PERFORMANCE WORK STATEMENT

Document Destruction Services for the National Labor Relations Board Date: 03/18/2026

1. INTRODUCTION

1.1. BACKGROUND

The National Labor Relations Board (NLRB), headquartered in Washington, D.C., is an independent Federal agency created by Congress in 1935 to administer the National Labor Relations Act, the primary law governing relations between unions and employers in the private sector.

The NLRB’s Office of the Chief Information Officer, Information Assurance, Records Management Section has identified a requirement for document destruction services at NLRB Headquarters and its Field Offices located throughout the United States to include Hawaii and Puerto Rico. Secure paper destruction and recycling ("shredding") is a prominent practice among businesses and Federal agencies concerned with the proper shredding and recycling of sensitive information, such as Personally Identifiable Information (PII).

1.2. OBJECTIVES

The objective of this requirement is to meet the agency’s need for secure destruction of paper at various NLRB offices.

1.3. SCOPE

The scope of this Performance Work Statement (PWS) covers all labor, personnel, equipment, supplies, secured vehicles, materials, supervision and other related supplies and services necessary to provide secure document destruction services at various NLRB Offices.

2. GENERAL REQUIREMENTS

This section describes the general requirements for this effort. The following sub-sections provide details of various considerations.

2.1. NON-PERSONAL SERVICES

The services and performance required under this contract are determined to be not inherently governmental. The contractor shall not perform or give the appearance of performing inherently governmental functions as described in FAR Part 2 and Subpart 7.5. The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. All contractor personnel shall identify themselves as contracted support personnel in all forms of communication with all entities with whom NLRB has business dealings. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer immediately.

Contractor personnel working in situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that they are Government officials. All documents or reports produced by the contractor shall be marked as contractor products or otherwise indicate that contractor participation is disclosed.

2.2. BUSINESS RELATIONS

The contractor shall successfully integrate and coordinate all activity needed to execute the requirements specified herein. The contractor shall manage the timeliness, completeness, and quality of the deliverables. The contractor shall provide corrective action plans, quote submittals, timely identification of issues, and effective management of all contractor personnel (including subcontractors). The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

2.3. CONTRACT MANAGEMENT

The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to this requirement. The Contractor must maintain continuity between the support operations and the Contractor's corporate offices.

The Contractor shall establish processes and assign appropriate resources to effectively administer this contract. The Contractor shall respond to Government requests for contractual actions in a timely fashion. The Contractor shall have a single point of contact between the Government and Contract personnel assigned to support this PWS.

2.4. SUBCONTRACT MANAGEMENT

The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add vetted subcontractors to their team after notification to the Contracting Officer Representative (COR).

2.5. CONTRACTOR PERSONNEL, DISCIPLINES, AND SPECIALTIES

The contractor shall accomplish required tasks by employing and utilizing qualified personnel with appropriate combinations of training and experience. The contractor shall match personnel skills to the work or task with a minimum of under/over employment of resources.

The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the order.

2.6. TRAINING

The contractor shall ensure that all of its employees have been properly trained and are qualified to perform assigned tasks under this PWS. If training requires travel on the part of contractor employees, local travel costs shall be borne by the contract personnel.

2.7. LOCATION

Work shall be performed on-site via a secure mobile shredding truck at NLRB Headquarters in Washington, D.C. and Field Offices located throughout the United States, to include Hawaii and Puerto Rico (See Attachment 1, Service Requirements List for full list if sites to be serviced). Additional NLRB office locations may be added during the contact performance period. Service for any additional sites will be incorporated via a bi-lateral contract modification.

2.8. PERIOD OF PERFORMANCE

The period of performance is one 12-month base year and four 12-month option years. The Period of Performance is as follows:

2.9. HOURS OF WORK

For planning purposes, normal workdays are Monday through Friday except US Federal Holidays. Core hours of work are from 9:00 am to 3:00 p.m. daily. Recognized Federal holidays are as follows:

NOTE: Any of the above holidays falling on a Saturday will be observed on the preceding Friday; holidays falling on a Sunday will be observed on the following Monday. Any holidays that are declared by Presidential Executive Order shall be observed in the same manner as the holidays listed above.

