and the offer display will collapse. The “message of submission”, a red lined box, will be your confirmation and should state something like: “The offer was submitted on 2021-09-22 10:51:07 AM Eastern Daylight Time (2021-09-22 15:51:07 UTC) by Proposal Manager. Please print this page and maintain for your records.” The Solicitation Module automatically tracks the date and time of all submissions. Proposals not received by the designated submission deadline will be regarded as “late” and will not be considered (see FAR 15.208 for further information regarding late proposals).
L-4.1.3 Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal at the time of proposal submission may result in an unacceptable proposal that the Government eliminates from consideration for award. The Government will not accept any changes to offerors’ proposals after the closing date of this solicitation.
L-5 DISPOSITION OF UNSUCCESSFUL PROPOSALS. In compliance with FAR Subpart 4.8, the Government will retain one copy of all proposals.
L-6 PROPOSAL PREPARATION INSTRUCTIONS
L-6.1. The instructions below prescribe the format of proposals. The proposal shall include all of the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation.
L-6.2. A proposal that is orderly and sufficiently documented will enable the Government to easily understand and perform a thorough and fair evaluation. The Government may incorporate into this contract, by reference or full text, portions of the successful offeror’s proposal submitted in response to this solicitation as revised and supplemented through the final proposal revision.
L-6.3. Proposal Format. A complete proposal consists of three (3) separate volumes: Technical, Past Performance, and Price. To the greatest extent possible, each volume shall be written on a stand-alone basis so that its contents may be evaluated with no cross referencing to other volumes of the proposal. Information required for proposal evaluation which is not found in its designated volume and/or section will be assumed to have been omitted from the proposal.
L-6.3.1. General Page Instructions. Page size shall be 8.5 x 11 inches unless stated otherwise within this document. Pages shall be single spaced, and the text size shall be no less than Microsoft Word Times New Roman 10 point font, single column, normal proportional spacing and one inch (1”) margins (top, bottom, left and right). The text for charts, tables, graphs, and figures shall be no smaller than Microsoft Word, Times New Roman 10 point font. Text lines and table lines of text shall be single-spaced. All pages provided by the offeror in excess of the stated limitations will not be evaluated. These page size and format restrictions shall apply to responses to ENs if determined necessary.
L-6.3.2. Table, Chart, and other graphics Instructions. Legible tables, charts, graphics, figures, etc. may be used where a single 8 ½” x 11” page cannot accommodate a table or other graphic. These displays shall not exceed 11” x 17” in size and they shall not be used for pages of text. Each 11” x 17” page shall count as 1 page and are included in the page count, with exception of items stated in L-6.3.5. Text shall be no less than 10 point Times New Roman Font, and margins shall be no less than ½ inch on all sides unless stated otherwise within this document.
L-6.3.3. Submission Format. The Offeror shall submit each volume in electronic format readable by Microsoft (MS) Office Word 2016, MS Office Excel 2016 or Adobe PDF. Each proposal volume shall be in a single searchable file, with copy/paste capability. Offerors shall label each document with the volume and section numbers to which it belongs. This will provide organizational structure and allow rapid location of all portions of the proposal. The offeror shall use the following labeling format for their submissions: [Offeror Name]_[Volume #-Section #]_[Document/File Name]: i.e., Acme_III_Price].
L-6.3.4. Organization/Page Limit/Closing Date. Information submitted shall not exceed the page limits stated below for each volume. Evaluators will only read up to the maximum number of pages specified. If the page limit is exceeded, the pages in excess of the limit will not be considered as part of the evaluation.

L-6.3.5. Pages Not Included in Page Count. The organizational chart, acronym list, cross reference matrix, and overview section (for exceptions) will not be included in the page count. Covers for volumes, tables of contents, indices, title pages, and section dividers/tables will not be included in the page count if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. They will be counted if they contain any other information, e.g., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” will not be counted.
L-6.3.6. Proposal Markings. Proposals shall be marked in accordance with FAR 52.215-1(e), Restriction on Disclosure and Use of Data, and FAR 3.104-4, Disclosure, Protection, and Marking of Contractor Bid or Proposal Information and Source Selection Information. Offerors shall not include proprietary markings on attachments and documents that will become a part of the contract (i.e., L-10.2. Proposal Documentation. )
L-7 EXCEPTIONS
L-7.1. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. If offerors find it necessary to take exception to any of the requirements specified in this solicitation (Sections A through M, to include the PWS and attachments), clearly identify each exception at the front of the appropriate volume along with a complete explanation of why the exception was taken and the resulting benefit to the Government as well as its impact, if any, on the performance, schedule, price and specific requirements of the solicitation. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Offerors are cautioned that taking an exception may render the offer ineligible for award.
