1. BACKGROUND
Kings Mountain National Military Park (KIMO) commemorates the battle of Kings Mountain that took place October 7th, 1780.
Dellingham Road is critical to the park’s wildland fire program and search and rescue operations in the backcountry areas of the park. This road acts as a administration road and has controlled access. Traffic is limited to government equipment. The public can use the road as multi use trail (hiking, day use etc.).
2. PROJECT IDENTIFIERS:
PMIS Number: 246144 Project Title: “Replace Damaged Culverts on Dellingham Road”
3. PLACE OF PERFORMANCE:
Kings Mountain National Military Park Dellingham Road
4. PERIOD OF PERFORMANCE:
Contractor shall have no more than sixty (60) calendar days to finish the project once work begins, with the only exceptions of bad weather or other unforeseen events beyond the contractor’s control.
5. SCOPE:
The purpose of this project is to clean existing drainage and replace culverts along the historic Stone House Road, (commonly known as Dellingham Road) at Kings Mountain National Military Park (NMP).
This project will remove siltation and built up debris from an approximate 4,435 LF drainage ditch measuring approximately eighteen (18) inches wide by six (6) inches deep, and its associated culverts along the unpaved roadway. Built up soil, silt, and debris will be removed in order to allow runoff to drain freely without damaging the unpaved road surface. Four (4) existing damaged road culverts (steel) will be removed and replaced (polyethylene) at locations identified on the attached map. Each area of work has been GPS located with latitude and longitude coordinates. One (1) eighteen (18) inch wide by six (6) inch deep grade-dip will be installed at a location that has also been GPS located. Attached is a map of culvert locations. Double wall Polyethylene culverts will be used to provide better design life and lower O/M cost.
6. TASK:
The contractor shall provide all materials and labor required to complete the following tasks:
1.A. Replace one (1) 20-inch diameter by 25 LF steel culvert with a new 24-inch diameter by 25 LF double walled polyethylene culvert. GPS location: Lat 35.1437729, Long -81.411962
1.B. Replace one (1) 18-inch diameter by 25 LF steel culvert with a new 24-inch diameter by 25 LF double walled polyethylene culvert. GPS location: Lat 35.146975 Long - -81.413509
1.C. Replace one (1) 18-inch diameter by 25 LF steel culvert with a new 24-inch diameter by 25 LF double walled polyethylene culvert. GPS location: Lat 35.134413 Long -81.413852
1.D. Replace one (1) 18-inch diameter by 25 LF steel culvert with a new 24-inch diameter by 25 LF double walled polyethylene culvert. GPS location: Lat 35.133658 Long 81.415934
1.E. Install one (1) eighteen (18) inch wide by six (6) inch deep grade-dip. The grade-dip will have tapered edges to allow for traffic to cross uninterrupted. GPS location: Lat, 35.134413 Long -81.415483
2) Placement of rip rap within ditch to reduce the occurrence of future erosion. Rip rap will be placed approximately 50 LF on the lead or entrance (higher graded) side of each replaced culvert and grade-dip. Rip rap will be Granite # 4 stone gray in color sourced from a area vendor for color consistency with landscape.
7. GENERAL WORK REQUIREMENTS:
Work Hours: 8:00am to 3:30 pm Monday through Friday, excluding federal holidays.
Contractor shall coordinate the on-site work schedule with the Contracting Officer and the COR five days prior to the performance start date. Work outside of normal business hours shall be preapproved by the Contracting Officer and the COR. All work will be performed in accordance with IBC and/or local building codes, local and state electrical codes, OSHA and EPA regulations. All construction debris will be cleaned up and removed daily by the contractor at the contractor's expense and the work area will remain orderly at all times. Contractor will provide advanced work schedule to COR for scheduling of park events and cultural resource surveillance.
8. MANAGEMENT:
The contractor shall manage the total work effort in accordance with effective and efficient management principles and safe working practices to ensure on time completion of this contract.
9. SAFETY AND ENVIRONMENTAL COMPLIANCE:
• The contractor shall comply with pertinent provisions of the Occupational Safety and Health Act (OSHA), and state, local, safety, laws.
• The contractor shall comply with pertinent Environmental Protection Agency laws and regulations.
• The COR has the authority to issue restraint or cease-and-desist orders to the contractor when violations or unsafe acts are present and threaten Government and contractor employees or damage to Government property.
• The contractor shall immediately report to the COR and/or the Contracting Officer, all accidents resulting in employee injury or death or damage to property while performing this contract.
10. INSURANCE:
The Contractor shall be insured in accordance with the State of South Carolina insurance regulations.
The government is not responsible for damage to Contractor’s equipment, vehicles, tools, or materials or their employees and any personal property brought on site. The government will not accept any liability due to Contractor employee negligence.
• Workers Compensation- The contractor shall furnish proof of worker’s compensation insurance to the Contracting Officer for those employees performing work related to this contract and shall comply with the Workman’s Compensation Laws of the State of South Carolina.
• Liability- Contractor shall maintain a level of insurance that will protect the Contractor and Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract, and shall submit proof of insurance to the Contracting Officer.
11. CONTRACTOR USE OF SITE:
Contractor shall have limited use of the site for construction operations. Tools, equipment and materials may be stored on-site under the guidance and permission given by the COR. Contractor will prevent damage to natural surroundings. Damage to natural surroundings will be restored through NPS approved methods or repairing or replanting, at no additional cost to the government.
