PERFORMANCE WORK STATEMENT

Performance Work Statement

Custodial and Refuse Collection Services

Poe’s Ridge Recreation Area Moncure, NC 27559

I. General Information

A. Introduction

The purpose of this work is to provide custodial and refuse collection services at Poe’s

Ridge recreation area. These facilities are located in Moncure, Chatham County, North

Carolina 27559. They are operated and maintained by the U.S. Army Corps of Engineers, Wilmington District.

B. Background

Poe’s Ridge consists of B. Everett Jordan Dam Visitor Assistance Center (VAC), Jordan

Dam, Dam Tailrace area, Boat Ramps, access roads, picnic areas, playgrounds, and shoreline areas open for fishing.

All facilities (and grounds) as described and shown in attached maps are associated with the following addresses:

C. Variations in Estimated Quantities

The number of facilities covered under this contract are subject to change as a result of an increase or decrease in public visitation, flood water storage or other factors. If the addition or removal of equipment and facilities causes an increase or decrease in the cost of performing the work, an adjustment may be made in accordance with the “Changes” clause.

D. Normal Working Hours

Normal working hours for the contractor shall be 7:30 am - 4:30 pm, unless otherwise specified, or as specifically approved in advance by the Contracting Officer’s

Representative. No work on site other than specified shall be permitted without specific approval by the Contracting Officer’s Representative (COR).

Daily requirements inside the Visitor Assistance Center shall be completed by 10:00 am on scheduled days; all other daily tasks shall be complete by 3:00 pm.

E. Site Visit

Contractors are encouraged to schedule a site visit at Poe’ Ridge to prevent underbidding.

II. Pre-Work Conference and Commencement of Work

A. Once awarded, the Contractor or their representative shall attend a pre-work meeting on site prior to commencement of work.

B. The Contractor shall obtain all maps and instructions from the Government necessary to accomplish the work.

C. The Contractor shall inspect the site to become familiar with the facilities and requirements which may affect the work or costs to perform the work. Any failure by the

Contractor to review all available information concerning these conditions shall not relieve them from the responsibility for estimating the difficulty or cost of successfully performing the work.

D. The (Primary) Contractor shall be fully responsible for the quality control, administration, contractor health, and the comprehensive safety requirements of the

Wilmington Safety Office.

III. Period of Performance

A. The contract Base Performance Period shall be followed by four (4) Optional

Performance periods.

a. Base Period of Performance:

1) 1 March 2024 thru 28 February 2025

b. Optional Performance Periods:

1) 1 March 2025 thru 28 February 2026

2) 1 March 2026 thru 28 February 2027

3) 1 March 2027 thru 28 February 2028

4) 1 March 2028 thru 28 February 2029

B. Upon award of the contract, the Contractor shall commence work under this contract on the first scheduled day of service. An approved Activity Hazard Analysis (AHA) for all work associated with the contract and accepted by the Wilmington Safety Office is required before commencing work as mentioned below in Section VII.B. Activity Hazard

Analysis (AHA).

a. Contractor employees are required to be visibly identifiable as a federal contractor while onsite. (i.e. uniform, badge, vest, etc.)

b. Subcontractors: If the primary contractor plans to use subcontractors the subcontractor shall be lined up and ready to work on the start date above to avoid commencing the contract in default.

c. Primary Contractor: The primary contractor is responsible for the onsite supervision of their subcontractors and shall be onsite for the safety and quality enforcement of the contract.

C. Inclement Weather and Holiday Work

a. The Contractor shall maintain the schedule of services despite inclement weather, except when severe conditions make it impractical or hazardous to perform the work.

b. The Contractor shall perform services on federal holidays between 1st April and 31st

October (Peak Season).

c. The Contractor shall not perform services on federal holidays between 1st November and 31st March unless specifically outlined in requirements below.

