About this file

This is a Justification and Approval document for a sole-source procurement under FAR Part 6. The U.S. Army Corps of Engineers, New Orleans District, is seeking approval to award a $345,000 firm-fixed-price contract to Schindler Elevator Corporation (CAGE Code 3W6B8, Unique Entity ID VUAHMK87BFW7) for elevator maintenance and repair services at its headquarters building. The five-year base contract with four one-year options runs from May 1, 2026, through April 30, 2031, with an additional FAR 52.217-8 period through October 31, 2031, bringing the estimated overall total to $379,500. The annual base year cost is $69,000. Solicitation number W912P8-26-R-A030 will use Overhead/Revolving funds for full funding.

The justification authorizes sole-source procurement under 10 U.S.C. 3204(a)(1) and FAR 6.103-1 based on Schindler being the only responsible source capable of servicing the elevators and proprietary drive systems currently installed since 1985. The contract covers maintenance, repair, inspection, testing, and cleaning of all 11 elevators (two freight and nine passenger) across three buildings. Schindler's proprietary control modules, drive systems, and software are incompatible with other manufacturers' equipment, and only Schindler-certified technicians are authorized to troubleshoot, repair, calibrate, and test the systems. The document cites compliance requirements with 2018 code ANSI A17.1 and notes that using any other vendor would necessitate replacement of parts not at the end of their service life. The procurement history shows five prior sole-source contracts awarded to Schindler between 2010 and 2026. Market research confirmed no alternatives exist, and interested sources were not solicited due to the proprietary nature of required services.

5. Authority Cited: The statutory authority requested for use of other than full and open competition is 10 U.S.C 3204(a)(1), as implemented by RFO FAR 6.103-1 "Only one responsible source and no other supplies or services will satisfy agency requirements". Schindler Elevator Corporation is the only responsible source for servicing the elevators and major components of the drive systems for the elevators currently installed at MVN. Schindler is the only source that will satisfy agency requirement to install and service equipment and software required to connect and compatible to communicate with existing elevator components.

6. Reason for Authority Cited: Background: All elevators, in use at MVN headquarters building, were designed, manufactured, and installed in 1985 and have been maintained by Schindler Elevator Corporation since. The competitive nature of the original contract awarded in 1985 is unknown. The current system consists of two freight elevators and nine passenger elevators. The elevator services contract has been included in the Capital Improvement Plan and will take place over the next few fiscal years. The exact timing will depend on future budget constraints. The Schindler control modules and drive systems in the elevators throughout the district communicate with proprietary software from Schindler Elevator Corporation. Because of the proprietary nature of the existing equipment and software, only Schindler replacement components and software will interconnect and communicate with the existing system and only Schindler-certified technicians are permitted to troubleshoot, repair, calibrate, and test the elevators. Other technicians would not have permissions to read the existing control board and trouble shoot the elevator and major parts of the drive systems.

This contract will include maintenance services for all 11 elevators in MVN's headquarters building are included in an existing service contract with Schindler that provides full maintenance, including operation, testing, inspections, alterations, and repairs required to maintain the elevator system.

Justification:

The existing elevators include proprietary software in the control modules to communicate with the proprietary drive systems. Although the majority of other physical elevator components are non-proprietary, such as the cables, guide rails, counterweights, the drive system and the control module, which runs the drive system, are unique to each company. However, all the parts (proprietary or not) need to be compatible with each other and fall under this scope of the current elevator maintenance contract. If the work was to be completed by a company other than Schindler it would necessitate the replacing of parts that are not at the end of their life and would not otherwise need to be replaced to ensure compatibility.

Schindler is the only responsible source for this action because they are the only source for the new "modernized" Schindler control modules and drive system updates that are necessary to maintain the existing Schindler installed system. Additionally, Schindler certified technicians are the only technicians permitted to access the software components needed for the implementation.

Impact:

Schindler is the only responsible source for this action because they are the only source for the new modernized Schindler control modules and drive system updates and because Schindler certified technicians are the only technicians permitted to access the software components needed for elevator maintenance and repairs. As discussed above, no other supplies or services will satisfy agency requirements. Failure to procure Schindler's supplies and services for the elevator services at MVN will result in a lack of compliance with 2018 code ANSI A17.1. This lack of compliance could result in the freight elevators annual certification not being renewed or potential damage to personnel and property.

Failure to approve the J&A would force MVN to procure new elevators, which are not only significantly more expensive and exceeds existing budget limitations but also far exceeds the government minimum needs elevator services.

7. Efforts to Obtain Competition: Previous contracts awarded to Schindler Elevator Corporation for similar services did not include opportunities for subcontracting.

8. Actions to Increase Competition: As the overall project moves forward market research will continue to determine if there are opportunities to increase competition.

9. Market Research: Market research was conducted by Kevin Calico, Facility Operations Specialist and Angela Day, Contract Specialist. Requirement is a commercial service valued below $1 million and will be procured through FAR Part 12, using FAR Part 13 Simplified Acquisition Procedures or FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items.

- NAICS Code 333921 - Elevator and Moving Stairway Manufacturing

- PSC 3960 - Freight Elevators

This requirement is for the servicing, repair and testing of all elevators at the New Orleans District Headquarters, buildings #816, #817 and #830. Elevators will be serviced and tested by current city, state, and local codes. Special consideration is also given to the fire, life safety, and building codes throughout the process, as

CUI//SP-PROCURE//FEDCON

JUNE 2025

these codes require reconfiguration and testing during each proprietary software upgrade to ensure accuracy of the emergency notification system and operability with the proprietary software.

Techniques and methods utilized to conduct Market Research include:

- Review of similar historical procurement, W912P821P0023 MVN

Elevator Service Contract.

- Internet searches

(https://facilitymanagement.com/elevator-modernization/, https://www.dayelevator.com/how-much-does-commercial-elevator-cost/, https://www.delfarelevator.com/freight-elevator-cost.html)

- Conferences with Schindler Elevator Corporation

As a result of this market research, MVN concluded that only Schindler control modules and drive system updates could be used for these elevator services because other software and equipment could not interconnect with existing equipment. Further, only Schindler certified technicians can access the software information needed to complete these repairs and maintenance.

Schindler is the only responsible source for this action. No other supplies or services will satisfy agency requirements.

10. Interested Sources: In accordance with RFO FAR 6.103-1 interested sources were not solicited due to the proprietary nature of the services required.

11. Other Facts: Schindler Elevator Corporation has provided reliable service to MVN for many years with no safety issues or performance concerns under past service contracts.