L-7.2. If the offeror takes no exception to the stated requirements, a statement to this effect shall be included at the front of the subject volume. The Government will consider the absence of a stated exception at the front of the subject volume to mean the offeror takes no exception to the solicitation and the proposal will be evaluated as submitted.
L-8 INSTRUCTIONS FOR VOLUME I, TECHNICAL (FACTOR 1)
L-8.1. To facilitate evaluation, the Technical Volume shall be specific, detailed, and complete to clearly and fully demonstrate that offerors have a thorough understanding of the requirements to accomplishment the effort. This volume of the proposal shall consist of the offeror’s technical approach, addressing risk management or mitigation strategies, if applicable. The offeror shall provide a clear and concise description of how the offeror plans to meet or exceed the requirements of the RFP, specifically identifying any innovations or efficiencies that would result in cost reductions, cost avoidance, or qualitative improvements resulting in a benefit to the Government in relation to the PWS and the technical evaluation subfactors. The Source Selection Authority, in consultation with the Source Selection Team, is the sole arbiter of whether or not qualitative improvements represent a benefit to the Government. Statements that offerors understand, can, or will comply with the PWS (including referenced AF publications, etc.), statements paraphrasing the PWS or parts thereof (including applicable AF publications, Technical data, etc.), and phrases such as “standard procedures will be employed” or “well known techniques will be used” etc., will be considered unacceptable. Offerors should note that data submitted prior to the proposal submission will not be considered in the Government’s evaluation and such data should not be relied upon or incorporated in the Technical proposal by reference. Offerors shall address the requirements noted in this section by imperative verbs regardless of whether such requirements are preceded by “the offeror shall”. The offeror’s proposal shall, at a minimum, be prepared in a form consistent with the Technical Criteria set forth in Section M, Evaluation Factors for Award, of this solicitation. All information that the offeror deems appropriate to address for this factor and subfactors must be included in the proposal in an orderly format. This section shall not contain any pricing data.
L-8.2. Cross-Reference Matrix. As part of offerors’ proposals, a separate cross-reference matrix shall be completed and submitted with the Technical Volume. All referenced paragraphs include all subsequent subparagraphs (for example, 5.0 includes 5.1, 5.2, 5.2.1, etc.). Offeror shall fill in the columns related to their proposal. This is only a tool to assist in the proposal preparation process and references to the PWS, Sections L and M in the sample matrix below may not reflect actual subfactors and references. Offerors are ultimately responsible for ensuring that their proposal fully addresses all areas and that all requested information is completed in accordance with Sections L and M of this solicitation. Offerors shall complete the last column of this matrix with paragraph number references from the Technical Volume. Offerors may provide additional references to the other columns as deemed necessary. L-8.3. Acronym List. An acronym list shall be provided as an attachment within the Technical Volume.
L-8.4. Technical. The purpose of section L-8.4 is to set forth, in the most comprehensive manner, offerors’ understanding of the program requirements and to demonstrate their ability to meet the evaluation requirements of Section M, Factor 1, Technical. The Technical volume shall present a clear, concise description of how offerors plan to meet award requirements and shall not contain any pricing data.
L-8.4.1. Technical Subfactors.
L-8.4.1.1. Subfactor A: Management.
L-8.4.1.1.1. Aspect I: Program Management. Provide an organizational structure and explanation of the proposed program management approach to meet and perform PWS requirements by addressing the following:
· Provide an organizational chart that identifies responsibilities, functional relationships (to include teaming partners and subcontractors), and lines of communication.
· Describe rational for selecting key positions to successfully execute the requirements of the program.
· Summarize key management and technical positions and list minimum qualifications of each position. Your summary shall include, at a minimum, the following information:
· Position/Title
· Work Experience (management, supervision, technical)
· Clearance (Top Secret, Secret, national agency check)
· Certifications
· Training
· Provide labor categories, roles, skill levels, number of personnel, and proposed shift or duty schedules required to meet PWS requirements using the format provided in the ACTS Site Manning and Shift Matrix.
· Provide proposed staffing processes to ensure all needed personnel resources are provided to successfully accomplish or exceed program requirements.
· Describe process to ensure continuation of services and minimal impact to contract requirements during personnel absences due to sickness, leave, voluntary or involuntary termination from employment.
· Describe plan for supporting flexible operational schedules, deployments, and surge operations.