IV. Performance Requirements

A. The Contractor shall perform work as specified in this scope of work to the satisfaction of the Contracting Officer during normal working hours unless otherwise specified, or as specifically approved in advance by the COR. The COR has no authority to make changes to this scope of work. Changes must be agreed upon by the Contractor and

Contracting Officer in Wilmington.

B. Additional Government Contracts/Contractors

a. The Contractor shall cooperate fully with all Contractors in the area and shall not impede the work of others in any way.

C. Water Requirements

a. Water required for cleaning may be obtained from existing Government water supply systems. The Contractor shall furnish all equipment necessary to load, contain, and transport water for cleaning in areas where water is not available.

D. Vehicle Requirements

a. All vehicles utilized under this contract shall be presentable, serviceable and shall comply with all applicable Federal and State motor vehicle regulations.

b. All vehicles utilized under this contract shall meet all safety requirements set forth in

EM 385-1-1.

c. All Contractor vehicles shall be identified with the company name or logo, type of business and address conspicuously displayed on the door panels. Professionally done hand lettering, magnetic signs, or pressure sensitive decals with 1½” or larger lettering may be used to comply with this specification.

d. The Contractor shall be required to equip vehicles with approved magnetic signs indicating that vehicles are operating under contract to the U.S. Army Corps of

Engineers.

e. The Government reserves the right to inspect all equipment proposed by the contractor for use in performance of custodial services and refuse collection prior to offer acceptance, prior to commencement of work, and/or during performance under the contract. Equipment which is not acceptable to the Contracting Officer shall be replaced at no additional cost to the government.

E. Supplies and Equipment Required

a. The Contractor shall furnish all cleaning supplies, Safety Data Sheets (SDS), materials, and equipment. All cleaning material, paper products, and other supplies furnished by the Contractor shall be considered green and/or biodegradable.

b. The Contractor shall furnish samples of all cleaning supplies and related materials proposed for use under this contract to the Government for approval prior to use.

Samples shall include but are not limited to the following items: soaps, detergents, disinfectants, insecticides, deodorants, chrome polish, refuse container liners, and toilet tissue.

c. No cleaning solutions or products shall be stored on Government property unless clearly identified. No unmarked bottles, cans or other containers shall be used.

d. The Contractor shall obtain Safety Data Sheets for all cleaning products used; and those SDS will be stored where the products are accessed or stored.

e. All supplies, materials, and equipment shall be kept in janitor’s closets or pipe chase areas around the work locations.

f. Contractor shall ensure that these storage areas are free of dirt, debris, insects, insect nests, trash, and empty containers. Equipment and supplies shall be stored in a neat and orderly fashion so that there is easy access to equipment in the pipe chase.

g. Cleaning supplies ordered and shipped to the VAC while the contractor is not onsite will be received by USACE staff and stored near the entrances in which they were delivered. All boxes of cleaning supplies received by USACE staff and stored in the

VAC shall be removed and distributed to their proper storage areas by the contractor on the following day of scheduled service.

h. The Government will not be responsible for any supplies addressed to the project office /VAC which are mis-delivered, damaged or missing. The Contractor shall direct delivery drivers not to leave packages outside of buildings or to drop off shipments after 4:30 pm.

F. Government Owned Equipment

a. The areas to be serviced under this contract are equipped with thirty-two (32) gallon refuse containers with lids. The Contractor shall be responsible for taking all reasonable precautions in handling the refuse cans to ensure against damage to the cans and lids. Any cans or lids which are wantonly or deliberately damaged by the contractor or any of his employees shall be replaced by, and at the expense of, the

Contractor and to the satisfaction of the COR.

