About this file
This is a Request to Restrict Competition memorandum from the Naval Surface Warfare Center, Carderock Division, seeking approval to limit competition for a commercial product procurement under FAR Part 12 simplified acquisition procedures.
The Naval Surface Warfare Center, Carderock Division requires replacement of Pump #1 on a York Chiller #1 located in Building 157, which cools Building 13 Server Rooms due to a failed bearing. The procurement is classified as a Brand Name restriction, with the OEM identified as Johnson Controls (JCI) located at 5757 N Green Bay Ave., #X81, Milwaukee, WI 53209-4408. Market research was conducted by Stephen Hicks at (800) 289-2647 (inquiry@jci.com) using OEM-provided research. The restriction is justified on two primary bases: first, JCI maintains exclusive proprietary ownership of the York hardware architecture, firmware, and source code, with diagnostic software and calibration tables accessible only to authorized entities; and second, the pump serves as a direct replacement component for existing equipment that has been physically isolated to operate exclusively on Pump #2, creating a single point of failure scenario where any secondary malfunction would result in catastrophic cooling loss. The memorandum notes that JCI does not license proprietary diagnostic tools or warranty-backed replacement assemblies to unauthorized third parties, and utilizing non-OEM certified personnel would breach End User Licensing Agreements and void manufacturer warranties. While the procurement is restricted by brand name, it remains open to all JCI authorized technicians. The Requirements Owner and Contracting Officer have both certified and approved the restriction pursuant to FAR 12.102(a). The PID is N00167-26-SIMACQ-CD-76-0040, with a date of 10 September 2026.

B03 Request to Restrict Competition NTE SAT v060126 Effective June 2026
CUI
CUI
Johnson Controls Inc. (JCI) maintains exclusive, proprietary ownership of the York hardware architecture and underlying firmware/source code. Non-OEM entities do not possess access to proprietary diagnostic software, calibration tables, or intellectual property required to align pump telemetry with chiller logic. The chillers are protected under active manufacturer warranties and End User Licensing Agreements (EULA). Utilizing third-party, non-OEM certified personnel directly breaches EULA terms and immediately voids existing warranties, resulting in substantial financial risk to the Government. The introduction of unauthorized parts or non-certified labor poses significant risk of system trip, control bus malfunction, and thermal failure for supported mission operations.
Market research was conducted to identify whether aftermarket parts or independent service operators (ISOs) could perform the overhaul without invalidating system integrity. Because JCI does not license its proprietary diagnostic tools or warranty-backed replacement assemblies to unauthorized third parties, full and open competition would introduce unacceptable technical risk.
While it is requested that manufacturer and part numbers be limited, the procurement is open to all JCI authorized technicians.