12. MOTOR VEHICLE AND TRAFFIC REGULATIONS:
Contractor employees operating motor vehicles shall possess a valid driver's license. Driver and vehicle permits, licenses, registrations and proof of insurance shall be maintained in the vehicle at all times and made available upon request. Contractor employees shall comply with federal vehicle motor law requiring seat belts be worn at all times. Contractor employees shall adhere to the posted speed limits.
Contractor employees are expected to comply with all KMIO regulations.
13. EMPLOYEES BADGES/PARKING. All contractor employees shall comply with parking procedures published for KMIO.
14. NON-PAYMENT FOR ADDITIONAL WORK:
Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than the appointed Contracting Officer, expect as may be explicitly authorized in the contract, shall be performed at the financial risk of the Contractor. Only the appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.
15. CONFLICT OF INTEREST:
The contractor shall not employ off-duty COR’s or other Government employees if such employment would create a conflict of interest or be contrary to the policies contained in conflict-of-interest directives.
16. CONTRACTOR’S PROPOSAL PACKAGE:
The following deliverables are to be submitted with offer in response to RFQ.
• Technical approach to perform required services.
• Contractor safety plan.
• Proof of Insurance–Business Liability & Workers Compensation.
17. INSPECTION:
The Government will conduct inspection upon completion of required services. Final payment will be processed upon confirming that all noted contractor performance deficiencies have been satisfactorily corrected.
18. GOVERNMENT-FURNISHED PROPERTY, MATERIAL, EQUIPMENT, OR
INFORMATION (GFP, GFM, GFE, OR GFI):
None.
19. SECURITY:
Replacement of Contractor Employee for Security Reasons. The Government retains the right to request removal of the contractor’s employee(s), regardless of prior clearances.
20. TRAVEL:
Contractor is HIGHLY encouraged to make a site visit prior to bidding the project.
21. FOOD STORAGE GUIDELINES:
Due to black bear populations (as well as other foraging animals) in the work area, all Contractor employees shall comply with KIMO food storage guidelines. All food items must be stored in a hard-sided vehicle or in a food storage locker and must never be left unattended. "Food" includes any item with a scent, regardless of packaging. This may include items that you do not consider food, such as canned goods, bottles, drinks, soaps, cosmetics, toiletries, trash, ice chests (even when empty), and unwashed items used for preparing or eating meals.

23: PROJECT MAP
Bid Option #1 Clean Roadway Culverts on Dellingham Road
SCOPE:
The contractor shall provide the National Park Service with all labor, supplies, equipment, and materials to properly clean removing dirt and buildup from Two Galvan Steel, Culverts 25LF by, 24 IN located on Dellingham Road.
TASK:
Remove all dirt and organic buildup from two (2) 25LF by 24IN culverts to allow storm water to flow freely draining through the culvert.
Bid Option #2 Regrading Damaged Sections of Dellingham Road
24. SCOPE:
The contractor shall provide the National Park Service with all labor, supplies, equipment, and materials to properly grade select sections Dellingham Road surfaces roughly 29,560 LF by 20 LF. Contractor will apply a gravel across road surfaces to allow for a consistent smooth surface. This will include applying larger stone to areas that have been affected by runoff. See photos below for the area of repair.
25. TASK:
The contractor shall provide all materials and labor required to complete the following tasks:
• Install gravel to build back road surface in the area were wash occurred in the roadway.
• After wash damage has been repaired regrade the same section of roadway to smooth consistent surface at a minimum of 2-inch buildup of crush and run gravel will be applied. Rough area is 29,560 LF by 20 LF
26 Appendix: A Required Mitigations
• Contractor must comply with applicable state laws and regulations with this work near a SC State Resource Water
• Trees - If any trees larger than 3" in diameter need to be removed the removal must first be approved by the COR.
• Trees - If pruning of tree limbs is necessary - pruning should be done correctly to the main stem of the tree.
• Trees - care should be taken not to damage trees along the edges of the road during project activities.
• Erosion - If any type of erosion control fabric is to be used it must first be approved by the chief of resource management.
• Exotic species - All equipment must be cleaned of dirt and debris before being used on this project to avoid bringing in exotic plant seeds or plant material.
• Water Quality - Contractor should either have installed or have erosion control materials (silt fence and straw bales) readily available if needed during project work.

• Water quality - All project work (including staging rock and gravel materials) should be completed in a manner that limits the potential for construction materials and/or disturbed soil to erode into or impact the water quality of nearby creek. Use of erosion control materials may be necessary.
• Project lead will provide to the compliance team the final approved technical approach to perform the required service by the chosen contractor.
• Contractor MUST remove all food waste and trash from project site each day and follow KIMO food storage guidelines.
• Notification of work - project lead needs to let the compliance team know 5 days prior to performance start date.
• In the event that remains are discovered during maintenance activities, all work on the project must stop and the park archeologist contacted immediately. As required by law, the coroner will be notified first. All provisions outlined in the Native American Graves Protection and Repatriation Act (1990) will be followed.
• Any discovered cultural resources must be turned over to the park immediately upon discovery.
• All workers will be informed of the penalties of illegally collecting artifacts or intentionally damaging any archeological or historic property.