V. Work Requirements

A. Sanitary Facilities

a. The Contractor shall ensure that sanitary facilities are sanitary, clean, free of objectionable odors, and always have supplies of toilet tissue, paper towels, and soap.

b. The Contractor shall ensure all drains and lines are inspected, and clogs removed.

c. The Contractor shall ensure all light fixtures are cleaned, ensuring there are no spider webs, dust accumulations and/or bugs inside the fixture.

d. The Contractor shall inspect, deodorize, and clean facilities including, but not limited to fixtures, mirrors, commodes, partitions, floors, walls, ceilings, doors, and windows to result in no spots, streaks, dirt, or other residue(s) left behind.

e. The Contractor shall ensure a disinfectant-type cleaner is used and allowed sufficient contact time to be effective per manufacturer’s recommendations.

f. The Contractor shall dry recently cleaned surfaces before use of the facility by the public.

g. The Contractor shall ensure all hard surfaced floors have dried and shall remove wet floor signs before leaving for the day.

h. The Contractor shall remove all insects, insect nests, and webs, from louvers, screens, doors, windows, inside and outside walls, ceilings, recesses, and eaves.

i. The Contractor shall ensure interior areas subject to wet or damp conditions kept free of mold, mildew, fungi, and other biological formations.

j. The Contractor shall clean outside grounds and facilities including walks, paved parking areas, water fountains, and benches.

k. The Contractor shall ensure water fountains, sinks and toilets are kept clean, free from foreign matter and in a sanitary condition.

l. The Contractor shall furnish and distribute roll toilet tissue, paper towels, and soap as necessary to make a continuous supply available to the public. An adequate supply of rolls of toilet tissue, paper towels, and soap shall be maintained in each facility to assure that the supply shall not become depleted between cleanings. Toilet tissue equal to no less than 75% of dispenser capacity shall be placed in facility dispensers each scheduled day. Care shall be exercised during cleaning operations to protect toilet tissue from becoming wet. If toilet paper becomes wet, dry rolls shall be placed in the dispenser. Toilet paper shall be stored in pipe chase areas. Wet floor signs shall be placed during the mopping of floors.

B. Restroom Schedules

a. Visitor Center Staff Restroom Facilities Schedule: Sanitary facilities at Visitor

Centers shall be checked and cleaned two (2) days per week (Monday, Thursday) year-round.

b. Visitor Center Public Restroom Facilities Schedule: Sanitary facilities at Visitor

Centers shall be checked and cleaned three (3) days per week (Monday, Wednesday, Saturday) year-round.

(1) Additionally, these sanitary facilities shall be checked and cleaned the day after the following holidays: Memorial Day, July 4th, and Labor Day even if not on a typically scheduled day.

c. Tailrace Fishing Area Restroom Facilities Schedule: All sanitary facilities at

Tailrace Fishing Areas shall be checked and cleaned as shown below during the Peak

Season. During off-peak months, all open facilities shall be checked and cleaned three

(3) times per week (Mondays, Wednesdays, and Saturdays).

1) The Contractor shall ensure all Tailrace sanitary facilities are checked and cleaned the day after the following holidays: Memorial Day, July 4th, and Labor Day even if not on a typically scheduled day.

Peak Season:

1 April to 31 Oct.

Peak Season: 5 days a week - Monday, Wednesday, Friday, Saturday, Sunday

Off Peak: 3 days a week – Monday, Wednesday, Saturday

d. Vault Toilet Schedule: The Contractor shall maintain and clean the single vault toilet at Poe’s Ridge Boat Ramp. Cleaning shall include, but is not limited to sweeping interior, removing cobwebs and insect nests, scrubbing seats with detergent, treating seat and floor with disinfectant, cleaning outside of building and providing toilet paper. Hand sanitizer shall be stocked and maintained.

The vault toilet shall be checked and cleaned five (5) days per week (Monday, Wednesday, Friday, Saturday, Sunday) (including holidays) during Peak Season.

1) The Contractor shall ensure the vault toilet is checked and cleaned the day after the following holidays: Memorial Day, July 4th, and Labor Day even if not on a typically scheduled day.

2) 1st November – 31st March the vault toilet shall be checked and cleaned at least three (3) times per week (Mondays, Wednesday, and Saturday).

