JUSTIFICATION FOR

OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

UNDER FEDERAL ACQUISITION REGULATION FAR SUBPART 6.3

1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense, Washington Headquarters

Services, Acquisition Directorate; “The Site”.

2. DESCRIPTION OF ACTION: The current “THE SITE”’s Ansul Inergen clean agent system has been installed and maintained by Fire-X Sales & Service Corp. There is no contract vehicle for maintenance services for the Ansul Inergen clean agent system. The “THE SITE” is seeking approval for a firm-fixed price sole source award to Fire-X Sales & Service Corp.

3. DESCRIPTION OF SUPPLIES/SERVICES: Currently, “THE SITE” is utilizing Ansul Inergen Clean

Agent Systems that provides fire suppression to mission critical rooms that have electronic equipment within them. The contract is to provide the necessary maintenance and services, if necessary, system lifecycle replacements of these clean agent systems.

4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c) (1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. Fire-X Sales & Service Corp is the is the Authorized ANSUL Distributor for the ANSUL INERGEN clean agent fire suppression system product line for Adams County, PA.

5. REASON FOR AUTHORITY CITED: Currently, “THE SITE” is using the Ansul Inergen clean agent system that provides fire suppression protection within the entire complex. Fire-X Sales & Service Corp is the Authorized ANSUL Distributor for the Ansul Inergen clean agent fire suppression system product line for Adams County, PA. The Ansul Inergen bottles installed by Fire-X Sales & Service Corp have a 20-year warranty. If any other company, other than Fire-X Sales & Service Corp performs any maintenance on these bottles, it will null and void the warranty which will potentially costing the government a significant amount of money by replacing the entire clean agent system. In addition, Fire X Sales & Service Corp is the only company that has designed, engineered, installed, and maintained all the Inergen Clean Agent Systems in “THE SITE”. Fire X Sales & Service Corp have the proprietary software that is needed to maintain these ANSUL Inergen systems.

6. EFFORTS TO OBTAIN COMPETITION: The “THE SITE” is currently using Fire-X parts and accessories for compatibility with the existing clean agent system and will continue to do so for the foreseeable future. Future requirements for specialized equipment from the “THE SITE” will be researched to increase competition to the fullest to provide the best value to the government.

7. FAIR AND REASONABLE COST DETERMINATION: The Contracting Officer will make a fair and reasonable price determination prior to awarding utilizing the following techniques identified in

FAR13.106-3. No certified cost or pricing data is required for this effort.

8. MARKET RESEARCH: Market research revealed that there are two or more small businesses, which could provide clear agent system maintenance. However, due to the proprietary features of the Ansul Inergen clean agent system, no other company can meet the government’s requirement other than the authorized distributors. Furthermore, there are no other Authorized

Distributors for this area that provide ANSUL Inergen certified technicians to work on these clean agent systems.

9. OTHER FACTS: Fire-X Sales & Service Corp is the Authorized ANSUL Distributor for the ANSUL

INERGEN clean agent fire suppression system product line for Adams County, PA.

10. INTERESTED SOURCES: Not Applicable

11. ACTIONS TO INCREASE COMPETITION: The Ansul equipment and maintenance for this effort is essential to the “THE SITE”s daily operations. Market research indicates other manufacturer’s equipment does not meet and cannot be modified to meet the agency’s needs. After the clean agent system is completely serviced, the agency will continue to monitor the market for equipment and materials, which may be compatible with the Ansul products and services for future requirements.