L-8.4.1.1.2. Aspect II: Quality Management. Provide an organizational structure and explanation of the proposed quality management approach and QMS controls to meet and perform PWS requirements by addressing the following:
· Describe the approach to meet ANSI/ISO/ASQ 9001:2015 requirements and paragraph 3.5.3.1.3 of the PWS.
· Identify QMS methods to enforce compliance with technical data, deficiency resolution procedures, and continual process improvement procedures.
· Describe the number and distribution of quality control personnel across the ACTS program.
L-8.4.1.2 Subfactor B: Operations, Maintenance, & Engineering
L-8.4.1.2.1. Aspect I: Operations. Describe approach to provide proactive, flexible operations to reduce system downtime and maximize ACTS operational availability by addressing the following:
· Provide plan to perform ACTS loading, unloading, and transport to meet flying and debriefing schedules.
· Describe plan to perform all necessary tasks to ensure an instrumented debrief capability.
· Describe approach to perform all ACTS operations in compliance with security and safety requirements.
· Describe approach to provide certified personnel to perform all necessary RTO and TDLM tasks.
· Describe technical expertise operating and using the airborne systems, ground systems, communications systems, datalink systems, RTO systems, network systems, and Virtual/Constructive systems listed in the PWS.
L-8.4.1.2.2. Aspect II: Maintenance. Describe approach to provide a comprehensive maintenance program that meets requirements stated in the PWS for ACTS sustainment by addressing the following:
· Describe technical expertise maintaining, troubleshooting, and repairing the airborne systems, ground systems, communications systems, datalink systems, RTO systems, network systems, and Virtual/Constructive systems listed in the PWS.
· Identify expertise with using test equipment, to include ACTS-specific maintenance (e.g. pod-leveling tool), and tools listed in this PWS and technical exhibit.
· Describe expertise in ensuring that test equipment is ready to use for maintenance on assigned equipment.
L-8.4.1.2.3. Aspect III: Engineering. Describe approach to provide a comprehensive engineering function that meets requirements stated in the PWS by addressing the following:
· Provide a summary that identifies projected number, type and locations of engineering personnel.
· Describe rational for selecting the projected number, type, and locations of engineering personnel and how they will help the offeror successfully execute the requirements of the program.
· Describe software engineering capability for comprehensive product development and lifecycle support.
· Describe software engineering expertise for evolving and integrating software products with ACTS equipment covered by this PWS.
· Describe capability to provide Radio and Transceiver System engineering support in requirements collection, system design, architecture development, configuration management, and troubleshooting.
· Describe capability for on-site Radio and Transceiver System engineering support to include implementation of final designs and approach for accomplishing on-tower installations.
· Describe capability to provide Network System engineering support in requirements collection, system design, architecture development, configuration management, and troubleshooting.
· Describe capability for on-site Network engineering support to include implementation of final designs and integration with local networks and circuits.
L-8.4.1.3 Subfactor C: Transition. Describe approach for effectively transitioning resources and personnel during Phase-In at the start of the contract by addressing the following:
· Provide key milestones, process flow chart, and proposed timeline for staffing phase-in at each location to prevent interruption in services.
· Describe processes for transitioning all existing work (work orders, requisitions, and items in the incumbent’s data management system) to hand-off and complete open actions.
· Identify proposed controls and procedures to verify that all major subcontracted efforts will be in place as necessary for contract performance.
L-9 INSTRUCTIONS FOR VOLUME II, PAST PERFORMANCE (FACTOR 2).

L-9.1.1. Summary. Describe roles of offerors and all subcontractors, teaming partners, and/or joint venture partners requiring past performance information IAW paragraph L-9.1.2.
L-9.1.2. Past Performance Information (PPI) Contract References (see Attachment 1). Offerors shall submit information on Federal, State, and local government and private contracts considered most relevant in demonstrating the ability to perform the ACTS Operations, Maintenance, and Engineering Services. This information is required on offeror, subcontractors, teaming partners, or joint venture partners considered critical to overall successful performance. Information for individual task order/call/delivery/purchase order contract shall be submitted as a separate PPI reference. The offeror shall provide a maximum of three (3) contract references, each with a PPI Sheet identifying active or completed contracts, for the prime offeror. In addition, the offeror may provide a maximum of three (3) different contract references, each with a PPI Sheet identifying active or completed contracts, for each proposed critical subcontractor, teaming partner or joint venture partner. To clarify, if an offeror has two subcontractors or partners, the offeror may submit up to 9 references; three references as prime and three for each subcontractor or partner. PPI reference inputs will be treated as source selection information IAW FAR Part 2.101 and 3.104.