C. Impact Sites (Picnic Sites/Tables/Shelters/Grills)

a. Picnic Sites/Tables refer to tables that are both the Mini-Shelter type and just picnic tables. They range from just tables sitting out to those that sit on a gravel pad with a grill.

b. The contractor shall clean tables, including seats, and tops, clean the slab, eaves, and underside of the roof (as applicable), and clean adjacent grounds and facilities such as parking areas, steps, and walks of litter, including pop tops and cigarette butts.

c. The Contractor shall ensure all impact sites and associated amenities are checked and cleaned three (3) times per week (Mondays, Wednesdays, and Saturdays) from 1st

April thru 31st October.

d. From 1st November thru 31st March The Contractor shall ensure all open facilities are checked and cleaned one (1) time per week (Monday).

e. Cleaning shall include trash removal, grill cleaning, and the removal of food items left behind by visitors.

f. Contractor cleaning shall only be completed when picnic sites are not occupied by visitors.

g. The Contractor shall remove ashes and debris from within and around grills and dispose of properly. The Contractor shall ensure take care in the disposal of hot ash material to prevent fires and endanger visitors or Contractor employees.

D. Overlook

a. The Overlook shall be checked, and trash litter cleaned up to three (3) times per week

(Mondays, Wednesdays, and Saturdays) from 1st April thru 31st October.

b. The Overlook shall be checked, and trash litter cleaned up to one (1) time per week from 1st November thru 31st March.

E. Garbage/Recycling Collection And Disposal

a. The Contractor shall check all outdoor refuse and recycling containers during each scheduled pickup.

b. The Contractor shall empty each trash can, equip the can with a new clear plastic bag insert, and replace the can lid.

c. Collection vehicles shall have closed bodies or employ tarps to prevent loss of material during transport to disposal site.

d. Collected material (trash, garbage, debris, etc.) shall be disposed of in the dumpster.

e. Trash, and debris on the ground and within sight of cans shall be removed. Cans that are soiled internally or externally shall be washed and disinfected. Damaged or missing trash cans shall be reported to the Government. Advise the Government promptly when any household or other outside garbage or debris is found on the

Project.

f. The Contractor shall ensure that garbage and recyclables are emptied into the appropriate dumpsters. Garbage shall not be emptied into the dumpster marked

Recyclables Only. Recyclables shall be dumped into the Recyclables dumpster loosely, and not in plastic bags. Recycling centers do not accept plastic bags.

g. Trashcans and Recycling Containers (with exception of Tailrace Fishing Areas) shall be checked and emptied when half full four (4) times per week (Mondays, Wednesdays, Saturdays, and Sundays) from 1st April thru 31st October (including holidays).

h. All trashcans shall be checked and emptied the day after the following holidays:

Memorial Day, July 4th, and Labor Day even if not on a typically scheduled day.

i. From 1st November thru 31st March all trashcans shall be checked and emptied two

(2) times per week (Mondays and Saturdays).

j. Trashcans and Recycling Containers at the Tailrace Fishing area shall be checked and emptied regardless of amount of trash found in them. Tailrace trashcans shall be checked and emptied seven (7) days per week from 1st April thru 31st October

(including holidays).

k. All trashcans shall be checked and emptied the day after the following holidays:

Memorial Day, July 4th and Labor Day even if not on a typically scheduled day.

l. From 1st November thru 31st March all trashcans shall be checked and emptied two

(2) times per week (Mondays and Saturdays).

F. Removal Of Litter And Debris From Public Use And Operational Areas (Ramps, Playgrounds, Park Roadsides, Parking Lots, Boat Ramps, Mowed Areas, Riprap, etc.)

a. The Contractor shall pick up trash, paper, bottles, dead animals, limbs, cans, etc. and dispose of properly at all associated facilities. This includes in hard-to-reach areas such as steep slopes and riprap areas and to the water’s edge. The work shall be performed seven (7) days per week (including holidays) 1st April thru 31st October.

b. During off-peak season, 1st November thru 31st March the work shall be performed four (4) times per week (Mondays, Wednesdays, Thursdays, and Saturdays).

