Attachment D.4 Example Scenario 3 – Phase I Environmental Site Assessment

For the scenario provided below, prepare, and submit:

· A conceptual “expanded” Phase I Environmental Site Assessment (ESA) work plan that provides a description of how contractor would address the scenario. The conceptual work plan needs to include and address the following:

· Description of the work to be performed.

· Discussion of any specific exclusions/assumptions the contractor may have regarding their response to the scenario in question.

· Conceptual listing of personnel, including subcontractor(s) that would be utilized for preparation of the ESA.

· Price Proposal to accompany the conceptual “expanded” Phase I Environmental Site Assessment work plan.

· Example of a previous ESA that the firm has prepared (can be redacted as necessary).

SITE SCENARIO:

The contractor shall conduct an “expanded” Phase I Environmental Site Assessment under Activity VII, Task 4 of the Regional Environmental Response Contract.

A “expanded” environmental site assessment work plan that provides a description of how contractor would address the scenario. “Expanded” environmental site assessment means identification of the full range of environmental issues and liabilities with the property beyond those associated with Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) liabilities and petroleum products.

Environmental issues and liabilities include, but are not limited to, those issues and liabilities under the Resource Conservation and Recovery Act (RCRA), the Safe Drinking Water Act (SDWA), the Clean Air Act (CAA), the Clean Water Act (CWA), the Toxic Substance Control Act (TSCA). These issues and liabilities include, but are not limited to, asbestos containing material, radon, lead-based paint, non-hazardous solid waste disposal areas, waste water disposal systems, drinking water systems, drinking water and/or other wells.

The contractor shall evaluate the potential for the occurrence of vapor intrusion at the property using the approach described in EPA’s June 2015 Technical Guides, review recorded land title records and judicial records for environmental liens and Activity and Use Limitations (AULs) and identify all “de minimis” issues/liabilities.

The “expanded” Phase I Site Assessment is also intended to fulfill the Forest Service’s obligations under Section 120(h) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), for real property conveyances that involve the Termination of Federal Government Operations (TFGO)

Property Description

The land identified as the Batcheller Small Tracts Act Interchange (Land Exchange) is identified as a non-federal and a federal parcel. A description of each parcel is listed below.

Non-Federal Parcel: The 0.44-acre Batcheller (Sierra County Assessor’s Parcel Number 004- 060-018) is located between California Highway 49 and the North Fork of the Yuba River in an area known as Indian Valley. The only improvements on the Batcheller property are a metal pipe and an old rock-line channel that was used to convey water to nearby pre-1940s placer mining operations.

Federal Parcel: The 0.33-acre parcel owned by the United States is located between California Highway 49 and the western extension of the Batcheller property that is not included in this exchange. A portion of a 20’ x 30’ wooden shed used to store personal property belonging to the owners of the Batcheller property; several piles of firewood; a concrete slab with a slate rock apron; a small haulage trailer; a hydraulic log splitter and a portion of the rock lined channel located on property owned by the United States.

Improvements located on both the non-federal and federal parcel are privately owned.

In this interchange of lands, the USA will be exchanging a triangular-shaped piece of Federal land, between Highway 49 and the 1/16 section line, for a triangular-shaped piece of land (non- Federal parcel) adjacent to the North Yuba River (Figures 1 and 2).

The “expanded ESA” should include both the Non-Federal (Batcheller) parcel and the Federal parcel.

The North Yuba River in this area was extensively placer mined with a dragline dredge prior to the 1940s as evidenced by tailings throughout the parcel.

Property Location

The property is located approximately 40 miles north of Nevada City, between the towns of Camptonville and Downieville. The Indian Valley Outpost is less than one mile to the west. The Forest Service Indian Valley Campground is located less than one mile to the east (Figures 1 and 2).

Format and Contents of ESA work plans and reports shall be in accordance Other Technical Support and Assistance, Activity VII, Task 4 of Section III of the Regional CERCLA Environmental Response Contract.
