DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C256-20-AP-1185

1. Contracting Activity:

Department of Veterans Affairs, VISN 16, Alexandria VA Health Care System (AVAHCS), Pineville, LA 71360. Purchase Request Number: 502-20-2-5784-0007.

2. Nature and/or Description of the Action Being Processed:

Project No. 502-16-104 Replace HVAC System in Building 2, includes the requirement for new Systems Controls for the HVAC System. Systems Controls helps prevent or eliminate degradation in any part of the overall system, initiates immediate response to demands that are placed on the system, and responds to changes in the system to meet the long-range requirement. They also perform immediate circuit utilization actions, continuous control of circuit quality, continuous control of equipment performance, development of procedures for immediate repair, restoration, or replacement of facilities and equipment, continuous liaison with system users and with representatives of other systems, and the provision of advice and provide assistance in the system use. The Controls for the Replace HVAC System in Building 2 must seamlessly interface with the overall Systems Controls currently being replaced station-wide on the AVAHCS Campus. The AVAHCS is currently in the final stages of a nearly $6M Project to replace obsolete pneumatic HVAC controls with digital controls throughout the entire campus with Siemens automated controls. Siemens’ controls will interface seamlessly with our facilities Energy Management Control System. Also, the AVAHCS plans to have a station-wide Service Contract with Siemens upon completion of the HVAC Controls Project (beyond the 1-Year Construction Warranty Period). Anything other than Siemens’ controls would not fall within the campus-wide standardization, will not directly interface with the Siemens’ controls, and would not be covered by the upcoming station-wide Siemens’ Controls Service Contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The AVAHCS requires new Siemens’ controls for the Building 2 HVAC Project. The intent of the project is to provide new fully functional fan coil units with new control systems. Controls will be integrated into the facilities existing Energy Management Control System to allow for specific point monitoring and alarm functions. The total estimated cost for this controls and instrumentation system to be completely installed is approximately

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The AVAHCS is currently in the final stages of a nearly $6M project to replace obsolete pneumatic HVAC controls with digital controls throughout the entire campus with Siemens automated controls. Siemens’ controls contain proprietary hardware and software that will not seamlessly interface with other control manufacturer’s hardware/software. The AVAHCS has (or currently is) investing approximately $6M overall towards the use and implementation of new Siemens’ controls campus wide. It would not be feasible, either from a controls (technical) or a monetary (fiscal) standpoint, to have multiple controls manufacturer’s equipment and software on campus that would not interface with each other and would take multiple monitoring stations to function and to monitor,

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Any future project with controls requirements will be examined to see if there are any other control manufacturer’s equipment and software that can seamlessly interface with Siemens’ controls currently installed (or being installed) campus wide at the AVAHCS.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The Replace HVAC Systems in Building 2 Project will include a requirement for specific pricing for the controls portion of the requirement so the CO will know how much each offeror is proposing. As such, and because we believe we will receive adequate price competition, this will help in determining the controls pricing to be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted:

Market Research was conducted for the original contract to replace the obsolete controls at the AVAHCS Campus ($6M Project). As such, specific Market Research for the controls portion of the Replace HVAC System in Building 2 Project was not conducted.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None to date. There are currently eight (8) SDVOSB’s on the >$500K MATOC (which expired on February 28, 2020) who have successfully completed projects of similar scope and dollar value from our personal knowledge. There are also four (4) SDVOSB’s on the <$500K MATOC servicing the Alexandria VA Medical Center (who possess the capability to perform this size and magnitude of construction project) whom we believe, among several others open market SDVOSB firms, will be very interested in proposing on this project.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

Due to the scope of this project, the magnitude of construction, and overall complexity, it has been determined that there are no barriers to competition for the overall project itself. We will continue to monitor the market for any other control manufacturer’s equipment and software that could seamlessly interface with Siemens’ controls (without major controls modifications and a large expenditure of funds to be able to do so) for inclusion in future requirements. If such controls hardware and software are found to exist, the sole source requirement for Siemens’ controls can be relaxed (or eliminated) from further projects that are added (or modified into) into the AVAHCS’ station-wide controls infrastructure.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