G. Cleaning of Fishing Piers, Fishing Platforms and Courtesy Docks

a. The Contractor shall ensure the fishing piers and courtesy docks are checked and cleaned one (1) time per month year-round of bird droppings.

b. The Tailrace Fish platform and walkway shall be scrubbed with water and stiff brush.

All debris shall be removed from these areas prior to hosing with water to prevent undesirable material from being washed into the river.

1) NOTE: Cleaning of fishing platform and walkway shall not be conducted during the months of December, January, or February.

H. Visitor Assistance Center

a. The contractor shall provide cleaning services as necessary for Jordan Lake Visitor

Assistance Center (VAC). The VAC contains approximately 2679 sq. ft. of floor space with carpet and tile floors that require cleaning, vacuuming, and periodic stain removal. The exhibits in the Visitors' Center portion of the buildings also require regular cleaning. The VAC contains extensive plate glass doors and windows, which require cleaning twice per year.

b. The Contractor shall perform cleaning and recycling services at a time and in such manner to minimize the impact on staff and visitors. Cleaning supplies, toilet paper and paper towels shall always be stocked in the janitorial closet. These tasks shall be performed during normal business hours.

c. Cleaning of restrooms shall comply with Section V.A. Sanitary Facilities. Cleaning of kitchens shall include cleaning and disinfecting of countertops, sinks, exterior of appliances, table, and chairs. The contractor shall leave them free of any residue, spots, smudges, stains, or other marks.

d. The following is a guide for performing these services. The contractor shall provide services as necessary to maintain an acceptable professional appearance. Daily requirements shall be completed by 10:00 am on scheduled days.

1) Daily Requirements (Monday and Thursday):

(1) Empty and clean trash receptacles.

(2) Clean and maintain rest rooms, kitchen counters, stovetops, sink and cabinets, replace tissue, soap/dish soap and paper towels.

(3) Sweep and keep clean all entrance/doorways free of leaves, cobwebs, debris, etc.

(4) Sweep or vacuum floors, includes entrance areas.

(5) Wet mop tile and wooden floors

(6) Clean Glass and Exhibit Surfaces in Reception Areas/Lobby

2) Weekly Requirements (Thursday):

(1) Dust furniture, cabinets, picture frames, tables, counters, window sills, baseboards, and office machines.

(2) Inspect area (inside and outside porches/patios) for insect nests and webs;

treat and/or remove.

(3) Clean all outdoor interpretive panels at VAC patios and overlooks.

(4) Litter pick-up around building and any visible litter in nearby wooded areas.

(5) Empty recycling bins.

3) Special Cleanings:

(1) Strip and wax tile floors once per year in January.

(2) Shampoo and clean carpets once per year in January using a dirt extracting carpet cleaner.

(3) Clean, polish and buff wooden floors in the visitor area once per year in

January.

(4) Clean all windows inside and out, blinds, light fixtures, and dust air vents/intakes once per year in January.

I. Maintenance Shop and Shed

a. The contractor shall provide cleaning services as necessary for B. Everett Jordan

Lake Maintenance Shop. The Maintenance Shop contains approximately 1500 sq. ft. of floor space with tile floors that require cleaning.

b. The contractor shall perform cleaning and recycling services at a time and in such manner to minimize the impact on staff and visitors. Cleaning supplies, paper towels and toilet paper shall always be stocked in the janitorial closet in shop. These tasks shall be performed during normal business hours.

c. Cleaning of restroom shall comply with Section V.A. Sanitary Facilities and include the shower.

d. The following is a guide for performing these services. The contractor shall provide services as necessary to maintain an acceptable professional appearance. The

Contractor shall clean these areas by 3:00 pm on scheduled days.

1) Weekly Requirements (Thursday):

(1) Empty and clean trash receptacles.

(2) Clean and maintain rest room, replace tissue, soap/dish soap and paper towels.

(3) Sweep and keep clean all entrance/doorways free of leaves, cobwebs, debris, etc.