L-9.1.2.1. Recency Determination. Each PPI contract reference shall have active work/services (minimum of 12 months performance) that was/were performed during the last three (3) years preceding the date of issuance of this solicitation. This includes contracts that were awarded prior to this period, but still had active performance (minimum of 12 months) during the last three years.
L-9.1.2.2. Relevant Contracts. Offerors shall submit performance information on contracts they consider relevant to this effort. This information should include rationale supporting their assertion of relevance IAW Section M, Evaluation Factors for Award, paragraph M-3.2.2. of this solicitation. Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort, and to what aspects of the ACTS PWS they relate.
L-9.1.3. Subcontractor/Teaming Partner Consent Letter (Attachment 2). The offeror shall provide an original consent letter for each proposed Subcontractor or Teaming/Joint Venture Partner using the format provided in section L Attachment 2, Example Format for Consent Letter. This letter allows the release of Sub-contractor or Teaming/Joint Venture Partner, Present/Past performance information to the offeror. PPI concerning subcontractor and teaming partners cannot be disclosed to a private party without the subcontractor’s or teaming partner’s consent. Because a Prime Contractor is a private party, the Government will need that consent before disclosing subcontractor/teaming partner PPI to the Prime during exchanges with offerors after receipt of proposals. Completed consent forms shall be submitted as part of the Past Performance Volume.
L-9.1.4. Organizational Structure Change History. Many companies have acquired, have been acquired by, or have otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate the Government’s past performance evaluation, offerors shall include in this proposal volume a detailed “roadmap” describing all such organizational changes (if applicable), to include specific names of “sister”, predecessor, subsidiary companies with their applicable CAGE codes, and dates of organizational changes.
L-9.2. Past Performance Questionnaires (PPQ) (Attachment 3). When completed CPARS is available to reflect past performance data, a Past Performance Questionnaire (PPQ) is not required. Offerors without formal documented Government Contractor Performance Assessment Reports (CPARS) shall send a Past Performance Questionnaire (PPQ) to the Government or commercial POC identified in each PPI reference cited in the offeror’s Past Performance Volume. All PPQs are to be submitted by the submitting PPI POC and sent via email directly to ACCAMIC.PKB.ACTSContract@us.af.mil. Any PPQs submitted by offerors will be ignored and will not be considered as part of the evaluation. The Government may also utilize the attached PPQ to send to additional sources. In the event no past performance can be retrieved via PPIRS, the Government may use the attached PPQ as a tool for conducting Past Performance telephonic or email interviews.
L-9.3. Other Sources. The Government may utilize references other than those identified by offerors in evaluation of offerors’ Past Performance. While the Government may elect to consider data obtained from other sources, the burden of providing accurate and complete, recent and relevant PPI that demonstrates the ability to perform this requirement rests with each offeror.
L-9.4. Determination of Responsibility. Even though the assessment of Past Performance is separate and distinct from Determination of Responsibility required by FAR Part 9, PPI contained herein may be used to support the Determination of Responsibility for successful offerors.
L-9.5 Authorization Letter. In order to validate a prime offeror's past performance as a subcontractor on a submitted PPI contract reference, offerors are required to provide written authorization for the Government to contact the prime contractor on the contract referenced in the submitted PPI.
L-10 INSTRUCTIONS FOR VOLUME III, PRICE (FACTOR 3)
L-10.1. The offeror shall provide all Schedule B information (Schedule of Supplies and Services) Contract Line Item Numbers (CLINs) information in the attached Microsoft Excel spreadsheet (see RFP Section J Attachment XX). This spreadsheet will be used to populate the contract Schedule B CLINs upon award. The offeror shall insert the price elements (unit price and extended amount) for all Firm Fixed Price (FFP) CLINS. The Government has pre-filled a not-to-exceed (NTE) amount for Cost Reimbursable CLINs. These pre-established amounts are to be included in the offerors proposal exclusive of indirect rates and fee. Offerors shall not change the pre-established NTE amounts for the CLIN.
L-10.1.1. For ease of administration, offerors shall round all unit prices of proposed FFP CLINs to whole dollar amounts before they are multiplied by the quantity. The unit price multiplied by the number of units shall equal the extended price of each CLIN. If submitted unit prices are not rounded to the nearest dollar, the Government will round the unit prices to whole dollar amounts at the time of contract award or modification. If the decimal is followed by 5, 6, 7, 8, or 9, the price will be rounded up to the nearest whole dollar. If the decimal is followed by 0, 1, 2, 3, or 4, the price will be rounded down to the nearest whole dollar.