If a Regularly Scheduled service day falls on a Federal holiday or inclement weather day, service for the affected office will be canceled for that day and shall be resumed the next available business day.

2.10. SECURITY

Confidentiality of all paper materials is required throughout the shredding process. At no time may the Contractor manually remove any paper from a bin or transfer the contents of a bin to another container for transport to the mobile shredding truck. Contractors shall be escorted while working in NLRB offices.

3. PERFORMANCE REQUIREMENTS

The following section specifies the Performance Objectives and Performance Elements for the requirement.

3.1 Document Destruction Bins: The contractor shall install, supply, and maintain lockable bins to remain at each NLRB office location indicated on the Service Requirements List. Installation of the required number of bins at NLRB office locations shall occur within 30 days of award. The bins shall be standard 96-gallon capacity containers with wheels, handles, and lockable tops with drop slots. The bins shall have key or combinations locks, the keys or codes to which will be provided to the Agency office and be delivered in a sanitary and good working condition. If a bin is damaged, the contractor shall replace it. The contractor and Office Manager at each location will determine where, in the office workspace, the bins will be located. The contractor shall ensure each NLRB site is provided with the correct number of bins per the Service Requirements List. The contractor shall ensure the bins are removed from the office workspace at the end of the contract performance period.

3.2 General Document Destruction Requirements: The Contractor shall provide secure on-site destruction of documents placed in the secure bins so they are unreadable and cannot be reconstructed. Shredded documents shall adhere to AAA NAID shred size and be destroyed to a particle size no wider than 5/8″ shred width.

3.2.1 The Contractor shall perform shredding services during the working hours of the facility at which the services are being performed.

3.2.2 The contractor’s Project Manager shall communicate in writing via email any service schedule changes or adjustments as soon as possible to the COR. The Contractor shall have a main point-of-contact for NLRB to communicate with for document destruction scheduling, reporting, and issue resolution.

3.2.3 The Contractor shall provide a Certificate of Destruction after each site visit.

3.2.4 The Contractor shall comply with all requirements of the National Association of Information Destruction (NAID) guidelines.

3.3 The Document Destruction Transport: The mobile shredding truck shall be specified designed for secure shredding. The contractor shall transport to and dispose of the shredded documents at a recycling facility. The contractor shall transport the material in a vehicle that prevents unauthorized access to the documents and prevents it from inadvertently being blown out of the vehicle during transportation to the recycling facility.

3.4 Non-recurring/On-Demand Document Destruction Services: The contractor shall provide on-demand secure on-site document destruction services. As specified in section 3.1, the contractor shall provide the required numbers of bins per locations indicated on the attached Service Requirements List. The contractor will be notified by the Contracting Officer Representative (COR) when the bin/s at a specific location need to be serviced. The contractor shall schedule the requested bin/s to be serviced within 5-10 business days of receiving the request from the COR. On the scheduled service date, the contractor shall notify the on-site POC they are in route, collect the bin/s for shredding, transport the bin/s from the office to the mobile shredding truck, ensure documents are securely shredded, and return emptied bin/s to their original office location.

3.4.1 On-demand service may also be required in the event of excess material due to an office closing or upcoming move. The location and estimate of excess shredding material will be provided to the contractor in advance of scheduling the one-time on-demand service.

3.4.2 On-demand destruction service may be required for media items that need to be disposed of such as VHS, Compact Discs (CDs), ¾ Floppy discs, and hard drives.

3.4.3 Requests for on-demand services may only be communicated to the contractor via the CO appointed Contracting Officer Representative. Requests made by other non-authorized NLRB employees shall not be completed by the contractor.

3.5 OPTIONAL TASK: Regular/Recurring Document Destruction Services: This is an optional task and will not be exercised at the time of award. The NLRB retains the right to exercise this optional task should an office location have an unusually high volume of paper requiring regular destruction. At present, it is uncertain whether these services will be necessary.

3.5.1 If the Optional Task for recurring services is exercised, the contractor shall provide recurring (monthly) document destruction services for the specific office location. On the scheduled regular service date, the contractor shall notify the on-site POC they are in route, collect the bin/s for shredding, transport the bin/s from the office to the mobile shredding truck, ensure documents are securely shredded, and return bins to their original office location.