(4) Sweep or vacuum tile floors.

(5) Wet mop tile floors

(6) Dust furniture, cabinets, picture frames, tables, counters, window sills, baseboards, and office machines.

(7) Inspect area (inside and out) for insect nests and webs; treat and/or remove.

(8) Litter pick-up around building and any visible litter in nearby wooded areas.

(9) Empty recycling bins.

2) Special Cleanings:

(1) Strip and wax tile floors once per year in January.

(2) Clean all windows inside and out, blinds, and light fixtures once per year in

January.

VI. Quality Control/Quality Assurance

A. General

a. The Contractor (Primary Contractor) is responsible for maintaining adequate quality control to be sure the specifications of this contract are met (by the subcontractor).

B. Quality Control (QC)

a. The Contractor shall utilize or establish a complete QC Inspection Checklist to assure all the requirements of the contract are provided as specified. One copy of the

Contractor's QC Inspection Checklist shall be provided to the Government at the pre work conference and an updated copy shall be provided to the Government as changes occur.

b. The QC Inspection Checklist shall cover all work completed during the site visit each day. The daily checklists shall be provided to the Government by the Primary

Contractor upon completion each day for quality assurance inspection and invoice verification. It may be a hard copy in person, e-mail to john.h.rochevot@usace.army.mil, or a text message to (919) 801-1902.

The Primary Contractor shall not expect the COR to Quality Control their subcontractors.

Failure to Quality Control subcontractors will result in a Notification of

Contract Discrepancy Report to the Primary Contractor when functional areas of this contract are not met. This may require the contractor to return to the site for correction and/or result in a delayed or reduced payment.

C. Quality Assurance (QA)

a. The Government will monitor the Contractor's performance in each functional area under this contract and reserves the right to use additional surveillance procedures. If the Contractor fails to perform according to the performance standards of the contract including QC, a Notification of Contract Discrepancy Report will be issued to the

Primary Contractor by the Government.

b. The Contractor shall explain in writing why the performance was less than satisfactory, and how recurrence of the problem shall be prevented in the future. The

Government may make inspection of services rendered. Any work not meeting acceptable standards will be remedied to the satisfaction of the Government prior to payment. Failure or inability to perform acceptable services may result in a delayed or reduced payment.

VII. Government Safety Requirements

A. Safety

All work shall be conducted in a safe manner and comply with OSHA standards and EM

385-1-1:

a. The following reference paragraphs from the safety manual are applicable to landscape operations, but may not be all-inclusive:

1) Use high visibility work vests when working on or near roadways, or near heavy equipment. High visibility apparel shall comply with ANSI/ISEA 107, Class 2 requirements. sec. 5.F.01.

2) The minimum clothing worn shall be short sleeve shirts and long pants (The wearing of shorts is not approved), and leather or other protective work shoes or boots for this contract. sec 5.A.06.

3) Hearing protection shall meet the requirements of ANSI S3.19.

4) All vehicles and equipment trailers shall have working brake lights, turn signal lights, and emergency flashers. Emergency flashers shall be used whenever vehicles and/or equipment trailers are parked on roadways or road shoulders.

b. The employer (Primary Contractor) shall be responsible for maintaining a safety program that complies with all Federal and State safety standards and the requirements specified herein.

B. Activity Hazard Analysis (AHA)

a. An approved Activity Hazard Analysis (AHA) for all work associated with the contract and accepted by the Wilmington Safety Office is required before commencing work. The Contracting Officer will provide electronic copies of the

AHA form. The Contractor shall commence work under this contract on the first scheduled day upon acceptance of the AHA.

C. Daily Safety Meetings

a. The Contractor shall conduct daily safety meetings to discuss the activities for the day, including a review of the AHA for planned activities for the day, if necessary, updating the AHA, and a discussion about any unusual conditions. The meeting shall be documented (form provided by the COR) and given to the Contracting Officer at the end of the work week.