L-10.1.2. Supporting Price Backup Data. Certified cost or pricing data is not required; however, supporting data other than certified cost and pricing data is requested. Supporting data should explain the methodology used in developing your price. This information shall be submitted in Microsoft Excel and supplemented with a Microsoft Word document as needed. The documentation provided shall provide support for all direct and indirect costs proposed based on the offeror’s accounting system and any applicable Forward Pricing Rate Agreements.
L-10.1.3. Service Contract Labor Standards. Offerors shall comply with clause 52.222-43 for their price proposal with regard to employees covered by the Service Contract Labor Standards. Proposed option year prices shall not include allowances for any contingency to cover increased wage or benefits costs for which contract price adjustment is provided by clause 52.222-43.
L-10.1.4. Reasonableness and Realism. Any inconsistency, whether real or apparent between promised performance/technical approach and price, shall be explained in the proposal. The burden of proof as to price credibility rests with the offeror.
L-10.1.5. Unbalanced Offers. Offerors are cautioned against submitting an offer with unbalanced pricing; see FAR 15.404-1(g). Examples of unbalance pricing include: proposed labor rates that are significantly less than or significantly overstated in relation to the proposed rates for other labor categories (either of the offeror’s proposal or the same labor categories as proposed by other offerors); significant differences between proposed labor rates in the same labor category between option periods; or proposed prices from year to year are above what would be considered a reasonable adjustment for inflation.
L-10.2. Proposal Documentation. In addition to the pricing information requested above, this volume shall also contain the following documents:
L-10.2.1. Section A. Complete in its entirety the “Offeror” portion of the SF 33; an official having the authority to bind your company contractually must sign the SF 33 IAW FAR 4.102. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through J. These sections constitute the model contract. One copy of the SF 33 must bear an original signature.
L-10.2.2. Sections C Through K. Complete the necessary fill-ins and certifications, and provide any information requested in Sections C through K. For Sections C through I, the offeror shall submit only those pages that require a fill-in. For Section K, complete Representations, Certifications and Other Statements of Offerors, or provide a copy of completed System for Award Management (SAM) located at https://www.sam.gov.
L-10.2.3. Amendments. Offerors shall acknowledge awareness of all amendments to the solicitation by signing and dating Page 1 of each Standard Form 30, Amendment of Solicitation/Modification of Contract, and include it in Volume III, Price, of the proposal.
L-10.2.4. Responsibility Information. Contracts shall be awarded to responsible prospective contractors. To assist the Contracting Officer in making the responsibility determination in accordance with FAR 9.1, Responsible Prospective Contractors, provide the following information.
L-10.2.4.1. A written statement explaining the offeror’s ability to obtain required resources to perform the contract requirements per FAR 9.104-1(a),. The offeror shall also provide evidence to support the explanation. Evidence may include, official letter(s) from financial institutions demonstrating that the offeror has the financial resources required to cover all financial commitment.
L-10.2.4.2. An Explanation of the offeror’s organizational controls and measures per FAR 9.104-1(e). At a minimum, the offeror shall address their accounting controls, operational controls, quality assurance measures, and safety program. The offeror shall also provide evidence to support the explanation. Evidence may include a list of organizational policies or Standard Operating Procedures (SOPs) which demonstrates the organizational controls and measures of the offeror. If a list is provided, the offeror shall include the title of each policy or SOP, the date of each document, and a brief description of each document. The offeror shall also define which element of FAR 9.104-1(e) the policy or SOP applies to.
L-10.2.5. Pre-award Clearances. Provide the following documentation:
L-10.2.5.1. EEO (FAR 52.222-24): Provide the information required by FAR 22.805(a)(5) for the prime and any subcontractors over $10M (total value), or a copy of the applicable Notices of Compliance; and
L-10.2.5.2. VETS-4212 (FAR52.222-37 & 52.222-38): Provide documentation that the prime, and any subcontractors over $150k (total value), is/are current with their reporting as required by FAR Subpart 22.13.
L-10.2.6. List any exceptions and deviations to the RFP.
L-10.2.7. Changes Resulting From Discussions. In the event any adjustment of price becomes necessary to reflect changes resulting from discussions, if discussions are held, a complete traceable trail shall be provided to show how the changes took place.
L-11. Debriefing of Offerors. Debriefings are conducted to identify to offerors their evaluated weaknesses and/or deficiencies for consideration in preparation of future proposals. Successful or unsuccessful offerors may request debriefings by providing a written request to the Contracting Officer. Debriefings shall be conducted in accordance with FAR 15.505 for pre-award debriefings and FAR 15.506 for post-award debriefings.
