About this file

This is a sample Section 3 Business Concern Certification form developed by HUD consultants and intended for use by Public Housing Authorities (PHAs) and Community Development Offices to certify businesses seeking contracting preferences on Section 3 projects. The form allows businesses to self-certify their Section 3 status by meeting one of three eligibility criteria: ownership and control by at least 51 percent low- or very low-income persons, ownership and control by at least 51 percent current public housing or Section 8-assisted housing residents, or performance of over 75 percent labor hours by Section 3 workers during the prior three-month period. The certification requires businesses to provide standard business information including name, address, owner contact details, and business type (corporation, partnership, sole proprietorship, or joint venture), along with an affirmation statement signed under penalty of law. Certifications expire within six months of the signature date, and grantees are instructed to retain executed forms in their Section 3 compliance files for five years.

The form includes Section 3 income limits eligibility guidelines referencing HUD's established extremely low-income limits (30 percent of Area Median Income), very low-income limits (50 percent), and low-income limits (80 percent), with specific dollar thresholds provided for individual income determinations. The document defines Section 3 workers as low or very low-income residents, employees of Section 3 business concerns, or YouthBuild participants, and establishes a targeted Section 3 worker category encompassing Section 3 business employees and individuals meeting specified low-income housing residency criteria within the past five years. The form is designed as an adaptable template for local jurisdictions to customize according to their specific community resources and program requirements, with grantees encouraged to consult legal counsel to ensure compliance with applicable local and state laws.