D. Public Safety

a. The contract work shall be taking place in public areas and government personnel may require access during the work period. Contractors shall take all necessary precautions to ensure the safety of the visiting public and government personnel.

E. Accident Notification Plan

a. In the event of an accident, notification to the Contracting Officer or designated representative shall occur as soon as possible, but not later than 4-hours after occurrence. Accident notifications shall be followed up with an ENG Form 3394, USACE Accident Investigation Report. ENG Form 3394 serves as the Initial

Accident Report (IAR), Final Accident Report (FAR), and Near Miss Report. The

IAR shall be submitted to the Government within five days of the accident and the

FAR shall be submitted within fifteen days of the accident. Near Miss Reports shall be submitted to the Government with fifteen days of the near miss. ENG Form 3394 will be supplied by the Government at the time of notification.

VIII. Supporting Information

A. Security

a. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/)

(website subject to change) to meet the contract employment eligibility requirements.

Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United

States immigration laws in accordance with FAR 22.102-1(i). A list of E-verified / eligible candidates shall be provided to the Government prior to commencement of work. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the

Contracting Officer to become part of the official contract file.

b. Contract Personnel

1) All contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation

/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index

(commonly referred to as “NCIC-III”) and Terrorist Screening Database

(commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the

Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the Requiring

Activity representative.

2) The Contracting Officer’s Representative (COR) may direct the Contractor to replace any employee(s) that the Government deems incompetent, careless, insubordinate, under the influence of intoxicating drugs, beverages, etc. or whose continued employment is deemed to be contrary to the public interest. The

Contractor shall be responsible for the immediate replacement of any employee under the conditions identified above: in addition to any costs associated with the replacement of an unsuitable employee.

3) The Contractor shall be responsible for ensuring that contractor employees strictly observe the laws of the United States, North Carolina, Wake County, and any other governing bodies which may affect the work to be completed under this contract. Contractors with non-English speaking workers shall have a person(s) fluent in English to be onsite while work is being performed.

c. Security of Government Buildings

1) The Contractor shall be responsible for the security of the buildings and gates during his/her working hours, and to secure those facilities when leaving the area.

The Visitor Assistance Center office and dam intake tower shall not be entered until Government personnel have first disabled the security alarms. A government employee shall be present at all times for any work performed inside of the tower.

Contractor will immediately notify USACE staff upon discovering any active alarm engaged on property.

d. General security requirements and guidance:

The security requirements described below apply to all contract personnel

(including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative

(COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the

Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations.

Additionally, all contract personnel shall comply with Force Protection Condition

(FPCON) measures, Random Antiterrorism Measures (commonly referred to as

“RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or proceed.

B. Damage Responsibility

a. The Contractor shall be responsible for any damage to Government or private property, facilities, structures, or landscape features occurring as a result of his operation. The Contractor shall be required to satisfactorily rectify notices of damage from the public and to protect the Government from claims resulting from damage caused by his activities and make immediate notification to the Government concerning said damage or injury to any person. In instances where contract employees damage government property and/or equipment, verbal notification shall be made by the next workday. A full written report of the incident and extent of such damage shall be submitted to the Government within 2 work days (less weekends and holidays).

C. Vandalism Reporting

a. The Contractor shall report all instances of vandalism to the COR, including missing, damaged, or unserviceable refuse containers, lids, damaged restroom dispensers, partitions, plumbing, etc.

D. Inspection and Acceptance

a. The Government or representative will verify the QC Inspection Checklist and inspect services rendered.

b. Work quality not meeting professional standards shall be remedied to the satisfaction of the inspector prior to final payment.

c. Failure or inability to perform professional services will result in postponement of, or reduction in payment as provided by Section 37(d)(2) of General Provisions entitled

Inspection of Services.

E. Payment

a. The Contractor shall submit to the Government an invoice and herbicide actual usage report for work completed under this contract by the 7th day of each month. The submittals shall be sent to:

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services--

Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-

Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph

(d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause

52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or

Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)

(https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The
