BRAND NAME JUSTIFICATION
1. Agency/Contracting Activity: US Army Corps of Engineers

2. Description of Action: Solicitation of a Simplified Acquisition-Small Construction Contract to install an Automated Data Acquisition System (ADAS) to improve dam safety monitoring at B. Everett Jordan Dam. The contract will require the Contractor to purchase specified Brand Name equipment and install it to fulfill the contract.

3. Description of Services or Supplies:
The total estimated value of the proposed action is $ 82,135.00 (equipment only) / $ 158,796.00 (Full Installation by Contractor).
The ADAS provides USACE state-of-the art dam safety monitoring of water levels within the earthen embankment at B. Everett Jordan Lake Dam. A BRAND NAME justification is required in order to specify to a Contractor/Installer what system of components is acceptable for the Small Construction Contract. The ADAS equipment specified in this SOW is currently in use at both Falls Lake and Island Creek Dams. The specified equipment brands (Geokon/Durham Geo Slope Indicator (DGSI) are easy to set-up, require no follow-on coding/formulation programming, and are compatible with established USACE digital communications architecture. Furthermore, Geokon, is the only manufacturer of narrow-gauge vibrating wire transducers that are small enough to fit into the small (1/2-inch) diameter piezometers located at the dam. DGSI is the only manufacturer of datalogger and gateway equipment that are compatible with the Geokon vibrating wire transducers. The desired components are listed below.

4. Authority: FAR 13.106-1(b)(1)
Action using simplified acquisition procedures (select one):
FAR 13.106-1(b)(1)(i): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization).
5. Reasons for Authority Cited:
The components listed in Table 1 and within the Statement of Work were selected by USACE to fit the needs of B. Everett Jordan Lake Dam and the size constraints of the piezometers already installed at the dam. The listed components were selected by USACE personnel based on careful consideration of equipment compatibility, component sizing as related to the piezometer wells on site, ease of installation, and past performance history on similar projects. Geokon, is the only manufacturer of narrow-gauge vibrating wire transducers that are small enough to fit into the small (1/2-inch) diameter piezometers located at the dam. Geokon is only compatible with DGSI-made datalogger and gateway equipment.
There is expected competition for the contract as a whole, due to the need for set-up and installation.
6. Efforts to Increase Competition: The contract requires a Contractor to purchase the specified equipment and install it on site, using common construction methods such as trenching. There are multiple dealers/distributors that a Contractor can access to acquire these components.

9. Interested Sources: To date, no other sources have expressed interest in this acquisition.
10. Other Facts: The following are site-specific constraints that factored into USACE’s selection of the brand-name components listed in Table 1:
1) Vibrating Wire Transducer Size. The inside diameter of the piezometer riser pipes currently installed at B. Everett Jordan Lake Dam is ½ inches. USACE determined there is only one supplier that manufactures transducers that can fit into the existing piezometers, which is Geokon.
2) Datalogger Compatibility and Ease of Programming. The datalogger and remote monitoring units (RMU) manufactured by DGSI is completely compatible with the Geokon Vibrating Wire Transducer. Furthermore, DGSI dataloggers are unique in that they are “plug-and play” and do not require additional coding or component modification to be implemented by USACE staff before they are put into operation.
3) Ancillary Equipment Availability. USACE determined during its plan development that the protective enclosure boxes offered by Campbell Scientific were readily available from suppliers able to supply the mandated equipment, and these enclosure boxes were verified to satisfactorily hold and protect the aforementioned equipment. DGSI does not manufacture a protective enclosure specifically for their components. Investigation revealed that supply chain issues make sourcing from some other vendors problematic. Since the other components are mandated by brand name, the enclosure boxes must also be designated to ensure proper fitting, availability and ability to protect the mandated equipment
