About this file

This is a vendor compliance document issued by the City of San Angelo, Texas Purchasing Division regarding reciprocity requirements for non-resident vendors on the Construction Equipment bid opportunity. The document establishes compliance procedures for vendors whose principal place of business is located outside of Texas in accordance with Texas Government Code 2252.002. The City of San Angelo Fleet Services Department is requesting bids for construction equipment, with quantities specified in bid tables noted as approximate. Equipment may be financed through a third party at the City's discretion.

All non-resident vendors must complete Section A of the compliance form by identifying their state of principal business location and specifying the percentage by which they are required to underbid Texas resident vendors under their home state's reciprocity laws, or stating that no such requirement exists in their state. Texas resident vendors must complete Section B by indicating their principal place of business or corporate offices are located in Texas. Failure to complete the appropriate section will result in automatic disqualification. This reciprocity requirement does not apply to contracts involving Federal funds. Vendors must provide their name, address, contact information, and authorization signature from an authorized agent on the compliance form at submission.

Vendor Compliance with Reciprocity on Non-Resident Vendors

Texas Government Code 2252.002 provides that, in order to be awarded a contract as low vendor, a non-resident vendor must bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident vendor by the same amount that a Texas resident vendor would be required to underbid a non-resident vendor in order to obtain a comparable contract in the state in which the non-resident’s principal place of business is located.

A non-resident vendor is a contractor whose corporate offices or principal place of business is outside of the state of Texas. This requirement does not apply to a contract involving Federal funds. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident vendors for your submission to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that vendor. Texas resident vendors must check the blank in Section B.