4. SPECIAL REQUIREMENTS

This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.

4.1. KEY PERSONNEL

The following positions under this effort are considered Key Personnel. The Contractor shall provide qualified personnel for the key position under this contract. The Contractor shall ensure that all its personnel possess the skills, knowledge, training, and certification(s) required to satisfactorily perform all services required by the contract.

· Project Manager – The Project Manager shall have a minimum of 5 years of experience in the document destruction industry.

During the first 90 calendar days of performance, the Contractor shall make no substitutions of key personnel without the approval of the Contracting Officer, unless illness, death, or termination of employment necessitates the substitution. The Contractor shall notify the Contracting Officer as soon as possible after the occurrence of any of these events and provide the information required below.

After the initial 90 calendar day period, the Contractor may propose a substitution. The Contractor shall notify the Contracting Officer in writing of any proposed substitution at least thirty (30) days in advance of the proposed substitution. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. The Contractor shall, prior to making any substitution permanent, demonstrate to the satisfaction of the Contracting Officer, that the qualifications of the proposed substitute personnel is equal to or better than the qualifications of the personnel originally identified for the position. The Contracting officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on proposed substitutions.

4.2. CONTRACTOR REQUIREMENTS

The contractor shall:

· Have National Association for Information Destruction (NAID) certification for paper destruction.

· Maintain NAID certification for paper destruction for the duration of the contract.

· Be bonded and maintain required licenses and liability insurance.

· Furnish a valid Certificate of Insurance if required by the local building management of an Agency office.

The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and [Agency] guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.

4.3. QUALITY CONTROL PLAN

The Contractor shall prepare and adhere to a Quality Control Plan (QCP). The QCP shall document how the Contractor will meet and comply with the quality standards specified in the PWS, and Quality Assurance Surveillance Plan (QASP). At a minimum, the QCP must include a self-inspection plan and an outline of the procedures that the Contractor will use to maintain quality, timeliness, responsiveness, customer satisfaction, and any other requirements set forth in this PWS.

4.4. ENVIRONMENTAL CONSIDERATIONS

The shredded material shall be recycled in accordance with accepted industry standards.

4.5. DOCUMENTATION

Documents, data files, reports, correspondence, and all other documents and writings, together with any charts, graphs, tables, illustrations, photographs, images, and other illustrative, explanatory, historical documents related thereto or independent thereof, regardless of the medium (or media) by which they were produced, preserved, stored, or created in connection with or for purpose(s) of work performed under this PWS and contract, are property of the Government.

The Contractor agrees to assume responsibility for protecting the confidentiality of Government records, which is not considered public information. Each Contractor or employee of the Contractor to whom information may be made available or disclosed shall be notified in writing by the Contractor that such information may be disclosed only for purposes and to the extent authorized herein. The Contractor shall not release any information related to this order to the public, media or other unauthorized persons or organizations.

4.6. TRANSITION

It is essential that attention be given to minimize interruptions or delays that would impact the agency mission. The Contractor must plan for the transfer of work control, delineating the method for processing and assigning tasks during the transition-out period. The Contractor shall provide a transition-out plan no later than sixty (60) days prior to expiration of this order. All files in the possession of the contractor are the property of the Government and shall be turned over to the Contracting Officer or the COR at the completion or termination of the order.

Bins are clean and in good working condition.

All schedule changes/adjustments are communicated in writing to the COR.

Deliverables are factual, well-written, and free of grammatical errors or misspellings.

Deliverables are accomplished by the due date/time specified in Section 6 of the PWS.

Random review of by the COR no less than once a month and feedback from appropriate Government sources.

6. DELIVERABLES

Deliverables shall be submitted to the COR designated in the COR Appointment letter and Contracting Officer. All deliverables shall be submitted using Microsoft Office suite of tools (for example, MS Word, MS Excel, MS PowerPoint), or Adobe PDF format, unless otherwise specified by the COR. Electronic submission shall be made via email, unless otherwise agreed to by the COR.

The COR has the right to reject or require correction of any deficiencies found in the deliverables. In the event of a rejected deliverable, the Contractor will be notified in writing by the COR of the specific reasons for rejection.
